Based on the findings, parcel number 901112001 can be considered two(2) separate parcel as described in the legal descriptions submitted with the application. 2.) To process this segregation, you will need to submit a wrttten request and a copy of the recorded survey to the Jefferson County Assessor's Office to have additional parcel numbers assigned. A copy of this permit will be forwarded to the Assessor's Office. Please contact the Jefferson County Assessor's Office (360-385-9105)with any questions regarding this process.. 3.) The survey and legal descriptions shall be recorded with Jefferson County Auditor's office. FINDINGS: 1.) The Administrator finds that this application complies with applicable provisions of the Unified Development Code, all other applicable ordinances and regulations, and is consistent with the Jefferson County Comprehensive Plan and Land Use map. 2.) As the Parcels are found exempt from RCW 58.17 and Jefferson County Code 18.35, a title report is not required. It is the property owners responsibility to identify and rectify any security interest conveyances, encumbrances, easements or restrictions affecting the subject properties involved in this county reviewed exemption. 3.) The proposal is found to be an exemption under Jefferson County Code(JCC) Section 18.35.040(4): (4) Divisions of land relating to the acquisition of a fee simple interest in land by public agencies, including, but not limited to, divisions made for road or public right-of-way conveyance or widening purposes. This exemption shall not be construed to include acquisitions of easements. 4.) On July 11, 2012, Sherrie Shold's in the Assessor's Office commented as follows: I have reviewed the survey and have no additional comments. 5.) On July 9, 2012, Pat Perry man in the Assessor's GIS department commented as follows: I had no problems with this lot certification survey. 6.) The parcel has been designated as urban low density residential ULDR 4-6 under the Jefferson County Comprehensive Land Use Map effective August 28, 1998 as amended on March 23, 2099 per ordinance No. 03-0323-09. The parcel transitional zoning is rural residential 1-10 RR 1:10. Jefferson County will apply transitional rural zoning on parcels that do not yet have sewer available. 7.) The application was reviewed by the Jefferson County Department of Community Development staff on 7-13-2012 for the potential presence of Environmentally Sensitive Areas (ESAs) under the provisions of the Unified Development Code (UDC). After an initial Geographic Information Systems mapping review, the following ESAs were confirmed to be present on the subject property: seismic hazard, wetlands, special aquifer recharge protection areas and susceptible aquifer recharge areas. 8.) NOTICE: This permit does not excuse the proponent from complying with other local, state, and federal ordinances, regulations, or statutes applicable to the proposed development, but consistent with RCW 90.58. Development pursuant to this permit shall be undertaken subject to the applicable policies and performance standards of the Jefferson County Shoreline Management Master Program and the Jefferson County Unified Development Code. If during excavation or development of the site an area of potential archaeological significance is uncovered, all activity in the immediate area shall be halted, and the Administrator shall be notified at once. The Federal Endangered Species Act rules to protect threatened Chinook and Summer-run Chum salmon became effective on January 8, 2001. Bull trout have been listed as threatened since early 2000. Under the ESA, any person may bring lawsuit against any individual or agency that"takes" listed species(defined as causing harm, harassing, or damaging habitat for the listed species). In addition, the National Marine Fisheries Service can levy penalties. All areas in Jefferson County are included as"critical habitat" for a listed species. Development of property along any marine shoreline, freshwater shoreline, or floodplains could harm habitat if protective measures are not taken. To minimize the potential to damage habitat, all property owners developing adjacent to marine shoreline, freshwater shoreline, or floodplains are advised to do the following: -All development activities should avoid unstable slopes, wetlands, and forested areas near surface waters - Remove minimal vegetation for site development, especially large trees -Allow trees that have fallen into surface waters to remain there - Infiltrate stormwater from buildings and driveways onsite through drywells rather than discharging directly into surface waters or roadside ditches The Federal Bald and Golden Eagle Protection Act requires landowners within 660 feet(1/8th of a mile)of an eagle nest to consult with the US Fish and Wildlife Service. This Eagle Act prohibits anyone from "taking" bald eagles. This federal law defines the term "take" and describes the possible legal consequences when a"take" occurs. Among other actions, "take" includes a disturbance of bald eagles or their habitat. Under federal law a permit may still be required for activities that impact bald eagles or their habitat. Contact the US Fish and Wildlife Service (http://www.fws.gov/pacific/eagle/)to learn more about how this law affects your project. Any individual, group, or agency can bring suit for a listed species"taking", even if you are in compliance with Jefferson County development codes. The risk of a lawsuit against you can be reduced by consulting with a professional fisheries habitat biologist, and following the recommendations for site development provided by the biologist. For more information, contact the National Marine Fisheries Service in Seattle, or the U.S. Fish and Wildlife Service. The application was reviewed by Jefferson County Permit Center staff on 04/20/95 for the potential presence of critical areas regulated under the provisions of the Ordinance, and the following critical areas were confirmed as potentially present on the subject property: wetlands. 2.) Acting upon the above information, Jefferson County staff conducted a site inspection of the subject property on 05/04/95 and confirmed the existence of the following critical areas and/or their associated buffers on the property: wetlands. 3.) County staff visted subject parcel on 05/04/95 as part of a routine site inspection to determine the suitability of on-site sewage disposal. The subject parcel is 15.93 acres and contains a small portion of a large Class II wetland, most of which lies off-site to the north. Class II wetlands require a minimum buffer of 50 feet for low-intensity land use. Applicant's proposed development lies well outside of the minimum required buffer. 4.) A setback of 50 feet, measured perpendicularly from the wetland edge, shall be permanently maintained as a buffer. No filling, grading, clearing or other alteration of the wetland or its buffer is allowed without permission from the US Army Corps of Engineers. 5.) No alteration shall be made to the wetland or its buffer without prior authorization by the Critical Area Administrator. Buffer enhancement is allowed as long as native species are selected for planting. 6.) The proposed development shall be located on the subject property exactly as identified on the Universal Plot Plan, or other Site Plan, approved by the County as part of the triggering permit application. Applicant shall be responsible for contacting and notifying contractor(s) of the above conditions in order to ensure compliance at various stages of construction/development. This waiver is valid for both the current septic permit and a future building permit as long as the above conditions are met.
