No other changes, alterations or additions are proposed or approved. ATTACHMENTS: • Type II Land Use Approval — MLA 15-00026 • Written Findings and Conclusions for Administrative Summary Decision. Mylar ready for BoCC signing ANALYSIS: Staff has determined that the application as submitted on May 20, 2015 meets the required criteria of Article VII Plat Alterations JCC 18.35 as addressed in written Findings and Conclusions for Administrative Summary Decision and Preliminary Plat Approval MLA 15-00016. Written Findings and Conclusions are required per RCW 58.17.195 which state in part that a county makes a formal written finding of fact that the proposed Subdivision or Plat Alteration is in conformity with applicable zoning ordinance or other land use controls which may exist. ALTERNATIVES: The requested action is mandatory per RCW 58.17.170 and Chapter 18.35 JCC. FISCAL IMPACT /COST BENEFIT ANALYSIS: There is no identifiable fiscal impact related to this request for final plat alteration approval. RECOMMENDATION: Per Jefferson County Ordinance and State Law, DCD requests that the BoCC grant final short plat approval by adopting the written findings and conclusions and sign the final Mylar. The alteration will move the lot/boundary line from a vertical north/south orientation to a horizontal east/west orientation. No other changes will be made to the plat. Property Location: The proposal site is located at 202 Chase Road, Port Townsend, WA 98368. Legal Description: Parcel Numbers 947 200 009 & 947 200 010, Section 19, Township 30N, Range I W, WM, Located at 202 Chase Road, Port Townsend, X98368 Property Description. 'The subject parcels are long and rectangular in shape and approximately 10 acres in size, 'The site is flat and heavily vegetated with native plants and tree. There several Category 11 & [11 wetlands with associated buffers of 100 and 50 feet respectively on each parcel. Lot 10 is currently developed with a single family residence, while Lot 9 is undeveloped. Current use of the property is residential. Zoning: 'The Jefferson County Comprehensive Plan Land Use Map designates the site as Rural Residential (1;10). Applicable Goals and Policies: Jefferson County Comprehensive Plan Chapter 3, "Rural Residential Land Use Policies," pages 3-47 to 3-49. Chapter 3, "Environment," pages 3-59-60 Chapter 3, "Transportation Policies," page 3 -61. Chapter 3, "Rural Character Policies," 3-61 to 3-64. Applicable Ordinances, Ordinance No. 1.1- 1218 -00, Jefferson County Unified Development Code, as amended SEPA. The proposed Plat Alteration is categorically exempt from environmental review. (WAC 197- 11 -800(6)(a) . Notice Information.- Notice of Application was mailed to agencies and to adjacent property owners on Kawlins Plat Alteration SUB] 5-00007 W3 ) 1/2015 June 9, 2015, Notice was published in the June 10, 2015 edition of the Port Townsend and Jefferson County Leader, Staff posted the notice on-site Oil June, 10, 2015. Testimony: No written comments received from the adjacent properties or the general public. Agency Responses: Jefferson County Assessor: review comments regarding errors and needed corrections. Acreage of Lot 9 will change from 9.6 acres to 9.7 acres, while acreage of Lot 10 will C 10 acres to 10.1 acres, These densities are consistent with Jefferson County Code requirements for parcel densities. 3. No other changes will be made to the plat other than described above under 41 & 92. 4. The proposed plat alteration is for residential use. 5. The proposed plat alteration is subject to the policies of the Jefferson County Comprehensive Plan. The applicable policies are discussed below. I The proposed short subdivision is subject to the requirements of Sections 18,10 & 18,35 of the Jefferson County Code (JCC). There are several ordinance requirements that apply to the proposed Plat alteration: JCC 18,30,030, Water Supplies; JCC 18.30,040, Sewage Disposal; JCC 18.30-080, Roads; JCC 18,35,090 Article VII, Plat Alteration. Cr "Preserve the functions and values of critical environmental areas and protect development frorn the risks of environmental hazard." The proposal was subject to Critical Area review. There are existing wetlands on-site that are identified on the face of the plat. No alteration to the wetlands or the locations of the wetlands on the face of the plat will result from the proposed plat alteration. The existing plat was created in 2004 under current Unified Development Code standards for roads and transportation and reviewed by the Public Works department., No alteration to the approved roadways, of the location of roadways as depicted on the face of the plat will take place as a result of the proposed plat alteration. No additional review or approval by the Public Works Department is necessary or warranted. &Qj 8 WI�L ,,When the development or redevelopment of land requires the availability of a supply of potable Rawlins Plat Alteration SUB 15-00007 8/31/2015 -2- water as determined by the Administrator, potable water shall be delivered by a means approved by the Washington Department of Health and/or Jefferson County Health and Fluman Services." The existing plat was approved in 2004 with the condition that the plat did not constitute approval of further development including water. Proof of potable water is required at time of building permit application. The proposed plat alteration will not change or affect that requirement and is consistent with JCC 18.3i1.030, I(Lc:j. , 3 at _w .,5'e _�dgg--pivosal: ... "All development shall be provided with an individual, on-site septic system and drainfield approved by the Jefferson COLinty Health Department in compliance with Chapter 8.15 JCC, unless the Jefferson County Flealth Department determines that public sewer is available which would then require connection to the approved public sewer." The existing plat was reviewed and approved by the Jefferson County Environmental Health Department and confirmed to have lot sizes that meet minimum land area requirements per WAC 246-272 for use of onsite sewage systems. The proposed plat alteration will not change or affect that requirement and is consistent with JCC 18.30.040. The existing plat was reviewed by the Jefferson County Department of Public Works for road development standards and subsequently approved. The proposed plat alteration will not change or affect that requirement or alter the location of the roadways on the face of the plat. (2) Notice shall be given to the affected parties, a public hearing may be requested by a person receiving notice within 14 days of receipt of notice, When a public hearing is requested the application shall be processed according to the procedures for Type III decisions established in Chapter 18.40 JCC and the criteria listed in RCW 58.17.215-, 5,taffJ10 Notice of application sent to adjacent property owners, published in the local newspaper and posted on site on June 10, 2015. (4) Based on comments from county departments, applicable agencies and other information, the administrator shall review the proposal subJect to the criteria contained in this section. A proposed plat amendment shall only be approved when consistent with all the provisions of JCC 18.35.690 and RC W 58,17.215. [Ord. 8-06 § I I %Aff Comment: Based on comments from the Assessor's office, the proposed plat alteration requires the modifications and clarifications noted below in the conditions section. Subsequent comments received have confirmed that the requested changes have been made. Based on the previous findings, the proposal is found to be consistent with the Comprehensive Plan and JCC Title 18. STAFF RECOMMENDATION: Based on the preceding findings and conclusions, staff recommends finding that the proposal is consistent with the applicable plans and ordinances and that it meets the Plat Alteration review criteria. Approval of the Plat Alteration should be granted subject to the following conditions. CONDITIONS, 1. Please add a Treasurer's signature block. 2.
