PROJECT LOCATION:
Parcel 601 031 007 in Section 3, Township 26N, Range 01W located at 714 Deer Creek Road, Quilcene, WA 98376
CONDITIONS:
1.) The Applicant shall comply with the recommendations for completion of road/access improvements in the
Discussion section of the Geotechnical Report prepared by Tim Roberts of South Sound Geotechnical
Consulting dated September 29, 2014.
2.) PRIOR TO FINAL BUILDING OCCUPANCY, PROPONENT SHALL SUBMIT A WRITTEN LETTER FROM THE
GEOLOGIST(TIM ROBERTS) WHO PREPARED THE GEOTECHNICAL REPORT DATED SEPTEMBER 29,
2014 STATING THAT THE STRUCTURE AND/OR FACILITIES HAVE BEEN CONSTRUCTED IN
CONFORMANCE WITH THE REQUIREMENTS OF THE "GEOTECHNICAL REPORT." THE LETTER SHALL
BE STAMPED BY THE LICENSED GEOLOGIST/ENGINEER.
3.) Landslide Hazard Areas and their associated buffers shall remain naturally vegetated. Should buffer
disturbance occur during construction, the Unified Development Code (UDC) Administrator shall require
replanting with native vegetation. No alterations shall be made to the Landslide Hazard Area or its associated
buffer without prior authorization by the UDC Administrator.
4.) The project shall adhere to the Best Management Practices (BMPs)to control stormwater, erosion and
sediment during construction. BMPs shall address permanent measures to stabilize soil exposed during
construction, and in the design and operation of stormwater and drainage control systems.
5.) A Stormwater Management Plan has been submitted and approved by the Department of Community
Development. Once the subject permit has been issued the applicant shall fully implement the provisions of the
submitted plan and contact the Jefferson County Department of Community Development to arrange a schedule
to inspect the property for plan compliance. A Certificate of Occupancy will not be issued until the Department
verifies plan compliance. No clearing for roadways or utilities shall occur on the project site until clearing
necessary for the installation of temporary sedimentation and erosion control measures have been completed.
FINDINGS:
1.) The Administrator finds that this application complies with applicable provisions of the Unified Development Code, all other
applicable ordinances and regulations, and is consistent with the Jefferson County Comprehensive Plan and Land Use
map.

2.) The application was reviewed by the Jefferson County Department of Community Development staff on
September 11, 2014for the potential presence of Environmentally Sensitive Areas (ESAs) under the provisions
of the Unified Development Code (UDC). After an initial Geographic Information Systems mapping review and
an investigative site inspection, the following ESA5 were confirmed to be present on the subject property:
Unstable Shoreline Slope Stability; Moderate Landslide Hazard Area; Type N Stream; Susceptible Aquifer
Recharge Area.
3.) A Geotechnical Report was submitted in conjunction with the application to address the Landslide Hazard,
BMPs and potential erosion potential work to date.
4.) Jefferson County determined that this proposal is categorically exempt from review under the State
Environmental Policy Act(SEPA) pursuant to WAC 197-11-800(1)(b)(v).
5.) The site plan as submitted with the Stormwater Management Permit application on Septebmer 11, 2014 has
been reviewed for consistency under the UDC, and has been approved by Jefferson County Department of
Community Development. Any modifications, changes, and/or additions to the stamped, approved site plan
dated October 3, 2014 shall be resubmitted for review and approval by Jefferson County Department of
Community Development.
6.) See COM14-00078 for complaint case. The proposal is to improve road access on-site and does not include
work to Deer Creek Road, a private road.
APPEALS:
Pursuant to RCW 36.70C,the applicant or any aggrieved party may appeal this final decision to Jefferson County Superior Court
within twenty-one (21)calendar days of the date of issuance of this land use decision. For more information related to judical

Dear Mr. Kirkpatrick:
South Sound Geotechnical Consulting (SSGC) has prepared this letter regarding our observations of
recent earthwork activities for driveways into and paths on your property. SSGC visited your property on
September 15,2014. Our observations include:
• Two driveways (eastern and western along Deer Creek Road) provide access to the
property. The eastern driveway accesses a level area where an existing camper trailer is
located. The western driveway accesses open area with a storage shed. Several paths
lead from this area to other portions of the property.
• Recent grading was observed at the two driveways and along some of the interior paths.
Driveway entrances and several of the paths had been widened/cleared. New fill had
been placed at the driveway entrances adjacent to Deer Creek Road. The fill consisted
mostly of sand with little fines (silt and clay) or gravel. The surface of the sand fill was
loose.
• Widening at the eastern driveway appears to consist mostly of new fill (embankment)
placed on the west side. The bottom edge of the new fill extended near the end of a
culvert in the ditch on the northern side of the road. Inclination of the new fill slope was
estimated at about 1H:1V (Horizontal:Vertical). The new fill raised grades on the
western side to the original elevation of the driveway/road.
• A new corrugated plastic culvert had been placed in the ditch at the western driveway
with new sand fill placed to raise grades to road level. Overall fill thickness above the
culvert was on the order of 1 (+/-) foot.
• Some paths within the property had been cleared of brush and weeds. No new cutting of
trees was observed. Some cuts into native dense glacial soils were observed, along with
side-cast fill for path widening. Exterior slopes of the fill embankments on the interior
paths typically ranged from about 1H:lV to 2H:1V.

DISCUSSION
Fill placed on inclines (slopes) require special construction methods to build a stable embankment.
Standard construction procedures usually include removing existing vegetation, topsoil, and loose
materials down to firm native soil. Level benches excavated in a stair-step fashion are constructed into
the native soils. Suitable fill materials are then placed and compacted on the benches to construct the
embankment. Finish exterior grades on embankments will generally have inclinations of 2H:1 V or flatter,
but can vary based on the type of material used for construction. New fill embankments in the driveways
do not appear to have been constructed in this fashion and typically have exterior slopes steeper than
2H:1 V. They are considered susceptible to localized slumping and erosion in their current condition.
We recommend that the new embankments and fill in driveway entrances along Deer Creek Road are
modified to reduce the risk of sloughing and erosion. This could be accomplished by removing some of
the existing loose sand fill and replacing with compacted well-graded sand and gravel or crushed rock. At
the eastern driveway entrance (west side of entrance), existing loose sand should be removed to within
about 2 feet of original native grade(prior to existing fill placement). Remaining sand should be moisture
conditioned (wetted or dried) and compacted to a firm and unyielding condition with mechanical
equipment. New granular fill placed on level benches should be placed and compacted to a firm and
unyielding condition. We understand that you have a new contractor who has suggested using 11/4 -inch
crushed rock. This type of material is considered suitable for embankment construction. Finish
embankment grades should be sloped no steeper than 2H:1V. Any remaining exposed sand from the
original embankment construction should be vegetated or covered with a minimum 6-inch layer of gravel
to limit erosion. We also recommend that the driveway surfaces above the entrance where new sand was
placed are covered with a layer of gravel. Original gravel driveway surfaces not covered with new sand
can be left as-is.
The western driveway entrance only has about 1 foot(+1-) of recently placed sand over the new culvert.
At least 6 inches of the existing loose sand fill should be removed and replaced with well graded granular
fill or crushed stone. Loose sand in this driveway leading into the property should also be covered with a
layer of gravel. Gravel or shot rock should be placed around the inlet and outlet sides of the culvert on
the sand to reduce the potential for erosion.
Existing fill embankments inside the property on interior driveways and paths will be susceptible to
slumping and erosion due to their steep inclinations and loose condition of the sand. They could be
reconstructed as discussed above for new embankment construction or could be left as-is. If they are left
in their existing condition they will be susceptible to localized slumping, however,any movement should
not impact neighboring properties.
Cuts made for interior path widening extend into dense glacially consolidated soils and are on the order of
several feet high. These soils can be observed along Deer Creek Road in the steep cuts made during
original construction of the road. Although the glacial sand and gravel is susceptible to erosion and

localized sloughing when exposed in steep cuts, the risk of large scale failure is considered low in short
cut slopes.Observed cuts for path widening on the property will not impact neighboring properties.
Although the recently placed sand fill (embankments) is susceptible to erosion, it is our opinion that Best
Management Practices(BMP)for erosion control can be utilized such that the risk of off-site transport of
sediment can be mitigated. Placement of straw and planting of grass seed, covering the sand with a layer
of gravel, or other commercially available erosion protection systems(jute mats or other erosion fabrics)
with seeding will limit the risk of erosion. Straw bales were stockpiled on the property near the camper
trailer, and Mr. Kirkpatrick informed us that exposed fill/cleared areas will be seeded and covered with
straw. We were also informed that a new contractor will be modifying driveway embankments including
replacing some of the loose sand and placing 11/4 - inch crushed rock over the driveway entrance areas.
New surface vegetation was observed growing on recently cleared paths in the interior of the property.
As this vegetation develops, supplemented with the planned placement of straw and new grass seed on
larger exposed areas, the risk of erosion and off-site transport of sediment will be minimal and the same
as pre-cleared conditions.

This letter has been prepared for the exclusive use of Mr. Steve Kirkpatrick for specific application to the
project discussed. No warranties, either express or implied, are intended or made. The comments and
opinions contained in this letter are based on surface conditions observed at the time of our site visit on
September 15, 2014. No subsurface explorations were completed for this study by SSGC. Should site
conditions presented in this document change,or new information become available, the conclusions and
recommendations contained herein shall not be considered valid unless SSGC reviews the new/revised
information and either verifies or modifies the conclusions in writing.

I represent Alan Haws, who owns property in Jefferson County located next
door to property owned by your clients, Linda Skurdal and Steve Kirkpatrick
During the last few days, your clients have engaged in a blatant and destructive
trespass upon the Haws property, sending a bulldozer on to the Haws property to
blaze a roadway in an area where they have absolutely no right to do so. The area in
which this occurred is right next to the water well that provides water to the Class B
community water system which serves four residences in the area. Your clients are not
parties to that community well and have no right or need to access the well site. The
grading was done without obtaining a grading permit from the County. If a permit
had been applied for,it would most certainly have been denied by the County since it
lies within the setback area for the community well system.
My client has furnished me with a copy of the letter that you wrote to him
dated September 17, 2013, in which you asserted that your clients had established a
prescriptive easement over the Haws property. That assertion is, in my client's
opinion, absolute baloney. There is no express or implied easement over the Haws
property and there has not been any use that would establish a prescriptive easement.
Even if utility providers should need to access any utilities in the area, that would not
create a right for your client to have such access or to build a road. What your client is
apparently trying to do is "bootstrap" an easement across someone else's property to
provide access to the new parcel he is trying to create by subdividing his 20-acre parcel
into two 10-acre parcels. If he is going to subdivide his property he needs to create an
easement for the new parcel across his own remaining property. In fact, his property is
already festooned with roadways which he has graded, many of which are "roads to

nowhere." His property is already ringed with multiple access points and gateways
which could provide convenient access to his new parcel.
As you know, the law provides for the recovery of treble damages and attorneys
fees whenever damage is caused to real property by a trespasser. Mr. Haws demands
that your clients immediately cease any further trespassing. If there are any further
trespasses upon the Haws property, he will call the Jefferson County Sheriff and will
also report your client's unpermitted and unlawful grading activities to the County
authorities. In the meantime, my client is obtaining a new survey of the boundary so
that there will be no uncertainty about where the boundary is located between the
properties. That survey will be completed within a week. If you have any credible
evidence (i.e., evidence other than your clients' own statements) regarding their claim
to have acquired a prescriptive easement, please forward that evidence to me.
Unfortunately, Michael, your clients have become pariahs in the neighborhood.
This recent incident is just another display of their irresponsibility and their disrespect
for the rights of their neighbors. You may recall that we recently filed a lien against
their property due to their failure to pay their share of the road maintenance expenses.
That lien still remains unpaid and may be foreclosed at any time.
Please telephone me and assure me that your clients will cease any further
trespasses upon the Haws property. If I do not have that assurance shortly, we may
find it necessary to obtain a restraining order to prevent any further trespasses. If such
an action needs to be filed, we will also be seeking treble damages for the damages that
have already occurred.

Re: Planned Rural Residential Development
The purpose of this memorandum is to provide background information on the
Planned Rural Residential Development (PRRD) provisions in the Unified
Development Code (UDC) in the context of site-specific Comprehensive Plan
amendments on the 2005 Amendment Docket. The PRRD provisions are
section 3.6.13 of the UDC.
MILAN-51 — Kirkpatrick/Skurdal
To illustrate how a PRRD application could influence land division, the site-
specific application MLA05-51 will be used as an example.
The landowners of Assessor's Parcel Number (APN) #601031007 have indicated
that they wish to do a cluster development for their property if their rezone is
approved. The property is approximately 20 acres and is currently zoned Rural
Residential 1:20. The Planning Commission has recommended re-designation of
the property to RR 1:10 with the condition that the applicants develop the
property as a PRRD.2
The site's biggest limitation is the 250-foot Commercial Forest buffer
requirement. The buffer is shown in Figure 1 below; a significant portion of the
site falls into this area.

Jefferson County's Geographic Information System (GIS) database shows the
presence of a Type V (seasonal) stream on the north side of the property. The
stream has a buffer requirement of 50 feet. See Figure 2 below.

The property is also in a Landslide Hazard zone. See Figure 3 below. The
western portion of the site is within the "slight" zone and the remaining portion of
the site is in a "moderate]] zone. A land division of the current parcel would
create a lot in a landslide hazard. Therefore, a land division application would
trigger a requirement for a geotechnical report that will determine the stability of
the slopes and ascertain whether resulting drainage would affect the neighboring
properties.

Under a PRRD, the majority of the site—in this case 75% or 15 acres—must be
set aside in perpetuity for open space. The remainder of the site is then divided
into residential lots of an average of 1.25 acres. In this case the open space tract
includes the 250-foot forest buffer and a buffer for the creek.

Community water systems, septic drainfields, and stormwater detention ponds
are all allowed within the reserve tract to accommodate the small lots sizes for
cluster development. There is also a conditional use process allowed for golf
courses.
The area shown within the red in Figures 4 and 5 below represent an
approximation of the developable area of the PRRD in two different scenarios.
Depending on whether a density bonus is granted, and to what degree, the
proposal could develop up to five (5) dwelling units within the developable tract
that could be arranged any number of ways, based on topography, minimizing
road construction costs, or addressing any other constraint. The geotechnical
report and septic evaluation are likely to determine in large part how the PRRD
will be configured.

PRRD has been mentioned as a condition of approval for MLA 05-60. (See
Figure 6 below.) The application encompasses seven tax parcels that are zoned
RR 1:20 and are 265 acres in aggregate. The zoning of these parcels will
determine how much of the area will need to be set aside as a reserve. Bonus
density is awarded based on the benefit to the public. The following table
displays the potential reserve area based on the assigned density of the Rural
Residential land use designation.

Written Description of Complaint:Mr. Kirkpatrick was approved to subdivide his 20 acre(zoned 1:20)into
two ten acre parcels zone 1:10. He had a pre conference in 2008. Now he is punching in roads(2)with no permits
and over property that does not belong to him. Additionally, he placed one of the roads approx.fifty feet from a well
that is also not his over property that is also not his.
Please issue a stop work order and red tag this property until all issues are resolved and legally permitted.
No action necessary because: no potential violation in complaint _complaint has already been
investigated on Complaint Resolved

The Department of Community Development is in the process of reviewing your application. The
following information is needed to continue review of your project.
Please provide a geotechnical report on the site and work done to date that recommends further
action.
Please submit the above information to the Department of Community Development within 90 days
of the date of this letter which would be 12/11/2014. As required by Jefferson County Code, JCC
18.40.110(3) and (6), if the information is not submitted or additional time to submit the required
information within the ninety (90) calendar day period is not requested, the application would be
considered abandoned and therefore withdrawn and application fees will be forfeited. Jefferson
County Code provides that the Department of Community Development shall not be responsible for
notifying the applicant of an impending expiration, thus any further notification would not be
forthcoming.

Impervious surface is a hard surface that either prevents or retards the entry of water into the soil mantle as under natural conditions
prior to development. A hard surface area which causes water to run off the surface in greater quantities or at an increased rate of flow
from the flow present under natural conditions prior to development. Common impervious surfaces include, but are not limited to roof
tops, walkways, patios, driveways, parking lots or storage areas, concrete or asphalt paving, gravel roads, packed earthen materials,

Requirements for stormwater management. DCD staff will help verify the classification of the project and the application requirements.
For proponents of "small" projects who must comply only with Minimum Requirement #2—Construction Stormwater Pollution
Prevention—an additional submittal is not required. The proponent is responsible for employing the 12 Elements to control erosion and
prevent sediment and other pollutants from leaving the site during the construction phase of the project. Pick up the Construction
Stormwater Pollution Prevention (SWPP) Best Management Practices (BMPs) Packet. Proponents of"medium" projects—those
that must meet only Minimum Requirements #1 through #5—and for "large" projects—those that must meet all 10 Minimum
Requirements—are required to submit a Stormwater Site Plan. DCD has prepared a submittal template of a Stormwater Site Plan,
principally for rural residential projects. Complete the template in the Stormwater Site Plan Instructions and Submittal Template or
prepare a Stormwater Site Plan using the step-by-step guidance in the Stormwater Management Manual.
