After an initial Geographic Information Systems mapping review and an investigative site inspection, the following ESAs were confirmed to be present on the subject property: Shoreline Designation: Conservancy, Shoreline Slope Stability: Unstable and Unstable Recent Slide, Stream: Type F and Type Np, Fish and Wildlife Habitat Conservation Area (FWHCA), Landslide Hazard Area: Moderate& High, Susceptible Aquifer Recharge Area (SUSC), Coastal Seawater Intrusion Protection Zone. 2.) The parcel was developed with a single-family residence prior to a county adopted Critical Area Ordinance. Aerial photographs from 1977 show the single-family residence, lawn and boat ramp. RCW 36.70A.480 allows an existing use or structure to be redeveloped or modified provided a)the redevelopment or modification is consistent with the local government's master program; and b) the local government determines that the proposed redevelopment or modification will result in no net loss of shoreline ecological functions. On April 26, 2012 the applicant submitted a special report demonstrating the upgraded and expanded septic system meets no net loss of shoreline ecological functions. 3.) Geologically HazardousAreas in Jefferson County are characterized by slope, soil type, geologic material, and groundwater that may combine to create problems with slope stability, erosion, and water quality during and after construction or during natural events such as earthquakes or severe rainstorms. 4.) The geotechnical report prepared by Stratum Group dated April 1, 2011 and submitted on September 15, 2011 concludes the following: We conclude that there are no risks of landslides within the proposed septic drainfield area or along the proposed septic line route. Construction of the septic drainfield and septic line will not increase the risk of landslides on or outside the proposed improvement areas. 5.) Susceptible Aquifer Recharge Areas are those with geologic and hydrologic conditions that promote rapid infiltration of recharge waters to groundwater aquifers. 6.) A Type F and Type Np Streams (Fish and Wildlife Habitat Conservation Area) have been identified on the subject property. The streams will require a buffer of 150-feet and 75 ft respectively. The buffers shall be measured horizontally from the Ordinary High Water Mark(OHWM). Fish and Wildlife Habitat Areas shall also have Buffers and Building Setbacks established. 7.) Buffers are areas that shall be maintained in their natural condition, however, minor pruning or alteration of vegetation may be permitted as long as the function and character of the buffer are not diminished. 8.) The parcel is located within a coastal SIPZ(seawater intrusion protection zone) according to the County GIS map. There are voluntary and mandatory measures identified in the Jefferson County Seawater Intrusion Policy(Resolution 44-22, effective September 23, 2002)that apply to well drilling proposals and building permit applications on existing lots of record. A Coastal SIPZ is defined as: all islands and area within one-quarter mile of marine shoreline, but no history of chloride concentration above 100 mg/L in groundwater sources within 1000 feet. 9.) The project shall adhere to the Best Management Practices (BMPs) to control stormwater, erosion and sediment during construction. BMPs shall address permanent measures to stabilize soil exposed during construction, and in the design and operation of stormwater and drainage control systems. 10.) The Federal Endangered Species Act rules to protect threatened Chinook and Summer-run Chum salmon became effective on January 8, 2001. Bull trout have been listed as threatened since early 2000. Under the ESA, any person may bring lawsuit against any individual or agency that"takes" listed species (defined as causing harm, harassing, or damaging habitat for the listed species). In addition, the National Marine Fisheries Service can levy penalties. All areas in Jefferson County are included as"critical habitat" for a listed species. Development of property along any marine shoreline, freshwater shoreline, or floodplains could harm habitat if protective measures are not taken. To minimize the potential to damage habitat, all property owners developing adjacent to marine shoreline, freshwater shoreline, or floodplains are advised to do the following: -All development activities should avoid unstable slopes, wetlands, and forested areas near surface waters - Remove minimal vegetation for site development, especially large trees -Allow trees that have fallen into surface waters to remain there - Infiltrate stormwater from buildings and driveways onsite through drywells rather than discharging directly into surface waters or roadside ditches The Federal Bald and Golden Eagle Protection Act requires landowners within 660 feet (1/8th of a mile) of an eagle nest to consult with the US Fish and Wildlife Service. This Eagle Act prohibits anyone from "taking" bald eagles. This federal law defines the term "take" and describes the possible legal consequences when a "take" occurs. Among other actions, "take" includes a disturbance of bald eagles or their habitat. Under federal law a permit may still be required for activities that impact bald eagles or their habitat.
