SPAAD-Site Plan Approval Advanced Determination for residential development PROJECT LOCATION: Parcel number 921 332 030, Section 33, Township 29N, Range 1E, WM, located off Bayview Dr, Port Ludlow 98365 CONDITIONS: 1.) Duration of Approval-Several of the included findings shall become conditions upon the submittal of a building and septic permit. The duration of approval of the Site Plan shall be effective for five (5)years from the date of original approval by the Administrator. If a building permit has not been issued within the five(5)year period, the Site Plan Approval Advance Determination (SPAAD)cannot be revived or extended except by new application that must meet all the existing criteria and conditions listed in this Section. Knowledge of the expiration date shall be the responsibility of the applicant. The county will not provide notification prior to expiration. Limitations of Approval-Approval of the site plan shall not guarantee the performance of specific site features or improvements (e.g. wells, septic systems, stormwater drainage facilities, etc.) and shall not be immune from changes in state or federal law which are enacted or have an effective date after the date of the Site Plan Approval Advance Determination (SPAAD)and which may affect the performance and implementation of the site plan and associated use or activity. Any subsequent land division or boundary line adjustment of a parcel or lot which has received site plan approval advance determination under this Section 8.7 shall void such site plan approval and require a new site plan approval advance determination application. Approval of a site plan under this section does not constitute authority to comence any development or building activity until such time as final authorizing permits are issued (e.g., septic, wells, stormwater management, or building permit, etc.). Modification to an approved site plan may be required by the applicant and approved by the Administrator subject to the provisions for Type I decisions. (Please request a copy of Section 8.7 of the UDC for criteria pertaining to modifications). 2.) To help prevent seawater from intruding landward into underground aquifers, all new development activity on Marrowstone Island, Indian Island and within 1/4 mile of any marine shoreline shall be required to infiltrate all stormwater runoff onsite. 3.) MANDATORY MEASURES FOR AN AT RISK SIPZ: 1. For proof of potable water on a building permit application, applicant must utilize DOH-approved public water system if available. 2. If public water is unavailable, a qualifying alternative system may be used as proof of potable water or an individual well may be used as proof of potable water subject to the following requirements: a. Chloride concentration of a laboratory-certified well water sample submitted with building permit application. b. Installation of a flow meter. c. On-going well monitoring for chloride concentration. d. Submittal of flow and chloride data to the County per monitoring program. 3. If public water is unavailable, a qualifying alternative system may be used as proof of potable water. 4.) MANDATORY MEASURES OF HIGH RISK SIPZ: Water conservation measures: 1. Roof and other intercepted precipitation shall be routed to on-site detention ponds and/or other approved means and allowed to be released to the soil slowly. 2. Water collected from Storm water and roof catchments may be used for watering lawns and gardens. Unless catchment water has been treated to meet drinking water standards, there shall be no cross connections allowed between the potable supply and impounded water. 3. Water withdrawn from wells on each property shall not be used for watering of lawns and/or gardens. 4. Ground water withdrawn from each property shall be restricted to a rate of three(3) gallons per minute. 5. Installation of water conserving fixtures such as low flow toilets, faucets and shower restrictors and other water saving plumbing fixtures. 6. Landscaping plan (xeriscaping, native vegetation with minimal amounts of irrigation). Please NOTE that the above listed measures are not intended to be exhaustive, but rather is intended to be illustrative of the types of water conservation measures. 5.) MANDATORY MEASURES FOR HIGH RISK SIPZ: 1. For proof of potable water on a building permit application, applicant must utilize DOH-approved public water system if available. 2. If public water is unavailable, a qualifying alternative system may be used as proof of potable water or an individual well may be used as proof of potable water subject to the following requirements: a. Variance from Chapter 173 WAC standards granted by Ecology per WAC 173-160-106 for a new groundwater well within 100 feet of a sea-salt water intrusion area per WAC 173-160-171 (i.e., within 100 feet of a groundwater source showing chloride concentrations above 200mg/L or within 100 feet of the marine shoreline); or for an existing or proposed groundwater well not subject to an Ecology variance, applicant provide evidence through a hydrogeologic assessment(relevant components of an Aquifer Recharge Area Report per UDC 3.6.10.e) of a reasonable probability that the subject aquifer will not be degraded by the proposed use of well. b. Installation of a flow meter. c. On-going well monitoring for chloride concentration. d. Submittal of flow and chloride data to the County per monitoring program. 3. If public water is unavailable, a qualifying alternative system may be used as proof of potable water. 6.) The property owner shall comply with Water Conservation Measures(per list maintained by the UDC Administrator). 7.) A flow meter shall be installed prior to final sign off of the building permit. 8.) On-going well monitoring for chloride concentration is required. The property owner shall allow access to Jefferson County PUD or approved contractor to take samples as required. 9.) A Geotechnical Report dated October 1, 2009 prepared by Zenovic&Associates was submitted in conjunction with this application. The report addressed the stability of the geologic hazard area. 10.) The applicant shall fully adhere to all conditions and requirements of the approved Eagle Habitat Management Plan. 11.) A stormwater management plan shall be prepared and submitted at time of building permit application and shall comply with the Washington State Department of Ecology Stormwater Management Manual for Western Washington to control stormwater, erosion and sediment during construction, to address permanent measures to stabilize soil exposed during construction, and in the design and operation of a stormwater and drainage control system. 12.) Outdoor residential storage shall be maintained in an orderly manner and shall create no fire, safety, health or sanitary hazard. 13.) Not more than 2 unlicensed vehicles shall be stored on any lot unless totally screened from view of neighboring dwellings and rights-of-way. Such screening shall meet all applicable performance and development standards specific to the district in which the storage is kept, and shall be in keeping with the character of the area. Screening shall meet the requirements of Chapter 18.30 JCC. Outdoor storage of 3 or more junk motor vehicles is prohibited except in those districts where specified as an automobile wrecking yard or junk (or salvage)yard and allowed as a permitted use in Table 3-1 or Chapter 18.18 JCC, and such storage shall meet the requirements of JCC 18.20.100, Automobile wrecking yards and junk(or salvage)yards. In no case, shall any such junk motor vehicles be stored in a critical area. 14.) A minimum of two (2) on-site parking spaces shall be provided for the single family residence. 15.) Minimum setback from North Bayview Drive right-of-way shall be 20 feet. Minimum side yard setbacks shall be 5 feet. Minimum setback from top of shoreline bank is as follows: The standard setback for residential structures, including common appurtenant structures such as garages and workshops, shall be thirty(30)feet or one(1)foot for each foot of bank height, whichever is greater. This setback shall be measured from the bank's edge when the bank's height exceeds 10 feet. When the bank's height is less than 10 feet, the setback shall be measured from the ordinary high water mark. The setback shall not exceed 100 feet.ide yard setbacks shall be 5 feet. Minimum setback from top of shoreline bank 16.) The building height is not to exceed 35 feet. 17.) Pre-existing legal lots of record less than one acre in size in rural residential districts are subject to the stormwater requirements in Chapter 18.30 JCC and must meet the"Area of Impervious Surface Coverage"to the maximum extent practicable as determined by the administrator. Lot coverage is defined as amount of impervious surface, which includes rooftops, driveways, concrete, etc. 18.) Exterior lighting for residential uses shall not exceed twenty feet(20') in height from the finished grade, excepting when such lighting is an integral part of a building or structure. Ground level lighting is encouraged. 19.) Lighting fixtures shall be designed and hooded to prevent the light source from being directly visible from outside the boundaries of the property. The intensity or brightness of all lighting, during construction and after project completion shall not adversely affect the use of surrounding properties or adjoining rights-of-way. 20.) The applicant shall apply for a Shoreline Substantial Development Permit Exemption for any accessory structures or at the time of a building permit for the addition to the single-family residence. 21.) Residential developers and individual builders shall be required to preserve shoreline vegetation and reduce the associated risk of erosion during construction and any future activity which may impact the stability of the shoreline. 22.) The applicant shall provide proof of potable water at the time of building permit application. This application does not vest the parcel for potable water. 23.) The proposal is located within 200 feet of Ordinary High Water Mark, and is within shoreline jurisdiction per the Shoreline Master Program, Chapter 18.25 Jefferson County Code. The remainder of the parcel, landward of 200 feet from Ordinary High Water Mark is located outside of shoreline jurisdiction and is subject to the Growth Management Act and critical area codes under chapter 18.22 Jefferson County Code. 24.) Maintaining ground cover will help reduce erosion from surface runoff. Any bare areas that develop should be revegetated. Native low growing vegetation that requires little or no irrigation would be the most beneficial 25.) Tree limbs, lawn clippings, etc. should not be thrown over the bluff because these piles have a tendency to damage/kill the underlying vegetation which in turn increases the erosion potential of the bluff soils. These piles also add unnecessary weight to the bluff soils, especially when saturated with water. 26.) Silt fences or other sediment control devices may be needed during construction such that sedimentation off site does not significantly exceed predevelopment conditions. Standard erosion control best management practices (BMP's) should be utilized as necessary to prevent erosion and off-site runoff. Temporary stabilization might include silt fences and/or hay bails or straw waddles staked with rebar. Permanent stabilization might include replanting, mulching or gravel. FINDINGS: 1.) The Administrator finds that this application complies with applicable provisions of the Unified Development Code,all other applicable ordinances and regulations,and is consistent with the Jefferson County Comprehensive Plan and Land Use map. 2.) The soils report enclosed with the SPAAD application supports a finding that an onsite sewage system can be installed on the property in the area evaluated. SPAAD approval DOES NOT constitute an onsite sewage system design approval. 3.) Any removal or disturbance of soil in the area evaluated may create site conditions that are unacceptable for the installation of an onsite sewage system and may invalidate this approval. 4.) The application was reviewed by the Jefferson County Department of Community Development staff on April 15, 2010 for the potential presence of Environmentally Sensitive Areas(ESAs) under the provisions of the Unified Development Code (UDC). After an initial Geographic Information Systems mapping review and an investigative site inspection, the following ESAs were confirmed to be present on the subject property: conservancy shoreline designation; eagle; stable/intermediate shoreline slope stability. 5.) Geologically Hazardous Areas in Jefferson County are characterized by slope, soil type, geologic material, and groundwater that may combine to create problems with slope stability, erosion, and water quality during and after construction or during natural events such as earthquakes or severe rainstorms. 6.) Marine shorelines and islands are susceptible to a condition that is known as seawater intrusion. Seawater intrusion is a condition in which the saltwater/freshwater interface in an aquifer moves inland so that wells drillec on upland areas cannot obtain freshwater suitable for public consumption without significant additional treatment and cost. Maintaining a stable balance in the saltwater/freshwater interface is primarily a function of the rate of aquifer recharge(primarily through rainfall) and the rate of groundwater withdrawals (primarily through wells). The Washington Department of Ecology is the agency with statutory authority to regulate groundwater withdrawal for individual wells in Jefferson County. New development, redevelopment, and land use activities on islands and in close proximity to marine shorelines in particular should be developed in such a manner to maximize aquifer recharge and maintain the saltwater/freshwater balance to the maximum extent possible by infiltrating stormwater runoff so that it recharges the aquifer. 7.) The parcel is located within an At Risk SIPZ(seawater intrusion protection zone) according to the County GIS map. There are voluntary and mandatory measures identified in the Jefferson County Seawater Intrusion Polic} (Resolution 44-22, effective September 23, 2002)that apply to well drilling proposals and building permit applications on existing lots of record. An At Risk SIPZ is defined as: areas within 1,000 feet of a groundwater source with a history of chloride analyses between 100 mg/L and 200 mg/L (milligrams per liter). 8.) The parcel is located within a High Risk SIPZ(seawater intrusion protection zone) according to the County GIS map. There are mandatory measures identified in the Jefferson County Seawater Intrusion Policy(Resolution 44-22, effective September 23, 2002)that apply to well drilling proposals and building permit applications on existing lots of record. A High Risk SIPZ is defined as: areas within 1,000 feet of a groundwater source with a history of chloride analyses above 200 milligrams per liter(mg/L). 9.) Jefferson County determined that this proposal is categorically exempt from review under the State Environmental Policy Act(SEPA) pursuant to WAC 197-11-800(1)(b)(i). 10.) The revised site plan dated January 28, 2010 has been reviewed for consistency under the UDC, and has been approved by Jefferson County Department of Community Development. Any modifications, changes, and/or additions to the stamped, approved site plan dated July 20, 2010 shall be resubmitted for review and approval by Jefferson County Department of Community Development. 11.) This approval is for a SPAAD only. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits. 12.) The parcel has been designated as RR 1:5 under the Jefferson County Comprehensive Land Use Map effective August 28, 1998. 13.) The proposal was reviewed against the site plan determination criteria of the Unified Development Code (Section 8.7). The criteria for approval is as follows: 1. The proposed site plan conforms to all applicable county, state, and federal land use, environmental and health regulations and plans, including but not limited to the following: The Jefferson County Comprehensive Plan and the provisions of the Unified Development Code. Staff comment: The application was reviewed for consistency under the provisions of the Unified Development Code, Comprehensive Plan, and Shoreline Master Program. The application was found in compliance with all ordinances pertaining to the proposed development. 2. Adequate provisions for utilities and other public services necessary to serve the needs of the proposed site plan have been demonstrated, including open spaces, drainage ways, roads, and other public ways, potable water, sewerage disposal, fire flow and other improvements. Staff comment: The parcels total approximately5.25 acres, and the revised site plan dated as submitted on January 27, 2010 complies with UDC Table 6-1: Density, Dimension and Open Space Standards. Environmental Health reviewed the revised site plan for consistency and the soils report enclosed with the SPAAD application supports a finding that an onsite sewage system can be installed on the property in the area evaluated. SPAAD approval DOES NOT constitute an onsite sewage system design approval. The parcel will be served by a two-party well. Potable water is required at time of building permit application. The SPAAD does not vest for potable water. The approved site plan has not been reviewed for stormwater requirements. Sections JCC 18.30.060 and JCC 18.30.070 of the Jefferson County Code requires the project applicant prepare a stormwater plan in compliance with the Department of Ecology Stormwater Management Manual for Western Washington to control stormwater, erosion and sediment during construction, to address permanent measures to stabilize soil exposed during construction, and in the design and operation of stormwater and drainage control systems. The SPAAD was not reviewed for fire flow due to the application as proposed identifies the parcel as utilizing a well. Jefferson County has no specific adopted fire flow requirements for utilization in permitting. Application of Coordinated Water System Plan (CWSP) fire flow requirements for individual projects is inappropriate since the primary purpose is for water system design to assure adequate pipe size, source and storage. 3. The probable significant adverse environmental impacts of the proposed site plan, together with any practical means of mitigating adverse impacts, have been considered such that the proposal will not have an unacceptable adverse effect upon the quality of the environment, in accordance with the State Environmental Policy Act(SEPA) implementing the provisions contained within Section 8 of this Code and Chapter 43.21 C RCW. Staff comment: Single family residences are EXEMPT from the State Environmental Policy Act(SEPA). WAC 197-11-800(1)(b)(i) identifies the construction of any residential structure of four(4) dwelling units. 4. Approving the proposed site plan will serve the public use and interest and adequate provision has been made for the public health, safety and general welfare. Staff comment: The proposal will not affect the public health, safety, and general welfare. 14.) Due to a recent Washington State Supreme Court Case: Futurewise v. WA State DOTED, Ecology, Case #80396-0, the Critical Areas Ordinance(Chapter 18.22, JCC)does not apply to development within Shoreline jurisdiction. Only the Jefferson County Shoreline Management Master Program (Chapter 18.25, JCC)applies to development within 200 feet of the OHWM. 15.) NOTICE: This permit does not excuse the proponent from complying with other local, state, and federal ordinances, regulations, or statutes applicable to the proposed development, but consistent with RCW 90.58. Development pursuant to this permit shall be undertaken subject to the applicable policies and performance standards of the Jefferson County Shoreline Management Master Program and the Jefferson County Unified Development Code. If during excavation or development of the site an area of potential archaeological significance is uncovered, all activity in the immediate area shall be halted, and the Administrator shall be notified at once. The Federal Endangered Species Act rules to protect threatened Chinook and Summer-run Chum salmon became effective on January 8, 2001. Bull trout have been listed as threatened since early 2000. Under the ESA, any person may bring lawsuit against any individual or agency that"takes" listed species (defined as causing harm, harassing, or damaging habitat for the listed species). In addition, the National Marine Fisheries Service can levy penalties. All areas in Jefferson County are included as"critical habitat"for a listed species. Development of property along any marine shoreline, freshwater shoreline, or floodplains could harm habitat if protective measures are not taken. To minimize the potential to damage habitat, all property owners developinc adjacent to marine shoreline, freshwater shoreline, or floodplains are advised to do the following: -All development activities should avoid unstable slopes, wetlands, and forested areas near surface waters - Remove minimal vegetation for site development, especially large trees -Allow trees that have fallen into surface waters to remain there -Infiltrate stormwater from buildings and driveways onsite through drywells rather than discharging directly into surface waters or roadside ditches Any individual, group, or agency can bring suit for a listed species"taking", even if you are in compliance with Jefferson County development codes. The risk of a lawsuit against you can be reduced by consulting with a professional fisheries habitat biologist, and following the recommendations for site development provided by the biologist. For more information, contact the National Marine Fisheries Service in Seattle, or the U.S. Fish and Wildlife Service. APPEALS: Pursuant to RCW 36.70C,the applicant or any aggrieved party may appeal this final decision to Jefferson County Superior Court within twenty-one(21)calendar days of the date of issuance of this land use decision. The following conditions apply to portions of a parcel that fall within the distance guidelines: X CONDITION 1: This parcel is within 400 feet of a bald eagle nest. Retain all known perch trees, all native conifers and all black cottonwood trees >24 inches diameter at breast height (diameter 4.5 feet from ground, known as d.b.h). No. 921-332-030 Dear Mr. Herion: Zenovic&Associates, Inc. presents herein the results of our geotechnical review of the referenced property, located on the west side of Admiralty Inlet, approximately 1.5 miles north of Port Ludlow, Jefferson County. The property is situated just north of the inlet to Mats Mats Bay. Access to the property is from North Bayview Drive, at the east end of Mats Mats Beach Road,just east of Oak Bay Road. We understand that your intent is to construct a single-family residence on the subject property. The bank from the upland area on the site to the beach has been mapped as Intermediate Slope in the Washington Coastal Zone Atlas and the Jefferson County Shoreline Map. Intermediate slopes are typically slopes greater than 30 percent with no known failed areas but are susceptible to failure if altered by grading activities. PURPOSE AND SCOPE OF SERVICES The purpose of the geotechnical review is to provide information regarding the soil and slope stability in order to develop the site in a manner that will not induce soil erosion or endanger on-site or adjacent off-site properties, consistent with the requirements of the Jefferson County Unified Development Code (JCC Chapter 18.22). The scope of the review included a field inspection of the site and determination of site and adjacent property slopes using a hand-held clinometer. Research of available data included a review of aerial photos as provided on the Jefferson County website (1994, 2000, 2006), the Soil Survey of Jefferson County Area, Washington (USDA/SCS, August, 1975), the Washington State Coastal Zone Atlas, and Jefferson County Unified Development Code. Page 2 Mr. George Herion - Property on North Bayview Drive, Jefferson County October 5, 2009 REGIONAL GEOLOGIC AND SOIL CONDTIONS According to the Soil Survey of Jefferson County Area, General Soil Map, a significant area comprised of the Alderwood-Sinclair soil association extends south and east from Discovery Bay to the Admiralty Inlet/Hood Canal shoreline, encompassing the majority of the easterly portion of Jefferson County, including the Dabob and Coyle peninsulas. The subject site is located in the extreme northeasterly portion of the mapped soil association. The Alderwood-Sinclair soils are typically moderately well-drained, dominantly strongly sloping to steep, gravelly soils underlain by glacial till. Inspection of the soil maps of the site indicate that the property lies within an extensive area of Olete very gravelly silt loam, 0 to 30 percent slopes, that extends along the west side of Admiralty Inlet around the inlet to Mats Mats Bay. The Olete soils are formed in the old basalt flows that have been uplifted from the sea bottom. Typically, the surface soils are typically 20" to 30" deep. SITE OBSERVATIONS An engineer from Zenovic&Associates, Inc. conducted a site visit on September 22, 2009 to observe the site slopes, vegetation, surface and immediate subsurface hydrology, and evaluate in-situ soils for density. Existing Slopes The easterly half of the site slopes downhill consistently from west to east at an estimated slope of 20-25 percent to the top of a marine bluff approximately 35 feet high. The bluff is a nearly vertical slope comprised of the basalt bedrock that underlies the site. The westerly portion of the site slopes downhill at a slope of around 25% in a northeasterly direction from a high point near the southwest corner or the property to a generally level area along the north line of the property. The topography of the site is such that minimal storm water runoff from adjacent properties enters the site. Soil Conditions Visual observation of the site indicates that the site soils appear to be consistently the Olete very gravelly silt loam throughout the site. Test pit excavations completed throughout the site show the tan to reddish surface soils with roots extending to the basalt bedrock at depths ranging from 12" to 30". No erosion of surface soils was observed in the areas previously cleared for roadway access. . Page 3 Mr. George Herion - Property on North Bayview Drive, Jefferson County October 5, 2009 Vegetation The site vegetation consists of moderately dense stand of fir, cedar, madrona, red alder, and big leaf maple trees. Understory vegetation is a dense mat of salal and sword fern, with extensive areas of nettles where soils have been disturbed by prior minor site clearing. Hydrology and Drainage As noted previously, the site is situated such that no upgradient areas drain onto and through the site. The surface soils above the restrictive layer were generally dry. The silt loam soils hold about 2"to 4" of water available for plants. The subsurface basalt layer appears to slope in a manner similar to the ground surface so no perched water is present. Due to the shallow soils depth, infiltration of storm water runoff is not the preferred alternative for storm water runoff control for the site. Discharge of runoff onto the face of the exposed basalt face of the marine bluff is acceptable for this site. International Building Code Site and Soil Categorization Seismic design parameters for this site include a seismic zone soil profile of Type D in accordance with Table 1615.1.1 of the International Building Code. The native surficial site soils can be classified as a sand, silty sand, clayey sand, silty gravel, and clayey gravel consistent with Class 4 materials as set forth in Table 1804.2 of the International Building Code. Increases for depth and width as set forth in the table footnotes are not recommended for this site due to the site slopes and potential for soil saturation. Excavation though the surficial soils to the substantial basalt bedrock layer below may allow for increased soil bearing capacity. CONCLUSIONS Based on my review of the site, adjacent properties, and available data, it is my opinion that the soils on the site are stable. The underlying basalt bedrock is not susceptible to erosion from wave and tidal action of Admiralty Inlet, so the potential of failure of the steep slope along the shoreline is minimal. The upland slopes and soil conditions combine to minimize the potential of slope erosion when adequately vegetated. A setback equal to the bluff height, or approximately 35 feet, is appropriate for this site. RECOMMENDATIONS General The proposed project shall be constructed in conformance with all requirements of Jefferson County, including, but not limited to, the International Building Code and applicable clearing, grading, drainage, and erosion control requirements. Page 4 Mr. George Herion - Property on North Bayview Drive, Jefferson County October 5, 2009 Excavation and Grading Excavation for the proposed foundation components of any structures on the site shall be carried to firm, substantial, unyielding subsoil, at a depth of not less than 12 inches below the existing surface grade. Extending the excavation depth to the underlying bedrock will result in a substantially better foundation system. Excavation work shall occur not earlier than March 1, and shall be complete to the permanent condition before October 15. Drainage and Erosion Control Drainage facilities shall be provided that collect all storm water runoff from all impervious surfaces on the site and direct the runoff over the top of the bluff and onto the basalt bedrock at the base of the bluff. Runoff from pollution generating surfaces, such as driveways and parking areas, shall have appropriate pre-treatment to protect the marine environment. As an alternative, storm water runoff may be directed to appropriately sized infiltration trench located not less than 100 feet from the top of the bluff. Slope Maintenance Proper maintenance of the existing marine bluff is critical to the continued safety of the site and for minimizing damage to the bluff. No organic material, including grass clippings and tree or brush trimmings should be thrown over the top of the bluff. These materials may help hold water on the slope, thereby reducing slope stability. On-site Sewage Disposal System Drainfield If an on-site sewage disposal system is required for this site, the on-site sewage disposal drainfield shall be located as far as practical from the shoreline, but shall be not less than 100 feet from the top of the bank. The drainfield shall be installed in accordance with the requirements of the permit for the system, as approved by the Jefferson County Environmental Health Department. Septic tanks, pump chambers, and collection and transport piping shall be placed not less than 50 feet from the top of the bank. All systems components shall be water-tight; piping within recommended setback area shall be tested for leaks prior to cover. USE OF THIS REPORT This report has been prepared at the request of Mr. George Herion for the purpose of determining the relative stability of a marine bluff on the subject property. I believe it went on for nearly 2 hours. I will recap some of the issues discussed. From the discussion we agreed that we will push ahead with the Bald Eagle Plan for the Lucas property followed by the Herion Eagle Plan. You stated that you will be able to do a lot of"cut and paste"on the Lucas plan to the Herion plan. This should save time as the Background/Justification and Factors Considered should be near duplicate with the exception of distances from Active Eagle Tree Nest#2. From the attachment, you will see my notes in RED. Hopefully I scrubbed them well enough for you to understand what my comments were. As for the Nest trees, this is what I understood: Nest Tree# 1 is vacant and borders Lucas/Wlde property of the southern border of the Lucas property Nest Tree#2 is active and on the Wilde Property north of the Herion property; approximately 660 feet in from the water's edge and 50 north of the northern border of Herion's parcel. Nest Tree#3 may be the tree you and Mr. Wilde identified as a large Doug Fir near the Bank 5/24/2010 Page 3 of 3 Edge on the Lucas property. I looked into the WAC 232-12-292 plus a few others within WAC 232-12 and could not find where it stated " 400 feet from the property line". This may be a mute point, then again, I was hoping this would be a one page issue. Also, I want to emphasize any misunderstanding of where the homesite footprint will be. It will be west of Eagle Nest Tree#1. I believe I may have mislead you in thinking that I wanted the residence to be located 3 e i 35 feet back from the 9 high water mark. And as mentioned in conversation n the site will be well over the 400 foot bench mark from Eagle Nest Tree#2 (New Nest). You will see a comment about"roosting". It was buried in one of the paragraphs. We discussed this issue. Boiler plate info always bothers me as discussed. If it is policy then I understand. But if it is an individual expression from previous plans, then I don't think it is helpful. I understand the "purpose of the Site- Specific management plan is to provide for the protection of specific bald eagle habitat " (WAC 232- 12-292), But I fear when recommendations get interpreted as policy then the landowner becomes bound to that action. Pending Activity Site Plan Approval Advance Determination (SPAAD)to secure development within the current set-back zone along the shoreline. The landowners are planning to sell the property. Residential development shall be proposed in the future. Development to include installation of a new driveway, construction of a single-family residence, and installation of septic system. Some vegetation removal along property lines is also proposed. FACTORS CONSIDERED 1) Landowners goals were considered through a review of a proposed site development plan and SPAAD application submitted to Jefferson County. Various phone conversations and e-mail exchanges were conducted with the landowner representative, George Herion,to review the proposed development. A site visit was conducted to the property on April 15, 2010. The WDFW obtained permission to access the property. During the site visit WDFW located the three bald eagle nest trees, reviewed the specific site development proposal, and reviewed trees in general areas proposed for removal. 2) Bald eagle habitat use was considered by analysis of territory integrity through time, current surrounding habitat conditions, potential for blowdown, current status of the bald eagle population and scientific literature concerning bald eagle habitat protection. Bald Eagle Management Plans prepared for other landowners within the territory were also reviewed. BACKGROUND The Olele Point Bald Eagle Territory is located approximately 3 miles north of Port Ludlow in Jefferson County (Figure 1). The bald eagle nest trees are located along the Page 1 of 10 west side of Admiralty Inlet within the Puget Sound. The history of the surrounding vicinity has been one of conversion of a timbered peninsula to an increasingly subdivided area where a considerable portion of the suitable bald eagle habitat has been altered by timber clearing and residential development. The area is vulnerable to high winds and the potential for the blow down of remaining trees is present. The Washington Department of Fish and Wildlife (WDFW) initiated monitoring the Olele Point Bald Eagle Territory in 1980. It is possible that the territory was established prior to documentation by the WDFW. A total of three nest trees have been documented within the territory (Figure 2). All three nest trees are located within approximately 500 feet of each other along Admiralty Inlet approximately 400 feet north of the entrance to Mats Mats Bay and 1000 feet north of the currently operating quarry located at the south entrance to Mats Mats Bay. The original nest tree is a tall dominant live spindly-topped Douglas fir tree located approximately 250 feet west of the shoreline. A total of at least 7 young had been produced in this Nest#1 since 1980. During the aerial survey conducted by the WDFW in April of 1995 to check the occupancy of eagle territories it was documented that this nest had been destroyed. The nest tree is still present and has suitable structure to support another nest. During the same survey a new Nest#2 nest was documented in a flat-topped Douglas fir tree approximately 400 feet northeast of the original nest tree. This nest tree is located approximately 60 feet west of the shoreline of Admiralty Inlet. An adult eagle was observed in incubation posture on the nest during the survey. A productivity survey was conducted in June of 1995 and 1 young eaglet was documented in the nest. During the aerial survey conducted by the WDFW in April of 1996 and 1997 an adult eagle was documented in incubation posture on Nest#2. A survey to check the productivity results was not conducted in June of these seasons so it is unknown if any young were produced during these years. With the exception of 2001, Nest#2 was continuously occupied by the resident pair of eagles since 1995. At least six young were produced in this nest from 1995 - 2000. Nest Tree #3 was located by WDFW during an aerial survey conducted in April of 2001. This nest tree is located approximately 300 feet south of the tree containing Nest#2 and approximately 200 feet northeast of Nest tree #1 along the shoreline of Admiralty Inlet. Nest#3 was occupied by the resident pair of eagles in 2001 and produced one young. The eagle pair nested in Nest#2 during the 2002 nesting season. It is unknown how many young were produced at the nest that season. The WDFW did not conduct any aerial surveys during the 2003 or 2004 seasons so nesting activity is not known for these seasons. The WDFW did conduct a statewide aerial survey of eagle nesting territories in 2005. The Olele Point Territory was surveyed on April 8, 2005. No nests were found in the trees that had contained Nest#1 and Nest#3 but the trees were reported to still be suitable to support nests. The Nest#2 was located during the survey and was reported as unrepaired. No eagles were observed at the nest. The nesting status of the Olele Point Territory is unknown for the 2006—2009 nesting seasons. The WDFW no longer has funding or staff time to monitor bald eagle nests each season. However, it can be noted that during the site visit to review development plans for this plan on April 15, 2010, that eagle activity was present within the territory. There were considerable eagle vocalizations heard along the shoreline area. Nest#2 was located and one adult eagle was observed on the nest. The behavior observed conveyed that the eagle was likely brooding young in the nest. During the site visit, WDFW confirmed that the tree that the trees that contained Page 2 of 10 Nest#1 and Nest#3 were still present. It was also documented that the adjacent landowners has conducted some recent clearing near the tree containing Nest#2. The nest tree that had contained Nest#1 is on a parcel of property that has been developed. This property contains a single-family home with detached shop and guesthouse under a Bald Eagle Management Plan that was executed in October 1996. Nest Trees #2 and #3 are located on undeveloped parcels of land bordering Admiralty Inlet. These undeveloped parcels contain stands of deciduous trees with a mix of conifer trees. Numerous large mature conifer trees exist along the shoreline of these undeveloped parcels. George and Leslie Herion have owned a 4.7 acre parcel of property within the Olele Point Eagle Territory for many years (Figure 3). The landowners are not planning to develop the property in the future and will be putting the parcel up for sale. The documented Olele Point bald eagle Nest Tree#1 is located two parcels to the north. The tree containing Nest#2 that is active this season is located on the parcel directly to the south and tree that had contained Nest#3 is located along the shoreline on the property adjacent to the north. The Herion property parcel contains significant bald eagle habitat that includes buffering habitat to all nest trees, shoreline perching habitat, and potential alternate nest trees. The landowners were apparently not aware of the need for a Bald Eagle Management Plan. The landowners are planning to sell the parcel of property in the future. They submitted a Site Plan Approval Advance Determination(SPAAD) application to Jefferson County in early 2010. They initiated the SPAAD process to preserve the shoreline set back from the high water mark. The property is rectangular shaped and contains approximately 240 feet of medium bluff waterfront above the Admiralty Inlet. The property was substantially logged in the mid 70's. An access road was constructed in the late 1990's. The property is actually accessed off an easement road that runs north-south across the property. This is a maintained easement road that actually borders the western edge of the property. The landowners actually own a acre parcel of property directly to the west of the easement road. There is currently no easy access to the beach on the waterfront property. A majority of the parcel is fairly wooded with a mix of conifer trees and a large component of young red alder and large-leaf maple trees. A few cherry trees are located on the property. Ground vegetation includes sword fern, stinging nettles, various berry species, salal, ocean spray, and other shrubs and forbs. There are some mature conifer trees and a large snag tree that have potential for bald eagle perching. There are also alternate nest trees on the property. Some portions of the Herion property are relatively steep with a descending slope to the shoreline. There is a steep drainage located along the northeastern side of the property. There are portions of the property that are not suitable for building. An area on the eastern side of the easement road and west of the shoreline is the area proposed for development on the SPAAD application. Bald eagle Nest Tree #2 and other significant bald eagle habitat are located in this portion of the property. A Geology Hazard Assessment Report was required to determine if there were any landslide hazard areas on the property. The county has a 1:1 ratio set back requirement for the bluff. The Geo-Tech report, dated October 1, 2009, concluded that Page 3 of 10 • nest trees. The protection of bald eagle perching habitat and potential alternate nest trees that exist on the Lucas property is also important. There is also some concern that the proposed development and increased human disturbance could cause nest failure, reduced productivity over time, or abandonment of the territory. The WDFW no longer requires timing restrictions for heavy equipment operations or outside construction within 800 feet of a nest tree. However, timing restrictions will be recommended in this plan to minimize disturbance during the bald eagle breeding and nesting season. The planting of conifer seedling trees on the property has been recommended by WDFW. The conifers will enhance the existing buffer on the nest tree, supplement screening of the proposed residence, and provide future bald eagle habitat. The landowners have exhibited a strong desire to protect the local eagle pair and the remaining significant bald eagle habitat that is located on the property. CONDITIONS The following conditions apply to protect bald eagles and their habitat: 1) The Douglas fir tree located on the property that was documented to contain the Olele Point bald eagle Nest#2 shall not be damaged or removed. 2) The landowner agrees to assume any and all risks resulting from the presence of proposing development near the bald eagle Nest Trees#2 and will not seek authorization to remove these trees. 3) The WDFW shall grant approval of the proposed SPAAD for the parcel but the purchaser of the property shall work closely with the WDFW to define specific locations for the proposed development on the property. 4) The proposal to install a new driveway and septic system on the property, as shown on the SPAAD plan, shall be allowed (Figure 4). 5) The proposal to construct a single-family residence on the property, as shown on the SPAAD plan, shall be allowed (Figure 4). 6) A finalized site development plan shall be provided to WDFW prior to any further tree removal, clearing, or development on the parcel. The WDFW and landowner shall work together to define a specific home foot print location that will protect important bald eagle habitat. 7) The proposal to remove understory vegetation and identified trees within the areas proposed for development shall be allowed. Trees proposed for removal will be shown on the finalized site development plan. All clearing shall be in compliance with Jefferson County regulations and the Drainage and Erosion Control Plan developed for the property. Page 5 of 10 8) The clearing of vegetation along property lines shall be allowed. Every effort should be made to protect existing trees along the property boundaries. The landowner representative shall contact WDFW if any conifer trees> 12 inches diameter at breast height(DBH) are proposed for removal. 9) The selective removal/trimming of understory vegetation,the selective removal of small (< inches diameter at breast height) hardwood trees, and the limbing of conifer trees shall be allowed to achieve and maintain a water view. No more than 30% of the live crown of a conifer tree shall be removed. The landowners shall maintain the existing screen of vegetation towards the nest trees as much as possible. 10) Danger trees may be removed if trees are identified as hazardous by a professional forester or certified arborist. A written report from the forester/arborist must be submitted to the WDFW before approval to remove the hazard trees is granted. A tree that presents imminent danger to the safety or property of individuals may be removed without a report. 11) It is recommended that no heavy equipment operation, clearing, tree cutting, outside home construction, or burning shall occur during the bald eagle breeding and nesting season from February 1 - August 15 of any given year. Timing restrictions shall not be required for a given year if it may be determined that the eagle pair is not actively nesting at the nest or within 800 feet of the property. If an eagle does not show signs of incubating eggs by May 1, then the recommended timing restrictions do not apply for that year. Surveys to determine nesting status must be conducted by a qualified biologist. * Special note: The WDFW is no longer requiring timing restrictions but has requested that the landowner work cooperatively to minimize disturbance during the nesting season. The landowner shall contact WDFW if any heavy equipment work or outside construction activities are proposed during the bald eagle breeding and nesting season. The landowner and WDFW shall develop a plan to minimize disturbance and potential impacts to the eagles. 12) The WDFW recommends no discharge of firearms, fireworks, or explosives during the bald eagle breeding and nesting season from February 1 - August 15 of any given year. 13) The landowner trustees shall notify all potential buyers that a bald eagle management plan is required for the property. 14) The future purchaser of the property shall be required to sign a finalized Bald Eagle Management Plan based on the conditions of this plan. Page 6 of 10 JUSTIFICATION The landowner was granted approval to develop within 400 feet of identified bald eagle nest trees due to the fact that Nest Tree#2 is located on the adjacent property, the tree that contained Nest#3 is on the adjacent property. The WDFW recognizes that the landowner be granted reasonable use of the property. The WDFW worked closely with the landowner to minimize impacts of proposed development. A diligent effort was made to use existing cleared areas and to minimize tree removal on the property. The WDFW has recommended the planting of conifer trees to improve buffering around the nest trees and provide future bald eagle habitat. DURATION OF PROTECTION This plan applies to the landowner who signs the plan. If the ownership changes, the new landowner may sign the approved bald eagle plan or request a new one. Since eagles return to the same traditional use areas each year, the conditions of this plan shall apply indefinitely unless a breeding territory has been unoccupied for 5 consecutive years. If the breeding territory is unoccupied for 5 consecutive years, then the WDFW biologist and the landowner should evaluate the continued need for protection of the bald eagle habitat. If an eagle does not show signs of incubating eggs by May 1, then the recommended timing restrictions do not apply for that year. Surveys shall be done by a qualified wildlife biologist. Please contact WDFW if the eagles change the location of their nest. Do not assume that the conditions of this plan no longer apply. REVIEW AND AMENDMENT This plan will be subject to the following review and amendment process. The plan may be reviewed periodically by the WDFW to determine whether: 1)the plan requires amendment in response to changing eagle and landowner circumstances; or, 2)the terms of the plan comply with applicable laws and regulations; or, 3)the parties to the plan are complying with its terms. APPEAL PROCEDURE In addition to the provisions of WAC 232-12-292 (7.1)-(7.3), the landowner may request a formal appeal of WDFW actions according the Administrative Procedures Act, Chapter 34.05 RCW, and the Model Rules of Procedure, Chapter 10.08 WCA. Such a request shall be filed with the Department within 20 days of receipt of the contested WDFW decision. The appeal request shall clearly state the relief sought and the ground for appeal. If you send her out to locate the nest she doesn't have to go on the Wilde property. I first located the nest while standing in the proposed building envelope area on your lot. I heard 2 eagles vocalizing first from the Lucas lot. When I moved north to your lot I spotted the nest. I then climbed to a higher elevation on your lot to determine if the nest was active. I observed one adult eagle at the nest. I sure wish I had my camera with me! The tree the nest was located in did meet the description of Nest Tree#2. If you do have Barbara go out to the site I sure hope she will not share too much information with Mr. Wilde when she calls to have him open the gate. I believe he may have conducted some illegal clearing of his property but I have not had time to initiate a full investigation with the DNR,the county, and my agency Law Enforcement staff. As you know there is some history between Dale and my agency(+the ,county and DNR for that matter). I know he told you the eagle nests were no longer present. It is certainly possible that he doesn't know about the nest but I think it would be difficult for him not to see the nest or at least view the activity at this nest from his cleared property to the north. Due to the sensitive nature of the situation I have not contacted him to discuss the active nest. Barbara also wrote me a rude message in which she questions the delay in the plan for your lot. I know your SPAAD deadline is May 24th for this lot and I planned to draft that plan soon. Please know George April—June is the busiest time of year for me and I have very limited time to work on eagle management. I'm trying me best to assist you so you meet or are at least close to your deadlines (at no cost). It sounds like Michelle is totally fine with giving you an extension on the SPAAD approval. I certainly would want you to be acceptable of the information and conditions presented in the plan before you sign it. I'm happy to discuss any concerns you may have. Hopefully we can actually talk soon. You had suggested tomorrow but I will be at aircraft training all day in Port Angeles. I'm certainly aware that Mr. Herion has a deadline for the SPAAD on the Lucas Lot of May 12 and on his lot of May 24. I was planning to have both plans completed by this week but was then recruited to assist with deer fawn captures and have been out of the office. I'm still planning to have the plan for the Lucas lot completed as soon as possible (to meet the deadline next week). I have initiated drafting the plan. I have to be in the field g p for survey work today and tomorrow. Hopefully Mr. Herion and I can work together to have a finalized plan on Monday or Tuesday. The plan for the Herion lot will be the next priority and should be finalized before the 24th 5/13/2010 Page 5 of 6 Both parcels of property contain very significant nest buffering habitat and perch trees that I observed during my site visit. As you know.......the SPAAD application site plans I have do not convey the specific location of proposed development. There is no exact footprint shown for the home location,just a general buildable area. There is also no specific location for a driveway for each parcel. For the purposes of completing Bald Eagle Management Plans it would be preferred to have more finalized site plans. At this time, I'm drafting plans that will contain some wording that WDFW will work closely with the landowner in the future to identify the specific home site location. Our agency must allow reasonable use of the property so it is a given that a driveway,septic system, and single family residence will be allowed on each lot. A condition of the plan will be that the landowner provide WDFW with a finalized site development plan (showing the footprint of a home) prior to any tree cutting, clearing, or development. On a side note: During my site visit to the Herion property, I did note that Dale Wilde has conducted more clearing and other land-use activities on his Parcel#921332002. Limitations of Approval -Approval of the site plan shall not guarantee the performance of specific site features or improvements (e.g. wells, septic systems, stormwater drainage facilities, etc.)and shall not be immune from changes in state or federal law which are enacted or have an effective date after the date of the Site Plan Approval Advance Determination (SPAAD) and which may affect the performance and implementation of the site plan and associated use or activity. Any subsequent land division or boundary line adjustment of a parcel or lot which has received site plan approval advance determination under this Section 8.7 shall void such site plan approval and require a new site plan approval advance determination application. Approval of a site plan under this section does not constitute authority to comence any development or building activity until such time as final authorizing permits are issued (e.g., septic, wells, stormwater management, or building permit, etc.). Modification to an approved site plan may be required by the applicant and approved by the Administrator subject to the provisions for Type I decisions. (Please request a copy of Section 8.7 of the UDC for criteria pertaining to modifications).
