FINDINGS: 1.) The Administrator finds that this application complies with applicable provisions of the Unified Development Code, all other applicable ordinances and regulations, and is consistent with the Jefferson County Comprehensive Plan and Land Use map. 2.) The application was reviewed by the Jefferson County Department of Community Development staff on 5/21/2015 for the potential presence of Environmentally Sensitive Areas (ESAs) under the provisions of the Unified Development Code (UDC). After an initial Geographic Information Systems mapping review and an investigative site inspection, the following ESAs were confirmed to be present on the subject property: Fish and Wildlife Habitat Conservation Area; Inventoried Shoreline Stream--Priority Aquatic and Conservation Shoreline Environmental Designations; wetlands; seismic hazard; and Susceptible Aquifer Recharge Area. 3.) Aquifer Recharge Areas in Jefferson County are characterized by porous geological formations that allow percolation of the surface water into the soils and the underlying zone of saturation. Aquifers are geologic formations that contain sufficient saturated permeable material to yield significant quantities of water to wells and springs. Aquifers serve as the source of drinking water within most of the rural portions of Jefferson County. 4.) Susceptible Aquifer Recharge Areas are those with geologic and hydrologic conditions that promote rapid infiltration of recharge waters to groundwater aquifers. 5.) Geologically HazardousAreas in Jefferson County are characterized by slope, soil type, geologic material, and groundwater that may combine to create problems with slope stability, erosion, and water quality during and after construction or during natural events such as earthquakes or severe rainstorms. 6.) The applicant is not proposing to create or add impervious surface. Dredging and stabilization will be completed as maintenance activities. For this project, approximately 10 cubic yards of stream gravel will be shaped to act as a temporary diversion of flow into a bypass channel and away from the work area in the sediment basin. A maximum of 900 cubic yards of stream sand, silt and gravel will be removed from the sediment basin. The proposal shall comply with JCC 18.30.060, Grading and Excavation Standards, and JCC 18.30.070, Stormwater Management Standards, which requires the proposal to meet the "Small" Project Minimum Requirement #2 of the 2012 Ecology Stormwater Management Manual for Western Washington. 7.) The Washington Department of Fish and Wildlife issued Hydraulic Project Approval (HPA) for this activity on June 30, 2014 under Control Number 133480-1, WDFW Hatchery Maintenance. The HPA expires on June 29, 2019. 8.) The project was reviewed under the State Environmental Policy Act (SEPA) by WDFW acting as lead agency. A Determination of Non-Significance (DNS) for Routine Maintenance and Operations at Washington Department of Fish and Wildlife (WDFW) Finfish Hatcheries and Rearing Ponds was issued on September 25, 2008. 9.) The site plan as submitted with the Shoreline Exemption application on 4/29/2015 has been reviewed for consistency under the UDC, and has been approved by Jefferson County Department of Community Development. Any modifications, changes, and/or additions to the stamped, approved site plan dated 5/29/2015 shall be resubmitted for review and approval by Jefferson County Department of Community Development. 10.) This approval is for a shoreline exemption to maintain the channel conditions for fish traps only. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits. 11.) The parcel has been designated as Rural Residential 1:5 under the Jefferson County Comprehensive Land Use Map effective August 28, 1998. 12.) The Development Review Division finds that this proposal is consistent with Shoreline Master Program Sections 18.25.570 (18) exemption for fish project; 18.25.360 (3) (ix) Dredging; 18.25.370 (1) (ii) Filling and Excavation; and 18.25.400 Restoration; and is consequently exempt from the substantial development permit (SDP) requirements. Exemptions from the substantial development permit requirements do not exempt a proposed development from compliance with the applicable policies and standards of the Shoreline Master Program or other applicable Federal, State, or local permit or license requirements. 13.) The proposed project will be conducted within Snow Creek. This segment of Snow Creek is a Type S water, which is a shoreline of the state. The Shoreline environmental designations are "Priority Habitat and "Conservancy". 14.) NOTICE: This permit does not excuse the proponent from complying with other local, state, and federal ordinances, regulations, or statutes applicable to the proposed development, but consistent with RCW 90.58. Development pursuant to this permit shall be undertaken subject to the applicable policies and performance standards of the Jefferson County Shoreline Management Master Program and the Jefferson County Unified Development Code. If during excavation or development of the site an area of potential archaeological significance is uncovered, all activity in the immediate area shall be halted, and the Administrator shall be notified at once. The Federal Endangered Species Act rules to protect threatened Chinook and Summer-run Chum salmon became effective on January 8, 2001. Bull trout have been listed as threatened since early 2000. Under the ESA, any person may bring lawsuit against any individual or agency that"takes" listed species (defined as causing harm, harassing, or damaging habitat for the listed species). In addition, the National Marine Fisheries Service can levy penalties. Portions of Jefferson County, including marine environments are included as "critical habitat" for listed species. Development of property along any marine shoreline, freshwater shoreline, or floodplains could harm habitat if protective measures are not taken. To minimize the potential to damage habitat, all property owners developing adjacent to marine shoreline, freshwater shoreline, or floodplains are advised to do the following: -All development activities should avoid unstable slopes, wetlands, and forested areas near surface waters - Remove minimal vegetation for site development, especially large trees -Allow trees that have fallen into surface waters to remain there - Infiltrate stormwater from buildings and driveways onsite through drywells rather than discharging directly into surface waters or roadside ditches The Federal Bald and Golden Eagle Protection Act requires landowners within 660 feet(1/8th of a mile)of an eagle nest to consult with the US Fish and Wildlife Service. This Eagle Act prohibits anyone from"taking" bald eagles. This federal law defines the term "take"and describes the possible legal consequences when a "take" occurs. Among other actions, "take" includes a disturbance of bald eagles or their habitat. Under federal law a permit may still be required for activities that impact bald eagles or their habitat. Contact the US Fish and Wildlife Service (http://www.fws.gov/pacific/eagle/) to learn more about how this law affects your project. Any individual, group, or agency can bring suit for a listed species"taking", even if you are in compliance with Jefferson County development codes. The risk of a lawsuit against you can be reduced by consulting with a professional fisheries habitat biologist, and following the recommendations for site development provided by the biologist. For more information, contact the National Marine Fisheries Service in Seattle, or the U.S. Fish and Wildlife Service. CONDITIONS: 1.) The project shall adhere to the Best Management Practices (BMPs) to control stormwater, erosion and sediment during construction. BMPs shall address permanent measures to stabilize soil exposed during construction, and in the design and operation of stormwater and drainage control systems. 2.) In addition to Jefferson County permit conditions, the project proponent shall comply with all conditions set forth by the Washington Department of Fish and Wildlife through Hydraulic Project Approval. 3.) Work within the jurisdiction of the Shoreline Master Program other than as described above shall receive separate review from this Department. 4.) Materials removed from the vicinity of the fish trap shall be disposed of at an approved in-water disposal site, or an approved upland location that will not re-enter waters of the state. 5.) Only plant species native to the region shall be used to revegetate areas within the 150-foot stream buffer. [help] The weir was designed with the basin functioning as a holding area for out migrant salmonid and trout smolt (ESA listed steelhead, coho and cutthroat trout). During the spring outmigration the pond is seined every 1 to 2 days to move the fish into the trap where they are collected enumerated, biosampled and released. Because the basin also traps sediment and there is a great deal of erosion in the watershed upstream of the pond it fills up every few years reducing the holding area for juvenile salmonids and adult steelhead kelts. This reduced area increases the velocity of flow in the pond making it less favorable for the fish and exposing them to increased predation from birds and otter. In addition, when there is less water capacity in the pond the screens across the span have less area to pass water and the otential for flooding around the weir structure increases. P 9 6c. This Hydraulic Project Approval (HPA) authorizes the maintenance activities at specific sites listed in the attachment entitled 'DFW Planned Maintenance Activities.xls'which are necessary for the continuing operation of Washington Department of Fish and Wildlife (WDFW) owned and/or maintained finfish hatchery facilities. The following maintenance activities are authorized by this HPA: a. Routine intake and outfall maintenance (sediment removal) b. Large Woody Material (LWM) repositioning c. Organic material and debris removal d. Temporary fish trapping, rack installation, maintenance, re-installation during the trapping season. Racks may be associated with a temporary or permanent trapping structure e. lnstream adult holding and/or trapping pond maintenance f. Vegetation management. Any other hydraulic project activities, including emergencies, require a separate HPA. Emergency HPAs can be obtained by calling the local Habitat Biologist (HB) during normal business hours, or the after-hours hotline number of(360) 902-2537. 2. NOTIFICATION REQUIREMENT: Three days prior to the start of any operation, other than normal screen cleaning and removal of minor organic debris such as leaves, twigs, etc., within the ordinary high water line (OHWL) of waters of the state, the Regional Habitat Program Manager (RHPM) shall be notified (see attached list). Notification may be by mail, FAX, or e-mail and shall include the starting date, description of work, location, and the control number of this HPA. 3. TIMING LIMITATIONS: Routine maintenance authorized under this HPA may begin immediately and shall be completed by June 29, 2019, within the following limitations: a. Sediment removal (la) work shall be conducted during the time periods specified in the attachment entitled 'ALLOWABLE FRESHWATER WORK TIMES April 2014.doc' in fish bearing waters. b. Fish traps or racks shall be placed and maintained in the stream either during the time periods specified in the attachment entitled 'ALLOWABLE FRESHWATER WORK TIMES April 2014.doc'or no more than one week prior to the anticipated return or out-migration of the targeted stock and entirely removed no more than three days after completion of the trapping operation. FISH KILL/WATER QUALITY PROBLEM NOTIFICATION: If at any time, as a result of project activities, fish are observed in distress, a fish kill occurs, or water quality problems develop (including equipment leaks or spills), immediate notification shall be made to Washington Military Department Emergency Management Division at 1-800-258-5990, and to the local WDFW Habitat Biologist (http://wdfw.wa.gov/conservation/habitat/ahb/). FISH REMOVAL AND SCREENING (FOR SEDIMENT REMOVAL WORK IN THE WETTED PERIMETER) 6. When conducting sediment removal work (la), the permittee shall capture and safely move food fish, game fish, and other fish life from the job site. Invasive species captured shall not be placed back into state waters. The permittee shall have fish exclusion, fish capture, and transportation equipment ready and on the job site. Captured fish shall be immediately and safely transferred to free-flowing water upstream or downstream of the project site. 7. Any device used for diverting water from a fish-bearing stream and any pump used to bypass water from the work area within a watercourse shall be equipped with a fish guard to prevent passage of fish into the diversion device pursuant to RCW 77.57.010 and 77.57.070. The pump intake shall be screened as follows: a) Perforated Plate: 0.094 inch (maximum opening diameter). b) Profile Bar: 0.069 inch (maximum width opening). c) Woven Wire: 0.087 inch (maximum opening in the narrow direction). The minimum open area for all types of fish guards is 27%. The screened intake shall consist of a facility with enough surface area to ensure that the velocity through the screen is less than 0.4 feet per second. Screen maintenance shall be adequate to prevent injury or entrapment to juvenile fish and the screen shall remain in place whenever water is withdrawn from the stream through the pump intake. 8. Screening is not required on equipment within areas where all fish have been removed and excluded. 9. If a gravity pipe bypass is used, it shall be of sufficient size to pass all flows and debris downstream of the project site for the duration of the project. BYPASS 10. Fish removal and screening provisions are followed, b. Work is performed during the attached work windows (Attachment 1), and c. Water quality provisions are met. 11. A temporary bypass cofferdam, or similar structure is not required when any of the following instances exists, and the provisions of this HPA can still be met: a. When installing a coffer dam, bypass or similar structure would cause greater impacts to fish life than it would prevent; b. When the work area is in deep or swiftly flowing water; c. When turbidity is not a concern (i.e. the stream is dry, very slow flow); d. When fish can be excluded by nets or screens, or e. When fish are not present. 12. The bypass or berm shall be of sufficient size to pass all flows and debris for the duration of the project. 13. Back water shall not enter the work area from the bypass downstream end. If needed: A sandbag revetment or similar device shall be installed at the downstream end of the bypass to prevent backwater from entering the work area. 14. Water removed from within the work area shall be routed to an area landward of the OHWL to allow removal of fine sediment and other contaminants prior to being discharged to the waters of the state. 15. The de-watering discharge point shall be designed and operated so as not to cause erosion or scour in the stream channel, banks or vegetation. 16. Prior to releasing the water flow to the project area, all work below the OHWL shall be completed. 17. Upon completion of the project, all material used in the temporary bypass shall be removed from the site and the site returned to pre-project or improved conditions. 18. Reintroduction of water to the channel shall be done gradually and in stages so as to minimize the mobilization of sediments and fines into downstream waters. EQUIPMENT 19. Equipment used for this project shall be free of external petroleum-based products while working around state waters. 20. Equipment shall be inspected prior to use and at least once during the course of work to ensure that there are no fluid leaks. If a leak does occur, the equipment shall be immediately removed from the area and not used again until adequately repaired. Equipment shall not be left unattended within the stream channel. With the exception of bypass pumps, all machinery and equipment shall be serviced, fueled, and maintained on uplands more than 200 feet from waters of the state to prevent contamination of surface waters, when practicable. Fueling areas shall be provided with enough spill containment materials to prevent a spill from reaching waters of the state. 22. Whenever feasible, heavy equipment shall be stationed on and operate from the top of the bank, the roadway, dry gravel bar area, or a work platform (e.g. excavator pads). The drive mechanism of the equipment shall not enter or operate within the wetted perimeter, except to properly install, set, and remove temporary fish trapping structures. Accumulation of soils, debris, and noxious weeds shall be removed from the drive mechanisms (wheels, tires, tracks, etc.) and undercarriage of equipment prior to using it to conduct work below the ordinary high water line. 23. The permitee shall ensure that WDFW protocols (http://wdfw.wa.gov/ais/)for controlling the spread of aquatic invasive species are implemented during the course of the project. Every effort shall be implemented to control the spread of noxious and nuisance weeds, including but not limited to: cleaning of equipment of loose vegetation material and seeds before transport. ROUTINE INTAKE AND OUTFALL MAINTENANCE - SEDIMENT REMOVAL 24. Sediment removal in areas that have no fish life may occur at any time on intakes or outfalls provided no sediment is allowed to impact areas with fish life downstream. 25. Sediment removal operations for intake and outfall maintenance shall not extend more than 100 feet from the intake or outfall. Every effort shall be made to keep this distance as minimal as possible. 26. The amount of sediment removed shall be limited to that necessary to maintain the function of the WDFW facility, but shall not exceed the limit identified for each site in the application attachment entitled "DFW Planned Maintenance Activities.xls", and should ensure that further removal will not be necessary during fish spawning, intra-gravel development, or out-migration. Sediment removal shall not create an unstable streambed upstream of the point where gravel is removed; the transition from within the excavation area shall be gradually sloped (approximately 5%) to meet the natural stream grade. 27. Some intake facilities have a "Tanner Gate" designed to reduce the accumulation of material in the intake. At these facilities, the Tanner Gate shall be operated at all times in a manner that will minimize accumulation. This may require frequent(possibly hourly) inspections and adjustments during fluctuating stream flows. 28. Existing stream crossing structures shall be used to cross the stream. The use of existing bridges and culverts is preferred to the use of fords. 29. All sediment removed shall be disposed of at an upland site that prevents it from reentering state waters. Floating shear logs may be used to help protect the facility by deflecting debris, including ice. These floating shear logs shall be anchored in a manner to minimize the accumulation of debris at the shear log. 31. Areas at each facility that tend to accumulate wood and debris shall be inspected frequently. Wood repositioning and debris removal shall be frequent enough to prevent the build-up of large jams. Non-embedded debris shall be removed and disposed of upland so it will not reenter the stream. Non-embedded small woody material may be removed and disposed of upland or returned to the stream downstream of the work area. Non-embedded large woody material (LWM) shall be returned to the stream downstream of the work area. LWM embedded in the streambed or banks shall not be disturbed. 32. LWM shall be suspended during its repositioning to minimize damage to the streambed or banks. Yarding corridors (for LWM) or full suspension shall be used to avoid damage to riparian vegetation. 33. LWM shall not be cut to a length less than the channel width at the OHWL. Root wads shall not be removed from the LWM trunk. The diameter of the root wad shall not be reduced. If wood must be cut beyond these limitations, a separate HPA is required to include mitigation. 34. Where LWM cannot be suspended above the streambed and banks, skid logs or similar methods shall be used to avoid bank damage. Upon completion of the operation, skid logs shall be removed in a manner that avoids damage to stream banks and vegetation, and the bank shall be restored to pre-project or improved condition. 35. LWM repositioning shall be accomplished in a manner that minimizes the sudden release of bedload, logs, or other debris downstream. TEMPORARY FISH TRAP AND RACK INSTALLATION AND REMOVAL 36. If it is necessary to place gravel along the bottom of the rack, it may be obtained from a dry gravel bar in the immediate vicinity. Removal of gravel shall be held to the absolute minimum necessary to ensure the ability of the rack to function properly and shall be no greater than the amount indicated in the application attachment entitled "DFW Planned Maintenance Activities.xls"". 37. The gravel bar from which gravel is taken for placement along the bottom of the rack shall be above the existing water level and free of pits or potholes when finished. The finished grade shall provide a smooth slope of at least 2 percent downward toward the wetted perimeter of the stream. 38. The rack shall be maintained in a condition that will allow continuous stream-flow through the area without creating a significant backwater curve. Adequate personnel and equipment shall be available at the site at all times to ensure proper maintenance and necessary action is taken if an emergency occurs. 39. If a washout occurs, the rack shall immediately be removed or reinstalled to prevent further damage to the bed or banks of the stream. 40. Trap and rack installation and removal shall be accomplished in a manner that will minimize disturbance of the streambed. Each segment of the structure shall be lifted by hand or with equipment and transported to or from the stream with full suspension so that it does not drag on the bed or banks of the stream. INSTREAM ADULT HOLDING AND TRAPPING POND MAINTENANCE 41 . The instream pond may be cleaned on an annual basis by sluicing material downstream, provided there is less than one-half cubic yard of material and downstream spawning areas can be protected from sediment impacts. Sluicing shall occur only during higher turbid stream flows or when sediment traps constructed as follows are installed downstream: a. At least three sediment traps shall be placed downstream of the project. These traps shall consist of laying filter fabric on the streambed and creating a dam on the downstream edge of the filter fabric. b. The dam shall be just high enough to create a backwater curve over the length of filter fabric. c. The sediment traps shall be removed from the stream within two days of completing the sluicing operation. All sediment trap materials and materials captured by them shall be completely removed and disposed of so they do not reenter state waters. 42. All material removed from the pond by a method other than sluicing shall be disposed of so that it does not reenter state waters. WATER QUALITY 43. Every effort shall be taken during all phases of this project to ensure that sediment-laden water is not allowed to enter the stream. 44. Wastewater from project activities and water removed from within the work area shall be routed to an area landward of the ordinary high water line to allow removal of fine sediment and other contaminants prior to being discharged to the stream. 45. All waste material such as construction debris, silt, excess dirt or overburden resulting from this project shall be deposited above the limits of flood water in an approved upland disposal site. 46. If high flow conditions that may cause siltation are encountered during this project, work shall stop until the flow subsides. VEGETATION MANAGEMENT 47. Revegetation shall occur per the application attachment entitled "Vegetation Management Plan for WDFW Hatcheries", except as modified by this HPA. 48. Bank and bank vegetation removed or damaged as a result of facility maintenance or other construction shall be limited to that necessary to construct the project. If vegetation is removed or damaged, re-establishment of native vegetation shall occur as soon as the weather permits, but no more than six months after the removal or damage. Vegetation shall be maintained as necessary for three years to ensure at least 80 percent survival. 49. ANNUAL REPORTING: A calendar year annual report of work shall be submitted in unlocked Microsoft Excel (*.xls) format to HPAapplications @dfw.wa.gov by February 28 of the following year, or in the final year of the HPA, prior to the expiration date using the template included with this HPA entitled "133480 WDFW Hatchery Maintenance Annual Report template.xlsx". An annual report is required even if no work was conducted. The annual report shall include: a. General: HPA Control Number, permittee, contact person, address, telephone number, date of report, time period represented. b. Summary: Total number of individual projects by hatchery facility and statewide. c. Problem(s) encountered: Provision violation, notification, corrective action, impacts to fish life and water quality from problem, invasive species removed. d. Recommendations for improvement to provisions. e. List of individual projects completed at each facility including details noted in the template. DEFINITIONS Debris: Inorganic material including trash, tires and garbage etc. This definition does not include Large Woody Material (LWM), woody material smaller than LWM, woody material resulting from beaver activity, or woody material placed in channels for an environmentally beneficial purpose. Large Woody Material (LWM): Trees or tree parts larger than four inches in diameter and longer than six feet in length, including rootwads. This material is located wholly or partially waterward of the Ordinary High Water Line (OHWL). Ordinary High Water Line (OHWL): The mark on the shores of all waters that will be found by examining the bed and banks and ascertaining where the presence and action of waters are so common and usual and so long continued in ordinary years, as to mark upon the soil or vegetation a character distinct from that of the abutting upland provided that in any area where the ordinary high water line cannot be found the ordinary high water line adjoining saltwater shall be the line of mean higher high water and the ordinary high water line adjoining freshwater shall be the elevation of the mean annual flood. Organic Material: Natural woody and plant material smaller than LWM. Examples include woody material resulting from beaver activity, twigs, leaves, and dead fish. Sediment(s): Settled particulate matter located in the predominant biologically active aquatic zone, or exposed to the water column. Sediment also includes settled particulate matter exposed by human activity (e.g., dredging) to the biologically active aquatic zone or to the water column. You may request subsequent minor modifications to the required work timing. A minor modification of the plans and specifications means any changes in the materials, characteristics or construction of your project that does not alter the project's impact to fish life or habitat and does not require a change in the provisions of the HPA to mitigate the impacts of the modification. Minor modifications do not require you to pay additional application fees or be issued a new HPA.
