CONDITIONS: 1.) As the Parcels are found exempt from RCW 58.17 and Jefferson County Code 18.35, a title report is not required. It is the property owner's responsibility to identify and rectify any security interest, conveyances, encumbrances, easements or restrictions affecting the subject properties involved in this county reviewed exemption. 2.) Parcel numbers are assigned upon recording of Statement of Intent. 3.) The Lot Certification Statement of Intent shall be recorded with Jefferson County Auditor's Office. 4.) To process this segregation, you will need to submit a written request and a copy of the recorded legal descriptions to the Jefferson County Assessor's Office to have additional parcel numbers assigned. A copy of this permit will be forwarded to the Assessor's Office. Please contact the Jefferson County Assessor's Office (360-385-9105)with any questions regarding this process. FINDINGS: 1.) The Administrator finds that this application complies with applicable provisions of the Unified Development Code, all other applicable ordinances and regulations,and is consistent with the Jefferson County Comprehensive Plan and Land Use map. 2.) The application was reviewed by the Jefferson County Department of Community Development staff on March 12, 2015 for the potential presence of Environmentally Sensitive Areas (ESAs) under the provisions of the Unified Development Code (UDC). After an initial Geographic Information Systems mapping review and an investigative site inspection, the following ESAs were confirmed to be present on the subject property:fish habitat streams, wetlands, geologically hazardous area, FEMA flood area, aquifer recharge area, and fish and wildlife conservation area. 3.) Jefferson County determined that this proposal is categorically exempt from review under the State Environmental Policy Act(SEPA) pursuant to WAC 197-11-800(6)(a). 4.) This approval is for a Lot Certification for a road segregation of one parcel into two parcels only. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits. 5.) This determination does not guarantee an ability to develop the parcels. All development shall comply with the on-site sewage code, the building codes and local development regulations in effect at the time of application, 6.) The parcel has been designated as Commerical Agriculture(AP-20) under the Jefferson County Comprehensive Land Use Map effective August 28, 1998. • 7.) Based on the findings, parcel number 901352004 can be considered two (2)separate parcel as described in the legal descriptions submitted with the application. This approval is for a lot certification/road segregation only Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits. 8.) RCW 58.17 requires regulation of the division of and and was passed in 1969. 9.) The proposal is found to be an exemption under Jefferson County Code(JCC) Section 18.35.040(4): (4) Divisions of land relating to the acquisition of a fee simple interest in land by public agencies, including, but not limited to, divisions made for road or public right-of-way conveyance or widening purposes. This exemption shall not be construed to include acquisitions of easements. 10.) Contact the Jefferson county Environmental Health Department at (360) 379-9444 to determine potential limitations with regard to wells and on-site sewage requirements. 11.) On April 16, 2015 Mara Dotson from Public Works commented as follows: After a review of the Department of Public Works records, with regards to the above request, our records indicate the following: "This section of Center Road was established on December 6th 1922 by Permanent Highway 4D Extension Project. This portion was deeded by Thos &Josephine Yarr of Chimacum, WA. On January 3rd 1923 by Quite Claim Deed recorded in Volume 1 of Waivers Page 237, AFN49781. The old alignment and current alignment of the road are both shown on the 1915 Road Log Map. The right of way is 60 feet. The County Road Log indicateds that this road is 15.01 miles long." 12.) NOTICE: This permit does not excuse the proponent from complying with other local, state, and federal ordinances, regulations, or statutes applicable to the proposed development, but consistent with RCW 90.58. Development pursuant to this permit shall be undertaken subject to the applicable policies and performance standards of the Jefferson County Shoreline Management Master Program and the Jefferson County Unified Development Code. If during excavation or development of the site an area of potential archaeological significance is uncovered, all activity in the immediate area shall be halted, and the Administrator shall be notified at once. The Federal Endangered Species Act rules to protect threatened Chinook and Summer-run Chum salmon became effective on January 8, 2001. Bull trout have been listed as threatened since early 2000. Under the ESA, any person may bring lawsuit against any individual or agency that"takes" listed species (defined as causing harm, harassing, or damaging habitat for the listed species). In addition, the National Marine Fisheries Service can levy penalties. Portions of Jefferson County, including marine environments are included as "critical habitat"for listed species. Development of property along any marine shoreline, freshwater shoreline, or floodplains could harm habitat if protective measures are not taken. To minimize the potential to damage habitat, all property owners developing adjacent to marine shoreline,freshwater shoreline, or floodplains are advised to do the following: -All development activities should avoid unstable slopes, wetlands, and forested areas near surface waters - Remove minimal vegetation for site development, especially large trees -Allow trees that have fallen into surface waters to remain there - Infiltrate stormwater from buildings and driveways onsite through drywells rather than discharging directly into surface waters or roadside ditches The Federal Bald and Golden Eagle Protection Act requires landowners within 660 feet(1/8th of a mile)of an eagle nest to consult with the US Fish and Wildlife Service. This Eagle Act prohibits anyone from "taking" bald eagles. This federal law defines the term "take"and describes the possible legal consequences when a "take" occurs. Among other actions, "take" includes a disturbance of bald eagles or their habitat. Under federal law a permit may still be required for activities that impact bald eagles or their habitat. Contact the US Fish and Wildlife Service (http://www.fws.gov/pacific/eagle/)to learn more about how this law affects your project. Any individual, group, or agency can bring suit for a listed species "taking", even if you are in compliance with Jefferson County development codes. The risk of a lawsuit against you can be reduced by consulting with a professional fisheries habitat biologist, and following the recommendations for site development provided by the biologist. For more information, contact the National Marine Fisheries Service in Seattle, or the U.S. Fish and Wildlife Service. Department of Community Development commented as follows: For both lot certification proposals the following information is needed: Under the legal descriptions for the current parcel and revised parcels on the Statement of Intent, in addition to the see attached, the parcel number needs to be at the beginning of the description and a brief legal description (this could just be the Section, Township, and Range) is required to be recorded by the Auditor's Office. Also the Grantor and Grantee (need to be the same of the current property owners) is needed. Prior to the approval of this application all property taxes for the year must be paid in full. Records indicate that property taxes are still due on parcel number 901341005. I have received the signed permit application for SUB15-00004 (parcel number 901352004) from Mr. Neudorfer and the notarized statement of intent from Merrill and Ring. However, I still need a signed permit application for SUB15-00005 (parcel number 901341005) from Merrill and Ring Forest Products as they are the property owner. I have enclosed the permit application in this letter. Please have the appropriate person sign the permit application and return it to me. Our records indicate that this property has been sold to Merrill and Ring Forest Products since the application for this lot certification/road segregation was submitted. The property owner, being Merrill and Ring Forest Products, will need to need to compete the permit application and sign it in the places which I have highlighted to authorize this permit application and the changes being made to their property. If Merrill and Ring Forest Products would like you to remain the representative for this permit application, they can authorize this on the permit application under the designation of agent section. In addition, the signature page of the Statement of Intent will be need a notarized signature by Merrill and Ring Forest Products. The same legal descriptions as submitted with the application may be used for the Statement of Intent. As the road segregation of these parcels is a County road, Jefferson County Department of Public Works (who has jurisdiction over County roads)will also be reviewing and commenting on the proposal. Because of this, there is a $48.00 fee for Public Works review. This fee should have been charged at the time of the submittal of the permit applications but was missed. Therefore, enclosed are two$48.00 invoices, one for each lot certification. The required information which I have requested above is needed to continue processing these permits.
