In discussions, JeffCom911 was not able to demonstrate clear ownership and rights to the tower(a prerequisite to sublicensing to AT&T), due to conveyance issues with Jefferson County. Unable to resolve the ownership issues and sublicensing rights,AT&T embarked on other solutions,including submission of a proposal to Jefferson County to build a new tower structure. The Coyle Road Tower ownership issue has since been resolved by Jefferson County and JeffCom911.Accordingly, JeffCom911 is prepared to enter into a mutually acceptable commercial sublicense agreement with AT&T. However, since JeffCom911 and Jefferson County have now arrived at an understanding and resolution to the Coyle Road Tower,this collocation will not be necessary. Rights of AT&T to construct the proposed 200ft tower on Parcel #601101003: GCCSS had a discussion with the property owner on November 16, 2013,wherein they discussed the AT&T ground lease agreement in reference to the intent of having JeffCom911 as a subtenant. At the time, tfte property owner believed that they would arrive at an agreement. Unfortunately, last week property ownersuffered a serious medical incident and may be permanently incapacitated. On February 14, 2014,AT&T confirmed that the proposed terms of an agreement with property owner are unacceptable to AT&T,and stated in an email to GCCSS: "The most recent lease form submitted by the LL was not anywhere near acceptable by AT&T form a business perspective. Thanks.' It is possible that AT&T could arrive at an agreement with propert}h owner or his legal representative at some time in the distant future,but this does not appear likely. Additionally,th property owner may not be of sufficient capacity to withdraw his consent given of AT&T's application for this towe . Coverage Comparison (Suitable Alternative): The AT&T proposed site on Mr. McDermott's land and the existing JeffCom911 Coyle Road Tower site are 0.71 miles apart from each other with the ground elevation of the Coyle Road Tower site being slightly higher than the proposed AT&T site. The AT&T stated coverage objectives include the areas in and around Bangor Sub-Base. Attached are some coverage plots that indicate the differences with the current height of the JeffCom911 Coyle Road Tower and the proposed AT&T tower,at a height of 200ft. Additionally, JeffCom911 is open and willing to allow AT&T toj modify or add height to the JeffCom911 Coyle Road Tower site in order to meet AT&T's objectives for its operations. Considering that JeffCom911 has offered to allow AT&T to increase the height of the Coyle Road Tower to 200ft,the coverage plots below clearly demonstrate how the JeffCom911 Coyle Road Tower"as-is" displays very similar coverage to the proposed new AT&T 200ft tower. Any coverage deficiencies that may be expressed by AT&T should be demonstrated by displaying all of the adjoining AT&T sites in the area in relationship to JeffCom911 Coyle Road Tower Site or the proposed AT&T 200ft tower site. Any arguments of coverage deficiencies are only valid if another site does not fulfill the coverage area by using similar conventions for each location. 1 Redaction is for keeping the property owner's name confidential. However,specific"drive test"devices,as well as third party engineers, are available that can present a neutral conclusion to Jefferson County. AT THE VERY LEAST, AT&T SHOULD DEMONSTRATE THAT ANY PURPORTED DEFICIENCIES ARE NOT ALTERNATIVELY CORRECTABLE AT ADJACENT LOCATIONS. AT&T should expend the costs of such neutral party's analysis, as agreed to by JeffCom911, Jefferson County and AT&T, if AT&T intends to continue with the ZON13-00039 application. Northwest Tower Engineering performed a study in November of 2009 and this would need to be updated and performed again with the AT&T antenna configurations. Rights of AT&T to construct the proposed 200ft tower on Parcel#601101003: GCCSS had a discussion with the property owner on November 16,2013,wherein they discussed the AT&T ground lease agreement in reference to the intent of having JeffCom911 as a subtenant. At the time,the property owner believed that they would arrive at an agreement. Unfortunately, last week property owner suffered a serious medical incident and may be permanently incapacitated. (1)The number of wireless communication towers shall be minimized to the greatest extent feasible through colocation of wireless communications facilities and attachment of wireless communications antennas to existing alternative structures. (2) Installation of Accessory Equipment Shelters. Any provider who is authorized to colocate on an existing tower or alternative structure as provided above shall also be authorized to install any necessary accessory equipment shelter and related equipment at or near the base of the tower or alternative structure or within the structure; provided, that the equipment shelter and related equipment comply with the development standards (i.e., setbacks, height limitations, bulk, landscaping and screening, etc.) of the applicable zone as set forth in Chapter 18.30 JCC and the wireless facility design standards as set forth in JCC 18.42.090. (3) Preserving Landscaping and Buffering. To the greatest extent practicable landscaping that was required as a condition of approval of a wireless communications facility should not be removed in order to construct an accessory building or equipment for an additional colocated facility. If any such landscaping is removed, the applicant shall be required to replace it with the equivalent quantity and type of landscaping in a manner to achieve the original intent. [Ord. 6-99§ 1] 18.42.070 Colocation procedure. Colocation of antennas by providers is not always feasible for technical or business reasons. However, if all licensed providers are made aware of any pending tower or antenna permit applications, providers will be able to investigate all reasonable accommodations and maximize opportunities for colocation. This section establishes a process that will enable providers to equitably share publicly available, nonproprietary information among themselves, with interested persons and agencies, and with Jefferson County at the time the provider schedules a preapplication conference. (1) Preapplication Requirement. A preapplication conference is required for all proposed new towers. (2) Request Letter Requirement. At the time a preapplication conference is scheduled, the applicant shall demonstrate that the following notice was mailed to all other wireless providers licensed to provide service within Jefferson County: Pursuant to the requirements of the Jefferson County Wireless Telecommunications Facilities Ordinance,Chapter 18.42, JCC, (wireless provider legal name here) is hereby providing you with notice of our intent to meet with the Jefferson County Department of Community Development for a preapplication conference to discuss our proposal to construct a wireless communications facility tower at(general location and section, township and range).We propose to construct a feet high tower for the purpose of providing (cellular, PCS, etc.) service. Please inform us whether you have any existing or pending wireless facilities located within (distance in feet)of the proposed facility, that may be available for colocation opportunities. If you are not the person that can address these issues, please advise as to the correct person or department for me to contact. What other properties were considered for this tower? I know of 3 property owners on Blueberry Hill that were approached for this tower. Did AT & T look ANYWHERE ELSE besides Blueberry Hill? What is so attractive about the Blueberry Hill area to the planning department and AT & T? Is it because the infrastructure is already in place (electricity and road)making it less expensive for AT & T? There is an entire peninsula most of which is uninhabited where there would be little to no impact from a 200+ foot cell tower yet 3 properties on Blueberry Hill were being targeted for this tower and the proposed site is less that 500 feet from our homes. One Blueberry Hill property owner declined, one was being considered for an 80' tower but got passed over a 3 C r6:1' cs, • • because as the owner of the property stated "AT & T found a property that they could put up a TALLER tower" Could you please explain to me why 9395 Coyle road is being considered for a 200+ foot tower but 194 Blueberry Hill(owners Ray and Carol Ortmann) were only being considered for an 80 foot tower? Is the taller tower being considered because the McDermott's own both the Blueberry Hill lot and the large acreage adjacent to it? If that is the case, I am requesting that the planning department advise AT & T to take advantage of the large acreage made available to them by the McDermotts and move the cell tower to a less intrusive site further away from the residents of Blueberry Hill. One of my many concerns is the VISUAL IMPACT a 200+ foot tower will have on the residential community of Blueberry Hill. There is no way, regardless of the totally misleading pictures provided in the permit process, that 60 to 80 foot trees can negate the negative visual effect of a 200+ foot tower looming over them. I am requesting that the planning department require AT & T to do a BALLOON FLIGHT at the proposed site to determine that actual visual impact a 200+ foot cell tower would have on the community of Blueberry Hill. In addition, please require AT & T to give proper notification of the time and date of this balloon flight to the parties of record.
