To process this segregation/consolidation, you will need to submit a written request to the Jefferson County Assessor's Office to have additional parcel numbers assigned. A copy of this permit will be forwarded to the Assessor's Office. Please contact the Jefferson County Assessor's Office (360-385-9105)with any questions regarding this process. 2.) Based on the findings a portion of the tideland tax 20 in parcel number 721162010 can be consolidated with parcel 950100712 as described in the legal descriptions submitted with the application. 3.) The Lot Certification/Consolidation statement of intent legal descriptions shall be recorded with Jefferson County Auditor's office. 4.) As the Parcels are found exempt from RCW 58.17 and Jefferson County Code 18.35, a title report is not required. It is the property owner's responsibility to identify and rectify any security interest, conveyances, encumbrances, easements or restrictions affecting the subject properties involved in this county reviewed exemption. FINDINGS: 1.) The Administrator finds that this application complies with applicable provisions of the Unified Development Code,all other applicable ordinances and regulations,and is consistent with the Jefferson County Comprehensive Plan and Land Use map. 2.) RCW 58.17 requires regulation of the division of land and was passed in 1969 3.) On March 21, 2012, Pat Perryman in the Assessor'office and GIS department commented as follows: After reviewing the revisions submitted to us on March 16, 2012 by email, I have no further comments concerning this proposed action. All of my previous concerns pertaining to the action have been addressed. 4.) On March 22, 2012, Sherri Sholds in the Assessor's office commented as follows: after reviewing the revisions submitted to us on March 16, 2012 by email, I have no further comments concerning this proposed action. 5.) The administrator determined on 1-17-2012 that this application could be processed as a lot certification/ consolidation. Tidelands tax 20 is to be consolidated with an upland parcel. The following research and comments from the Assessor's office: Mr. Henry purchased the tideland parcels under two different transactions both in May of 1974. Tideland Tax A20 was purchased and created under Excise Tax#26154 and the remainder of the tideland aka-Tideland Tax A(less TL Al-Al 9)was purchased under Excise Tax#26156. My review of our historic ownership records indicate Tideland Tax A20 was identified with a separate tideland number but was never segregated into a separate parcel. 6.) NOTICE: This permit does not excuse the proponent from complying with other local, state, and federal ordinances, regulations, or statutes applicable to the proposed development, but consistent with RCW 90.58. Development pursuant to this permit shall be undertaken subject to the applicable policies and performance standards of the Jefferson County Shoreline Management Master Program and the Jefferson County Unified Development Code. If during excavation or development of the site an area of potential archaeological significance is uncovered, all activity in the immediate area shall be halted, and the Administrator shall be notified at once. The Federal Endangered Species Act rules to protect threatened Chinook and Summer-run Chum salmon became effective on January 8, 2001. Bull trout have been listed as threatened since early 2000. Under the ESA, any person may bring lawsuit against any individual or agency that"takes" listed species (defined as causing harm, harassing, or damaging habitat for the listed species). In addition, the National Marine Fisheries Service can levy penalties. All areas in Jefferson County are included as"critical habitat"for a listed species. Development of property along any marine shoreline, freshwater shoreline, or floodplains could harm habitat if protective measures are not taken. To minimize the potential to damage habitat, all property owners developinc adjacent to marine shoreline, freshwater shoreline, or floodplains are advised to do the following: -All development activities should avoid unstable slopes, wetlands, and forested areas near surface waters - Remove minimal vegetation for site development, especially large trees -Allow trees that have fallen into surface waters to remain there - Infiltrate stormwater from buildings and driveways onsite through drywells rather than discharging directly into surface waters or roadside ditches The Federal Bald and Golden Eagle Protection Act requires landowners within 660 feet(1/8th of a mile) of an eagle nest to consult with the US Fish and Wildlife Service. This Eagle Act prohibits anyone from "taking" bald eagles. This federal law defines the term "take"and describes the possible legal consequences when a"take" occurs. Among other actions, "take" includes a disturbance of bald eagles or their habitat. Under federal law a permit may still be required for activities that impact bald eagles or their habitat. Contact the US Fish and Wildlife Service (http://www.fws.gov/pacific/eagle/) to learn more about how this law affects your project. Any individual, group, or agency can bring suit for a listed species"taking", even if you are in compliance with Jefferson County development codes. The risk of a lawsuit against you can be reduced by consulting with a professional fisheries habitat biologist, and following the recommendations for site development provided by the biologist. For more information, contact the National Marine Fisheries Service in Seattle, or the U.S. Fish and Wildlife Service. If the upper tideland is going to be attached to Lots 8&9 why are we not doing a BLA instead of a Lot Certification? If an owner were to come into our office and ask for parcels to be consolidated we would send them to DCD to complete a BLA Consolidation. Tidelands cannot be segregated as a stand alone parcel; RCW79.125. Tidelands Tax A20 would be required to attach the tidelands to Paula Frial's waterfront parcel. Please revise the statement of intent legal description to include Paula's parcel and submit a copy of the tideland survey. The following comments were received from the Assessor's office, Sherrie Shold: I have completed my research of Henry's parcel and the following are my comments. Mr.Henry purchased the tideland parcels under two different transactions both in May of 1974. Tideland Tax A20 was purchased and created under Excise Tax#26154 and the remainder of the tideland aka- Tideland Tax A(less TL Al-A19)was purchased under Excise Tax#26156. My review of our historic ownership records indicate Tideland Tax A20 was identified with a separate tideland number but was never segregated into a separate parcel. The descriptions are the historic descriptions but I didn't check the AF#for accuracy,Pat will do that in her review. I did however note the parcel numbers referencing the location of the tidelands were incorrect they should be#950100709-711. I would suggest removing this reference*, as we would not process any description that would use a parcel number as a reference point. A suggestion may be to reference as such" said tidelands are adjacent to/and or abutting Lots 8 &9, Block 7, Trails End First Addition. • I would also suggest removing it for both parcels. The statement of intent submitted on 1-3-2012 has not been reviewed by Pat Perryman of the Jefferson County GIS department.
