The Lot Certification statement of intent legal descriptions shall be recorded with Jefferson County Auditor's office. FINDINGS: 1.) The Administrator finds that this application complies with applicable provisions of the Unified Development Code, all other applicable ordinances and regulations, and is consistent with the Jefferson County Comprehensive Plan and Land Use map. 2.) As the Parcels are found exempt from RCW 58.17 and Jefferson County Code 18.35, a title report is not required. It is the property owner's responsibility to identify and rectify any security interest conveyances, encumbrances, easements or restrictions affecting the subject properties involved in this county reviewed exemption. 3.) This determination does not guarantee an ability to develop the parcels. All development shall comply with the on-site sewage code, the building codes and local development regulations in effect at the time of application. 4.) A copy of the recorded Statement of Intent and a copy of this permit will be forwarded to the Assessor's Office. The Assessor's office will assign the new parcel number(s). Please contact the Jefferson County Assessor's Office (360-385-9105)for the new parcel number(s). 5.) Based on the findings, parcel number 901154005 can be considered two (2) separate parcel as described in the legal descriptions submitted with the application. This Parcel is segregated by Van Trojan Road. 6.) The parcel has been designated as RR 1:5 Rural Residential under the Jefferson County Comprehensive Land use Map effective August 28, 1998. 7.) On February 7, 2014, Sherrie Shold in the Assessor's Office commented as follows: I have no objections on moving forward with this road division request. 8.) On January 21, 2014, Pat Perryman in the Assessor's GIS department commented as follows: My only comment on this one is that in September 2004, Mr. Smith did a Boundary Line Adjustment. The legal description for the property defined in this legal description was bound together as one parcel per the Boundary Line Adjustment-AFN 489081. 9.) On 12-17-13 Jefferson County Public Works office commented as follows: This section of Van Trojen Road was established in by Order of Establishment on July 7th of 1914 as the "Van Trojan Cut-Off Rd". This portion was deeded by John Nesbit Sr. of Chimacum, WA. on July 7th 1914 by Quit Claim Deed recorded in Volume 53 of Deeds Page 205, AFN38334. The road is also shown on the 1915 Road Log Map. The right of way width is 30 feet. The County Road Log indicates that this road is 2.27 miles long. 10.) RCW 58.17 requires regulation of the division of land and was passed in 1969. 11.) Jefferson County determined that this proposal is categorically exempt from review under the State Environmental Policy Act(SEPA) pursuant to WAC 197-11-800(6)(a). 12.) A BLA was approved for the parcel in 2004. It was determined on November 6, 2013 a road segregation could be approved because the boundary line adjustment was not over the ROW. 13.) NOTICE: This permit does not excuse the proponent from complying with other local, state, and federal ordinances, regulations, or statutes applicable to the proposed development, but consistent with RCW 90.58. Development pursuant to this permit shall be undertaken subject to the applicable policies and performance standards of the Jefferson County Shoreline Management Master Program and the Jefferson County Unified Development Code. If during excavation or development of the site an area of potential archaeological significance is uncovered, all activity in the immediate area shall be halted, and the Administrator shall be notified at once. The Federal Endangered Species Act rules to protect threatened Chinook and Summer-run Chum salmon became effective on January 8, 2001. Bull trout have been listed as threatened since early 2000. Under the ESA, any person may bring lawsuit against any individual or agency that"takes" listed species (defined as causing harm, harassing, or damaging habitat for the listed species). In addition, the National Marine Fisheries Service can levy penalties. All areas in Jefferson County are included as"critical habitat"for a listed species. Development of property along any marine shoreline, freshwater shoreline, or floodplains could harm habitat if protective measures are not taken. To minimize the potential to damage habitat, all property owners developing adjacent to marine shoreline, freshwater shoreline, or floodplains are advised to do the following: -All development activities should avoid unstable slopes, wetlands, and forested areas near surface waters - Remove minimal vegetation for site development, especially large trees -Allow trees that have fallen into surface waters to remain there - Infiltrate stormwater from buildings and driveways onsite through drywells rather than discharging directly into surface waters or roadside ditches The Federal Bald and Golden Eagle Protection Act requires landowners within 660 feet (1/8th of a mile) of an eagle nest to consult with the US Fish and Wildlife Service. This Eagle Act prohibits anyone from "taking" bald eagles. This federal law defines the term "take" and describes the possible legal consequences when a"take" occurs. Among other actions, "take" includes a disturbance of bald eagles or their habitat. Under federal law a permit may still be required for activities that impact bald eagles or their habitat. Contact the US Fish and Wildlife Service (http://www.fws.gov/pacific/eagle/)to learn more about how this law affects your project. Any individual, group, or agency can bring suit for a listed species"taking", even if you are in compliance with Jefferson County development codes. The risk of a lawsuit against you can be reduced by consulting with a professional fisheries habitat biologist, and following the recommendations for site development provided by the biologist. For more information, contact the National Marine Fisheries Service in Seattle, or the U.S. Fish and Wildlife Service. Under the 3`d Edition Subdivision Ordinance (Ordinance No. 04-0525-92), Section 3.30 "Applicability" specifically number(2) states"Parcels in common ownership separated by a public right-of-way should not be considered a single parcel." This above applicability section has two parts: First, the applicability section addressed those properties existing at the time of the subdivision act came into existence. RCW 58.17 requires regulation of the division of land. Upon its passage in 1968,all future land subdivision would be regulated. There existed numerous properties in the county that were functionally split by a public road. Road rights-of-way were common physical boundaries from which land descriptions were, for all intensive purposes, already subdivided and a requirement for a formal process would serve no public purpose. Particularly since the requirement for a formal subdivision occurred not be action of the property owner,but rather by application of the law. Those properties that are too small to meet minimum building standards could not be built upon, and would probably be combined with adjoining properties. Those large enough to serve as a building site could be developed. The applicability section was a practical means to deal with this class of properties without unduly burdening the property owner or thwarting the public interest in land subdivision. Second, there are circumstances where public entities are acquiring new rights-of-way for road purposes and these purchases pass through an existing parcel of property thereby severing the property into two pieces. The severed property may or may not become a building site depending on size, characteristics, topography, etc. The intent of the applicability section here is similar to that in the first instance. That is to say, the property is functionally subdivided by the public rights-of-way as the result of actions other than those of the property owner. This exemption shall not be construed to include acquisitions of easements." This section of the JCC is similar in the "applicability" section of the 3`d Edition Subdivision Ordinance as identified in the first and second parts. The key to JCC Section 18.35.040(4) is as mentioned above in both cases the result of the functional subdivision is the result of actions other than the property owner. If a property owner subdivided his/her property over a public road right-of-way the separation provisions do not apply. If the state or county decides to install a public right-of-way through a parcel of land, then it could be considered two separate parcels. The property may qualify for segregation if all of the following are met: 1. The road is a public right-of-way(county or state) and not a private easement or private road. 2. Parcel was in existence prior to 1968. 3. Road was installed through a parcel by the county or state after 1968. Here are a few examples of when the road segregation does not apply: 1. The road is private or is just an ingress/egress easement. 2. The parcel was platted or BLA'd over a public right-of-way after 1968. 3. Comp Plan NRP 3.3 states"Parcels designated as Forest Land in common ownership separated by a public right-of-way shall be considered as a single parcel." LASMP would not allow stairs to the beach as it is identified as a feeder bluff. A dirt path may be allowed depending upon the proposal. If the proposal has no structural components or no vegetation removal it may meet the criteria in the LASMP, page 6.5 #10. The path could be a shoreline exemption if meeting exemption #1 with a geo tech and LASMP page 6.5 #10. Any land disturbing activity may compromise the stability of the shoreline. The anticipated adoption of the LASMP is in December. Item: The proposal is for a home business for a catering business. To meet EH food service requirements and be considered a home business permit it would have to have a separate outside entrance from the SFR. If business is located within the same structure as the SFR would it meet the criteria in JCC 18.20.200(3)(c)? This approval is for a road approach permit only. Among native tree species which may be used includes: Vine Maple (Acer Circinatum), Big-Leaf Maple(Acer Macrophyllum), Red Alder(Alnus Rubra), Pacific Madrone(Arbutus Menziesii), Quaking Aspen(Populus Tremula), Black Cottonwood (Populus Trichocarpa), Bitter Cherry(Prunus Emarginata), Oregon White Oak(Quercus Garryana), Cascara (Rhamnus Purshiana), Pacific Willow(Saliz Lasiandra), and Scouler's Willow(Saliz Scouleriana). Among the native shrub species which may be used are: Sevice-Berry(AmalanchierAlnifolia), Red Osier Dogwood (Cornus Stolonifera)Salal (Gaultheria Shallon), Ocean Spray(Holodiscus Discolor), Indian Plum (Oemlaria Cerasiformis), Pacific Ninebark (Physocarpus Capitus), Red Flowering Currant(Ribes Sanguineum), Wild Rose (Rosa Nutkana), Swamp Rose(Rosa Pisocarpa), Willows (Salix ssp.), Red Elderberry(Sambucus Racemosa), Snowberry(Symphoricarpos Albus), Evergreen Huckleberry(Vaccinium Ovatum), Red Huckleberry(Vaccinium Parvifolium). 7.) Landslide Hazard Areas and their associated buffers shall remain naturally vegetated. Should buffer disturbance occur during construction, the Unified Development Code(UDC)Administrator shall require replanting with native vegetation. No alterations shall be made to the Landslide Hazard Area or its associated buffer without prior authorization by the UDC Administrator. 8.) Prior to and during approved construction activities, the perimeter of the landslide hazard area buffer shall be marked with a temporary sign. The sign shall be placed in such a manner that it can be directly observed from the construction area. The sign shall contain the following statement: "Landslide Hazard Area and Buffer- Do not Remove or Alter Existing Vegetation." 9.) The applicant shall permanently separate the boundary of the Landslide Hazard Area Buffer from the remainder of the subject property through installing logs, trees, a hedge row, or any other prominent physical marking approved by the UDC Administrator. 10.) Critical Aquifer Recharge Areas may require special protection measures to mitigate water quality degradation. The submitted proposal does not require additional aquifer protection measures. However, during construction the project shall follow the Best Management Practices (BMPs)and facility design standards as identified and defined in the Stormwater Management Manual for the Puget Sound Basin. 11.) Jefferson County determined that this proposal is categorically exempt from review under the State Environmental Policy Act(SEPA) pursuant to WAC 197-11-800(2)(j). 12.) This approval is for a BOUNDARY LINE ADJUSTMENT only. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits. 13.) APN 901 154 004 has been designated as Rural Residential 1:10 and APN 901 154 005 has been designated as Rural Residential 1:20 under the Jefferson County Comprehensive Plan Land Use Map effective August 28, 1998. 14.) A septic permit(SEP72-00075)was finaled on December 5, 2001 for a 5-bedroom system. 15.) APN 901 154 005 described within this Boundary Line Adjustment has not been evaluated for its suitability to support an on-site sewage system, no soils were evaluated on the lots. Sewage disposal systems has not been approved for this parcel contained within the BLA. On-site sewage disposal system(s)shall meet design standards and regulatory requirements in effect at the time of application for a sewage disposal permit. 16.) The proposal complies with UDC Section 7.2.1.a(4) in that the proposal is to correct situations wherein an established use is located across a lot line. 17.) Prior to any land disturbing activity or construction activity, applicant/owner shall contact the Jefferson County Department of Community Development regarding compliance for such ESA's. Approval of this Boundary Line Adjustment does not guarantee issuance of a building permit within said parcel(s). Such determination is dependent on approvals of water, septic, bulk and dimensional setbacks, and ESA requirements. 23.) Consistent with UDC Section 7.2.3.c, the applicant/surveyor is responsible for recording the Statement of Intent with the Jefferson County Auditor and referencing said statement of Intent AFN on the face of the survey. (An Excise Tax Affidavit will need to be completed for the Statement of Intent. An Excise Tax Affidavit is also required for every document that will be recorded such as Quit Claim Deeds or Statutory Warranty Deeds.)
