CONDITIONS: 1.) As the Parcels are found exempt from RCW 58.17 and Jefferson County Code 18.35, a title report is not required. It is the property owner's responsibility to identify and rectify any security interest, conveyances, encumbrances, easements or restrictions affecting the subject properties involved in this county reviewed exemption. 2.) Parcel numbers are assigned upon recording of Statement of Intent. 3.) The Lot Certification statement of intent legal descriptions shall be recorded with Jefferson County Auditor's office. 4.) To process this segregation, you will need to submit a written request and a copy of the recorded legal descriptions to the Jefferson County Assessor's Office to have additional parcel numbers assigned. A copy of this permit will be forwarded to the Assessor's Office. Please contact the Jefferson County Assessor's Office (360-385-9105)with any questions regarding this process. 5.) The six year moratoriums on non-forestry permits currently in place on this parcel shall remain on both parcels until the moratoriums expire. FINDINGS: 1.) The Administrator finds that this application complies with applicable provisions of the Unified Development Code, all other applicable ordinances and regulations, and is consistent with the Jefferson County Comprehensive Plan and Land Use map. 2.) The application was reviewed by the Jefferson County Department of Community Development staff on December 18, 2014 for the potential presence of Environmentally Sensitive Areas (ESAs) under the provisions of the Unified Development Code(UDC). After an initial Geographic Information Systems mapping review and an investigative site inspection, the following ESAs were confirmed to be present on the subject property: fish and wildlife conservation area, "F"fish and "N" non-fish bearing streams, wetlands, and susceptible aquifer recharge area. 3.) This determination does not guarantee an ability to develop the parcels. All development shall comply with the on-site sewage code, the building codes and local development regulations in effect at the time of application. 4.) Based on the findings, parcel number 613141002 can be considered two (2)separate parcel as described in the legal descriptions submitted with the application. 5.) The parcel has been designated as CF 1:80 Commericial Forest under the Jefferson County Comprehensive Land use Map effective August 28, 1998. 6.) RCW 58.17 requires regulation of the division of land and was passed in 1969. 7.) Jefferson County determined that this proposal is categorically exempt from review under the State Environmental Policy Act (SEPA) pursuant to WAC 197-11-800(6)(a). 8.) The administrator determined on January 7, 2009 &September 14, 2010 that no survey is required when following existing section lines. 9.) The proposal is found to be an exemption under Jefferson County Code(JCC) Section 18.35.040(1): (1)Divisions of land into lots, tracts or parcels each one of which is one-sixteenth of a section of land or larger, or 40 acres or larger if the land is not capable of description as a fraction of a section of land; provided, that for purposes of computing the size of a lot that borders on a street or road, the lot size shall be expanded to include that area that would be bounded by the center line of the street or road and the side lot lines of the lot running perpendicular to such center line; and provided further, that within the commercial forest district(i.e., CF-80), each lot, tract or parcel shall be at least 80 acres in size; 10.) Contact the Jefferson county Environmental Health Department at (360) 379-9444 to determine potential limitations with regard to wells and on-site sewage requirements. 11.) On December 11, 2014, Pat Perryman in the Assessor's GIS department commented as follows: "I have no objection of MLA14-00095, MLA14-00096, nor of MLA14-00097. The Parcels that result from the Lot Certification are 80 Acres(+/-) or greater. " 12.) On December 17, 2014, Sherrie Shold in the Assessor's Office commented as follows: "I found no additional comments to include with my original memo dated 9/30/2014." On September 30, 2014, Sherrie Shold in the Assessor's Office commented as follows: "described as -W1/2 NE & NW 1/4 (Less R/W)was created as described in 2004 when a portion of the original parcel was sold to Western Rivers Conservancy; so zoning will most likely dictate whether or not this may be divided." 13.) Jefferson County has determined that the use of real property for agriculture and forestry operations is a high priority and favored use in the county. The county will not consider to be a nuisance those inconveniences or discomforts arising from such operations, if such operations are consistent with commonly accepted best management practices in compliance with local, state, and federal laws. If your real property includes or is within five hundred (500)feet of real property designated as Rural Residential 1:10 or 1:20, Rural Industrial, Rural Commercial, Agriculture, or Forestry, you may be subject to inconveniences or discomforts arising from such farming and forestry operations, including but not limited to noise, tree removal, odors, flies, fumes, dust, smoke, the operation of farm and forestry machinery during any 24-hour period, the storage and disposal or manure, and the application of permitted fertilizers and permitted pesticides. One or more of these inconveniences may occur as a result of agricultural and forestry operations which are in conformance with existing laws and regulations. 14.) NOTICE: This permit does not excuse the proponent from complying with other local, state, and federal ordinances, regulations, or statutes applicable to the proposed development, but consistent with RCW 90.58. Development pursuant to this permit shall be undertaken subject to the applicable policies and performance standards of the Jefferson County Shoreline Management Master Program and the Jefferson County Unified Development Code. If during excavation or development of the site an area of potential archaeological significance is uncovered, all activity in the immediate area shall be halted, and the Administrator shall be notified at once. The Federal Endangered Species Act rules to protect threatened Chinook and Summer-run Chum salmon became effective on January 8, 2001. Bull trout have been listed as threatened since early 2000. Under the ESA, any person may bring lawsuit against any individual or agency that"takes"listed species (defined as causing harm, harassing, or damaging habitat for the listed species). In addition, the National Marine Fisheries Service can levy penalties. Portions of Jefferson County, including the marine environment, are included as "critical habitat"for a listed species. Development of property along any marine shoreline, freshwater shoreline, or floodplains could harm habitat if protective measures are not taken. To minimize the potential to damage habitat, all property owners developing adjacent to marine shoreline,freshwater shoreline, or floodplains are advised to do the following: -All development activities should avoid unstable slopes, wetlands, and forested areas near surface waters - Remove minimal vegetation for site development, especially large trees -Allow trees that have fallen into surface waters to remain there - Infiltrate stormwater from buildings and driveways onsite through drywells rather than discharging directly into surface waters or roadside ditches The Federal Bald and Golden Eagle Protection Act requires landowners within 660 feet(1/8th of a mile)of an eagle nest to consult with the US Fish and Wildlife Service. This Eagle Act prohibits anyone from "taking" bald eagles. This federal law defines the term "take"and describes the possible legal consequences when a"take" occurs. Among other actions, "take" includes a disturbance of bald eagles or their habitat. Under federal law a permit may still be required for activities that impact bald eagles or their habitat. Contact the US Fish and Wildlife Service(http://www.fws.gov/pacific/eagle/)to learn more about how this law affects your project. Any individual, group, or agency can bring suit for a listed species "taking", even if you are in compliance with Jefferson County development codes. The risk of a lawsuit against you can be reduced by consulting with a professional fisheries habitat biologist, and following the recommendations for site development provided by the biologist. For more information, contact the National Marine Fisheries Service in Seattle, or the U.S. Fish and Wildlife Service. 15.) This parcel is under a six year non-forest permit moratorium per JCC 18.20.160(5)(b): "Mandantory Six-Year Development Moratorium. For six years after the date of the application the county shall deny any and all applications for permits or approvals, including building permits and subdivision approvals, relating to or for nonforestry uses of land subject to the applicaitons (RCW 76.09.060(3)(b)(i), (ii), and (iii))." This application meets criteria for exemptions under subdivision per JCC 18.35.040(1).As this proposal is not being reviewed under the subdivision code and is a proposal to continue with foresty practices on the resulting parcels, this permit application is being considered for a foresty use. Here's more detail: • The Nature Conservancy (TNC) will continue to manage the property as working forest for the growth and harvest of timber. However,TNC will alter how the forest, much of it quite young, is managed primarily through broadening riparian buffers, eliminating logging within forested wetlands, reducing sediment and hydrological threats from roads, and extending harvest rotations. • TNC will permit the property to be used by the public for outdoor recreation activities such as hunting, fishing, bird-watching and hiking. • The property also may be used for research on forest restoration. The property will be available for research purposes to the Washington State Department of Natural Resources and the U.S. Forest Service as well as scientists associated with tribes, universities, and other scientifically-credible organizations and agencies.
