LIGHTING: Lighting fixtures shall be designed and hooded to prevent the light source from being directly visible from outside the boundaries of the property. The intensity or brightness of all lighting, during construction and after project completion shall not adversely affect the use of surrounding properties or adjoining rights-of-way. Exterior lighting for residential uses shall not exceed twenty feet (20') in height from excepting when such lighting is an integral part of a building or structure. Ground le\ encouraged. 2. BUILDING HEIGHT: The building height is not to exceed 35 feet. 3. OUTDOOR STORAGE: Outdoor residential storage shall be maintained in an orderly create no fire, safety, health or sanitary hazard. 4. UNLICENSED VEHICLES: Not more than 2 unlicensed vehicles shall be stored on any lot unless totally screened from view of neighboring dwellings and rights-of-way. Such screening shall meet all applicable performance and development standards specific to the district in which the storage is kept, and shall be in keeping with the character of the area. Screening shall meet the requirements of Chapter 18.30 JCC. Outdoor storage of 3 or more junk motor vehicles is prohibited except in those districts where specified as an automobile wrecking yard or junk (or salvage) yard and allowed as a permitted use in Table 3-1 or Chapter 18.18 JCC, and such storage shall meet the requirements of JCC 18.20.100, Automobile wrecking yards and junk (or salvage) yards. In no case, shall any such junk motor vehicles be stored in a critical area. 5. PARKING: A minimum of two (2) on-site parking spaces shall be provided for the single family residence. 6. This permit has been reviewed consistent with JCC 18.40.130 & 140. Notice: this permit does not excuse the applicant from complying with other local, state and federal ordinances, regulations or statues, applicable to the proposed development, but consistent with RCW 90.58. Future development beyond that specified in this permit shall require further review. 7. BMPs: The project shall adhere to the Best Management Practices (BMPs) to control stormwater, erosion and sediment during construction. BMPs shall address permanent measures to stabilize soil exposed during construction, and in the design and operation of stormwater and drainage control systems. 8. NOTICE: This permit does not excuse the proponent from complying with other local, state, and federal ordinances, regulations, or statutes applicable to the proposed development, but consistent with RCW 90.58. Development pursuant to this permit shall be undertaken subject to the applicable policies and performance standards of the Jefferson County Shoreline Management Master Program and the Jefferson County Unified Development Code. If during excavation or development of the site an area of potential archaeological significance is uncovered, all activity in the immediate area shall be halted, and the Administrator shall be notified at once. The Federal Endangered Species Act rules to protect threatened Chinook and Summer-run Chum salmon became effective on January 8, 2001. Bull trout have been listed as threatened since early 2000. Under the ESA, any person may bring lawsuit against any individual or agency that "takes" listed species (defined as causing harm, harassing, or damaging habitat for the listed species). It is our understanding that the property is for sale and as part of due diligence, Pacific Inspection Services, has performed a preliminary inspection of the residence at the request of the interested buyer, Mrs. Bianchi. Their observations showed settlement and erosion at some of the foundation footings. This report has been prepared to summarize our investigation with conclusions and recommendations regarding the residence's foundation footings. 2.0 GEOTECHNICAL OBSERVATIONS AND INDICATORS The residence and deck overhangs a shallow bluff which is comprised of consolidated rock with a thin soil cover. Many isolated footings of varying type and size support these structures. The floor beams of the house extend past the face of the bluff with their ends supported by wooden posts attached to concrete footings which are founded on the solid rock of the shoreline. These footings were observed to be in good condition and can be seen in Figure 1 of the Appendix. Beneath the eastern exterior wall of the residence, isolated concrete footings with wood posts and lateral braces support the inner portion of the floor beams. Observation of these concrete footings located near the top of the bluff showed that the surface soils have eroded away from these footings. This has caused the concrete footings to slightly rotate from horizontal due to inadequate lateral support. Five of these footings were observed to have been subject to substantial erosion. However, one of these unbraced footings has been subject to sufficient erosion to cause the footing and post to rotate. The unbraced interior footing can be seen in Figure 3 of the Appendix. The outermost deck posts along the northeast corner of the home were also inspected for signs of erosion and settlement. 4x4 posts placed on small concrete piers support a portion of the lightweight deck. One of these piers was observed to be poorly placed on uneven ground with no connection to the post. This rotated pier can be seen in Figure 4 of the Appendix. 3.0 CONCLUSIONS AND RECOMMENDATIONS The five braced footings near the top of the bluff and the one unbraced footing need to be modified to prevent future failure and complete loss of support to the floor beams. The rotated deck pier near the northeast corner also needs to be modified. Preliminary plans for construction have been prepared to modify the footings and deck pier mentioned in this report. See Appendix for construction details. Since the construction work will take place within 200 feet of the shoreline, a Shoreline Substantial Development Permit (SDP) Exemption consistent with the Jefferson County Shoreline Master Program (SMP) will be necessary. Exemptions are allowed for certain development work necessary to prevent a decline, lapse,or cessation from a lawfully established condition and for development of which the total cost does not exceed $6,416. For more information regarding the SDP Exemption process, we recommend contacting a planner with Jefferson County Department of Community Development at (360) 379-4450. 4.0 THE LIMITATIONS OF OUR INVESTIGATION AND FINDINGS This investigation was completed without the use of deep subsurface borings and without observations and measurements over long periods of time. Observation of these concrete footings located near the top of the bluff showed that the surface soils have eroded away from these footings. This has caused the concrete footings to slightly rotate from horizontal due to inadequate lateral support. Five of these footings were observed to have been subject to substantial erosion. A view showing the extent of erosion at one of these braced footings can 1 • • Geotechnical Investigation and Report 1 2014 be seen in Figure 2 of the Appendix The innermost concrete footings are comprised of simple square concrete pads with short wooden posts to support the floor beams above. These posts have no physical connection with the concrete pads and rely on compression to reduce beam flexure. Most of these footings remain in moderately good condition. However, one of these unbraced footings has been subject to sufficient erosion to cause the footing and post to rotate. The unbraced interior footing can be seen in Figure 3 of the Appendix. The outermost deck posts along the northeast corner of the home were also inspected for signs of erosion and settlement. 4x4 posts placed on small concrete piers support a portion of the lightweight deck. One of these piers was observed to be poorly placed on uneven ground with no connection to the post. This rotated pier can be seen in Figure 4 of the Appendix. 3.0 CONCLUSIONS AND RECOMMENDATIONS The five braced footings near the top of the bluff and the one unbraced footing need to be modified to prevent future failure and complete loss of support to the floor beams. The rotated deck pier near the northeast corner also needs to be modified. Preliminary plans for construction have been prepared to modify the footings and deck pier mentioned in this report. See Appendix for construction details. Since the construction work will take place within 200 feet of the shoreline, a Shoreline Substantial Development Permit (SDP) Exemption consistent with the Jefferson County Shoreline Master Program (SMP) will be necessary. Exemptions are allowed for certain development work necessary to prevent a decline, lapse, or cessation from a lawfully established condition and for development of which the total cost does not exceed $6,416. For more information regarding the SDP Exemption process, we recommend contacting a planner with Jefferson County Department of Community Development at (360) 379-4450. 4.0 THE LIMITATIONS OF OUR INVESTIGATION AND FINDINGS This investigation was completed without the use of deep subsurface borings and without observations and measurements over long periods of time. The observations and conclusions were derived from surface observations and inferences from surface observations. Undiscovered and unseen conditions could exist that would affect the observations and conclusions of this report. Users who require a higher degree of reliance on this assessment may wish to obtain more detailed studies. Non-conforming Development The following shall apply to non-conforming uses and developments, as defined in Article 2: A. Legally established uses,buildings, structures and/or lots of record that do not meet the specific standards of this Program are considered legal non-conforming and may continue as long as they remain otherwise lawful, and meet the following criteria: 1. Existing,Permitted, or Vested-The use,building, structure, or lot was existing on the effective date of initial adoption of the Program(December 20, 1974), or any subsequent amendment thereto,or was authorized under a permit or approval issued, or is otherwise vested to the Program; or 2. The rebuilt structure will not cause adverse effects to adjacent properties or to the shoreline environment; and 2. The site is geologically stable; and 3. No horizontal or vertical expansion or enlargement of the footprint or height, or any degree of relocation,will occur; and 4. No degree of relocation will occur, except to increase conformity,in which case the structure shall be located as far landward as possible or in the least environmentally damaging location relative to the shoreline or any critical area; and 5. The submittal of applications for permits necessary to restore the development is begun within six (6)months of the damage. The Administrator may waive this requirement in situations with extenuating circumstances such as resolution of an estate, or widespread economic or natural disaster; and 6. The reconstruction is commenced within two(2)years of the issuance of permits. Administrator may allow a one(1)year extension. /G. When allowed, an equivalent area of shoreline buffer area shall be enhanced through planting of native vegetation,plus additional mitigation to be required as appropriate. The Administrator shall require a planting plan to ensure this standard is implemented. 2. Changing an Existing Non-Conforming Use: A structure that is being or has been used for a non-conforming use may be used for a different non- conforming use only upon the approval of a conditional use permit,provided all the following criteria are met: i. No reasonable alternative conforming use is practical because of the configuration of the structure and/or the property; and ii. The purpose of the visit was to determine the Ordinary High Water Mark(OHWM) as it relates to proposed repair and maintenance of an existing deck and its foundation. • The existing deck is located on pilings that are embedded into a basalt outcrop. The outcrop slopes down laterally and toward the water in front of the house (see photo #0141). Adjacent outcrops on this and a neighboring parcel are more vertically oriented. The northern and southern-most pilings are essentially coincident with the uppermost line of barnacles encrusting on adjacent vertical outcrops of the same basalt rock (see photos 0142, 0143 & 0145 showing the barnacle line). In contrast to the more centrally located waterward support pilings, the bases of the end pilings show evidence of wave erosion(see photo #0142—piling base at lower right). This "mark" demonstrates that the presence and action of waters are so common and usual, and so long continued in all ordinary years, as to mark upon this structure a character distinct from those that rest on the adjacent upland. Thus,the OHWM is located at the elevation of waterward face of the northern and southern-most support pilings. Portions of the existing deck at each end appear to be waterward of this line.
