To process this segregation, you will need to submit a wrttten request and a copy of the recorded survey to the Jefferson County Assessor's Office to have additional parcel numbers assigned. A copy of this permit will be forwarded to the Assessor's Office. Please contact the Jefferson County Assessor's Office (360-385-9105) with any questions regarding this process. 2.) The survey and legal descriptions shall be recorded with Jefferson County Auditor's office. FINDINGS: 1.) The Administrator finds that this application complies with applicable provisions of the Unified Development Code, all other applicable ordinances and regulations, and is consistent with the Jefferson County Comprehensive Plan and Land Use map. 2.) As the Parcels are found exempt from RCW 58.17 and Jefferson County Code 18.35, a title report is not required. It is the property owner's responsibility to identify and rectify any security interest conveyances, encumbrances, easements or restrictions affecting the subject properties involved in this county reviewed exemption. 3.) The proposal is found to be an exemption under Jefferson County Code(JCC) Section 18.35.040(4): (4) Divisions of land relating to the acquisition of a fee simple interest in land by public agencies, including, but not limited to, divisions made for road or public right-of-way conveyance or widening purposes. This exemption shall not be construed to include acquisitions of easements. 4.) Based on the findings, parcel number 901112001 can be considered two (2) separate parcel as described in the legal descriptions submitted with the application. 5.) On 5-31-13, Sherrie Shold's in the Assessor's Office commented as follows: I have reviewed the survey and have no additional comments. 6.) On 5-31-13, Pat Perryman in the Assessor's GIS department commented as follows: I had no problems with this lot certification survey. 7.) The parcel has been designated as Urban Growth Area - Urban Light Industrial under the Jefferson County Comprehensive Land Use Map effective August 28, 1998 as amended on March 23, 1999 per ordinance No. 03-0323-09. The parcel transitional zoning is rural residential 1-10 RR 1:10. Jefferson County will apply transitional rural zoning on parcels that do not yet have sewer available. 8.) NOTICE: This permit does not excuse the proponent from complying with other local, state, and federal ordinances, regulations, or statutes applicable to the proposed development, but consistent with RCW 90.58. Development pursuant to this permit shall be undertaken subject to the applicable policies and performance standards of the Jefferson County Shoreline Management Master Program and the Jefferson County Unified Development Code. In addition, the National Marine Fisheries Service can levy penalties. All areas in Jefferson County are included as"critical habitat" for a listed species. Development of property along any marine shoreline, freshwater shoreline, or floodplains could harm habitat if protective measures are not taken. To minimize the potential to damage habitat, all property owners developing adjacent to marine shoreline, freshwater shoreline, or floodplains are advised to do the following: -All development activities should avoid unstable slopes, wetlands, and forested areas near surface waters - Remove minimal vegetation for site development, especially large trees -Allow trees that have fallen into surface waters to remain there - Infiltrate stormwater from buildings and driveways onsite through drywells rather than discharging directly into surface waters or roadside ditches The Federal Bald and Golden Eagle Protection Act requires landowners within 660 feet(1/8th of a mile) of an eagle nest to consult with the US Fish and Wildlife Service. This Eagle Act prohibits anyone from"taking" bald eagles. This federal law defines the term "take" and describes the possible legal consequences when a"take" occurs. Among other actions, "take" includes a disturbance of bald eagles or their habitat. Under federal law a permit may still be required for activities that impact bald eagles or their habitat. Contact the US Fish and Wildlife Service (http://www.fws.gov/pacific/eagle/)to learn more about how this law affects your project. Any individual, group, or agency can bring suit for a listed species"taking", even if you are in compliance with Jefferson County development codes. The risk of a lawsuit against you can be reduced by consulting with a professional fisheries habitat biologist, and following the recommendations for site development provided by the biologist. For more information, contact the National Marine Fisheries Service in Seattle, or the U.S. Fish and Wildlife Service. All development shall comply with the on-site sewage code, the building codes and local development regulations. Maybe the same language that is on a BLA survey should be added. On a BLA the following notice to public is added: Approval of this BLA does not provide any assurance that an onsite sewage system can be approved for the resulting lots. No soils were evaluated as part of this application. Onsite sewage disposal systems shall meet design standards and regulatory requirements in effect at the time of application for a sewage disposal permit. Purchaser should contact the Jefferson County Health Department for procedures concerning permit applications. Any removal of or major disturbances of soil within the proposed drainfield areas may create site conditions that are unacceptable for the installation of sewage disposal systems. I will talk to Stacie to see if we can add similar language to a lot certs that requires a survey. FYI not all lot certification require a survey. Previously, the site had been used for a surface mine covering approximately 20 acres. Mining activity has terminated, but the concrete manufacturing plant has continued operation under current ownership since 1980 together with a wash plant that sorts imported raw mineral resource material into round rock sized for concrete and oversize waste rock. Existing improvements include a maintenance shop, stormwater collection and treatment system, a wash plant process water treatment system, and outdoor storage for various formed concrete products. It is important to note that a rock crushing plant was located legally on the property in the mid-1980s and that a berm constructed along the southern property line to attenuate noise from the crushing plant to Jefferson County standards remains in place today. The proposed crusher would operate approximately six hours per day on average, depending on the season and market demand for the aggregate. The proposed crusher will be powered by electricity so that a generator and on-site fuel storage will not be required. Appropriate materials are stored on site to clean up accidental spills or leaks. 1.) The proposal shall be implemented in conformance with the approved site plans. 2.) The proposal shall comply with the Mitigation Measures as specified in the Final Mitigation Determination of Non-Significance dated January 11, 2010. a. In order to reduce noise levels, screening equipment shall be oriented in such a way that the sidewalls of the screen act as a noise barrier. b. In order to reduce noise levels, polyurethane or polyurethane coated screens instead of typical metal screens shall be used at the site. c. Once the screens are installed at the site, noise measurements shall be taken at all the original points as identified in the Environmental Noise Assessment dated May 27, 2009 prepared by DSA, Inc. and a report provided to the county with an analysis of the findings and recommendations and if additional mitigation is required. d. If noise meter readings exceed the state requirements after orienting the crusher and facility so that the sidewalls of the crushing plant curtail noise radiating to the eastern and southern property lines, a noise barrier shall be installed/constructed as described in the Environmental Noise Assessment dated May 27, 2009 prepared by DSA, Inc. e. Dust emissions from the crusher operations shall be controlled to meet the Olympic Region Clean Air Agency permit standards. f. The existing exempt well can expand and grow into the 5,000 gallons a day exemption limit relative to the industrial uses and the proposed expansion of the rock crusher. 3.) The existing berm located parallel to the southern property boundary shall remain in tact and maintained in a healthy growing condition for the life of the project. Any dead or dying plants/trees shall be replaced with evergreen trees to create a"full screen" adjacent to the southern property boundary. 4.) The proposal shall comply with noise standards outlined by WAC 173-60-040, which were adopted by Jefferson County by Resolution 67-85. 6.)
