HomeMy WebLinkAbout008 15Cc i 1 2 ' STATE OF WASHINGTON COUNTY OF JEFFERSON In the Matter of Annexation of Unprotected land within } Jefferson County into the Jurisdiction and Boundaries } RESOLUTION NO. 08-15 of Clallam County Fire Protection District No. WHEREAS, certain locations within unincorporated Jefferson County known as Dowans Creek Road and Undie Road are not within the jurisdiction or boundary of any Fire Protection District at this time; and WHEREAS, citizens living upon and at Dowans Creek Road and Undie Road obtained sufficient signatures on petitions seeking to have that location made part of Clallam County Fire Protection District 41; and WHEREAS, the Auditor's Office for Jefferson County has examined the signatures on the petition for annexation and found that 61.9% of the qualified registered electors residing within the area proposed for annexation have signed the petition seeking annexation; and WHEREAS, the Auditor's Office issued a Certificate of Sufficiency with respect to this petition on December 23, 2014; and WHEREAS, the Board of Commissioners for Clallam County Fire Protection District #1 has, via its Resolution 42014 -049 adopted on January 11, 2015, requested that the annexation be implemented; and WHEREAS, the annexation of this unprotected real property in unincorporated Jefferson County is in the public interest and conducive to the public safety, welfare and convenience of persons residing, working and recreating in the area to be annexed; and WHEREAS, pursuant to the petition method chosen by the affected citizens and Ch. 52.04 RCW an election in the territory and a hearing on the petition need not occur. NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners of Jefferson County, that the request of the Board of Commissioners of Clallam County Fire Protection District No. I is approved. BE IT FURTHER RESOLVED that the attached Exhibit A which includes the legal description of the area to be annexed and a map of the additional territory to be annexed to the jurisdiction of Clallam County Fire Protection District No. 1 are hereby approved. FPD No. 1 STATEMENT OF ISSUE: Two streets in the West End of Jefferson County are currently not within the boundary and jurisdiction of any Fire Protection District or "FPD." Persons residing on these two roads (Dowans Creek Rd. and Undie Rd.) have successfully completed the petition method under Ch. 52.04 RCW to be annexed into the nearest FPD which is Clallam County FPD No. 1. The petitioners have met the numerical requirements for annexation by petition and the Board of Commissioners for Clallam County FPD No. 1 has agreed, via their Resolution 92014 -049, to accept the annexed territory. All that remains to be done, per RCW 52.04.011(3), is for the Jefferson County Board of County Commissioners in their legislative capacity to "order" the incorporation of the territory subject to the petition "into the existing fire protection district." The attached Resolution formalizes the incorporation of the territory subject to the petition into the jurisdiction of the existing Clallam County FPD No. 1. ANALYSIS: Given the concurrence of the affected citizens and the Commission of Clallam FPD No. 1 that such an annexation should occur, the County Commission should implement this final step to annexation.
