LEGAL DESCRIPTION : The site is described as the northwest half of Lot 5 and Lots 6 , 7 , and 8 of Block 7 of Port Hadlock within Section 1 , Township 29 North, Range 1 West , WM . WATERBODY AND/OR ASSOCIATED WETLANDS: Port Townsend Bay SHORELINE OF STATE-WIDE SIGNIFICANCE: YES SHORELINE DESIGNATION : Urban CONDITIONS: Development pursuant to this permit shall be undertaken subject to the applicable policies and performance standards of the Jefferson-Port Townsend Shoreline Management Master Program and the following conditions : 1 ) The seaward line of the proposed docks and piers shall not extend beyond the line of the adjacent existing pier to the southeast . 2 ) The proposed structures shall be marked with aids to navigation as required by the U .S. Coast Guard . 3 ) Construction of any over-water structures other than the proposed dock and piers is not authorized by this permit . Ref . : SDP88-0018 frm 004a . . 4 ) Toxic and hazardous substances shall /not be stored on the proposed dock and piers . 5 ) Change of use , or moorage of vessels not belonging to the owner , shall be subject to shoreline management program review by the Jefferson County Planning and Building Department . Depending upon proposed changes , applicable subsections of the Jefferson-Port Townsend Shoreline Management Master Program could include Section 5 . 50 , "Commercial Development" ; 5 . 90 , " Industrial and Port Facilities " ; and 5 . 110 , "Marinas . " Based on this review, change of use or moorage of additional vessels could require a shoreline substantial development permit . NOTICE : 1 . This permit may be rescinded by the Jefferson County Board of Commissioners or the Washington State Shorelines Hearings Board upon the finding the permittee has not complied with the conditions herein , pursuant to RCW 90 . 58 . 140(8) , 2 . The permittee is liable for all damages to public and private property arising from violation of any provisions of the permit hereby granted , including the cost of restoring the affected area to its condition prior to violation and possible court costs that may ensue from violation , pursuant to RCW 90 . 58 . 230 . 3 . Construction pursuant to this permit will not begin nor is it authorized until thirty (30) days from the date of filing as defined in RCW 90 . 58 . 140( 6) and WAC 173-14-090 , or until all review proceedings initiated within thirty days from the date of such filing have terminated , except as provided in RCW 90 . 58 . 140( 5 . a-c) . Construction or substantial progress toward construction of the permitted development shall begin within two (2) years from the date of this permit and completion of the permitted development shall be accomplished with five ( 5) years from the date of this permit . 4 . Nothing in this permit shall excuse the permittee from complying with any other federal , state, or local statutes , ordinances , or regulations applicable to this project , but consistent with RCW 90 . 58 . November 26,1988 Dear Sirs: We have been asked by our landlord, John Westrum, to write our comments on Roy Newell, and his proposed shoreline project. We have nothing against a project of this kind, but we feel the Planning Department should be aware that Mr. Newell does not prac- tice common sense when it comes to boundary lines. Nor does he have an inch of consideration for the neighbors or the neighborhood he moved into about five years ago. For one thing Mr. Newell considers it appropriate and legal to simply move a boundary stake when he wants to use another persons land, which he has done to us. For another, he has placed a diesel generator under our bedroom window and stacked lumber two feet from the house we lease, and five feet over the registered survey line. When we approached Mr. Newell on these matters he told us the the boundary lines in the community are all wrong, which means that since about 1935 everything has been all messed up in this neighborhood that is until Mr. Newell moved in. As We said, this project does not bother us, and perhaps in Lower Hadlock, but hopefully you will see that boundary lines, and noise factors are considered for everyone before you make your final judge- ment. SDP88-0018 ROY NEWELL Dear Sirs: My name is John Westrem and I own the Hadlock Dock property which is adjacent to the Roy Newell property . We purchased our property eleven years ago , with the idea that when I retire we would reside there . I am opposed to the Newell proposal of dock extension because since he purchased this property several years ago , his parcel has become very run down with various pieces of old weathered equipment and lumber and is in general disarray over his entire area. This deterioration of his property, has in my mind, caused a devaluation of all the properties in the lower Hadlock area . Furthermore , he has placed heavy timbers and planking on my property and has refused to remove them, even though I have written and requested him to do so . My tenant, Tom Paul, who occupies my building says Newell has been most unneighborly and uncooperative in all matters . Just lately, Newell has installed a diesel generator to supply power for his work . Even though there is adequate space else- where , he located the generator close to Paul' s bedroom where the noise is a constant source of irritation to Paul and his wife . Other neighbors have also mentioned similar dis- pleasure with the unsightliness of his property. The time limit for completing the work authorized ends on 9 June 1992 If you find that you need more time to complete the authorized activity, sub- mit your request for a time extension to this office for consideration at least 1 month before the above date is reached. 2. Extensions. General condition 1 establishes a time limit for the comple- tion of the activity authorized by this permit. Unless there are circumstances requiring either a prompt completion of the authorized activity or a reevalua- tion of the public interest decision, the Corps will normally give favorable consideration to a request for an extension of this time limit. 3 • S i ROY NEWELL1 S II O R E L I NE SUBSTANTIAL. D E VE L O P ME NT P E RM I T AP P L I C AT I O N S D P 8 8 - 001 8 The proposal is to repair and extend two piers, and to construct a floating dock on Port Townsend Bay in lower Hadlock to provide moorage for the proponent's vessel. The northern pier is approximately 16 feet wide and 60 feet long and would be lengthened approximately 84 feet. The southern pier is approximately 8 feet wide and 70 feet long. A hinged ramp would be constructed leading to a 6 foot by 80 foot floating dock secured between one existing and one proposed dolphin. Existing decking and unsound piles would be replaced on both piers. The seaward line of the new construction would conform to existing adjoining docks and piers. Water and electric power utilities currently serve the proposal site. These utilities would be placed on the proposed dock and piers. No dock illumination is proposed. The site is described as Lots 5 (the northwest half) , 6, 7, and 8 of Block 7 of Port Hadlock within Section 1, Township 29 North, Range 1 West, WM. FINDINGS 1 . The Jefferson-Port Townsend Shoreline Management Master Program requires that a shoreline substantial development permit be issued by Jefferson County for development of the proposal. The following sections of the program apply in the review of the proposal: 1.20, "Purposes"; 4. 101, "Aquatic Designation"; 4.105, "Urban Designation"; 4.201, "Primary Use"; 4.30, "Shorelines of State-Wide Significance"; 5.60, "Docks, Piers, and Floats"; 5.200, "Utilities." 2. The proposal has been administratively classified as a primary use in an urban designation by criteria established in the Jefferson-Port Townsend Shoreline Management Master Program. 3. No critical biological areas or resources have been identified on or adjacent to the proposal site. 4. The Coastal Zane Atlas of Washington indicates that wave heights and littoral drift are minimal in the area. 5. The Coastal Zone Atlas of Washington and the Jefferson County Flood Insurance Rate Map indicate that the proposal site is within the 100- year flood plain and is subject to coastal flooding. 6. The proposed dock and piers are for the private moorage of the proponent's 80 foot wooden tug. No joint or public use facility is proposed. 7. The following additional permits are required for development of the proposal: a. U.S. Army Corps of Engineers section 10 permit. b. Washington State Department of Fisheries and Wildlife hydraulics permit. c. Jefferson County building permit. 8. The shoreline area to the southeast of the proposal site is occupied by two warehouses, a private pier, and the Port of Port Townsend's dock and boat launch. The shoreline area to the northwest is occupied by a marine repair facility. Landward across Water Street are several residences. 9. A site inspection was conducted on November 23, 1988, by a representative of the Jefferson County Planning and Building Department. 10. Notice of the application was made by publishing legal notices in the October 12 and 19, 1988 editions of the Port Townsend-Jefferson County Leader, posting the site of the proposed development with notices on October 27, 1988, and notifying by mail immediately adjacent property owners. • S 11. Notice of the public hearing scheduled fortNovember 28, 1988, was made by' notifying by mail immediately adjacent property owners. The public hearing is held by the Jefferson County Board of Commissioners. 12. The proposal has been reviewed according to the Washington State Environmental Policy Act by Jefferson County as the lead agency. The County has issued a determination of non-significance for the proposal on October 17, 1988. The determination states that the anticipated environmental impacts were adequately addressed in the environmental checklist and the preparation of an environmental impact statement was not necessary. WRITTEN TESTIMONY 1. A letter dated November 12, 1988, was received from adjacent property owners Mr. and Mrs. John Westrem who are opposed to the proposal. They object to the manner in which the proponent has maintained the proposal site. They are also concerned about the effect of noise associated with work on the site. CONDITIONS Issuance of a shoreline substantial development permit for the proposed project requires compliance with the Washington State Shoreline Management Act and the applicable policies and performance standards of the Jefferson- Port Townsend Shoreline Management Master Program, in addition to the following conditions: 1. The seaward line of the proposed docks and piers shall not extend beyond the line of the adjacent existing pier to the southeast. 2. The proposed structures shall be marked with aids to navigation as required by the U.S. Coast Guard. 3. Construction of any over-water structures other than the proposed dock and piers is not authorized by this permit. 4. Toxic and hazardous substances shall not be stored on the proposed dock and piers. 5. Change of use, or moorage of vessels not belonging to the owner, shall be subject to shoreline management program review by the Jefferson County Planning and Building Department. Depending upon proposed changes, applicable subsections of the Jefferson-Port Townsend Shoreline Management Master Program could include Section 5.50, "Commercial Development"; 5.90, "Industrial and Port Facilities"; and 5.110, "Marinas. " Based on this review, change of use or moorage of additional vessels could require a shoreline substantial development permit. BOARD OF COMMISSIONERS ACTION The Jefferson County Board of Commissioners reviewed the proposal, findings, and conditions at their November 28, 1988 meeting. BROWN, DISTRICT 3 NATIONAL HISTORIC SITE PORT TOWNSEND,WASHINGTON MITIGATED DETERMINATION OF NON-SIGNIFICANCE AND LEAD AGENCY STATUS I DATE: October 17, 1988 PROPONENT: Roy Newell PROPOSAL: The proposal is to repair and extend two piers, and to construct a floating dock on Port Townsend Bay in lower Hadlock to provide moorage for the proponents vessel. The northern pier is approximately 16 feet wide and 60 feet long and would be lengthened approximately 84 feet. The southern pier is approximately 8 feet wide and 70 feet long. A hinged ramp would be constructed leading to a 6 foot by 80 foot floating dock secured between one existing and one proposed dolphin. Existing decking and unsound piles would be replaced on both piers. The seaward line of the new construction would conform to existing adjoining docks and piers. MITIGATIVE MEASURES: 1. The seaward line of the proposed docks and piers shall not extend beyond the line of the adjacent existing pier to the southeast. 2. The proposed structures shall be marked with aids to navigation as required by the U.S. Coast Guard. LEGAL DESCRIPTION: The site is described as the northwest half of Lot 5 and Lots 6, 7, and 8 of Block 7 of Port Hadlock within Section 1, Township 29 North, Range 1 West, WM. NOTICE OF LEAD AGENCY: Jefferson County has determined that it is lead agency for the above-described proposal. NOTICE OF NON-SIGNIFICANCE: Jefferson County has determined that the above- described proposal would not have a probable significant adverse impact on the environment, and an environmental impact statement is not required under RCW 43. 21C.030( 2) (c) . This decision was made after review of a completed environmental checklist and other information on file with the Jefferson County Planning and Building Department. COMMENT PERIOD: This determination is issued pursuant to WAC 197-11-340(2) .
