Enclosed is a copy of the record drawing from the septic file SEP03-101. Contact the licensed designer, Bernt Ericsen to consult on the location of the septic system and alternative to allow for approval. Resubmit revisions for further review. It does not look like to me-anyone is telling Mr.Jackman-that this cannot be done-however I am not aware of all the details Susan discussed with Mr.Jackman- This permit is still in a pending status- if Mr.Jackman truly wishes to cancel the permit-please let me know- I hope the above information is helpful, if I can do anything else-please let me know. As I indicated earlier, I did my best to navigate your permit process and was met time and time again with extremely slow responses and misinformation. The permit was ultimately denied because the location of the septic system is different than that in the approved design. I was never notified of this change, and nobody ever advised me that that is something that I should look into prior to paying for the permit. I had the drawings that were included with the septic permit approval and had no reason to think that the location would have been changed. I was wary of writing the check given my experiences with the department on this project up to that point. I asked what would happen to the money if the permit was denied. I was specifically told that there is no way it would be denied and to go hire an engineer and not worry about it. Based on that, I spent almost$1000 that day. Also, had the responses been timely earlier in the process, an engineer would have never been necessary, and I would only be out$571. I would again like to request a refund of the permit fee. I would also like to request documentation of DCD time spent on the review for this project. The proposed structure was to include no plumbing and no electricity. It was to be a very simple structure. Even if the reviewers spent many hours on this (which does not seem necessary), no inspections were required as the permit was denied. It is my understanding that the fee I paid would have included those inspections. At least that was the case with the only other structure that I've ever built(my house that the pole barn was supposed to be placed next to). I strongly feel that the poor customer service I received from your department should be factored into your further consideration of my refund request. I live in Vancouver. I would like to relay to you my experience in attempting to obtain a building permit for a small pole building at that address. It started approximately one year ago. In February 2014, I stopped into the building department to ask what I needed to do to construct a pole building. I was given a handout for"Non-Engineered Pole Buildings". I reviewed the document and the various forms on your website and had a few questions, so I decided to call the DCD office. I made multiple calls over several days and someone finally got back to me. At that time I was told that if I wanted the county to answer any specific questions, I would need to submit a CAM form along with a check for$76. I completed the form and mailed the check on March 11, 2014. I heard nothing for several weeks. I again attempted to make contact and when I finally did, I was told that the CAM was never received (I know that this is not the case, as I have a record that the check was cashed by DCD). I was then advised to resubmit the CAM form along with a copy of the cancelled check. Again, I heard nothing for several weeks, so I started calling again. I finally made contact and spoke to David Johnson who then referred me to Frank B. We had a 5 minute conversation in which I was told that there are no issues, that I should move ahead, that I never should have submitted the CAM form in the first place, and that I would receive a refund. I never did receive a refund, despite inquiring about it several times since. I then completed the building permit application, the site plan, etc. on April 15. I had my neighbor hand deliver these documents to the DCD office as it very difficult for me to get to Port Townsend during the work week. Again, I heard nothing for several weeks, so I started calling again. At this point I made contact with Mary Blain and I asked her if she could look at the submittal and tell me if anything was missing. She said she couldn't find what was dropped off and suggested I email the documents for her review. She looked at what I sent and requested additional information and some changes to the plans. I made the requested changes right away and sent them back the same day. This was in July. Again, no response, so after a few calls, I emailed Mary again in September, with no response (I later learned that she was on maternity leave). Out of desperation, I hired a pole building contractor from Sequim to go to the DCD office and see what he could find out (it's now late October). The contractor was told that the plans need an engineers stamp and that the county does not have any provisions for prescriptive(non-engineered) pole buildings. Next(early November), I contacted Frank Benskin to try to clear up the engineering issue. Mr. Benskin was also unaware of any"non-engineered pole building" handout, but told me that Mary Blain was back and that I should talk to her. Mary also indicated that engineering would be required. I then sent her a copy of the handout(a copy of which she had already sent to me earlier in the process) and she agreed that it is applicable and that no engineering is necessary. She also said the revised plans look fine and that I should proceed. Based on my experience to that point, I decided I should wait until I could go to the office in person to finalize everything. I came in with multiple copies and sat down with Sally and Mary in December. I was then told that the county had revised the"non-engineered pole building" rules just a couple of weeks before, so now I'm back to needing an engineer. This was very unwelcome news as I had been trying to get approval for the better part of a year. They explained that since I hadn't yet paid the fee, the project is subject to the new requirements. I asked if they were sure that everything was in order except for the engineering. I wanted to know before I spent the money. I was assured that if I paid the permit fee and hired an engineer, all would be well and I would finally have my permit. I left the office and went directly to see an engineer. He did his work and submitted it to the county, in person, on my behalf. I didn't hear anything for a while, so I started leaving messages again. No response, but I did receive a letter from the Health Department. The site plan I submitted was based upon the septic design approved by the county. The letter sent to me the other day includes an "as built" site plan that is different than the design. This is the first time that I have ever seen this site plan. On the as-built, there is not enough room for the proposed pole building. As suggested in the Health Department letter, I contacted the septic installer. The installer told me that sometimes the as-built varies from the design and that there is nothing that can be done about it. So, in addition to spending a year trying to get this figured out, I have spent$76 on an apparently unnecessary CAM review(that was supposed to be refunded), $340 on engineering that I shouldn't have needed, and $571 on a permit that will never be issued. I have received incredibly poor customer service and conflicting information throughout the entire process. I realize that there is nothing that can be done about the money wasted on engineering, but I am requesting a refund of the $76 CAM fee and the $571 permit fee that I paid to DCD. I don't know if your department typically refunds any fees, but given my experience over the past year, it is more than appropriate in this case. To minimize the potential to damage habitat, all property owners developing adjacent to marine shoreline, freshwater shoreline, or floodplains are advised to do the following: All development activities should avoid unstable slopes, wetlands, and forested areas near surface waters Remove minimal vegetation for site development, especially large trees Allow trees that have fallen into surface waters to remain there Infiltrate stormwater from buildings and driveways onsite through drywells rather than discharging directly into surface waters or roadside ditches The Federal Bald and Golden Eagle Protection Act requires landowners within 660 feet(118th of a mile) of an eagle nest to consult with the US Fish and Wildlife Service. This Eagle Act prohibits anyone from "taking" bald eagles. This federal law defines the term "take"and describes the possible legal consequences when a"take"occurs_ Among other actions, "take" includes a disturbance of bald eagles or their habitat. Under federal law a permit may still be required for activities that impact bald eagles or their habitat. Contact the US Fish and Wildlife Service (http://www.fws.gov/pacific/eagle/)to learn more about how this law affects your project. The drywell that I had installed for the house contains 10 cubic yards of drain rock. According to the manual you sent, I would need no more than 90 cubic feet of drain rock per 1000 square-feet of roof. I have 2100 square-feet of roof, so I should need 189 cubic feet of drain rock. The drywell contains 10 yards (270 cubic feet). Sally, our permit technician, has indicated to me that you prefer to be contacted by email. I am contacting you because I need some additional information regarding stormwater management.All new development must address stormwater management based off of the 2012 Ecology Stormwater Management Manual for Western Washington.All stormwater needs to be managed on the property unless there is an agreement to divert it off of the property. It appears that for the proposed pole building downspouts and splashblocks have been proposed. Downspouts and splashblocks require a 50 foot vegetated flowpath based off the stormwater manual. With the slope of the property the stormwater will run northwest, however,there is not a 50 foot vegetated flow path from the proposed pole building to the property.This will need to be addressed before I can complete my review for this permit.As it does not appear that with the location of the proposed pole building, that there will be room for a 50 foot vegetated flow path, one option I see is to revise the stormwater management and use a drywell. Drywells have a 10 foot setback from structures and property lines. From the site plan it appears that you would have room to place a drywell to the east of the proposed pole building to meet these setbacks and to be outside of the 30' down-slope protection area. I see that Fred Esson is a representative, I only have a phone number for him so I could not copy him on this email. I noticed that you designed the site plan so I thought I would contact you first and if you would like Fred to work with the stormwater I will contact him. LIGHTING: Lighting fixtures shall be designed and hooded to prevent the light source from being directly visible from outside the boundaries of the property. The intensity or brightness of all lighting, during construction and after project completion shall not adversely affect the use of surrounding properties or adjoining rights-of-way. Exterior lighting for residential uses shall not exceed twenty feet (20') in height from the finished grade, excepting when such lighting is an integral part of a building or structure. Ground level lighting is encouraged. 2. BUILDING HEIGHT: The building height is not to exceed 35 feet. 3. OUTDOOR STORAGE: Outdoor residential storage shall be maintained in an orderly manner and shall create no fire, safety, health or sanitary hazard. 4. UNLICENSED VEHICLES: Not more than 2 unlicensed vehicles shall be stored on any lot unless totally screened from view of neighboring dwellings and rights-of-way. Drywell bottoms must be a minimum of 1 foot above seasonal high ground water level or impermeable soil layers. 2. When located in course sands and cobbles, drywells must contain a volume of gravel equal to or greater than 60 cubic feet per 1000 square feet of impervious surface served. When located in medium sands, drywells must contain at least 90 cubic feet of gravel per 1,000 square feet of impervious surface served. 3. Drywells must be at least 48 inches in diameter(minimum)and deep enough to contain the gravel amounts specified above for the soil type and impervious surface served. 4. Filter fabric (geotextile)must be placed on top of the drain rock and on trench or drywell sides prior to backfilling. 5. Spacing between drywells must be a minimum of 10 feet. 6. Downspout infiltration drywells must not be built on slopes greater than 25% (4:1).
