PROJECT LOCATION: Parcel 932 200717, Beckett Point Fisherman's Club, Assessor's Plat, South Beach Annex lots 17 & 18, Section 18, Township 30N, Range 2W, WM, located at 1130 Beckett Point Road, Port Townsend 98368 CONDITIONS: 1.) The lots contained within this"Lot Segregation"were approved based on design standards and regulatory requirements in effect at the time of final approval. A sewage disposal permit has not been approved for the lot 18. Onsite sewage disposal systems shall meet design standards and regulatory requirements in effect at the time of application for a sewage disposal tank only permit. Purchaser should contact the Jefferson County Health Department for procedures concerning permit applications. 2.) Approved per sewer connection given to Lot 18 by the Becket Point Fisherman's Club. There are no further sewer connections available. 3.) To process this segregation, you will need to submit a wrttten request to the Jefferson County Assessor's Office to have additional parcel numbers assigned. A copy of this permit will be forwarded to the Assessor's Office. Please contact the Jefferson County Assessor's Office (360-385-9105)with any questions regarding this process. 4.) Contact the Jefferson County Environmental Health Department at(360) 379-9444 to determine potential limitations with regard to wells and on-site sewage requirements. 5.) The legal descriptions shall be recorded with Jefferson County Auditor's office. FINDINGS: 1.) The Administrator finds that this application complies with applicable provisions of the Unified Development Code, all other applicable ordinances and regulations, and is consistent with the Jefferson County Comprehensive Plan and Land Use map. 2.) Based on the findings, parcel number 932200717 can be considered two (2)separate parcel as described in the legal descriptions submitted with the application. 3.) The parcel has been designated as RR 1:20 Rural Residential (1 unit/20 acres) under the Jefferson County Comprehensive Land use Map effective August 28, 1998 4.) As the Parcels are found exempt from RCW 58.17 and Jefferson County Code 18.35, a title report is not required. It is the property owner's responsibility to identify and rectify any security interest conveyances, encumbrances, easements or restrictions affecting the subject properties involved in this county reviewed exemption. 5.) RCW 58.17 requires regulation of the division of land and was passed in 1969. 6.) The application was reviewed by the Jefferson County Department of Community Development staff on March 11, 2013 for the potential presence of Environmentally Sensitive Areas (ESAs) under the provisions of the Unified Development Code (UDC). After an initial Geographic Information Systems mapping review the following ESAs were confirmed to be present on the subject property: wetlands, FEMA flood hazardous area, shoreline jurisdiction -suburban, seismic hazardous area, landslide hazardous area, fish and wildlife habitat conservation area, susceptible aquifer recharge area. 7.) On January 16, 2012, Pat Perryman in the Assessor's Office GIS department commented as follows: I have no comment pertaining to this Lot Certification. 8.) On February 11, 2013, Sherrie Sholds in the Assessor's Office commented as follows: we have no concerns about the completion of the Lot Certification. 9.) Jefferson County determined that this proposal is categorically exempt from review under the State Environmental Policy Act(SEPA) pursuant to WAC 197-11-800(6)(a). 10.) This determination does not guarantee an ability to develop the parcels. All development shall comply with the on-site sewage code, the building codes and local development regulations. 11.) NOTICE: This permit does not excuse the proponent from complying with other local, state, and federal ordinances, regulations, or statutes applicable to the proposed development, but consistent with RCW 90.58. Development pursuant to this permit shall be undertaken subject to the applicable policies and performance standards of the Jefferson County Shoreline Management Master Program and the Jefferson County Unified Development Code. If during excavation or development of the site an area of potential archaeological significance is uncovered, all activity in the immediate area shall be halted, and the Administrator shall be notified at once. The Federal Endangered Species Act rules to protect threatened Chinook and Summer-run Chum salmon became effective on January 8, 2001. Bull trout have been listed as threatened since early 2000. Under the ESA, any person may bring lawsuit against any individual or agency that"takes" listed species (defined as causing harm, harassing, or damaging habitat for the listed species). In addition, the National Marine Fisheries Service can levy penalties. All areas in Jefferson County are included as"critical habitat"for a listed species. Development of property along any marine shoreline, freshwater shoreline, or floodplains could harm habitat if protective measures are not taken. To minimize the potential to damage habitat, all property owners developing adjacent to marine shoreline, freshwater shoreline, or floodplains are advised to do the following: -All development activities should avoid unstable slopes, wetlands, and forested areas near surface waters - Remove minimal vegetation for site development, especially large trees -Allow trees that have fallen into surface waters to remain there - Infiltrate stormwater from buildings and driveways onsite through drywells rather than discharging directly into surface waters or roadside ditches The Federal Bald and Golden Eagle Protection Act requires landowners within 660 feet(1/8th of a mile)of an eagle nest to consult with the US Fish and Wildlife Service. This Eagle Act prohibits anyone from"taking" bald eagles. This federal law defines the term "take" and describes the possible legal consequences when a"take" occurs. Among other actions, "take" includes a disturbance of bald eagles or their habitat. Under federal law a permit may still be required for activities that impact bald eagles or their habitat. Contact the US Fish and Wildlife Service (http://www.fws.gov/pacific/eagle/)to learn more about how this law affects your project. Any individual, group, or agency can bring suit for a listed species"taking", even if you are in compliance with Jefferson County development codes. The risk of a lawsuit against you can be reduced by consulting with a professional fisheries habitat biologist, and following the recommendations for site development provided by the biologist. For more information, contact the National Marine Fisheries Service in Seattle, or the U.S. Fish and Wildlife Service. The original septic permit was issued for lots 17 and 18 and has been decommissioned as part of the residences connection to the community system. Below is the comments I have received from EH. 2-26-13 Following review of the referenced application I have the following comments: The lot described as vacant, lot 18, does not meet minimum land area and there is not an onsite sewage system currently available for the property. The original septic permit was issued for lots 17 and 18 and has been decommissioned as part of the residences connection to the community system. An approval for connection to the community onsite sewage system owned and operated by the PUD would be required for this office to consider approval of the lot certification. 2-27-13 I received this comment from Randy this morning: I would also require DOH sign off as this would be an expansion to the originally approved number of connections. Also Patty Salinger who is on the Becket Point Board needs to have a say as there are other properties that are on a list for any remaining connections. Patty has been managing connections from the beginning of the project. As soon as I get Patty's email I will work with EH to determine if they can sign off or what the next step will be.
