JEFFERSON COUNTY DEPARTMENT OF COMMUNITY DEVELOPMENT UNIFIED DEVELOPMENT CODE TYPE I LAND USE PERMIT SHORELINE SUBSTANTIAL DEVELOPMENT PERMIT EXEMPTION WASHINGTON STATE SHORELINE MANAGEMENT ACT(RCW 90.58) PROPONENT: JEFFERSON COUNTY PUBLIC WORKS 623 SHERIDAN STREET PORT TOWNSEND WA 98368 DATE ISSUED: June 15, 2015 DATE EXPIRES: June 15, 2016 MLA NUMBER: MLA15-00032 CASE NUMBER:SDP15-00010 PROJECT PLANNER: Anna Bausher PROJECT DESCRIPTION: Shoreline Exemption for maintenance to Dosewallips Road. Project will cut logs in an existing log jam into 20 foot sections, all woody debris will continue to remain in place once cut, none will be removed. This will open up the overflow channel of the river and reduce the amount of pressure on the road embankment, avoiding further damage to the Dosewallips Road. WATERBODY AND/OR ASSOCIATED WETLANDS: DOSEWALLIPS RIVER PROJECT LOCATION: Section: 29, Township: 26N, Range: 2W; Located at: Mile Post 3.25 of Dosewallips Road. FINDINGS: 1.) The Administrator finds that this application complies with applicable provisions of the Unified Development Code, all other applicable ordinances and regulations, and is consistent with the Jefferson County Comprehensive Plan and Land Use map. 2.) The application was reviewed by the Jefferson County Department of Community Development staff on June 8, 2015 for the potential presence of Environmentally Sensitive Areas (ESAs) under the provisions of the Unified Development Code(UDC). After an initial Geographic Information Systems mapping review and an investigative site inspection, the following ESAs were confirmed to be present on the subject property: fish and wildlife conservation area, natural and priority aquatic shoreline, wetlands, geologically hazardous area, FEMA flood area, susceptible aquifer recharge area, and channel migration zone. 3.) Aquifer Recharge Areas in Jefferson County are characterized by porous geological formations that allow percolation of the surface water into the soils and the underlying zone of saturation. Aquifers are geologic formations that contain sufficient saturated permeable material to yield significant quantities of water to wells and springs. Aquifers serve as the source of drinking water within most of the rural portions of Jefferson County. 4.) Susceptible Aquifer Recharge Areas are those with geologic and hydrologic conditions that promote rapid infiltration of recharge waters to groundwater aquifers. 5.) Jefferson County has determined that the use of real property for agriculture and forestry operations is a high priority and favored use in the county. The county will not consider to be a nuisance those inconveniences or discomforts arising from such operations, if such operations are consistent with commonly accepted best management practices in compliance with local, state, and federal laws. If your real property includes or is within five hundred (500)feet of real property designated as Rural Residential 1:10 or 1:20, Rural Industrial, Rural Commercial, Agriculture, or Forestry, you may be subject to inconveniences or discomforts arising from such farming and forestry operations, including but not limited to noise, tree removal, odors, flies, fumes, dust, smoke, the operation of farm and forestry machinery during any 24-hour period, the storage and disposal or manure, and the application of permitted fertilizers and permitted pesticides. One or more of these inconveniences may occur as a result of agricultural and forestry operations which are in conformance with existing laws and regulations. 6.) Jefferson County determined that this proposal is categorically exempt from review under the State Environmental Policy Act(SEPA) pursuant to WAC 197-11-800(3). 7.) This approval is for a shoreline exemption permit for maintenance of an existing right-of-way(Dosewallips Road) only by cutting logs in an existing log jam into 20 foot sections to open side channel and reduce the amount of pressure on the road embankment. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits. 8.) The Development Review Division finds that this proposal is consistent with Shoreline Master Program Section 18.25.560(2)and is consequently exempt from the substantial development permit(SDP)requirements. Exemptions from the substantial development permit requirements do not exempt a proposed development from compliance with the applicable policies and standards of the Shoreline Master Program or other applicable Federal, State, or local permit or license requirements. 9.) This proposal meet the critical area ordiance exemption for maintenance and reconstruction as found in JCC 18.22.070(3). 10.) Per the decision of the administrator, this proposal does not meet the definition of development under JCC 15.15 and therefore is not subject to review and compliance of JCC 15.15 Flood Damage Prevention and FEMA flood area development regulations. 11.) The site plan as submitted with the shoreline exemption application on June 2, 2015 has been reviewed for consistency under the UDC, and has been approved by Jefferson County Department of Community Development. Any modifications, changes, and/or additions to the stamped, approved site plan dated June 15, 2015 shall be resubmitted for review and approval by Jefferson County Department of Community Development. 12.) The proposed project will be conducted within the Dosewallips River. This segment of the Dosewallips River is a Type S water, which is a shoreline of the state. The Shoreline environmental designations are "Priority Aquatic" and "Natural". 13.) NOTICE: This permit does not excuse the proponent from complying with other local, state, and federal ordinances, regulations, or statutes applicable to the proposed development, but consistent with RCW 90.58. Development pursuant to this permit shall be undertaken subject to the applicable policies and performance standards of the Jefferson County Shoreline Management Master Program and the Jefferson County Unified Development Code. If during excavation or development of the site an area of potential archaeological significance is uncovered, all activity in the immediate area shall be halted, and the Administrator shall be notified at once. The Federal Endangered Species Act rules to protect threatened Chinook and Summer-run Chum salmon became effective on January 8, 2001. Bull trout have been listed as threatened since early 2000. Under the ESA, any person may bring lawsuit against any individual or agency that"takes" listed species (defined as causing harm, harassing, or damaging habitat for the listed species). In addition, the National Marine Fisheries Service can levy penalties. Portions of Jefferson County, including marine environments are included as "critical habitat"for listed species. Development of property along any marine shoreline, freshwater shoreline, or floodplains could harm habitat if protective measures are not taken. To minimize the potential to damage habitat, all property owners developing adjacent to marine shoreline, freshwater shoreline, or floodplains are advised to do the following: -All development activities should avoid unstable slopes, wetlands, and forested areas near surface waters - Remove minimal vegetation for site development, especially large trees -Allow trees that have fallen into surface waters to remain there - Infiltrate stormwater from buildings and driveways onsite through drywells rather than discharging directly into surface waters or roadside ditches The Federal Bald and Golden Eagle Protection Act requires landowners within 660 feet(1/8th of a mile)of an eagle nest to consult with the US Fish and Wildlife Service. This Eagle Act prohibits anyone from "taking" bald eagles. This federal law defines the term "take" and describes the possible legal consequences when a "take" occurs. Among other actions, "take" includes a disturbance of bald eagles or their habitat. Under federal law a permit may still be required for activities that impact bald eagles or their habitat. Contact the US Fish and Wildlife Service(http://www.fws.gov/pacific/eagle/)to learn more about how this law affects your project. Any individual, group, or agency can bring suit for a listed species "taking", even if you are in compliance with Jefferson County development codes. The risk of a lawsuit against you can be reduced by consulting with a professional fisheries habitat biologist, and following the recommendations for site development provided by the biologist. For more information, contact the National Marine Fisheries Service in Seattle, or the U.S. Fish and Wildlife Service. CONDITIONS: 1.) Landslide Hazard Areas and their associated buffers shall remain naturally vegetated. Should buffer disturbance occur during construction,the Unified Development Code(UDC)Administrator shall require replanting with native vegetation. No alterations shall be made to the Landslide Hazard Area or its associated buffer without prior authorization by the UDC Administrator. 2.) Critical Aquifer Recharge Areas may require special protection measures to mitigate water quality degradation. The submitted proposal does not require additional aquifer protection measures. However, during construction the project shall follow the Best Management Practices (BMPs)and facility design standards as identified and defined in the Stormwater Management Manual for the Puget Sound Basin. 3.) The project shall adhere to the Best Management Practices(BMPs)to control stormwater, erosion and sediment during construction. BMPs shall address permanent measures to stabilize soil exposed during construction, and in the design and operation of stormwater and drainage control systems. 4.) Work within the jurisdiction of the Shoreline Master Program other than as described above shall receive separate review from this Department. 5.) The development shall be essentially the same as the original in location, size, configuration, and external appearance. 6.) Substantial progress towards completion of the project shall be performed within two years of the issuance of the permit. 7.) No fill or other material may be placed in the waters or intertidal areas of Jefferson County. 8.) Prior to commencing development activity, proponent is responsible for informing the Washington Department of Fish and Wildlife(WDFW)in order for WDFW to determine whether this action is subject to the Washington State Hydraulic Code(Chapter 220-10 WAC). Hydraulic Project Approval (HPA)is required for all hydraulic projects, which are defined as construction or performance of other work that will use,divert, obstruct, or change the natural flow or bed of any of the salt or fresh waters of the state. 9.) Prior to commencing development activity, the proponent is responsible for informing the US Army Corps of Engineers(COE)in order for COE to determine whether a Department of the Army permit or review is required. Generally, review is required for construction and dredging in or around navigable waters of the US and for work or fill in hydrologically connected wetlands. We would like to cut up the log jam before next winter to maybe avoid more damage to the road. WDFW has agreed to write a permit, but apparently their HPA application requires the applicant to indicate whether SEPA has been completed or is necessary. The property owners have indicated support for this effort. Work to repair the slide was done under an emergency declaration last winter. Cutting up the log jam is not an emergency if it can be completed before this coming winter(say Sept 151. I also included a couple of photos of last winter just for context of the slide damage and repair work. Thanks for discussing this with your group. Will look to hear from you next week. Proposal: Per on-site discussion with Area Habitat Biologist Margaret Bigelow on 2/12/15, applicant will saw logs into 20-foot lengths as indicated on subsequent photo and leave them in place. This will allow future high flows to move the wood,thereby opening up more area for an overflow channel and taking pressure off the road embankment. Prior to December 2014 storms,the main channel occupied the area where the log jam now sits and the area behind it (above it in the photo). Slides upstream mobilized significant quantities of wood and gravel which deposited here shifting the river over some 30 feet towards the road and undercutting the embankment. This set off a large landslide which closed one lane of the road and cost approximately$100,000 to repair. I understand that you have been in contact with the Department of Fish and Wildlife regarding an HPA for the project. Have you contacted or received any other comments or permits from other agencies which may have jurisdiction? I have attached the emergency HPA for the repair done last winter which is complete. I have also attached the HPA recently received for cutting up of the log jam. A JARPA is needed for the project, please submit a copy of the JARPA to DCD. If you have not yet completed a JARPA for the HPA, I can provide the application to you if do not have it. We applied to DCD for a permit to cut up logs in the river. A JARPA is not required for this activity and WDFW does not use the JARPA process anymore. They use their on line APPS system which is how we got our HPA. Since we are not doing any work below the Ordinary High Water, are not placing any fill, or doing any excavating, no other permits are necessary in our opinion. In addition, is there a site plan/design drawing and description of the repair that has been done on the road? It appears from one of the photos that geotextile was placed on the embankment of the river where the repair was done. Was this area (or will it be) hydro seeded or re-vegetated in any way? The area was seeded and trees planted in accordance with our HPA. The application sent to DCD is for work related to cut up the log jam and is unrelated to the work done to restore the slide area last winter under the emergency declaration.
