The Lot Certification statement of intent legal descriptions shall be recorded with Jefferson County Auditor's office. FINDINGS: 1.) The Administrator finds that this application complies with applicable provisions of the Unified Development Code, all other applicable ordinances and regulations, and is consistent with the Jefferson County Comprehensive Plan and Land Use map. 2.) As the Parcels are found exempt from RCW 58.17 and Jefferson County Code 18.35, a title report is not required. It is the property owner's responsibility to identify and rectify any security interest conveyances, encumbrances, easements or restrictions affecting the subject properties involved in this county reviewed exemption. 3.) This determination does not guarantee an ability to develop the parcels. All development shall comply with the on-site sewage code, the building codes and local development regulations in effect at the time of application. 4.) The parcel has been designated as LI/C Light Industrial/Commercial under the Jefferson County Comprehensive Land use Map effective August 28, 1998. 5.) On 5-16-14, the Assessor's commented as follows: I had no problems with this lot certification. 6.) Jefferson County determined that this proposal is categorically exempt from review under the State Environmental Policy Act (SEPA) pursuant to WAC 197-11-800(6)(a). 7.) NOTICE: This permit does not excuse the proponent from complying with other local, state, and federal ordinances, regulations, or statutes applicable to the proposed development, but consistent with RCW 90.58. Development pursuant to this permit shall be undertaken subject to the applicable policies and performance standards of the Jefferson County Shoreline Management Master Program and the Jefferson County Unified Development Code. If during excavation or development of the site an area of potential archaeological significance is uncovered, all activity in the immediate area shall be halted, and the Administrator shall be notified at once. The Federal Endangered Species Act rules to protect threatened Chinook and Summer-run Chum salmon became effective on January 8, 2001. Bull trout have been listed as threatened since early 2000. Under the ESA, any person may bring lawsuit against any individual or agency that"takes" listed species (defined as causing harm, harassing, or damaging habitat for the listed species). In addition, the National Marine Fisheries Service can levy penalties. All areas in Jefferson County are included as"critical habitat"for a listed species. Development of property along any marine shoreline, freshwater shoreline, or floodplains could harm habitat if protective measures are not taken. To minimize the potential to damage habitat, all property owners developing adjacent to marine shoreline, freshwater shoreline, or floodplains are advised to do the following: -All development activities should avoid unstable slopes, wetlands, and forested areas near surface waters - Remove minimal vegetation for site development, especially large trees -Allow trees that have fallen into surface waters to remain there - Infiltrate stormwater from buildings and driveways onsite through drywells rather than discharging directly into surface waters or roadside ditches The Federal Bald and Golden Eagle Protection Act requires landowners within 660 feet(1/8th of a mile)of an eagle nest to consult with the US Fish and Wildlife Service. This Eagle Act prohibits anyone from"taking" bald eagles. This federal law defines the term "take"and describes the possible legal consequences when a"take" occurs. Among other actions, "take" includes a disturbance of bald eagles or their habitat. Under federal law a permit may still be required for activities that impact bald eagles or their habitat. Contact the US Fish and Wildlife Service (http://www.fws.gov/pacific/eagle/)to learn more about how this law affects your project. Any individual, group, or agency can bring suit for a listed species"taking", even if you are in compliance with Jefferson County development codes. The risk of a lawsuit against you can be reduced by consulting with a professional fisheries habitat biologist, and following the recommendations for site development provided by the biologist. For more information, contact the National Marine Fisheries Service in Seattle, or the U.S. Fish and Wildlife Service. All of the vacations for Charles Street that I found were bound by Lot and Block calls(Resolutions 81-82[Lillian Street],55-93[Charles Street between Blocks 24 and 33]and 58-93[Charles Street between Lot 7 Block 25 and Lot 6 Block 32]. 2. This property is described as Parcel A but is actually two parcels(948603301 and 948603204) and needs to be described as Parcel A and Parcel B. 3. The North 15 feet of the South %of vacated Charles Street needs to be included. Property that lies under an easement is not removed from the ownership of the grantor. Mr. Loving is still the legal owner of the North 15 feet of the South%of vacated Charles Street. 4. A boundary line adjustment is required to move the lot lines. See note 6 in the Assessor's office comments The Assessor's office had the following comments: After reviewing this proposed action, I have the following comment(s): 1. I could find no documentation for the vacation of the intersection of Lillian Street and Charles Street. The only document I found for the vacation of Lillian Street excepted out the cross-streets (including Charles Street). All of the vacations for Charles Street that I found were bound by Lot and Block calls (Resolutions 81-82 [Lillian Street], 55-93 [Charles Street between Blocks 24 and 33] and 58-93[Charles Street between Lot 7 Block 25 and Lot 6 Block 32]. 2. This property is described as Parcel A but is actually two parcels (948603301 and 948603204) and needs to be described as Parcel A and Parcel B. 3. And since a new application to address the issue of the septic permit has been filed and the system is not actually be affected, only the reserve area, does Planning have to wait for clearance from them?....the ownership is not changing, the septic system is not changing ....the only change is to the assessor's tax identification number for the assemblage of the lots and their website notes to everyone that the tax number is not to be considered a legal description it is for tax purposes only Since Mr. Loving was not advised to consult with the Health Dept when he originally contacted the Planning Dept early last year, could not some consideration be allowed for this application since it was originally submitted in accordance with the instructions to Mr. Loving, although my package did contain the errors of the map not conforming to the legals. But as I indicated, the map and legals only had scrivener errors and were minor and are now corrected. If you could bring this issue up to your staff meeting and see if some special consideration could be made for this minor application, we would sincerely appreciate Planning Department re-evaluation of our position. No matter how old the permit it,the record drawing needs to be completed per JC code 8.15.110. see below. To designate a reserve area you need to do that through a permit application after you or a licensed designer has evaluated the holes for the area proposed and submitted the site plan and soil log information. Randy can then go look at the holes when he returns for verification that the soils and area are adequate. I think your bigger problem is minimum land area you better consult with a designer of your choice to review the code with them,in this regard. This error could have been corrected with a contingency of approval of the application rather than the denial e-mail from Health to the Planning Department. As soon as we know from the Health Department the criteria for a minimum lot size, we can address the issue of the undisclosed criteria that a lot line may not be moved. And if we cannot re-align the overall lot combinations as the lot lines now exist,then we will review the requirements for a Boundary Line application as you suggested. The current lot combination is for tax purposes which reflect the deeds. However, the Assessor can combine lot ownership in any configuration it desires for"tax purposes", which has no relevance to the legal description of the lots. However, if you are stating, Randy,that the Health Department cannot approve any lot re-orientation without further septic studies, then we are at an impasse we do not know who would be purchasing these lots or their future use someone could want to purchase a lot to be build a warehouse with no toilet facilities proposed which would then not require a septic field, which is not too farfetched?. I will attempt to provide clarification as you have requested below: 1) I am not aware of any lot certification instructions, regardless, if there are existing buildings, utilities and other improvements on a property that is made up of multiple lots and your proposal is to re-group the lots,then you need to show what you are asking us to approve. 2) Yes I did know there was an existing septic system to serve the existing plumbed building, I also assumed all parties were aware of its existence . You are correct that there are several ways to address the primary and reserve septic fields for this property and building. This needs to be a part of your proposal. You can't propose the existing reserve area to be separated from the building/permit it serves w/o addressing it. You will need to contact a septic system designer if you choose this path. 3) The lot segregation process does not assure that the resultant lots will meet minimum land area. Our office will always make a comment to this effect unless the lot size is lacre. Our office never approved the existing lots in their current configuration as buildable and the lot segregation process doesn't assure this either. If your goal is to be assured of meeting minimum and area for on-site sewage purposes then you will need to contact a septic system designer and apply for a "Boundary Line Adjustment." 4) My prior comment said another way is; our office will not approve any waivers for minimum land area for future applications involving these properties. I understand you are not applying for any waivers presently. You provided multiple pages of property descriptions befor and after using survey coordinates. Since no lots are being created and no property lines are being moved, Health would only comment on the issues that could arise if the applicant completes the "lot segregation" process. Health has reviewed a revised plot plan date stamped on 10/3/13 and a memo from Michael Anderson dated stamped 10/2/13. Health has the following comments regarding this revision to a Lot segregation application applied for under SUB13-00007. 1) The septic system permitted under SEP86-235 was designed and permitted on lots 3 through 10. Separating off any of these lots could limit future permits that utilize this septic system. 2) In addition to the above statement; separating off the reserve area from SEP86-235 w/o a legal easement will invalidate the septic permit. 3) The septic system file for SEP86-235 does not have an as-built,therefore,the exact location of the existing septic system is not known. The location show on the revised plot plan has not been verified by JCPH. 4) JCPH has not determined the suitability for development of any of the proposed lot configurations. Future approval of septic systems for any of these properties will need to meet the code in effect at that time,this includes among other things minimum land area. Please note that any future reviews of this project will require additional fees and will be billed on an hourly basis at$67 per hour(2013 rate.)
