The application was reviewed by the Jefferson County Department of Community Development staff on May 20, 2003 for the potential presence of Environmentally Sensitive Areas (ESAs) under the provisions of the Unified Development Code (UDC). After an initial Geographic Information Systems mapping review and an investigative site inspection, the following ESAs were confirmed to be present on the subject property: Susceptible Aquifer Recharge Area; Flood Zone A; Seismic Hazard; Osprey Nest; and Type 1 Marine Waters. 2.) Susceptible Aquifer Recharge Areas are those with geologic and hydrologic conditions that promote rapid infiltration of recharge waters to groundwater aquifers. 3.) Aquifer Recharge Areas in Jefferson County are characterized by porous geological formations that allow percolation of the surface water into the soils and the underlying zone of saturation. Aquifers are geologic formations that contain sufficient saturated permeable material to yield significant quantities of water to wells and springs. Aquifers serve as the source of drinking water within most of the rural portions of Jefferson County. 4.) A Final Environmental Impact Statement was issued by Jefferson County in March 1993 for the Ludlow Bay Village Development(formerly known as THE INN AT PORT LUDLOW)A mitigation measure in the FEIS requires "The lowest floor of all buildings would be elevated one foot above the base flood elevation. Further requirements for materials and methodsof construction from the County's Flood Plain Management Ordinance would also be followed." 5.) A Final Environmental Impact Statement was issued by JeffersonCounty in March 1993 for the Ludow Bay Village Development(FORMERLY KNOWN AS THE INN AT PORT LUDLOW). A mitigation in the FEIS states "Proposed structures would be designed, engineered and constructed in conformance with local building codes and current safey standards for landslide and seismic hazard protection. Further structural support or ground modification would be employed if the final geotechnical assessment identifies signifcant landslide and/or seismic hazard." 6.) A Final Environmental Impact Statement was issued by Jefferson County in March 1993 for the Ludlow Bay Village Development (formerly known as THE INN AT PORT LUDLOW). A mitigation in the FEIS states "Drainage lines would be installed behind retaining/basement walls and around building footings to prevent buildup of hydrostatic pressures and to intercept grounwater." 7.) A Final Environmental Impact Statement was issued by Jefferson County in March 1993 for the Port Ludlow Bay Village development(foremerly known as THE INN AT PORT LUDLOW). A mitigation measure in the final EIS states, "Interpretative signs would be installed to describe important habitat features and wildlife characteristics on the site. Pamplets and brochures would be distributed to residents and guests to increase awareness and respect for wildlife." 8.) This approval is for a 2-unit townhouse only. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits. 9.) The site plan as submitted with the building permit application on May 1, 2003 has been reviewed for consistency under the UDC, and has been approved by Jefferson County Department of Community Development. Any modifications, changes, and/or additions to the stamped, approved site plan dated May 1, 2003 shall be resubmitted for review and approval by Jefferson County Department of Community Development. 10.) The parcels in Ludlow Bay Village were created June 6, 1994 thourgh the long subdivision process and recorded under AFN 372517. 11.) Access is provided fromn Heron Road, a private road (P405). 12.) The applicant is proposing to create or add 3883 square feet of impervious surface and 2718 square feet of land disturbing activities. The Plat was reviewed for maximum stormwater buildout in 1994. 13.) The building height shall not exceed 35 feet. 14.) Minimum setback from Heron Road right-of-way line shall be 20 feet. Utility providers conducting Type A activities within County Rights-of-Way shall obtain an annual utility permit. Upon obtaining an annual utility permit,all utility providers shall provide written notification before starting any Type A activities and must provide written certification within ten (10) calendar days that the work was done in conformance with this Chapter. Type B Activities shall include individual service connections with more than 200 feet of trenching, all roadway crossings, installing underground vaults, constructing splice pits,attaching to any bridge structure, installing main lines, and all other utility activities within County Rights-of-Way. Utility providers conducting Type B activities within County Rights-of-Way shall obtain an individual utility permit for each Type B activity. Exempted Activities. Utility providers conducting the following exempted activities within County Rights-of-Way shall not be required to obtain a utility permit: stringing cables on utility poles and associated maintenance thereof, accessing and maintenance of existing manholes, handholes, pedestals, dosures and vaults,and replacing above-ground meters,transformers, dosures, and pedestals, and performing emergency work.
