If the mobile stand is a Conversion Vendor Unit defined per WAC 296-150V-0020,the mobile stand shall have a certification by Washington State Labor and Industries with the insignia posted on the unit. 2.) The stand shall meet all applicable setbacks. The setback from Rhody dr is 35. The setback from Hwy 116 is 30'.The right side setback is 5'.The rear side abutting a residential zone is 35'. 3.) At least two parking spaces shall be provided for each employee. 4.) The drive-up stand shall provide stacking space for up to six vehicles. Each stacking space shall be 15 linear feet. Stands with drive-up service shall have be useable by drivers from within their vehicles. 5.) The parcel has been designated as General Crossroads under the Jefferson County Comprehensive Plan Land Use Map effective August 28, 1998. Mobile food and beverage stands are allowed in this zoning designation (JCC 18.15.040,Table 3-1). 6.) Tie-downs or wheel locks shall be used to ensure that the stand does not move while in operation. 7.) Accessory structures, such as picnic tables, seating, and storage sheds, are prohibited where the stand is in operation. Accessory storage structures shall be used only at an approved servicing area. 8.) Trash receptacles shall be provided. Use of dumpsters is prohibited for meeting trash receptacle requirements. Stands with drive-up service shall have trash receptacles that are usable by drivers from within their vehicles. 9.) Food and beverage stands shall be located in the following manner: (a)the stand shall not block sidewalks, rights-of-way, emergency exits or fire lanes; (b)the stand and service area shall not encroach into vehicle travel lanes; and(3)the stand shall not be located within any required landscaping areas. 10.) Mobile units may use temporary signs, such as sandwich boards or signs affixed to the mobile unit. 11.) The project is for a Temporary(six month)Outdoor Espresso Stand. The application complies with all relevant code requirements for JCC Title 18 to include, but not limited to, JCC 18.20.182 Food and Beverage Stands, and JCC 18.20.380 Temporary outdoor uses. 12.) Temporary food and beverage stands may be permitted for a period of six months and may be extended for an additional six months upon findings and a review of the permit for complaints, problems, and adverse impacts. Identified problems and adverse impacts shall be corrected before an extension is granted. Once an extension has been granted the site may not be used for a temporary food and beverage stand for two years after the expiration of the permit extension 13.) Within three days after termination of any temporary outdoor use permit, such use shall be abated and all structures, signs and evidence of such use removed.The administrator may require a cash bond be posted by the applicant upon application to defray the cost of cleanup and repair of the property should the applicant fail to do so; and Temporary outdoor use permits not exercised within 180 days of issuance shall be null and void. 14.) In addition to any other remedy provided by this chapter, at any time when such temporary outdoor use is operated in violation of required conditions of this section, or otherwise found to constitute a nuisance, the county may revoke the temporary outdoor use permit.The permittee shall be given notice of and an opportunity to contest the revocation prior to a final determination. If, in the opinion of the administrator,the violation poses a life, health, or safety threat,the use permit may be revoked immediately, and the permittee shall be given the opportunity to request consideration and/or appeal. 15.) Temporary food and beverage stands must remain readily movable as defined in this section while the temporary use permit is in effect. FINDINGS: 1.) The Administrator finds that this application complies with applicable provisions of the Unified Development Code, all other applicable ordinances and regulations,and is consistent with the Jefferson County Comprehensive Plan and Land Use map. 2.) Jefferson County determined that this proposal is categorically exempt from review under the State Environmental Policy Act(SEPA)pursuant to WAC 197-11-800(6)(b). APPEALS: Pursuant to RCW 36.70C,the applicant or any aggrieved party may appeal this final decision to Jefferson County Superior Court within twenty-one(21)calendar days of the date of issuance of this land use decision.
