• ARTICLES OF DECLARATION made and entered this 21st day of
December , 199, by Douglas Milholland, hereinafter referred to
as "Owner," the legal and equitable owner of the following
described real property:
Lots 7 and 8 of Block 9, Tibbal's 2nd Addition to the
City of Port Townsend.
WHEREAS, the Owner has applied or will apply for a building
permit to make certain improvements upon the above-described
property, and
WHEREAS, for purposes of complying with the building and
zoning codes and ordinances of the City, the Owner desires to
treat all of the above-described property as one building tract,
and in particular, desires to do so for the purpose of conforming
to setback requirements for improvements to be built or added
upon the said property, and
WHEREAS, the Owner desires to assure and to provide
assurance to the City of Port Townsend that said property
described above shall be and remain as one building tract for
purposes of improvements to hereafter be constructed upon said
property,

follows:
(1) That the following restrictions affect and restrict all
the herein described land and that said restrictions are and
shall be construed as covenants running with the land binding

reasonable attorney's fees to be set by Court.
(4) That this declaration in full , does not amend or
modify, nor is it intended to amend or modify any other
requirements of the respective ordinances of the City of Port
Townsend or any other law or regulation dealing with the use of
land or construction of improvements upon lands, but rather as
additional covenants and agreements for the purposes herein set
forth.
(5) That the Owner by this declaration does specifically
estop itself and all of its successors and all persons presently
or hereafter owning or dealing with the land or any interest in
or part thereof, from asserting or contending in any manner or
fashion that these covenants are not full and adequate covenants
running with the land as herein described and binding thereon,
for all times hereafter until expressly modified or amended, if
at all, with the written consent of the City of Port Townsend.
(6) Invalidation of any one of these covenants by judgement
. or court order shall in no case affect any of the other covenants
which shall remain in full force and effect.
(7) The Owners signing below warrant that they are the sole
Owners in fee of the real property described above and are
authorized to make these covenants and so bind the land.
(8) These RESTRICTIVE COVENANTS shall be governed by the
laws of the State of Washington.
SPECIFIC RESTR CTIONS AND COVENANTS
(9) Lots 7 and 8 described above shall constitute a single
building site, and no lot or lots or any part thereof shall be
transferred or conveyed in any manner unless and until the
building, buildings or structures are made to conform to the
then-existing zoning provisions on a reduced site,
