Final approval of septic permit SEP06-00384 is required prior to receiving a final approval on any residential building permit. An engineer or licensed septic system designer must provide An as-built or record drawing of the sewage pump vault and certify the abandonment of the old septic system. This is required prior to final sign off the septic permit it by the environmental health department. 2.) RESIDENCE IS LIMITED TO 2 BEDROOMS IN SIZE 3.) BASED ON THE LETTER DATED JUNE 5, 2008 FROM THE DEPARTMENT OF ARCHAEOLOGY AND HISTORIC PRESERVATION, AN ARCHAEOLOGICAL SURVEY OF THE SITE SHALL BE SUBMITTED AT THE TIME OF BUILDING PERMIT APPLICATION. THE PROJECT IS WITHIN A RECORDED ARCHAEOLOGICAL SITE AND AN ARCHAEOLOGICAL SURVEY OF THE PROJECT AREA IS REQUIRED PRIOR TO ANY LAND DISTURBING ACTIVITY. 4.) At the time of a building permit application a stormwater plan in compliance with the Stormwater Management Manual for Western Washington (current edition) shall be submitted. If the proposal can not meet the prescriptive requirements of the stormwater manual, an engineered stormwater plan shall be required. 5.) THE PROPOSED BUILDING ENVELOPE SPANS ACROSS LOT LINES AND ONLY LOT 16 HAS A SEPTIC CONNECTION TO THE COMMUNITY SEPTIC SYSTEM. AT THE TIME OF BUILDING PERMIT APPLICATION, THE PROPERTY OWNER (BECKETT POINT FISHERMAN'S CLUB) SHALL RECORD A DECLARATION OF RESTRICTIVE COVENANT TO COMBINE WEST BEACH LOTS 16 AND 17 TO MEET BULK AND DIMENSIONAL REQUIREMENTS AND SEPTIC REQUIREMENTS. 6.) To help prevent seawater from intruding landward into underground aquifers, all new development activity on Marrowstone Island, Indian Island and within 1/4 mile of any marine shoreline shall be required to infiltrate all stormwater runoff onsite. 7.) VOLUNTARY MEASURES OF COASTAL&AT RISK SIPZ: Water conservation measures: 1. Roof and other intercepted precipitation shall be routed to on-site detention ponds and/or other approved means and allowed to be released to the soil slowly. 2. Water collected from Storm water and roof catchments may be used for watering lawns and gardens. Unless catchment water has been treated to meet drinking water standards, there shall be no cross connections allowed between the potable supply and impounded water. 3. Water withdrawn from wells on each property shall not be used for watering of lawns and/or gardens. 4. Ground water withdrawn from each property shall be restricted to a rate of three(3) gallons per minute. 5. Installation of water conserving fixtures such as low flow toilets, faucets and shower restrictors and other water saving plumbing fixtures. , 6. Landscaping plan (xeriscaping, native vegetation with minimal amounts of irrigation). Please NOTE that the above listed measures are not intended to be exhaustive, but rather is intended to be illustrative of the types of water conservation measures. 8.) Critical Aquifer Recharge Areas may require special protection measures to mitigate water quality degradation. The submitted proposal does not require additional aquifer protection measures. However, during construction the project shall follow the Best Management Practices (BMPs)and facility design standards as identified and defined in the Stormwater Management Manual for the Puget Sound Basin. 9.) The project shall adhere to the Best Management Practices (BMPs) to control stormwater, erosion and sediment during construction. BMPs shall address permanent measures to stabilize soil exposed during construction, and in the design and operation of stormwater and drainage control systems. 10.) Outdoor residential storage shall be maintained in an orderly manner and shall create no fire, safety, health or sanitary hazard. 11.) Not more than 2 unlicensed vehicles shall be stored on any lot unless totally screened from view of neighboring dwellings and rights-of-way. Such screening shall meet all applicable performance and development standards specific to the district in which the storage is kept, and shall be in keeping with the character of the area. Screening shall meet the requirements of Chapter 18.30 JCC. Outdoor storage of 3 or more junk motor vehicles is prohibited except in those districts where specified as an automobile wrecking yard or junk (or salvage)yard and allowed as a permitted use in Table 3-1 or Chapter 18.18 JCC, and such storage shall meet the requirements of JCC 18.20.100, Automobile wrecking yards and junk (or salvage)yards. In no case, shall any such junk motor vehicles be stored in a critical area. 12.) A minimum of two(2) on-site parking spaces shall be provided for the single family residence. 13.) Duration of Approval-Several of the included findings shall become conditions upon the submittal of a building and septic permit. The duration of approval of the Site Plan shall be effective for five (5)years from the date of original approval by the Administrator. If a building permit has not been issued within the five (5)year period, the Site Plan Approval Advance Determination (SPAAD)cannot be revived or extended except by new application that must meet all the existing criteria and conditions listed in this Section. Knowledge of the expiration date shall be the responsibility of the applicant. The county will not provide notification prior to expiration. Limitations of Approval -Approval of the site plan shall not guarantee the performance of specific site features or improvements (e.g. wells, septic systems, stormwater drainage facilities, etc.) and shall not be immune from changes in state or federal law which are enacted or have an effective date after the date of this Site Plan Approval Advance Determination (SPAAD) and which may affect the performance and implementation of the site plan and associated use or activity. Any subsequent land division or boundary line adjustment of a parcel or lot which has received site plan approval advance determination under this Article VII, Chapter 18.40 JCC shall void such site plan approval and require a new site plan approval advance determination application. Approval of a site plan under this section does not constitute authority to commence any development or building activity until such time as final authorizing permits are issued (e.g., septic, wells, stormwater management, or building permit, etc.). Modification to an approved site plan may be required by the applicant and approved by the Administrator subject to the provisions for Type I decisions. (Please request a copy of Article VII, Chapter 18.40 JCC for criteria pertaining to modifications). 14.) Minimum setback from Beckett Point Road right-of-way shall be 3 feet. Minimum side yard setbacks shall be 5 feet. Minimum rear setback(shoreline)shall be 22 feet from Ordinary High Water Mark(OHWM) and landward of the"historic build line" per the recorded plat. 15.) The building height is not to exceed 35 feet. 16.) Pre-existing legal lots of record less than one acre in size in rural residential districts are subject to the stormwater requirements in Chapter 18.30 JCC and must meet the"Area of Impervious Surface Coverage"to the maximum extent practicable as determined by the administrator. Lot coverage is defined as amount of impervious surface, which includes rooftops, driveways, concrete, etc. 17.) Exterior lighting for residential uses shall not exceed twenty feet(20') in height from the finished grade, excepting when such lighting is an integral part of a building or structure. Ground level lighting is encouraged. 18.) Lighting fixtures shall be designed and hooded to prevent the light source from being directly visible from outside the boundaries of the property. The intensity or brightness of all lighting, during construction and after project completion shall not adversely affect the use of surrounding properties or adjoining rights-of-way. 19.) Flood hazard reduction measures are to be used as required by the Jefferson County Flood Damage Prevention Ordinance 07-0515-06 (Jefferson County Code Chapter 15.15). 20.) Utilities shall be designed as specified in 15.15.080(c) of Jefferson County Flood Damage Prevention Ordinance 07-0515-06 (Jefferson County Code Chapter 15.15)which states: (i)All new and replacement water supply systems shall be designed to minimize or eliminate infiltration of flood waters into the systems; (ii)Water wells shall be located on high ground that is not in the floodway; (iii) New and replacement sanitary sewage systems , shall be designed to minimize or eliminate infiltration of flood waters into the systems and discharges from the systems into flood waters; (iv) Onsite waste disposal systems shall be located to avoid impairment to them or contamination from them during flooding. 21.) 1) All new construction and substantial improvements shall be anchored to prevent flotation, collapse, or lateral movement of the structure. 2) All manufactured homes shall be anchored to prevent flotation, collapse, or lateral movement, and shall be installed using methods and practices that minimize flood damage. Anchoring methods may include, but are not limited to, use of over-the top or frame ties to ground anchors. 22.) A flood elevation certificate prepared by a qualified professional shall be submitted with the application for the building permit. The flood elevation certificate shall meet the requirements found in Chapter 15.15, Jefferson County Code(JCC). Prior to final inspection of the single-family residence the applicant shall submit a"post construction"flood elevation certificate prepared by a qualified professional. 23.) The applicant shall apply for a Shoreline Substantial Development Permit Exemption for any accessory structures or at the time of a building permit the single-family residence. 24.) Residential developers and individual builders shall be required to preserve shoreline vegetation and reduce the associated risk of erosion during construction and any future activity which may impact the stability of the shoreline. 25.) The applicant shall provide proof of potable water at the time of building permit application. FINDINGS: 1.) The Administrator finds that this application complies with applicable provisions of the Unified Development Code,all other applicable ordinances and regulations,and is consistent with the Jefferson County Comprehensive Plan and Land Use map. 2.) The application was reviewed by the Jefferson County Department of Community Development staff on April 29, 2008 for the potential presence of Environmentally Sensitive Areas (ESAs) under the provisions of the Unified Development Code(UDC). After an initial Geographic Information Systems mapping review and an investigative site inspection, the following ESAs were confirmed to be present on the subject property: Shoreline Designation: Suburban, Shoreline Slope Stability: Stable, Coastal Salt Marsh, Blue Heron, Wetlands, Seismic Hazard Area, Frequently Flooded Area (FEMA Flood Zone A), Susceptible Aquifer Recharge Area (SUSC), Seawater Intrusion Protection Zone (SIPZ): Coastal. 3.) On March 25, 2010, the Jefferson County Department of Public Works provided the following comments: The following information is being provided in response to your request for comments regarding the road setback reduction. The site was staked showing the setback presumably measured from the road since no survey markers were found. The existing house is 12'from the right of way line as marked in the field. The setback request is 3'from the same line with an area approximately 4' long and marked 4' back. The house to the west at 750 Beckett Point Rd. appears to have been built on the right-of-way/property line. The homes easterly at 73, 720 and 710 appear to be set approximately±from the right-of-way line. Public Works previously commented to a request to reduce the setback of a garage, a distance of 11 &1/2 feet from the edge of pavement, which is located across from this site. This request, combined with the approval of the setback reduction for the garage across the street, further restricts the intended use of the right-of-way. The Applicant should be aware that the public right-of-way is reserved for transportation facilities and appurtenances including, but not limited to, the road surface, shoulders, drainage ditches or pipes, walking paths or sidewalks, cut and fill slopes, and franchised utilities (power, water, phone sewer, etc.). Under no circumstances shall any development be allowed on the public right-of-way or interfere with maintenance of transportation facilities, drainage facilities, or utilities. This is supported by Jefferson County Code. Public Works does not oppose the setback request given the development patterns in this area, if all other options have been exhausted. However, we strongly recommend the buildable area be setback to the furthest extent possible. The potential that public rights-of-way could be used for things connected to a building's footprint may be likely, i.e. entrance areas, building maintenance corridor, fences, landscaping, guest parking, etc., which may impede the function of the right-of-way. Since SPAAD's do not require actual house plans, the determination of a hardship is not clear. At that time, it may be that the reduction is justified. The County is not responsible for preventing runoff from the right-of-way from entering adjoining property. Development of adjoining properties shall not be cause for the County to undertake roadway improvements to alter drainage patterns. The property owner shall accommodate drainage and runoff as part of the development. Public Works staff is available to discuss any concerns you may have regarding the above. The original letter is filed in MLA08-00037. 4.) Aquifer Recharge Areas in Jefferson County are characterized by porous geological formations that allow percolation of the surface water into the soils and the underlying zone of saturation. Aquifers are geologic formations that contain sufficient saturated permeable material to yield significant quantities of water to wells and springs. Aquifers serve as the source of drinking water within most of the rural portions of Jefferson County. 5.) Susceptible Aquifer Recharge Areas are those with geologic and hydrologic conditions that promote rapid infiltration of recharge waters to groundwater aquifers. 6.) Critical Aquifer Recharge Areas are defined as Seawater Intrusion Areas, and Special Aquifer Recharge Protection Areas and the following land uses located within Susceptible Aquifer Recharge Areas (1)All Industrial Land Uses (2)All Commercial Uses (3)All Rural Residential Land Uses requiring a Discretionary Use or Conditional Use Permit(4)All Rural Residential Land Uses with nonconforming uses that would otherwise require a Discretionary Use or Conditional Use Permit(5) Unsewered Planned Rural Residential Developments (6) Unsewered residential development with gross densities greater than one unit per acre. All of the above listed uses shall be subject to the applicable requirements and standards of the Jefferson County Unified Development Code. 7.) Geologically Hazardous Areas in Jefferson County are characterized by slope, soil type, geologic material, and groundwater that may combine to create problems with slope stability, erosion, and water quality during and after construction or during natural events such as earthquakes or severe rainstorms. 8.) Marine shorelines and islands are susceptible to a condition that is known as seawater intrusion. Seawater intrusion is a condition in which the saltwater/freshwater interface in an aquifer moves inland so that wells drillec on upland areas cannot obtain freshwater suitable for public consumption without significant additional treatment and cost. Maintaining a stable balance in the saltwater/freshwater interface is primarily a function of the rate of aquifer recharge (primarily through rainfall) and the rate of groundwater withdrawals (primarily through wells). The Washington Department of Ecology is the agency with statutory authority to regulate groundwater withdrawal for individual wells in Jefferson County. New development,tY ment, redevelopment, and land P use activities on islands and in close proximity to marine shorelines in particular should be developed in such a manner to maximize aquifer recharge and maintain the saltwater/freshwater balance to the maximum extent possible by infiltrating stormwater runoff so that it recharges the aquifer. 9.) The parcel is located within a coastal SIPZ(seawater intrusion protection zone) according to the County GIS map. There are voluntary and mandatory measures identified in the Jefferson County Seawater Intrusion Policy (Resolution 44-22, effective September 23, 2002)that apply to well drilling proposals and building permit applications on existing lots of record. A Coastal SIPZ is defined as: all islands and area within one-quarter mile of marine shoreline, but no history of chloride concentration above 100 mg/L in groundwater sources within 1000 feet. 10.) Jefferson County determined that this proposal is categorically exempt from review under the State Environmental Policy Act(SEPA) pursuant to WAC 197-11-800(1)(b)(i). 11.) The revised site plan as submitted on March 25, 2010 has been reviewed for consistency under the UDC, and has been approved by Jefferson County Department of Community Development. Any modifications, changes, and/or additions to the stamped, approved site plan dated April 19, 2010 shall be resubmitted for review and approval by Jefferson County Department of Community Development. 12.) This approval is for a site plan approval advanced determination (SPAAD) only. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits. 13.) The parcel has been designated.as Rural Residential 1:20 under the Jefferson County Comprehensive Land Use Map effective August 28, 1998. 14.) The proposal was reviewed against the site plan determination criteria of the Jefferson County Code Chapter 18.40 Article VII. (Site Plan Approval Advance Determinations). The criteria for approval are as follows: 1. The proposed site plan conforms to all applicable county, state and federal, land use, environmental and health regulations and plans, including, but not limited to the following: (a)The Jefferson County Comprehensive Plan; and (b)The provisions of this code, including any incorporated standards. Staff comment: The application was reviewed for consistency under the provisions of the Unified Development Code and Comprehensive Plan. The application was found in compliance with all ordinances pertaining to the proposed development. • , 2. Adequate provisions for utilities and other public services necessary to serve the needs of the proposed site plan have been demonstrated, including open spaces, drainage ways, roads, and other public ways, potable water, sewage disposal, fire flow and other improvements. Staff comment: The combined size of the two subject lots is approximately 0.09 of an acre and the revised site plan as submitted on March 25, 2010 and stamped approved on April 22, 2010, complies with JCC 18.30.050, Table 6-1: Density, Dimension and Open Space Standards. Jefferson County Department of Environmental Health reviewed the application with regards to septic. The department conditioned the SPAAD approval as follows, "Residence is limited to 2 bedrooms in size." The SPAAD was not reviewed for fire flow. However, the parcel is located within a state approved water system. Jefferson County has no specific adopted fire flow requirements for utilization in permitting. Application of Coordinated Water System Plan (CWSP)fire flow requirements for individual projects is inappropriate since the primary purpose is for water system design to assure adequate pipe size, source, and storage. The applicant shall provide proof of potable water at the time of building permit application. This application does not vest the parcel for potable water. Access is provided by Beckett Point Rd. (C617509)which is a county local access road. Parking for the proposal is located in a two car garage directly across Beckett Point Rd. from lots 16 and 17. The approved site plan has not been reviewed for stormwater requirements. Sections JCC 18.30.060 and JCC 18.30.070 of the Jefferson County Code requires the project applicant prepare a stormwater plan in compliance with the Department of Ecology Stormwater Management Manual for Western Washington to control stormwater, erosion and sediment during construction, to address permanent measures to stabilize soil exposed during construction, and in the design and operation of stormwater and drainage control systems. At the time of a building permit application a stormwater plan in compliance with the Stormwater Management Manual for Western Washington (current edition) shall be submitted. If the proposal can not meet the prescriptive requirements of the stormwater manual, an engineered stormwater plan shall be required. 3. The probable significant adverse environmental impacts of the proposed site plan, together with any practical means of mitigating adverse impacts, have been considered such that the proposal will not have an unacceptable adverse effect upon the quality of the environment, in accordance with the State Environmental Policy Act(SEPA) implementing provisions contained within this chapter and Chapter 43.21 C RCW. Staff comment: Single-family residences are EXEMPT from the State Environmental Policy Act(SEPA). WAC 197-11-800(1)(b)(i) identifies the construction of any residential structure of four(4) dwelling units. 4. Approving the proposed site plan will serve the public use and interest and adequate provision has been made for the public health, safety and general welfare. Staff comment: The proposal will not affect the public health, safety, and general welfare. 15.) Due to a recent Washington State Supreme Court Case: Futurewise v. WA State DCTED, Ecology, Case #80396-0, the Critical Areas Ordinance(Chapter 18.22, JCC) does not apply to development within Shoreline jurisdiction. Only the Jefferson County Shoreline Management Master Program (Chapter 18.25, JCC)applies to development within 200 feet of the OHWM. 16.) This parcel was created through Beckett Point Fishermen's Club Assessor's Plat under AFN 535120, recorded June 24, 2008, Volume 8, pages 83-98 with the Jefferson County Auditor's office. 17.) Gretchen Kaehler, Dept. of Archaeology and Historic Preservation, provided the following comments in a letter dated June 5, 2008: We have reviewed the materials forwarded to our office for the proposed project referenced above.The project is within a recorded archaeological site and a survey of the project area is required. Therefore, we require a professional archaeological survey of the project area be conducted prior to ground disturbing activities. We also recommend consultation with the concerned Tribes'cultural committees and staff regarding cultural resource issues. The complete letter is filed in MLA08-00037 and was forwarded to the property owner and applicant on June 24 2008. 18.) The proposed building envelope is in an area of small lots surrounded by residences, outbuildings and roads. Per JCC 18.22.095 the administrator has determined the proposal is excluded from buffers for wetlands due to physical separation and functional isolation created by Beckett Point Road. 19.) The garage built under building permit number BLD09-00414/MLA09-00414 meets the parking requirements foi the proposed residence. 20.) On April 13, 2010 the UDC Administrator approved a Front/Road Setback Variance for this proposal. The minimum setback to the edge of the right-of-way for Beckett Point Rd. is 3 feet. 21.) NOTICE: This permit does not excuse the proponent from complying with other local, state, and federal ordinances, regulations, or statutes applicable to the proposed development, but consistent with RCW 90.58. Development pursuant to this permit shall be undertaken subject to the applicable policies and performance standards of the Jefferson County Shoreline Management Master Program and the Jefferson County Unified Development Code. If during excavation or development of the site an area of potential archaeological significance is uncovered, all activity in the immediate area shall be halted, and the Administrator shall be notified at once. The Federal Endangered Species Act rules to protect threatened Chinook and Summer-run Chum salmon became effective on January 8, 2001. Bull trout have been listed as threatened since early 2000. Under the ESA, any person may bring lawsuit against any individual or agency that"takes" listed species (defined as causing harm, harassing, or damaging habitat for the listed species). In addition, the National Marine Fisheries Service can levy penalties. All areas in Jefferson County are included as"critical habitat"for a listed species. Development of property along any marine shoreline, freshwater shoreline, or floodplains could harm habitat if protective measures are not taken. To minimize the potential to damage habitat, all property owners developinc adjacent to marine shoreline, freshwater shoreline, or floodplains are advised to do the following: -All development activities should avoid unstable slopes, wetlands, and forested areas near surface waters - Remove minimal vegetation for site development, especially large trees -Allow trees that have fallen into surface waters to remain there - Infiltrate stormwater from buildings and driveways onsite through drywells rather than discharging directly into surface waters or roadside ditches Any individual, group, or agency can bring suit for a listed species"taking", even if you are in compliance with Jefferson County development codes. The risk of a lawsuit against you can be reduced by consulting with a professional fisheries habitat biologist, and following the recommendations for site development provided by the biologist. For more information, contact the National Marine Fisheries Service in Seattle, or the U.S. Fish and Wildlife Service. APPEALS: Pursuant to RCW 36.70C,the applicant or any aggrieved party may appeal this final decision to Jefferson County Superior Court within twenty-one (21)calendar days of the date of issuance of this land use decision. The following information is being provided in response to your request for comments regarding the road setback reduction. The site was staked showing the setback presumably measured from the road since no survey markers were found. The existing house is 12'from the right of way line as marked in the field. The setback request is 3'from that same line with an area approximately 4' long marked 4' back. The house to the west at 750 Beckett Point Rd. appears to have been built on the right-of-way/property line. The homes easterly at 730,720, &710 appear to be set approximately 15'±from the right-of-way line. Public Works previously commented to a request to reduce the setback of a garage,a distance of 11&1/2 feet from the edge of pavement, which is located across from this site. This request,combined with the approval of the setback reduction for the garage across the street,further restricts the intended use of the right-of-way. The Applicant should be aware that the public right-of-way is reserved for transportation facilities and appurtenances including, but not limited to,the road surface, shoulders, drainage ditches or pipes, walking paths or sidewalks, cut and fill slopes,and franchised utilities(power,water, phone,sewer, etc.). Under no circumstances shall any development be allowed on the public right-of-way or interfere with maintenance of transportation facilities, drainage facilities,or utilities. This is supported by Jefferson County Code. Public Works does not oppose the setback request given the development patterns in this area, if all other options have been exhausted. However,we strongly recommend the buildable area be setback to the furthest extent possible. The potential that public rights-of-way could be used for things connected to a building's footprint may be likely, i.e. entrance areas, building maintenance corridor,fences, II landscaping,guest parking,etc.,which may impede the function of the right-of-way. Since SPAAD's do not require actual house plans,the determination of a hardship is not clear. At that time, it may be that the reduction is justified. The County is not responsible for preventing runoff from the right-of-way from entering adjoining property. Development of adjoining properties shall not be cause for the County to undertake roadway improvements to alter drainage patterns. The property owner shall accommodate drainage and runoff as part of the development. The Building Committee is currently working to provide a plan for two on-site parking spaces or an approved alternative. In order to develop the parking plan, we first had to have the wetland boundaries re- confirmed by a wetland specialist, Dr. Kenneth Brooks. From that point John Kennedy, Club President, has sketched out a first draft of the plan showing potential additional parking spaces near the point. We realize there are a number of issues remaining including how the spaces are allocated and if easements are involved. We believe we can resolve most of the issues. Since there is some time pressure with respect to SPAAD's and a final parking plan will take some time in order to resolve the above concerns, we are requesting that your department grant the SPAAD's conditioned upon the approval of the parking plan. Our Board of Trustees meet on January 10th, at which time the committee will submit and seek approval of the plan so that we can bring the final parking plan to you. The following information is being provided in response to your request for comments regarding the road setback reduction. The site was staked showing the setback presumably measured from the road since no survey markers were found. The existing house is 12'from the right of way line as marked in the field. The setback request is 3'from that same line with an area approximately 4' long marked 4' back. The house to the west at 750 Beckett Point Rd. appears to have been built on the right-of-way/property line. The homes easterly at 730,720, &710 appear to be set approximately 15'±from the right-of-way line. Public Works previously commented to a request to reduce the setback of a garage, a distance of 11&1/2 feet from the edge of pavement, which is located across from this site. This request, combined with the approval of the setback reduction for the garage across the street, further restricts the intended use of the right-of-way. The Applicant should be aware that the public right-of-way is reserved for transportation facilities and appurtenances including, but not limited to,the road surface, shoulders, drainage ditches or pipes, walking paths or sidewalks,cut and fill slopes,and franchised utilities(power,water, phone, sewer, etc.). Under no circumstances shall any development be allowed on the public right-of-way or interfere with maintenance of transportation facilities, drainage facilities, or utilities. This is supported by Jefferson County Code. Public Works does not oppose the setback request given the development patterns in this area, if all other options have been exhausted. However,we strongly recommend the buildable area be setback to the furthest extent possible. The potential that public rights-of-way could be used for things connected to a building's footprint may be likely, i.e.entrance areas, building maintenance corridor,fences, • landscaping,guest parking, etc.,which may impede the function of the right-of-way. Since SPAAD's do not require actual house plans,the determination of a hardship is not clear. At that time, it may be that the reduction is justified. The County is not responsible for preventing runoff from the right-of-way from entering adjoining property. Development of adjoining properties shall not be cause for the County to undertake roadway improvements to alter drainage patterns. The property owner shall accommodate drainage and runoff as part of the development. Public Works staff is available to discuss any concerns you may have regarding the above. Zoe assumes that Mo-chi reviewed in some way, but didn't see any notes. Landscaping wasn't really established or to plan. They want a final shortly on three buildings that are out there. They've got a new landscaper coming on board shortly. Zoe discussed with applicant representative on site, if they can submit another landscaping plan that meets requirements that they're willing to do, we could work with them. It's getting to be a bad time for planting. Zoe said that by the end of July,new landscaping plan with dates to implement. Does this work for finaling 3rd building? Decision: This will be ok to final buildings. They must submit a landscaping plan with timeline prior to finalling these buildings. Zoe will put in calendar to follow up with the dates they propose. If they're not complying,the issue will be sent to enforcement. ITEM: Beckett Point Parking—Zoe Jean Camfield SPAAD. Need 2 parking spaces. They have existing house, and they park on the wetland side, on the grass. Zoe let them know that they need to come in to compliance with new permitting. This parcel will be an open space tract on the Assessor's plat. Beckett Point homeowners association may be able to do a CASP. Decision: Two parking spaces will be required in order to approve the SPAAD. ITEM: Shoreline Averaging—Cara Shoreline averaging. There are two residents on one side of the proposed remodel within 300 ft. Are both used for averaging? One is on the far side of the road(60+ from OHWM), the other is one house further and on the shore side of the road(5 ish feet from OHWM). Decision: The house 5 ft(ish) from OHWM can be used for averaging(and excluding the one 60+ feet away). The setback,because the OHWM is bulkhead, which in one portion is 11 ft and another is 18 ft setback, will be measured as a curved line along the two portions. See attached copy of drawing from administrator. ITEM: BLA 821151004 POD Gary Green. Michelle. Shoreline parcels. There's a portion of the adjacent property that Green has been maintaining for 20 years. Can they do BLA? .65 acre is smallest parcel. Decision: As long as neither parcel becomes less than .65 acre, this can go through a BLA. ITEM: Density PRRD 601031007 David Goldsmith. Bonus Density. The parcel went through a comp plan amendment for rezone to 1:10. He wants to know if he can get three parcels with a density exemption for PRRD. When he does the calculation,he comes up with 2.5. Stream, Geohazard. Decision: 18.15.505(3)(a) a) The dimensions and area of each proposed lot,tract or parcel (including any reserve tract(s))to accurately show that the property proposed for the PRRD contains sufficient area to allow the number of lots,tracts or parcels proposed without exceeding the average density allowed in the underlying zoning district.Where a density bonus is requested under JCC 18.15.520,the average density allowed in the underlying district may be exceeded by up to 20 percent of the allowed density for that district and an additional 20 percent for the area in the reserve tract that are designated critical areas.An additional bonus may be granted for the buffer area(s)associated with environmentally sensitive or critical areas that are included within the reserve tract,the bonus shall not exceed 20 percent of the allowed density in the buffer area;and provided further,that the area of land contained in access easements,access panhandles or pipestem configurations shall not be included in the area computations; Straight PRRD w/Bonus #1 =2.4 Further, %75 reserve tract for 20 acres= 15 acre reserve tract x 20% additional bonus (#2). Additional bonus for acreage of CA's in Reserve Tract. Rounding up can be allowed. They will need to justify significantly(to the satisfaction of the hearing examiner)that they can meet the bonus density requirements. ITEM: SPAAD MLA03-00330- Colleen Syd Morrell. In Glen Cove—commercial SPAAD. Stormwater plus SPAAD for clearing. Wondering if it's like a BSP? This SPAAD expires august 18th 2008. Are they vested to build in the entire building envelope? David Goldsmith feels that if one building permit is approved. Is SPAAD vesting for Stormwater? Decision: They can revise the SPAAD and it will need to be reviewed for parking, etcetera(reviewed by Public Works as well for stormwater and parking/transportation). SEPA analysis could be used again,but SPAAD approval is only vesting for what comes in during the time that the SPAAD is vesting(5 years). Stormwater—hasn't changed under 18.30. 55%impervious surface coverage is still the same. If they build a stormwater system that addresses all of the other structures under 2001 SMMWW,Jim may approve future buildings because they've got an existing plan. Colleen will talk to Jim and give him a heads up about the issues. Engineer would need to sign off that it was constructed per the plans. Each proposal would have to give proof that the swt is appropriate to address the structures/proposals. If they don't build for all proposed structures, Jim will have to address the SWT. ITEM: Phillips Pre-app 602264002 Previous answer to these questions was that he needed a pre-ap to address the issues. Donna will be going to Pre-ap next week. The structure is 60-75 feet long. He's using it as a bulkhead. This is located down in Brinnon. The structure is existing and the assumption is that it went in previous to SMA. He wants an exemption for repair of existing structure. The wood dock is long since gone, and remaining concrete structure is serving as bulkhead. WDFW already said for HPA would need to use gravel. Would this be normal repair or would it be for bulkhead for SFR? It's more than"normal protective bulkhead" and isn't vertical. Proposal includes removal of creosote logs,using large woody debris and habitat enhancement. "Normal repair" exemption#6 may preclude through language about the existing and previous use. This was used as a dock,but has been discontinued—eroded away years ago. Decision: Would required SEPA review for work below OHWM and isn't"minor" repair as described in RCW. Jeffree Stewart's opinion will also be extremely relevant. This is a non-conforming structure in terms of bulkhead protection. Re-building it above OHWM could be done as exemption, but work beyond OHWM isn't a conforming structure. Meets "Common replacement of existing development" if it's more than 75% gone, then it wouldn't be common replacement. Meets non-conforming standards of WAC for non-conforming structure. Should be good plan in place to restore. ITEM: Ag Lands Soils Pre-ap. Pat McCullough. There will be 18,000 soil removal for enhancement project. People with Ag land adjacent. Adjacent properties want to put up to a foot of fill in their ag lands. Decision: Clearing and grading sections in 18.30. If it qualifies as something that's allowable under 18.20.030(2)(b)(iv), then no permitting but needs to meet BMP's. May require SEPA review if over thresholds. I have also attached a copy to this e-mail. The proposal is for a Site Plan Approval Advanced Determination (SPAAD). There is no land disturbing activity proposed at this time. However, approval of their proposal would vest them to build in the foot print for 5 years. On this particular lot there is an existing residence. They could either remove the existing house or do additions to the existing house as long as they remain in the building envelope.
