The easement states in part: The purpose of the well-site and pipeline easement agreements heretofore made by Choate/Pleasant Tides and Barbare (which agreements are ratified and confirmed herein) are for the purpose of providing a supply of potable water to the development of Pleasant Tides (known as"Pleasant Tides"), adjoining properties of Barbare, and likewise for the purpose of providing such water supply for the contemplated joint future development of the Barbare adjoining properties. The intent of the easement is simply and clearly stated, making broad provision for PT to address system improvements within the defined Sanitary Control Area surrounding our wells which are necessary to continue to provide water to our defined Service Area. It does not include any restrictive covenants. By not attaching or referencing restrictions it allows PT to provide the necessary equipment to furnish water to the areas described in the easement. The only restrictions are those required by the Washington Department of Health as outlined in PT Water System Plan and as required by Washington State Municipal Water Law. The purpose of the stand-by generator is to provide an uninterrupted and adequate supply of water to our full Service Area. Washington State DOH has determined that as the PT water system is functioning now we are only allowed to supply 99 full residential property connections. There are 134 lots in our Service Area. The additional of an uninterrupted power source will allow the system to provide full single family residential service to all lots entitled to water service, as we are legally required to provide. The Restrictive Covenants are also a part of the Municipal Water Law. The 100 ft radius around each well is a Sanitary Control Area (SCA)with strict regulations on what is allowed in these areas. The propane fueled generator is one of the things the DOH will allow within a defined SCA, and DOH has approved this addition in our case. The fencing is also required surrounding the wells and propane storage tank area is also required by DOH. Craig A Peck&Associates sent a plan showing what is being planned for the area in the SCA around the wells. This plan will need to be approved by the DOH and will provide details regarding how PH will comply with well protection measures. Your project plan submitted to DOH will answer the questions you posed in your email, regarding access and landscape screening. We do not see anything in the easement agreement indicating a need to rewrite the easement language, add additional covenants other than those required by law, or alter the PT liability insurance coverage. If there are other legal or regulatory provisions that form the basis of your request, please provide PT that information so that we may consider our options. It would be in the best interest of all to expedite signing and returning the PT Jefferson County Master Permit Application. While Pleasant Harbor reserves judgment on your analysis at this time, we will agree for the purposes of discussion only that the easement language is fairly broad in scope. However,I am not convinced that there is anything in the easements that actually require the Owner/Pleasant Harbor to sign additional documents. However,you can submit your request as a Project and I will review and discuss it with you.
