The project shall adhere to the Best Management Practices (BMPs) to control stormwater, erosion and sediment during construction. BMPs shall address permanent measures to stabilize soil exposed during construction, and in the design and operation of stormwater and drainage control systems. 4.) The project shall comply with Construction Stormwater Pollution Prevention (SWPP) Elements#1 through #12 of the Department of Ecology's Stormwater Management Manual for Western Washington to control stormwater, erosion and sediment during construction. BMPs shall address permanent measures to stabilize soil exposed during construction, and in the design and operation of stormwater and drainage control systems. 5.) The applicant shall fully adhere to all conditions and requirements of the eagle habitat management plan. 6.) In addition to Jefferson County permit conditions, the project proponent shall comply with all conditions set forth by the Washington Department of Fish and Wildlife through Hydraulic Project Approval. 7.) PRIOR TO BUILDING FINAL, THE APPLICANT SHALL SUBMIT AN AS-BUILT, AS REQUIRED BY THE CASP, FOR COUNTY REVIEW AND APPROVAL. A BUILDING FINAL SHALL NOT BE ISSUED UNTIL JEFFERSON COUNTY DEPARTMENT OF COMMUNITY DEVELOPMENT HAS APPROVED THE AS-BUILT. FINDINGS: 1.) The Administrator finds that this application complies with applicable provisions of the Unified Development Code, all other applicable ordinances and regulations, and is consistent with the Jefferson County Comprehensive Plan and Land Use map. 2.) This project received County Shoreline Approval on June 14, 2010. See SDP10-00035 for findings on Shoreline Approval. 3.) The applicant is proposing to create or add 205 square feet of impervious surface and 100 square feet of land disturbing activities. JCC 18.30.060 and 18.30.070 require your proposal comply with Minimum Requirement #2 (Construction Stormwater Pollution Prevention) of the Department of Ecology Stormwater Management Manual for Western Washington to control stormwater, erosion and sediment during construction. BMPs shall address permanent measures to stabilize soil exposed during construction, and in the design and operation of stormwater and drainage control systems. 4.) The site plan as submitted with the Building Permit application on May 24, 2010 has been reviewed for consistency under the UDC, and has been approved by Jefferson County Department of Community Development. Any modifications, changes, and/or additions to the stamped, approved site plan dated July 6, 2010 shall be resubmitted for review and approval by Jefferson County Department of Community Development. 5.) This approval is for a New Wooden Stairs to the Beach only. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits. 6.) NOTICE: This permit does not excuse the proponent from complying with other local, state, and federal ordinances, regulations, or statutes applicable to the proposed development, but consistent with RCW 90.58. 7.) The applicant is proposing to construct stairs to the shoreline within a fish and wildlife habitat conservation area buffer. A critical areas stewardship plan (CASP) was submitted as part of building permitting. The CASP and a Restrictive Covenant were recorded with the Auditor's Office on July 1, 2010 (AFN 552774). APPEALS: Pursuant to RCW 36.70C,the applicant or any aggrieved party may appeal this final deasion to Jefferson County Superior Court within twenty-one (21) calendar days of the date of issuance of this land use decision. Failure of the applicant to implement the CASP shall result in the ability of Jefferson County to use the applicant's deposit to complete the GASP requirements. 3.) Work within the fish and wildlife habitat conservation area other than as described above shall receive separate review from this Department. 4.) Construction shall be conducted in a manner that does not cause degradation of critical areas. FINDINGS: 1.) NOTICE: This permit does not excuse the proponent from complying with other local, state, and federal ordinances, regulations, or statutes applicable to the proposed development, but consistent with RCW 90.58. Development pursuant to this permit shall be undertaken subject to the applicable policies and performance standards of the Jefferson County Shoreline Management Master Program and the Jefferson County Code. If during excavation or development of the site an area of potential archaeological significance is uncovered, all activity in the immediate area shall be halted, and the Administrator shall be notified at once. The Federal Endangered Species Act rules to protect threatened Chinook and Summer-run Chum salmon became effective on January 8, 2001. Bull trout have been listed as threatened since early 2000. Under the ESA, any person may bring lawsuit against any individual or agency that"takes" listed species (defined as causing harm, harassing, or damaging habitat for the listed species). In addition, the National Marine Fisheries Service can levy penalties. All areas in Jefferson County are included as "critical habitat"for a listed species. Development of property along any marine shoreline, freshwater shoreline, or floodplains could harm habitat if protective measures are not taken. To minimize the potential to damage habitat, all property owners developinc adjacent to marine shoreline, freshwater shoreline, or floodplains are advised to do the following: -All development activities should avoid unstable slopes, wetlands, and forested areas near surface waters - Remove minimal vegetation for site development, especially large trees -Allow trees that have fallen into surface waters to remain there - Infiltrate stormwater from buildings and driveways onslte th r oug h drywells rather than discharging directly into surface waters or roadside ditches Any individual, group, or agency can bring suit for a listed species"taking", even if you are in compliance with Jefferson County development codes. The risk of a lawsuit against you can be reduced by consulting with a professional fisheries habitat biologist, and following the recommendations for site development provided by the biologist. For more information, contact the National Marine Fisheries Service in Seattle, or the UI.S. Fish and Wildlife Service. On April 3, 2015 the site was monitored and photographed. 2. Goals and objectives of CSP 1.0-00002 was reviewed which required the plpting of S to 7 native shrubs within 150 feet of the shoreline. FINDINGS A. All of the Legoked 5 to 7 native shrubs(Red-Osier dogwood)as well as an additional 7 plantings demonstrate a healthy, robust status and have increased to 4 to 6 feet in size since their initial planting in April 2010. B.All of the original 14 plantings have survived and demonstrate expanding root growth at their base. C.Path to stairway and the stairway continues to be well maintained. Site monitored and photographed October 6, 2013 2. Goals and objectives of the CASP to include the planting of 5 to 7 native shrubs within 150 feet of the shoreline was reviewed. 3. Path to stairway and the stairway is well maintained. 4. All of the required Red-Osier dogwood plantings as well as the additional 7, have continued to increase in size during the past year despite the unusual dry season. 5. All 14 plantings are healthy and growing well, with some plants over 6 feet tall. 6. Plantings and surrounding area are well groomed and mulched. 7. The project at 80 Burns Road, Port Ludlow, WA involved building a set of stairs down to the beach (approximate 27 foot elevation drop) replacingian existing access ladder. The site was monitored for compliance of the mitigation plan on September 27, 2010. Goals and objectives of the CASP include planting 5 to 7 native shrubs within 150' of the buffer. Species were chosen to increase species diversity along the boundary of the pasture. Thelse plantings will be monitored for health and survival rates for 3 to 5 years. This report represents the AS BUILT portion of the CASP. At the top of the slope 13 red-osier dogwoods were planted exceeding the requirements for the project. In addition a drip irrigation system was installed. All plants were healthy and thriving during this monitoring period. Herbaceous vegetation will be installed as per attached site plan. Mulch shall be placed around the installed plants for depth of 3 inches,with mulch being placed no closer than 2 inches from the stem or base of the plant. Installed plants shall be watered for the first two summers after planting. Plant survival rates are as follows: 100%for Year 1;90%for Year 2; and 80%for Years 3 through 5. Replanting will be required for any plants that fall below the above survival thresholds. Any Listed Species observed on-site None Potential impacts of wildlife due to construction and operation of the stairs: There will be no impact to wildlife during or after the construction of the stairs. The stairs and platforms will be elevated on pilings and therefore will not impede passage of fish or mammal species. Existing buffer conditions: At the top of the slope for at least 150 feet in each direction of the proposed stairway the buffers consist of dense native trees and shrubs. The depth of the vegetative hedge is approximately 95 feet Any other critical area on the property or project vicinity: None (.0 Any human disturbances: Currently there are minimal human disturbances observed near the projects area. The mowed trail to the site of proposed stairway consists of native species. The beach contains no creosote treated lumber or man-made structures with the exception of the ladders. Assessment of Functions and Values: The hedge of native vegetation along the shoreline has the function of erosion control, sediment filtration, water retention, screening, and habitat for birds and mammals. Assessment of Impacts to Functions and Values (including square footage of impacts): The upper landing will have a footprint of 5'X 5' and will be elevated above ground on pilings. The lower landing,4' X 4' will be sited above the shoreline. Neither structure will create additional impervious surface. Adjacent watershed, including hydrologic conditions: The Oak Bay/Mats Mats Watershed generally slopes from Oak Bay Road to Oak Bay with intermediate slope stability indicated on the Jefferson County maps. The parcels within this watershed are large and consist of rural development. The mapped wetlands are along the shoreline and in a few small areas well over 300 feet from the subject parcel. The stream channels are all mapped as (N) Non-fish Habitat channels. The hydrologic condition of the watershed as observed from this parcel and surrounding areas is generally in a natural unaltered condition. Goals of the CASP mitigation: The project will be to install a stairway extending from the top of the slope to the beach. The drop in elevation is approximately 27 feet. Since this development is along the shoreline and will be constructed of treated wood there will be a minimal water quality issues (leach ate). This project will be within the jurisdiction of the Washington Department of Fish and Wildlife since construction impacts will be within designated shoreline buffers. This buffer extends landward from the OHWM f1GtG1t 7c/i 150 feet as defined as Fish and Wildlife Habitat Conservation Areas (Jefferson County Code, Critical Areas, FWHC, Table 18.22.270, Buffers for Other FWHCA, Locally Important Habitat Areas). Existing buffer conditions: At the top of the slope for at least 150 feet in each direction of the proposed stairway the buffers consist of dense native trees and shrubs. The mowed trail to the site of proposed stairway consists of native species. The beach contains no creosote treated lumber or man-made structures with the exception of the ladders. Assessment of Functions and Values: The hedge of native vegetation along the shoreline has the function of erosion control, sediment filtration, water retention, screening, and habitat for birds and mammals. Assessment of Impacts to Functions and Values (including square footage of impacts): The upper landing will have a footprint of 5'X 5' and will be elevated above ground on pilings. The lower landing,4' X 4' will be sited above the shoreline. Neither structure will create additional impervious surface. Adjacent watershed, including hydrologic conditions: The Oak Bay/Mats Mats Watershed generally slopes from Oak Bay Road to Oak Bay with intermediate slope stability indicated on the Jefferson County maps. The parcels within this watershed are large and consist of rural development. The mapped wetlands are along the shoreline and in a few small areas well over 300 feet from the subject parcel. The stream channels are all mapped as (N) Non-fish Habitat channels. The hydrologic condition of the watershed as observed from this parcel and surrounding areas is generally in a natural unaltered condition. Goals of the CASP mitigation: The project will be to install a stairway extending from the top of the slope to the beach. The drop in elevation is approximately 27 feet. Since this development is along the shoreline and will be constructed of treated wood there will be a minimal water quality issues (leach ate). This project will be within the jurisdiction of the Washington Department of Fish and Wildlife since construction impacts will be within designated shoreline buffers. This buffer extends landward from the OHWM • 150 feet as defined as Fish and Wildlife Habitat Conservation Areas (Jefferson County Code, Critical Areas, FWHC, Table 18.22.270, Buffers for Other FWHCA, Locally Important Habitat Areas). Goals of the CASP mitigation include planting trees and shrubs within the 150' buffer. SpeOies have been chosen to increase species diversity along the pasture hedge boundary. Objectives of the CASP mitigation: The project in general will have minimal environmental impacts (no vegetation removal, or .ncreased impervious surfaces)during or after the construction. Objectives of the CASP will be to pl t 5 to 7 trees or shrubs and to monitor survival rates for 3 to 5 years. The applicant shall obtain a building permit from the Jefferson County Department of Community Development prior to the construction of the stairway to include a CASP agreement for Stairs to the Shoreline (Log item 15). 2. Stormwater Management Standards, stormwater, erosion and sediment control shall be required for the project as part of the building permit approval. The required plan will be a small parcel erosion control plan, which does not require a stamp from a licensed engineer. 3. The design of the stairs shall be consistent with the plans submitted as Log item 6. 4. The applicant shall comply with the recommendations of the Geotechnical Report prepared by Stratum Group for the proposal and subject property dated October 3, 2005. 5. The stairway shall be constructed or material, painted or stained so as to blend into the natural color scheme of the shoreline bluff. 6. This approval does not authorize the removal of any large conifer trees. 7. Erosion control measures shall be in place prior to any clearing, grading, or construction. These control measures must be effective to prevent soil from being carried into surface water by stormwater runoff. Sand, silt, clay particles, and soil will damage aquatic habitat and are considered pollutants when discharged to waters of the state. 8. Proper disposal of construction debris shall be on land in such a manner that debris cannot enter the water body or cause water quality degradation of state waters. No fill or other material shall be placed in the waters or intertidal areas of Jefferson County. 9. Any discharge of sediment-laden runoff or other pollutants to waters of the state is in violation of Chapter 90.48, Water Pollution Control, and WAC 173-201A, Water Quality Standards for Surface Waters of the State of Washington, and is subject to enforcement action. 10. During construction, all releases of oils, hydraulic fluids, fuels, other petroleum products, paints, solvents, and other deleterious materials shall be contained and removed in a manner that will prevent their discharge to waters and soils of the state. The cleanup of spills shall take precedence over all other work on the site. 11. A permanent vegetative cover shall be established on denuded areas at final grade if they are not otherwise permanently stabilized. 12. Fresh uncured concrete in direct contact with the water is toxic to aquatic life. All concrete shall be poured in the dry and allowed to cure a minimum of seven (7) days before contact with the water. 13. All lumber and other materials treated with preservative shall be sufficiently cured to minimize leaching into the water or shore bed, in accordance with the Best Management Practices approved by the Washington Department of Fish and Wildlife. 14. Construction shall be in substantial compliance with the site plans (Log items 5 &6) submitted to Jefferson County during the permit process as they exist now or are hereafter amended by Jefferson County and/or the Washington State Department of Ecology. 15. Work within the jurisdiction of the Shoreline Program other than as described above shall receive separate review from this office. 16. Substantial progress towards completion of the project shall be performed within two years of the issuance of the permit. 17. Five hours is approximately how long it would take to fill out the form because a site visit is needed and the biologist has to prepare attachments (e.g., site photos, site plan showing mitigation areas) . It would be helpful to the biologist if you had a copy of the approved site plan available when she conducts the site visit. As the applicant, you need to sign the form that the biologist prepares - the biologist cannot sign on your behalf. The completed form with all applicable attachments and your original signature needs to be submitted as part of the building application. Let me know if you have any questions.
