A permanent physical separation along the upland boundary of the wetland buffer area shall be installed and permanently maintained. Such separation can include installing logs, trees, a hedgerow, or any other prominent physical marking approved by the UDC Administrator. 4.) The project shall adhere to the Best Management Practices (BMPs) to control stormwater, erosion and sediment during construction. BMPs shall address permanent measures to stabilize soil exposed during construction, and in the design and operation of stormwater and drainage control systems. 5.) The project shall comply with Construction Stormwater Pollution Prevention (SWPP) Elements#1 through #12 of the Department of Ecology's Stormwater Management Manual for Western Washington to control stormwater, erosion and sediment during construction. BMPs shall address permanent measures to stabilize soil exposed during construction, and in the design and operation of stormwater and drainage control systems. 6.) Stormwater shall be retained and infiltrated on site. The owner shall control all sedimentation and erosion on the property. 7.) Outdoor residential storage shall be maintained in an orderly manner and shall create no fire, safety, health or sanitary hazard. 8.) Not more than two (2) unlicensed or inoperable vehicles shall be stored on any lot less than one-half acre unless totally screened from view of neighboring dwellings and rights-of-way. Such screening shall meet all applicable performance and development standards specific to the district in which the storage is kept, and shall be in keeping with the character of the area. Screening shall meet the requirements of Unified Development Code (UDC) Section 6. Outdoor storage of thirteen (13) or more unlicensed or inoperable vehicles is prohibited except in those districts where specified as an automobile wrecking yard or junk (or salvage) yard and allowed as a Permitted Use in Table 3-1 of the UDC, and such storage shall meet the requirements of UDC Section 4.10. In no case, shall any such unlicensed or inoperable vehiclesbe stored in an Environmentally Sensitive Area (ESA). 9.) Maximum lot coverage is not to exceed 25%. Lot coverage is defined as amount of impervious surface which includes roof tops, driveways, concrete, etc. 10.) The building height is not to•exceed 35 feet. 11.) Exterior lighting for residential uses shall not exceed twenty feet(20') in height from the finished grade, excepting when such lighting is an integral part of a building or structure. Ground level lighting is encouraged. 12.) Lighting fixtures shall be designed and hooded to prevent the light source from being directly visible from outside the boundaries of the property. The intensity or brightness of all lighting, during construction and after project completion shall not adversely affect the use of surrounding properties or adjoining rights-of-way. 13.) Setback from Blossom Lane right-of-way is no less than 20 ft., side and rear setbacks are no less than 5 ft. If I I an environmentally sensitive area (ESA) is present,then the more restrictive setback shall apply. 14.) A minimum of two (2) on-site parking spaces is required for each single-family residence on the parcel. FINDINGS: 1.) The Administrator finds that this application complies with applicable provisions of the Unified Development Code, all other applicable ordinances and regulations,and is consistent with the Jefferson County Comprehensive Plan and Land Use map. 2.) A letter dated January 6, 2006 from Wiltermood Associates, Inc.was submitted in conjunction with the application to address the wetland on this parcel. The letter states the wetland is a Category III which requires a 75 ft. setback to qualify for a waiver from a full wetland delineation. The letter states the wetland is approximately 222 feet from the proposed building site. Based on this letter staff concludes this project does not require a wetland delineation. 3.) The application was reviewed by the Jefferson County Department of Community Development staff on December 14, 2005 for the potential presence of Environmentally Sensitive Areas (ESAs) under the provisions of the Unified Development Code (UDC). After an initial Geographic Information Systems mapping review,the following ESAs were confirmed to be present on the subject property: Wetlands. 4.) The applicant is proposing to create or add 1,996 square feet of impervious surface and 2,400 square feet of land disturbing activities. Sections 6.6 and 6.7 of the Jefferson County Unified Development Code requires that your proposal comply with Minimum Requirement#2 (Construction Stormwater Pollution Prevention) of the Department of Ecology Stormwater Management Manual for Western Washington to control stormwater, erosion and sediment during construction. BMPs shall address permanent measures to stabilize soil exposed during construction, and in the design and operation of stormwater and drainage control systems. 5.) Jefferson County determined that this proposal is categorically exempt from review under the State Environmental Policy Act (SEPA) pursuant to WAC 197-11-800(1)(b)(i). 6.) The revised site plan as submitted on January 26, 2006 has been reviewed for consistency under the UDC, and has been approved by Jefferson County Department of Community Development. Any modifications, changes, and/or additions to the stamped, approved site plan dated January 26, 2006 shall be resubmitted for review and approval by Jefferson County Department of Community Development. 7.) This approval is for a Accessory Dwelling Unit only. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits. 8.) This is a legal non-conforming parcel designated as Rural Residential 1:20 under the Jefferson County Comprehensive Plan Land Use Map effective August 28, 1998. 9.) This parcel is served by a two party individual well. P Y P Y 10.) A septic permit (SEP05-00710) was approved February 2, 2006 for a capacity of 240 gallons per day. 11.) Blossom Lane (P539) is a private local access road. A road approach is not required and an address of 603-A Blossom Lane has been assigned to the Accessory Dwelling Unit and 603 Blossom Lane has been assigned to the main residence. 12.) This parcel was created through a survey under AFN 350792, recorded June 17, 1992, Volume 13, page 217 with the Jefferson County Auditor's office. NOTICE: This permit does not excuse.the proponent from complying with other local, state, and federal ordinances, regulations,or statutes applicable to the proposed development. Development pursuant to this permit shall be undertaken subject to the applicable development and performance standards of the Jefferson County Unified Development Code. If during excavation or development of the site an area of potential archaeological significance is uncovered, all activity in the immediate area shall be halted, and the Administrator shall be notified at once. The Federal Endangered Species Act rules to protect threatened Chinook and Summer-run Chum salmon became effective on January 8,2001. Bull trout have been listed as threatened since early 2000. Under the ESA,any person may bring lawsuit against any individual or agency that"takes" listed species (defined as causing harm, harassing, or damaging habitat for the listed species). In addition,the National Marine Fisheries Service can levy penalties. All areas in Jefferson County are included as "critical habitat"for a listed species. Development of property along any marine shoreline,freshwater shoreline, or floodplains could harm habitat if protective measures are not taken. To minimize the potential to damage habitat,all property owners developing adjacent to marine shoreline,freshwater shoreline,or floodplains are advised to do the following: - Set back buildings, utilities and roads as far as possible from surface waters(streams, rivers, lakes, marine waters),or at least 150 feet from the edge of the water -All development activities should avoid unstable slopes,wetlands, and forested areas near surface waters - Remove minimal vegetation for site development, especially large trees -Allow trees that have fallen into surface waters to remain there - Infiltrate stormwater from buildings and driveways onsite through drywells rather than discharging directly into surface waters or roadside ditches Any individual, group, or agenc •can bring suit for a listed species"taking," even if you are in compliance with Jefferson County development codes. The risk of a lawsuit against you can be reduced by consulting with a professional fisheries habitat biologist, and following the recommendations for site development provided by the biologist. I am following up on an additional information request sent on December 21 , 2005. I've received the wetland information and I still need the site plan that is drawn to scale. The large site plan attached to the building plans looks like it is drawn to scale. The reduced size (11 x 17) site plan that was submitted on November 14 and routed to me is not to scale. Unfortunately, we can not make oversized copies. Please submit at least two more full size site plans OR one reduced site plan that has the correct scale. There are only two reviews left for this permit -- my review and septic review. Once I receive the site plan I will be able to complete my review. Please let me know if you have questions. Thank you. The following information is needed to continue review of your project 1) The scale on the submitted site plan shows 1"=30'-0". However, when I use this scale the distances do not work out. Please submit a new site plan with an accurate scale. 2) On the revised site plan show the distance from the edge of the wetland to the deck. 3) Please provide a wetland delineation report so we may determine the standard setback from the edge of the wetland. To qualify for a waiver from submitting the wetland delineation report a setback of 225 feet is required from the estimated wetland boundary to the proposed residence. If you can not meet the standard setback you will be required to submit a formal buffer enhancement plan developed by a qualified professional. Wetland delineation reports shall be prepared by either a biologist with wetlands expertise, or an individual or firm who has been certified by the United States Army Corps of Engineers, Region 10, to perform wetland delineations. (Tax Parcel No. 001202014) Dear Randy, This letter is a summary of a site visit conducted by biologist, Mudra Bergan on January 5, 2006. The purpose of the site visit was to determine the category of a known on site wetland and to verify the distance from the wetland edge to the edge of a proposed ADU building site. The categorization of the wetland was necessary to determine whether or not a wetland delineation and analysis letter will be necessary or will be waived under Section 3-3 of the Jefferson County Critical Area ordinance. The determination was conducted using the Department of Ecology, Washington State Wetlands Identification and Delineation Manual (Publication #96-74), as required by the Jefferson County Critical Areas Ordinance. This manual utilizes the three parameter methodology to determine the presence or absence of wetlands. The three • parameters of wetland hydrology, hydric soil, and hydrophytic vegetation and positive indicators of all three wetland parameters must be present for an area under normal circumstances to be considered a wetland. The use of this manual and the three wetland parameter methodology on this parcel revealed that the site is under normal circumstances and that there is one Category III wetland present near the southwest corner of the lot. The wetland is located —222 feet from the proposed building site. (Tax Parcel No. 001202014) Dear Randy, This letter is a summary of a site visit conducted by biologist, Mudra Bergan on January 5, 2006. The purpose of the site visit was to determine the category of a known on site wetland and to verify the distance from the wetland edge to the edge of a proposed ADU building site. The categorization of the wetland was necessary to determine whether or not a wetland delineation and analysis letter will be necessary or will be waived under Section 3-3 of the Jefferson County Critical Area ordinance. The determination was conducted "icing the Department of Ecology, Washington State Wetlands Identification and Delineation Manual (Publication #96-74), as required by the Jefferson County Critical Areas Ordinance. This manual utilizes the three parameter methodology to determine the presence or absence of wetlands. The three parameters of wetland hydrology, hydric soil, and hydrophytic vegetation and positive • indicators of all three wetland parameters must be present for an area under normal circumstances to be considered a wetland. The use of this manual and the three wetland parameter methodology on this parcel revealed that the site is under normal circumstances and that there is one Category III wetland present near the southwest corner of the lot. The wetland is located —222 feet from the proposed building site. Since the wetland has been determined to be a Category III and it is over 75 feet from the wetland edge to the building site, a full wetland delineation and special report will not be required. w 1015 S.W.
