JCC 18.40.310 Reconsideration A party of record at a public hearing may seek reconsideration only of a final decision by filing a written request for reconsideration with the hearing examiner within five business days of the date of the final written decision. The request shall comply with JCC 18.40.330(5)(b). The hearing examiner shall consider the request without public comment or argument by the party filing the request, and shall issue a decision within 10 working days of the request. If the request is denied, the previous action shall become final. If the request is granted, the hearing examiner may immediately revise and reissue his/her decision or may call for argument in accordance with the procedures for closed record appeals. Reconsideration should be granted only when an obvious legal error has occurred or a material factual issue has been overlooked that would change the previous decision. This proposal is exempt from SEPA. PROJECT LOCATION: Parcel 001 333 037 in Section 33, Township 30N, Range 1W located at 310 Four Corners Road, Port Townsend, WA 98368 CONDITIONS: 1.) 1. A building permit shall be required to construct the Single Family Residence. 2. The applicant shall comply with the recommendations outlined in the Geotechnical Hazard Assessment prepared by Northwestern Territories, Inc., dated May 2015. 3. Prior to issuance of the Jefferson County Building Permit, the applicant will be required to submit a small parcel Drainage and Erosion Control Plan as required by the Jefferson County Code. Once the subject permit has been issued, the applicant shall fully implement the provisions of the submitted Drainage and Erosion Control Plan. 4. The applicant shall submit a Habitat Management Plan as outlined in JCC 18.22.440 at time of building permit application. 5. Construction shall substantially comply with the site plans (log item 5) submitted to Jefferson County for the subject case MLA15-00030 as they exist now or are hereafter amended by Jefferson County and/or the Washington State Department of Ecology. 6. Work within the jurisdiction of the Shoreline Program other than as described in this report or depicted on the site plan (log item 5) above shall receive separate review from this office. 7. Final Approval of this Shoreline Variance is made by the Department of Ecology. 8. Construction shall be commenced or, where no construction is involved, the use or activity shall be commenced within two years of the effective date of the permit or permit exemption; provided, that the administrator may authorize a single extension based on reasonable factors, if a request for extension has been filed before the expiration date and notice of the proposed extension is given to parties of record and the Department of Ecology. 9. Authorization to conduct development activities shall terminate five years after the effective date of a permit or permit exemption; provided, that the shoreline administrator may authorize a single extension for a period not to exceed one year based on reasonable factors, if a request for extension has been filed before the expiration date and notice of the proposed extension is given to parties of record and the Department of Ecology. FINDINGS: 1.) The Administrator finds that this application complies with applicable provisions of the Unified Development Code, all other applicable ordinances and regulations, and is consistent with the Jefferson County Comprehensive Plan and Land Use map. 2.) Major Utilities in a Rural Residential Zone require a Type III Conditional Use permit. The property is located at 310 Four Corners Road, Port Townsend. Access to the parcel from Four Corners Road is via Highway 20 or Highway 19 —Airport Cutoff Road. SUMMARY OF DECISION: Request granted, subject to conditions. PUBLIC HEARING: After reviewing the Jefferson County Department of Community Development Staff Report and examining available information on file with the application, the Examiner conducted a public hearing on the request as follows: The hearing was opened on August 25, 2015, at 2:25 p.m. and adjourned at 2:40 p.m. Parties wishing to testify were sworn in by the Examiner. The following exhibits were submitted and made a part of the record as follows: SEE ATTACHED INDEX LIST DAVID JOHNSON appeared, presented the Department of Community Development Staff Report and testified that the applicant desires to expand office space in a facility located in the RR zone classification. Their water and electrical facilities are both on the site. They 1X purchased the parcel from PSE. They applied for a building permit and then found that their use is not allowed in the applicable zone without a conditional use permit. However, the site has been used for water and electrical utility purposes since 1973. The applicant could have used the nonconforming use expansion option but decided that the conditional use permit would eliminate the necessity for hearings in the future to expand the nonconforming use. The other option is to apply for a conditional use permit covering the entire site. The new building is well setback from the roads and will blend well with the substation and equipment storage onsite. With the conditional use permit they expand again by obtaining a building permit. He then discussed all conditional use criteria and found that the request satisfies all. The new building will create no demands on the existing infrastructure. The impervious surface coverage on the site is such that the present zone will not allow further increases. ROBERT W. PHILLIPS appeared on behalf of the request and testified that the reason for the building is to allow them to determine where possible growth would be created and the development for the future. JIM PARKER appeared and testified that costs of improvements on the site are an issue, and they cannot provide any locations for future improvements. A discussion occurred concerning limitations on impervious surfaces. No one spoke further in this matter and the Examiner took the matter under advisement. The hearing was concluded. NOTE: A complete record of this hearing is available in the office of Jefferson County Department of Community Development. FINDINGS, CONCLUSIONS, AND DECISION: FINDINGS: 1. The Hearing Examiner has heard testimony, admitted documentary evidence into the record, and taken this matter under advisement. 2. This application is exempt from review pursuant to the State Environmental Policy Act (SEPA). 3. A Public Hearing before the Hearing Examiner was scheduled for August 25, 2015 at 2 p.m. in the First Floor Conference Room of the Jefferson County Courthouse. The Notice of Public Hearing was published in the Port Townsend/Jefferson County Leader on August 12, 2015. Agencies and adjacent property owners were sent notice of the public hearing on August 11, 2015. The property was posted by Staff on August 11, 2015. 2X II 4. The applicant, Jefferson County Public Utility District #1 (PUD) has a possessory ownership interest in an irregularly shaped, 22 acre parcel of property located south of Four Corners Road, east of its intersection with SR-20 in the Port Townsend area of unincorporated Jefferson County. The PUD utilizes the parcel for its electrical utility operations center, and improvements include offices, equipment storage buildings, material storage areas, and an electrical substation. The applicant also utilizes the site to manage its water service. Approximately 236 linear feet of the parcel abut Four Corners Road but the majority of the parcel is to the south of a row of parcels abutting said road. The major portion of the site measures 1,069 linear feet in an east-west orientation and 866 feet in a north-south orientation. 5. The applicant desires to install a new, 1,440 square foot, modular office building and additional parking spaces southeast of the existing office building. Office improvements are located in the eastern portion of the site while the electrical substation is in the western portion thereof. The proposed building will have wood siding that will blend with existing buildings. The applicant would use the building for employee work stations and would also provide a more open environment in existing buildings for public contact. The existing access road would provide access to the new structure. Trees presently screen the building area from both streets and abutting parcels. Lighting, stormwater catch basins, and stormwater ponds already in place will serve the new building. The proposed 54 parking spaces will serve both employees and the public. 6. The parcel is located within the Rural Residential (RR 1:5) designation of the Jefferson County Comprehensive Plan and the RR1:5 zone classification of the Jefferson County Code (JCC). Section 18.15.040 JCC sets forth the allowed uses in rural residential zone classifications and authorizes "Utility developments, major" within the RR 1:5 classification subject to acquisition of a conditional use permit. Section 18.20.410 JCC defines "Utility development, major" as follows: Major Utility Developments. Major utility developments include utility development designed to serve a broader community or regional area, or are manned, including but not limited to: a. Electrical generating facilities greater than 10 megawatts in output. The applicant's use of the site meets the definition of major utility as the site supports an electrical utility serving east Jefferson County, a broader community. The site also serves as the main office of the PUD. 7. Prior to Puget Sound Energy establishing an electrical substation on the site, the parcel served as a sand and gravel surface mine. Neither the mine operator, Puget Sound Energy, nor the present applicant needed to apply for a conditional use permit to operate from the site based upon the JCC in effect at that time. 3X Therefore, the applicant's use of the site is legally nonconforming. The applicant could have obtained approval to locate the building and parking area onsite by requesting a conditional use to expand the nonconforming use. However, the applicant decided to request a conditional use permit that will cover the new building, parking areas, and all existing uses presently on the site. Approval of the permit will lessen the need for future hearings when the applicant needs to add improvements to the site. The applicant therefore requests the conditional use permit to authorize a "Utility development, major" on the site. 8. Prior to obtaining approval for a "Utility development, major" the applicant must show that the application satisfies the criteria set forth in JCC 18.20.220 that applies to industrial uses. The applicant must also show that the request satisfies all criteria for a conditional use permit as set forth in JCC 18.40.530. The applicant has made such showings as set forth on Pages 4-10 of the Staff Report (Log Item 10) as discussed by staff. The Examiner hereby adopts staff's findings on each criteria by this reference as if set forth in full. CONCLUSIONS: 1. The Hearing Examiner has jurisdiction to consider and decide the issues presented by this request. 2. The applicant has shown that the request for a conditional use permit to allow establishment of a Utility development, major on the site satisfies all criteria set forth in JCC 18.20.410, 18.20.220, and 18.40.530 and therefore should be approved subject to the following conditions: 1. The applicant shall have approved building permit BLD15-00057 to place a 1, 440 square foot modular office building on-site. 2. Lighting shall be required to conform to JCC 18.30.140 standards. Lighting shall not exceed thirty (30) feet in height from finished grade. In addition, lighting shall not be directed towards adjacent properties and shall be shielded in a manner to mitigate glare. 3. No additional impervious surface may be created for future development. Future development must utilize existing impervious surface. 4. No building permit shall be issued for any use involved in an application for approval for a conditional use permit until the conditional use permit is approved and becomes effective. 5. It shall be the affirmative duty of the applicant who proposes a major utility development to determine if any state or federal permits or licenses are necessary and then to obtain those permits or licenses at their own expense. 4X 6. A conditional use permit automatically expires and becomes void if the applicant fails to file for a building permit or other necessary development permit within three (3) years of the effective date (the date of the decision granting the permit) of the permit unless the permit approval provides for a greater period of time. 7. The use of chemicals, industrial solvents, or other noxious or hazardous substances shall comply with all federal, state, and county safety, fire, structural, storage, and disposal standards. 8. Extensions to the duration of the original permit approval are prohibited. The Department of Community Development shall not be responsible for notifying the applicant of an impending expiration. 9. Water supplies, wastewater, and sewage disposal facilities adequate to serve the proposed use shall be provided. Industrial wastewaters shall not be discharged into an on-site septic system and are subject to waste discharge permit requirements established by the water quality program of the Washington Department of Ecology. 10. No use shall be made of equipment or material which produces unreasonable vibration, noise, dust, smoke, heat, glare, odor, or electrical interference to the detriment of the quiet use and enjoyment of adjoining property. 11. The county may modify an approved conditional use permit as follows: the county may delete, modify or impose additional conditions upon finding that the use for which the approval was granted has been intensified, changed or modified by the property owner or by person(s) who control the property without approval so as to significantly impact surrounding land uses. A modification will be processed as a Type II land use decision pursuant to JCC 18.40.270 of this Code. 12. A conditional use permit granted under this JCC 18.40 shall continue to be valid upon a change of ownership of the site, business, service, use or structure that was the subject of the permit application. No other use is allowed without approval of an additional conditional use permit. 13. The County may suspend or revoke an approved conditional use permit pursuant to JCC 18.50 of this Code only upon finding that: a) The use for which the approval was granted has been abandoned for a period of at least one (1) year; 5X b) Approval of the permit was obtained by misrepresentation of material fact; or c) The permit is being exercised contrary to the terms of approval. 14. In appropriate circumstances, the Administrator may require a reasonable performance or maintenance assurance device, in a form acceptable to the county prosecutor, to assure compliance with the provisions of this Code and the conditional use permit as approved. DECISION: The request for a conditional use permit to authorize an existing "Utility development, major" together with an expansion consisting of a 1,440 square foot, modular office building with additional parking on a 22 acre site located at 310 Four Corners Road, Port Townsend, is hereby granted subject to the conditions contained in the conclusions above. Hearing Examiner 6X STAFF REPORT TO JEFFERSON COUNTY HEARING EXAMINER RE: Conditional Use Application ) PROPOSED FINDINGS File No: MLA15-00038/ZON15-00023 ) CONCLUSIONS, AND Applicants: Jefferson County Public ) RECOMMENDATIONS Utility District#1 (PUD) ) SUMMARY OF APPLICATION AND RECOMMENDATION: Proposal: CONDITIONAL USE PERMIT — Installation of a 1,440 square foot modular office building with additional parking for a legal non-conforming PUD Operations Center in a residential zone. Major Utilities in a Rural Residential Zone require a Type III Conditional Use permit with public notice and a Public Hearing with a decision by the Jefferson County Hearings Examiner. This proposal requires a building permit and is exempt from SEPA review. Recommendation: Approval with conditions Project Planner: David Wayne Johnson Associate Planner BACKGROUND INFORMATION: Landowner/ Applicant: Jefferson County Public Utility District #1 310 Four Corners Road Port Townsend, WA 98368 Property Location:The property is located at 310 Four Corners Road, Port Townsend, WA 98368. Access to the parcel from Four Corners Road is via Highway 20 or Highway 19 —Airport Cutoff Road. Legal Description: Parcel 001 333 037 in Section 33, Township 30N, Range 1W located at 310 Four Corners Road, Port Townsend, WA 98368 Property Description: The subject parcel encompasses approximately 22 acres and is relatively square in configuration. The site was historically a gravel processing plant that has since been and is currently developed with an electrical utility operations center LOG ITEM Paga_ . PUD Conforming Use & Modular Office Conditional Use Permit(ZON15-00023) Page 2 with offices, equipment storage buildings, material storage areas and an electrical substation. The parcel is flat in topography with a gradual slope down to the south. Approximately half the parcel has been cleared of most vegetation except along the fenced perimeter and is generally paved and graveled, while remainder is maintained in native trees and shrub which buffer and screen the use from surrounding properties. Surrounding Area: The property is bordered to the south by a gravel pit, to the west by a single family residence and mobile home trailer park, and to the east and north by single family residential development. Comprehensive Plan Designation: The Jefferson County Comprehensive Plan (adopted August 28, 1998) designates the site and area surrounding the subject parcel as Rural Residential 1 dwelling per 5 acres (RR 1:5), and the area directly south of the proposed site as Rural Forest Land (gravel pit). Date of Pre-application Conference: The required pre-application conference was held on March 25, 2015 (log item 1) Date of application: Application for a Type III Conditional Use permit to site a Major Utility in a Rural Residential Zone was submitted on June 18, 2015, and deemed substantially complete on June 26, 2015. Notice of Application: The Notice of Application was published in the Port Townsend/Jefferson County Leader on July 1, 2015. Agencies and adjacent property owners were sent notice of the proposal on June 30, 2015. The property was posted by Staff on July 1, 2015. The 14 day comment period for the application expired on July 15, 2015. No written comments were received. Notice of Public Hearing: A Public Hearing before the Hearing Examiner was scheduled for August 25, 2015 at 2 p.m. in the First Floor Conference Room of the Jefferson County Courthouse. The Notice of Public Hearing was published in the Port Townsend/Jefferson County Leader on August 12, 2015. Agencies and adjacent property owners were sent notice of the public hearing on August 11 , 2015. The property was posted by Staff on August 11, 2015. Site Visit: Staff conducted a site visit on July 1, 2015. CRITICAL AREA REVIEW: This proposal received consistency review pursuant to the Jefferson County Code Title 18 Unified Development Code, including consideration of Critical Areas (JCC 18.22). GIS mapping indicated the project site is within a Susceptible Aquifer Recharge Area (SARA). JCC 18.22.120 lists land use activities that are considered high impact and therefore are prohibited in the SARA. None of the items list except for storage tanks for petroleum products applies to the subject site. Two 6k gallon lined storage tanks were installed underground during the 1990's and LOG ITEM PUD Conforming Use& Modular Office Conditional Use Permit(ZON15-00023) Page 3 approved by Ecology and are therefore legal nonconforming. No other critical areas have been identified. JEFFERSON COUNTY DEVELOPMENT APPROVALS AND PERMITS REQUIRED: 1. Type III Conditional Use Permit 2. Building Permit (BLD17-00057) APPLICABLE JEFFERSON COUNTY ORDINANCES: • Jefferson County Comprehensive Plan, adopted August 28, 1998, as amended • Unified Development Code for Jefferson Count y, Washington; effective January amended and codified as Jefferson County 2001, asa y Code Title 18 ED FINDINGS, CONCLUSIONS, AND RECOMMENDATIONS: PROPOS , The following section constitutes staff's findings and conclusions regarding the applicant's consistency with the Jefferson County Comprehensive Plan, the Unified Development Code, and the Jefferson County Shoreline Management Master Program. Following these findings and conclusions are a series of conditions recommended for consideration by the Hearing Examiner. Any of the findings, conclusions and recommendations may be adopted, rejected, or modified by the Hearing Examiner based on testimony or evidence presented during the course of review. The proposal is subject to review to determine consistency with the Jefferson County Comprehensive Plan and the Jefferson County Unified Development Code. The following sections of the Plan and Code are applicable to the proposal and are specifically addressed below: The Jefferson County Comprehensive Plan, 1998 - the following sections of the Comprehensive Plan are applicable to the proposal: Land Use and Rural Element, Legal Existing Uses, Goal 8.0 (p. 3-54) states: "Support the continued existence and economic viability of legally established land uses which become nonconforming as a result of Comprehensive Plan Adoption." Staff Comment: The proposal is consistent with this goal. Land Use and Rural Element, Legal Existing Uses, Policy LNP 8.2 (p. 3-55) states: "Existing commercial and industrial uses in areas designated Rural Residential will have the right to continue and not be subject to nuisance claims if operating in compliance with all County regulations" Staff Comment: The proposal is consistent with this policy. JCC 18.15.040 Categories of Land Use — Table 3-1 Allowable and Prohibited Uses LOG ITEM P*019 a of PUD Conforming Use & Modular Office Conditional Use Permit(ZON15-00023) Page 4 The proposal to structurally expand a PUD operations center with the addition of a 1,440 square foot modular office on land zoned Rural Residential 1:20 was reviewed to determine whether that use was allowed under JCC 18.15.040 Categories of Land Use. Table 3-1 Allowable and Prohibited Uses indicates that Major Utilities in the RR 1 :5 zone require a Type Ill Conditional Use permit. The subject office would therefore be considered a legal non-conforming use since it was legally established and permitted before the current zoning took effect (JCC 18.20.260(1)). The applicant had the choice of whether to expand the legal nonconforming use with a conditional use permit under JCC 18.20.260, or make the use conforming under current zoning by meeting current code under JCC 18.20.410 Utility development major with a Type Ill Conditional Use permit as required under Table 3-1. Anticipating future development on-site, the applicant opted for the latter since they would only need a building permit instead of the conditional use permit and building permit each time they chose to develop. JCC 18.20.410 Utility development major (1) Major Utility Developments. Major utility developments include utility development designed to serve a broader community or regional area, or are manned, including but not limited to: (a) Electrical generating facilities greater than 10 megawatts in output; (b) Electrical transmission lines exceeding 115 kilovolts; (c) Pipelines for petroleum or petroleum products with an inside diameter of six inches or greater and exceeding five miles in length; (d) Pipelines for natural gas, synthetic natural gas, or liquid propane gas with an inside diameter of 12 inches or greater and exceeding five miles in length; (e) Other similar utility or energy facilities not meeting the definition of a minor utility development. Staff Comment: The subject site meets the definition of a major utility as an electrical utility serving a broader community which is East Jefferson County. The site is the main office for the Jefferson County Public Utility District #1 serving electricity, and was purchased from Puget Sound Energy the original developers of the site. (2) The following standards apply to all major utility developments: (a) The need for the particular location proposed shall be demonstrated by the applicant to the satisfaction of the approval authority, including a full accounting of alternative locations and sites; Staff Comment: Since the site and utility are existing and have existed in the present location since 1973, prior to current zoning, the application is to make the LOG ITEM '` a of PUD Conforming Use & Modular Office Conditional Use Permit(ZON15-00023) Page 5 utility conforming to current code and zoning. No alternative sites are proposed or warranted. (b) The physical and economic impacts of such facilities shall be evaluated, and measures to mitigate these impacts provided; Staff Comment: The physical impact to the community and surrounding uses is minimal since the use has been in its current location since 1973 and no written comments were received from neighboring properties. The economic impacts are positive since the utility provides jobs to local residents, and provides needed electricity to the community as a whole. No mitigation is proposed. (c) Development shall comply with the requirements of JCC 18.20.220, Industrial uses — Standards for site development; and Staff Comment: See the JCC 18.20.220 section below on industrial development. (d) It shall be the affirmative duty of the applicant who proposes a major utility development to determine if any state or federal permits or licenses are necessary and then to obtain those permits or licenses at their own expense. [Ord. 8-06 § 1] Staff Comment: As conditioned, the proposal meeting this requirement. JCC 18.20.220 Industrial uses — Standards for site development (1) All Industrial Uses. The following standards apply to all industrial uses as listed in Table 3-1 , all industrial uses identified in Chapter 18.18 JCC (Irondale and Port Hadlock UGA Implementing Regulations), and to those other uses determined by the administrator to be industrial uses: (a) The use of chemicals, industrial solvents, or other noxious or hazardous substances shall comply with all federal, state, and county safety, fire, structural, storage, and disposal standards. Staff Comment: As conditioned, the proposal complies with this standard. (b) Water supplies, wastewater, and sewage disposal facilities adequate to serve the proposed use shall be provided. Industrial wastewaters shall not be discharged into an on-site septic system and are subject to waste discharge permit requirements established by the water quality program of the Washington Department of Ecology. Staff Comment: The proposal is currently and adequately served by public water with a new septic system approved by Environmental Health to be installed. As conditioned, this proposal complies with this standard. (c) Retail sales and services incidental to a principally permitted use are allowable, provided: LOG ITEM 9 PUD Conforming Use & Modular Office Conditional Use Permit(ZON15-00023) Page 6 Staff Comments: No retails sales are proposed or approved. (d) No use shall be made of equipment or material which produces unreasonable vibration, noise, dust, smoke, heat, glare, odor, or electrical interference to the detriment of the quiet use and enjoyment of adjoining property. Staff Comments: As conditioned, the proposal complies with this standard. (e) Use of a county access road or private road for access to new industrial development shall be permitted only if the applicant demonstrates that public health, safety and welfare will be protected, and if traffic and maintenance impacts to the private road are minimized by conditions on the permit. Staff Comment: The access off County road Four Corners is an existing permitted approach. No new traffic impacts are anticipated. The proposal compiles with this standard. (f) Development standards, including parking, visual screening and landscaping requirements, shall be as specified in Chapter 18.30 JCC, Development Standards, for rural industrial uses and as specified in Chapter 18.18 JCC (Irondale and Port Hadlock UGA Implementing Regulations) for urban industrial uses, except as otherwise provided for in this chapter. Staff Comment: There is adequate space on-site for additional parking. Existing landscape screening complies with JCC 18.30.130(2)(a). The proposal complies with these standards. (2) Light Industrial Uses — Additional Standards. All operations other than loading and unloading shall be conducted within a fully enclosed building, except for concrete batch plants located in an urban district subject to the requirements of this chapter. [Ord. 8-06 § 1] Staff Comment: The proposal is for an existing electrical utility. There are no "operations"other than the maintenance of the substation, service vehicles and offices. JCC 18.40.040 Permit Project application framework Type III permit applications for full Conditional Use permits require a notice and an open record public hearing before the hearing examiner who has final decision-making authority. Appeals of Type III permits are made to Superior Court. Staff Comment: The required public hearing was scheduled for August 25, 2015. JCC 18.40.530 - Approval Criteria for All Conditional Uses The County may approve or approve with modifications an application for a conditional use permit if all of the following criteria are satisfied: JCC 18.40.530(1)(a) The conditional use is harmonious and appropriate in design, character and appearance with the existing or intended character and quality of LOGiTEM #1E ci d of PUD Conforming Use& Modular Office Conditional Use Permit(ZON15-00023) Page 7 development in the vicinity of the subject property and with the physical characteristics of the subject property; Applicant Comment: Modular office is wood sided; of modern design; and blends in with existing buildings. Building will be for employees work stations, but will allow for a more open environment in existing buildings for customer contact and public use. Staff Comment: The proposal has been in existing on this site since about 1973 and have become integrated into the neighborhood without standing out or being inharmonious with surrounding uses and properties. The proposal is consistent with this criterion. JCC 18.40.530(1)(b) The conditional use will be served by adequate infrastructure including roads, fire protection, water, wastewater disposal, and storm water, wastewater disposal, and storm water control; Applicant Comment: Existing paved road approach for ingress and egress. Fire hydrant at entrance and next to buildings. Water provided by the PUD to buildings and hydrants. New pressurized distribution sand-lined drainfield bed system permit issued by Jeffco Env Health to be installed. Stormwater controlled by catch basins to pond. Staff Comment: All existing infrastructure on-site is adequate to serve the expansion. The proposal is consistent with this criterion. JCC 18.40.530(1)(c) The conditional use will not be materially detrimental to uses or property in the vicinity of the subject parcel; Applicant Comment: There are commercial and business enterprises in the area along with residences. PUD operations are situated back from residences or across the street. The only fence not shielded by trees and shrubs borders a business located a distance from the other residences and street. Entrance gate is exposed to a residence. Staff Comment: The proposal is for a legal nonconforming utility to comply with current zoning and development standards, and an addition of a 1,440 square foot modular office building. The utility has not be materially detrimental uses in the vicinity nor is it anticipated that it possibility could in the future. The site as well as the new building addition will be screened from surrounding properties and fit into the existing development scheme without requiring additional services. The proposal is consistent with this criterion. JCC 18.40.530(1)(d) The conditional use will not introduce noise, smoke, dust, fumes, vibrations, odors, or other conditions or which unreasonably impact existing uses in the vicinity of the subject parcel; Applicant Comment: Diesel trucks are parked 275 feet from property frontage. Other noise would be normal passenger automobile and light truck. One street light at 1_011-EVI PUD Conforming Use &Modular Office Conditional Use Permit(ZON15-00023) Page 8 entrance and 14 street lights placed in yard enclosure for security and safe movement of employees. Minimal smoke and dust. No fumes or chemicals used on premise. Staff Comment: There will be minimal short term construction impacts, but no long term impacts from noise, smoke, dust, fumes, vibrations or odors. The building permit will be reviewed for lighting and will require the current development standards to protect adjacent properties from light. The proposal will not unreasonably impact uses in the vicinity. The proposal is consistent with this criterion. JCC 18.40.530(1)(e) The location, size, and height of buildings, structures, walls, and fences, and screening vegetation for the conditional use will not unreasonably interfere with allowable development or use of neighboring properties; Applicant Comment: Tallest existing building is 30 feet. Existing buildings occupy 23,000 square feet. New building is 1,440 square feet. Trees surround building area from street and neighbors. Streets side sign is 48 inches wide by 63 inches high seen from both directions. Chain link fence screened by trees and vegetation except for entrance gate. Staff Comment: The proposal in a small modular office building addition to a legally established utility office that is consistent with established use, and to bring the utility into compliance with current code and zoning. Existing landscaping and screening are hereby deemed sufficient under JCC 18.30.130(2)(a). The proposal will not impact or interfere with uses of the surrounding area. The proposal is consistent with this criterion. JCC 18.40.530(1)(f) The pedestrian and vehicular traffic associated with the conditional use will not be hazardous to existing and anticipated traffic in the vicinity of the subject parcel; Applicant Comment: Pedestrian traffic is minimal. Customer traffic is 8:30 to 5:00. Operations traffic is 24/7 leaving and arriving. Additional parking spaces will create a total of 54 spaces for employee and customers. Staff Comment: There will be minimal pedestrian traffic associated with the proposal. Vehicular traffic will consist of light car, truck and service trucks associated with the workers and service equipment and vehicles. The access from Four Corners road is an existing legally permitted commercial approach. The proposal will not impact existing or anticipated transportation system. The proposal is consistent with this criterion. JCC 18.40.530(1)(d) The conditional use complies with all other applicable criteria and standards of this Code and any other applicable local, state or federal law; and more specifically, conforms to the standards contained in JCC 18.20 and JCC 18.30 of this Code; Applicant Comment: Existing 115kv substation is not part of the use. This activity entails setting a 1,440 square foot modular office on existing impervious surface. Lighting, stormwater catch basins and pond are in place. Signage is in place and LOG ITEM PUD Conforming Use & Modular Office Conditional Use Permit(ZON15-00023) Page 9 conforms to JCC 18.30.150. Parking will be determined by the Administrator. 54 spaces provided for public and employees. Staff Comment: The required building permit will review and approve the proposal under the current code development standards under JCC 18.20 & 18.30. For purposes of converting this legal non-conforming use to a use conforming to current zoning, the substation is being included in the review and proposal. Impervious surface coverage is approximately at the maximum allowed 25% in the Rural Residential zone. Parking has been determined to be adequate by the Administrator under JCC 18.20.100 Table 6-2. This proposal complies with all other applicable plans, codes and laws. JCC 18.40.570 Additional Conditions The County may impose additional conditions on a particular use if it is deemed necessary for the protection of the surrounding properties, the neighborhood, or the general welfare of the public. Staff Comment: No unmitigated adverse impacts have been identified, and no additional conditions have been deemed necessary for this proposal. The proposal is consistent with this code section. JCC 18.40.580, Use of Property Before Final Decision No building permit shall be issued for any use involved in an application for approval for a conditional use permit until the conditional use permit is approved and becomes effective. Staff Comment: As conditioned, the proposal is consistent with this criterion. JCC 18.40.590, Effective Period — Expiration a. A conditional use permit automatically expires and becomes void if the applicant fails to file for a building permit or other necessary development permit within three (3) years of the effective date (the date of the decision granting the permit) of the permit unless the permit approval provides for a greater period of time. b. Extensions to the duration of the original permit approval are prohibited. c. The Department of Community Development shall not be responsible for notifying the applicant of an impending expiration. Staff Comment: As conditioned, the proposal is consistent with this criterion. JCC 18.40.600, Modification of a Conditional Use Permit The county may modify an approved conditional use permit as follows: the county may delete, modify or impose additional conditions upon finding that the use for which the approval was granted has been intensified, changed or modified by the property owner or by person(s) who control the property without approval so as to significantly impact surrounding land uses. A modification will be processed as a Type II land use decision pursuant to JCC 18.40.270 of this Code. JCC 18.40.610, Conditional Use Permit to Run with the Land A conditional use permit granted under this JCC 18.40 shall continue to be valid upon a change of ownership of the site, business, service, use or structure that was the subject of the permit application. No other use is allowed without approval of an additional conditional use permit. Staff Comment: As conditioned, the proposal is consistent with this criterion. JCC 18.40.620, Permit Suspension or Revocation The County may suspend or revoke an approved conditional use permit pursuant to JCC 18.50 of this Code only upon finding that: a. The use for which the approval was granted has been abandoned for a period of at least one (1) year; b. Approval of the permit was obtained by misrepresentation of material fact; or c. The permit is being exercised contrary to the terms of approval. Staff Comment: As conditioned, the proposal is consistent with this criterion. JCC 18.40.630, Assurance Device In appropriate circumstances, the Administrator may require a reasonable performance or maintenance assurance device, in a form acceptable to the county prosecutor, to assure compliance with the provisions of this Code and the conditional use permit as approved. Staff Comment: As conditioned, the proposal is consistent with this criterion. STAFF RECOMMENDATION Based on the preceding findings and conclusions, staff recommends APPROVAL WITH CONDITIONS of the conditional use permit application (ZON15-00019) for conversion of a legal non-conforming utility operations center with substation to one that conforms to current zoning, with associated placement of a 1 ,440 square foot modular office building. CONDITIONS OF APPROVAL 1. The applicant shall have approved building permit BLD15-00057 to place a 1, 440 square foot modular office building on-site. Future development must utilize existing impervious surface. 4. No building permit shall be issued for any use involved in an application for approval for a conditional use permit until the conditional use permit is approved and becomes effective. 5. It shall be the affirmative duty of the applicant who proposes a major utility development to determine if any state or federal permits or licenses are necessary and then to obtain those permits or licenses at their own expense. 6. A conditional use permit automatically expires and becomes void if the applicant fails to file for a building permit or other necessary development permit within three (3) years of the effective date (the date of the decision granting the permit) of the permit unless the permit approval provides for a greater period of time. 7. The use of chemicals, industrial solvents, or other noxious or hazardous substances shall comply with all federal, state, and county safety, fire, structural, storage, and disposal standards. 8. Extensions to the duration of the original permit approval are prohibited. The Department of Community Development shall not be responsible for notifying the applicant of an impending expiration. 9.
