Marlow Chairman Dave Garing Vice - Chairman Richard A. Broders Member Chairman William S. Marlow called the meeting to order at 9:30 a.m, in the presence of Vice- Chairman Dave Gating. Member Richard A. Broders was absent. APPROVAL OF MINUTES Vice - Chairman Gating moved to approve the minutes of October 20, 2009 as presented. Chairman Marlow seconded the motion. The motion carried. REQUEST TO RECONVENE Two (2) "Requests to Reconvene" were received by the Board of Equalization for the 2009 season. They were submitted on the basis that the taxpayers have met the specific requirement outlined in WAC 458 -14 -127 RECONVENED BOARDS - AUTHORITY (1)(c) which states that Boards of Equalization may reconvene on their own authority to hear requests or appeals concerning the current assessment year when the request or appeal is filed with the Board by April 30 of the tax year immediately following the Board's regularly convened session and when a bona fide purchaser or contract buyer of record has acquired an interest in real property subsequent to the first day of July and on or before December 31 of the assessment year and the sale price was less than ninety percent of the assessed value. The Clerk of the Board confirmed with the Assessor's office that both appellants have met this requirement. The motion carried. HEARINGS Olson Trust BOE: 09 -107 -R PN: 821 163 008 John & Patricia Olson 74 Bayside Court Port Ludlow, WA 98365 John and Patricia Olson were present. Appraiser Dennis Pownall represented the Assessor's office. After explaining the hearing process Chairman Marlow swore in both parties. Under appeal is the land and improvement value of property located at 74 Bayside Court, Port Ludlow. Currently, the property is assessed at $1,621,700 ($894,250 for the land and $727,450 for the improvements). The appellants estimate the value is $1,150,000 ($634,000 for the land and $516,000 for the improvements). Mr. Olson informed the Board that he and his wife purchased their property in November 2009 for $1,150,000. The home was built in 1998 and is not located in the Port Ludlow Master Planned Resort (MPR). He believes the correct value should be the purchase price. He reviewed the packet of information he received from the Assessor's office and feels that the information is outdated and that the market has declined about 20% since the information was compiled. In conclusion, Mr. Olson restated that the assessment of $1,621,700 is too high based on an open market transaction that occurred in 2009. The correct value should be the purchase price of $1,150,000. Appraiser Pownall explained that the assessment date for the appellants' property is January 1, 2007. The appellant's property is not located in the MPR, however, Appraiser Pownall provided maps of the MPR to show the amount of research used to determine values in Port Ludlow prior to 2007. The Port Ludlow area was revalued at the peak of the market and all the data indicates that the assessed value is correct as of January 1, 2007. Mr. Olson asked that the Board consider all the evidence using the 2009 sale and reduce their assessed value. Chairman Marlow explained that Jefferson County uses a four year revaluation cycle. Port Ludlow properties residents are locked into values that were determined as of January 1, 2007. Board of Equalization Minutes - March 16, 2010 Page: 3 The Port Ludlow area will be reassessed in 2011 for taxes payable in 2012. Vice - Chairman Garing informed the appellants that new legislation recently passed that requires all Washington State Counties to convert to a one year revaluation cycle by 2014. He added that the Assessor's worksheet shows an additional $10,000 site improvement value and asked if there was an additional building on the property? Appraiser Pownall replied that he will review the assessment and report back to the Board. Hearing no further testimony, Chairman Marlow closed the hearing. The Board will make a determination at a later date. Vice - Chairman Gating moved to adjourn the meeting. Chairman Marlow seconded the motion. The motion carried.
