FINDINGS
In accordance with the authority provided under subsection 4.101
and the requirements contained in Subsection 5.402 of the Jefferson
County Interim Critical Areas Ordinance, the following are findings
of fact relating to the referenced application:
1) The application was reviewed by Jefferson County Permit Center
staff on July 16, 1996 for the potential presence of critical areas
regulated under the provisions of the Ordinance, and the following
critical areas were confirmed as potentially present on the subject
property: Landslide Hazard Area, Critical Aquifer Recharge Area
andErosional Hazard Area.
2) Acting upon the above information, Jefferson County staff member,
Michelle Lewis conducted a site inspection of the subject property on
July 18, 1996 and confirmed the existence of the following critical
areas and/or their associated buffers on the property: Landslide Hazard
Area and Erosional Hazard Area.
3) Following the site inspection, Jefferson County staff reviewed the
application for conformance with the protection standards and
requirements for Landslide Hazard Areas and determined that. . . The
proposed location for the residence is surrounded by dense vegetation
on the north, east, and west sides of the cleared site area. South of
the proposed site, is a small berm (terrace like) which has been was
cut to place the road. It is this area, as well as the recent clearing
that is of concern. The parcel is situated on a landslide hazard area.
The recent clearing and grading of the road has also altered the
existing topography and is very steep, which will add to the occurence
of increased erosion in this area. It is for these reasons that the
following conditions apply.
This waiver from the provisions of the Jefferson County Interim Critical
Areas Ordinance is granted subject to the following conditions. Any
diviation from these conditions shall result in this waiver being
revoked and the application becoming subject to further review.

CONDITIONS OF APPROVAL
1) Vegetation retained on-site following completion of clearing for
roadways, utilities and the like, may be cleared only if such clearing
is absolutely necessary to complete the proposal (Note: This condition
shall not be construed as allowing removal of native vegetation within
a designated critical area or its associated buffer) .
2) The proposed development shall be located on the subject property
exactly as identified on the Universal Plot Plan, or other Site Plan,
approved by the County as part of the triggering permit application.
Applicant shall be responsible for contacting and notifying
contractor(s) of the above conditions in order to ensure compliance at
various stages of construction/development.
3) The applicant shall develop and submit to the Department of Public
Works for approval, a "Small Parcel Erosion Control Plan. " (see
enclosures) . The subject permit will not be issued unless the applicant
submits to the Permit Center, a copy of the "Small Parcel Erosion
Control Plan" showing a stamp of approval from the Department of Public
Works. Once the subject permit has been issued, the applicant shall
fully implement the provisions of the submitted "Small Parcel Erosion
Control Plan", and contact the Jefferson County Public Works Department
to arrange a schedule of inspection for plan compliance. A Certificate
of Occupancy will not be issued until the Public Works Department
verifies plan compliance.

1. Describe what primary temporary erosion and sedimentation control measure(s)will
be implemented to control erosion and p r e vent sediment from leaving the project site
or entering or impacting any critical areas during any clearing, grading, excavation,
embankment and/or construction activities. This requirement can be met by
implementing one or more of the measures listed below. Please check the measure(s)
you plan to implement and show their approximate location on the site plan.
Measures, other than those listed, may be proposed. Attach additional sheet(s)if more
space is required.
Start and complete all clearing, grading, and construction activities and stabilize
the site between April 1 and October 15. Stabilization means that disturbed areas
will have a well established plant cover or be landscaped to minimize erosion prior
to October 15. Areas that do not have a well established plant cover will be
covered with mulch or plastic to prevent erosion.
Limit clearing and grading activities to areas of less than 5000 square feet and
maintain a minimum of a 25 foot well established vegetative buffer between
V disturbed areas and all-property-boundaries, road side ditches and/or critical areas
designated as wetlands, aquatic habitat,landslide hazards or erosion hazards.
Cover exposed areas awaiting final grading and stabilization with a minimum of 2
inches of straw or hay or other material approved for this purpose.
Install a filter fence on the downhill portion of the lot, along the contour line
where possible, to filter run-off before it leaves the project site or enters any
buffer areas or areas designated as wetlands or aquatic habitat. The filter fence
shall be installed according to the installation instructions contained in the Storm
Water Management Manual for the Puget Sound Basin.
Propose other erosion and sedimentation control measures. Please describe
proposed measures below. Be specific as to design and specifications.

adjacent to the road (driveway) . The applicant shall amend this
area on the site with a retaining wall, vegetation groundcover, or
a bulkhead.
