CONDITIONS:
1.) Parcel numbers are assigned upon recording of Statement of Intent.
2.) The Lot Certification Statement of Intent legal descriptions shall be recorded with Jefferson County Auditor's
office.
3.) To process this segregation, you will need to submit a written request and a copy of the recorded legal
descriptions to the Jefferson County Assessor's Office to have additional parcel numbers assigned. A copy of
this permit will be forwarded to the Assessor's Office. Please contact the Jefferson County Assessor's Office
(360-385-9105)with any questions regarding this process.
FINDINGS:
1.) The Administrator finds that this application complies with applicable provisions of the Unified Development Code, all other
applicable ordinances and regulations, and is consistent with the Jefferson County Comprehensive Plan and Land Use
map.
2.) The application was reviewed by the Jefferson County Department of Community Development staff on January
27, 2015 for the potential presence of Environmentally Sensitive Areas (ESAs) under the provisions of the
Unified Development Code (UDC). After an initial Geographic Information Systems mapping review and an
investigative site inspection, the following ESAs were confirmed to be present on the subject property: fish and
non-fish habitat steams, fish and wildlife habitat conservation area for spotted owls and marbled murrlets, and a
aquifer recharge area.
3.) NOTICE: This permit does not excuse the proponent from complying with other local, state, and federal
ordinances, regulations, or statutes applicable to the proposed development, but consistent with RCW 90.58.
Development pursuant to this permit shall be undertaken subject to the applicable policies and performance
standards of the Jefferson County Shoreline Management Master Program and the Jefferson County Unified
Development Code.
If during excavation or development of the site an area of potential archaeological significance is uncovered, all
activity in the immediate area shall be halted, and the Administrator shall be notified at once.
The Federal Endangered Species Act rules to protect threatened Chinook and Summer-run Chum salmon
became effective on January 8, 2001. Bull trout have been listed as threatened since early 2000. Under the
ESA, any person may bring lawsuit against any individual or agency that"takes" listed species (defined as
causing harm, harassing, or damaging habitat for the listed species). In addition, the National Marine Fisheries
Service can levy penalties. Portions of Jefferson County, including the marine environment, are included as
"critical habitat" for a listed species, Development of property along any marine shoreline, freshwater shoreline,
or floodplains could harm habitat if protective measures are not taken. To minimize the potential to damage
habitat, all property owners developing adjacent to marine shoreline, freshwater shoreline, or floodplains are
advised to do the following:
-All development activities should avoid unstable slopes, wetlands, and forested areas near surface waters
- Remove minimal vegetation for site development, especially large trees
-Allow trees that have fallen into surface waters to remain there
- Infiltrate stormwater from buildings and driveways onsite through drywells rather than discharging directly into
surface waters or roadside ditches
The Federal Bald and Golden Eagle Protection Act requires landowners within 660 feet (1/8th of a mile) of an
eagle nest to consult with the US Fish and Wildlife Service. This Eagle Act prohibits anyone from "taking" bald
eagles. This federal law defines the term "take" and describes the possible legal consequences when a "take"
occurs. Among other actions, "take" includes a disturbance of bald eagles or their habitat. Under federal law a
permit may still be required for activities that impact bald eagles or their habitat. Contact the US Fish and
Wildlife Service (http://www.fws.gov/pacific/eagle/)to learn more about how this law affects your project.
Any individual, group, or agency can bring suit for a listed species"taking", even if you are in compliance with
Jefferson County development codes. The risk of a lawsuit against you can be reduced by consulting with a
professional fisheries habitat biologist, and following the recommendations for site development provided by the
biologist. For more information, contact the National Marine Fisheries Service in Seattle, or the U.S. Fish and
Wildlife Service.
4.) This approval is for a Lot Certification only. Any future permits on this site are subject to review for consistency
with applicable codes and ordinances and does not preclude review and conditions which may be placed on
future permits.
5.) Jefferson County determined that this proposal is categorically exempt from review under the State
Environmental Policy Act(SEPA) pursuant to WAC 197-11-800(6)(a).
6.) The parcel has been designated as Commerial Forest (CF-80) and Rural Forest(RF-40) under the Jefferson
County Comprehensive Land Use Map effective August 28, 1998.
7.) This determination does not guarantee an ability to develop the parcels. All development shall comply with the
on-site sewage code, the building codes and local development regulations in effect at the time of application.
8.) RCW 58.17 requires regulation of the division of land and was passed in 1969.
9.) The administrator determined on January 7, 2009 & September 14, 2010 that no survey is required when
following existing section lines.
10.) The proposal is found to be an exemption under Jefferson County Code(JCC) Section 18.35.040(1):
(1)Divisions of land into lots, tracts or parcels each one of which is one-sixteenth of a section of land or larger,
or 40 acres or larger if the land is not capable of description as a fraction of a section of land; provided, that for
purposes of computing the size of a lot that borders on a street or road, the lot size shall be expanded to include
that area that would be bounded by the center line of the street or road and the side lot lines of the lot running
perpendicular to such center line; and provided further, that within the commercial forest district (i.e., CF-80),
each lot, tract or parcel shall be at least 80 acres in size;
11.) Contact the Jefferson county Environmental Health Department at (360) 379-9444 to determine potential
limitations with regard to wells and on-site sewage requirements.
12.) Jefferson County has determined that the use of real property for agriculture and forestry operations is a high
priority and favored use in the county. The county will not consider to be a nuisance those inconveniences or
discomforts arising from such operations, if such operations are consistent with commonly accepted best
management practices in compliance with local, state, and federal laws. If your real property includes or is
within five hundred (500) feet of real property designated as Rural Residential 1:10 or 1:20, Rural Industrial,
Rural Commercial, Agriculture, or Forestry, you may be subject to inconveniences or discomforts arising from
such farming and forestry operations, including but not limited to noise, tree removal, odors, flies, fumes, dust,
smoke, the operation of farm and forestry machinery during any 24-hour period, the storage and disposal or
manure, and the application of permitted fertilizers and permitted pesticides. One or more of these
inconveniences may occur as a result of agricultural and forestry operations which are in conformance with
existing laws and regulations.
13.) Based on the findings, parcel number 412243001 can be considered two (2) seperate parcels as described in
the legal descriptions submitted with the application.
14.) As the Parcels are found exempt from RCW 58.17 and Jefferson County Code 18.35, a title report is not
required. It is the property owner's responsibility to identify and rectify any security interest conveyances,
encumbrances, easements or restrictions affecting the subject properties involved in this county reviewed
exemption.
APPEALS:
Pursuant to RCW 36.70C,the applicant or any aggrieved party may appeal this final decision to Jefferson County Superior Court
within twenty-one(21)calendar days of the date of issuance of this land use decision. For more information related to judical

We have sent the 2015 payment for the three tax parcels to the Treasurer. I'm not familiar with receipts for payment of
property taxes.
We just received the check to the Auditor for recording fees. Do we send that to your attention? Or, directly to the
Auditor? If to the Auditor, how do we identify how it is to be credited?

Hi Peter,
Since these lot certifications are in their final stage of the process I figure that you will have the taxes paid and recording
fees in order to complete them in the next couple of weeks. I wanted to inform you that I will be out of the office after
today through Friday, April 10th. I have asked one of the other planners, Colleen,to issue and record the Statement of
Intent if they reach that stage while I am gone. After today please know that she will be your contact while I am gone.
Once the taxes have been paid please let her know, the quickest way for her to confirm this is to email her a copy of the
receipts.

I have completed my review of the above Lot Certifications and the following are my comments.
MLA14-00106
The MLA number needs to be included on the document.
This is comment is just a "pet peeve" of mine; I would rather see the Parcel Number at the beginning of the description
or a separate line just before the description. Or, because it is already noted on the Parcel number line, removing it from
the body of the description would also work.
This concludes my comments/concerns for this Lot Certification.

I have wrote in the missing MLA numbers, I usually do but just had not done it yet. Because you mentioned that the

The purpose of this application is to segregate the following three parcels for
•the sole purpose of selling a portion of each to the State of Washington,
Department of Natural Resources (DNR).
P/N 412221000 - Section 22 - T24N, R12W - 560 acres to DNR,
80 acres retained by TNC.
P/N 412232001 - Section 23 - T24N, R12W— 200 acres to DNR,
160 acres retained by TNC.
P/N 412243001 — Section 24 —T24N, R12W—40 acres to DNR,
80 acres retained by TNC.
Assessor's Land Use Code for all three parcels: Designated Forest Land.
These lot segregations are compliant with Jefferson County Code 18.35.04
exemption (1 or 4) for the purpose or assisting with the segregation of land
into parcels 40 acres or larger or divisions of land relating to the acquisition of
a fee simple interest in land by public agencies.
We request that this application be treated as one segregation, however,for the
sake of clarity, we have prepared three Lot Certification forms.

In reviewing your proposal for segregating a portion of parcels 412221000, Meeting
412232001 and 412243001 the process of the segregation appears to meet the Start Time
subdivision exemption in JCC 18.35.040(4): End Time
18.35.040 Exemptions.
This chapter does not apply to the following: Total Due
(1) Divisions of land into lots, tracts or parcels each one of which is one-sixteenth Paid
of a section of land or larger, or 40 acres or larger if the land is not capable of
description as a fraction of a section of land; provided, that for purposes of
computing the size of a lot that borders on a street or road, the lot size shall be
expanded to include that area that would be bounded by the center line of the
street or road and the side lot lines of the lot running perpendicular to such
center line; and provided further, that within the commercial forest district (i.e.,
CF-80), each lot, tract or parcel shall be at least 80 acres in size;
(2) Cemeteries and burial plots while used for that purpose;
(3) Divisions of land made by testamentary provisions or the laws of descent;
provided-, that this exemption shall not be construed to permit inter vivos

transfers, and provided further, that any structure or use on the property must
comply with all other applicable county regulations; and ( )
(4) Divisions of land relating to the acquisition of a fee simple interest in land by
public agencies, including, but not limited to, divisions made for road or public.

The process to segregate the parcels is a lot certification. In this case you would
apply for 3 lot certifications 1 for each parcel that requires a segregation. The
application would consist of:
• Master Permit application.
• Statement of Intent. •
• Survey—a survey is not required if following existing section lines.
• Brief description of the proposal. Include information regarding the public R
aaencv meeting the requirements of exemption number 4.

You can handle this whichever way you want,whatever works best for you.
If you write a personal check- I can scan and email you the receipt back for reimbursement purposes.
Or you can give the invoice's to Nature Conservancy and have them mail us a check.
The permits are still under review- If for whatever reason we did not receive the payment before the permits where ready to be issued
and approved. We would contact you and tell you the permits are ready to be issued and or approved however the fee's would need to
be paid in full before they can be issued.
I hope that makes since- If I was you- I would personally just send the invoices to The Nature Conservancy.
