JCC 18.40.310 Reconsideration A party of record at a public hearing may seek reconsideration only of a final decision by filing a written request for reconsideration with the hearing examiner within five business days of the date of the final written decision. The request shall comply with JCC 18.40.330(5)(b). The hearing examiner shall consider the request without public comment or argument by the party filing the request, and shall issue a decision within 10 working days of the request. If the request is denied, the previous action shall become final. If the request is granted, the hearing examiner may immediately revise and reissue his/her decision or may call for argument in accordance with the procedures for closed record appeals. Reconsideration should be granted only when an obvious legal error has occurred or a material factual issue has been overlooked that would change the previous decision. PROJECT LOCATION: Parcel 801 102 008 in Section 10, Township 20, Range 01W, located at 5310 Eaglemount Road, Chimacum, WA 98325 CONDITIONS: 1.) 1. The applicant shall apply for and have approved a building permit to construct the 550 square foot addition. 2. Lighting shall be required to conform to JCC 18.30.140 standards. Lighting shall not exceed thirty (30) feet in height from finished grade. In addition, lighting shall not be directed towards adjacent properties and shall be shielded in a manner to mitigate glare. 3. No building permit shall be issued for any use involved in an application for approval for a conditional use permit until the conditional use permit is approved and becomes effective. 4. A conditional use permit automatically expires and becomes void if the applicant fails to file for a building permit or other necessary development permit within three (3)years of the effective date (the date of the decision granting the permit) of the permit unless the permit approval provides for a greater period of time. Extensions to the duration of the original permit approval are prohibited. The Department of Community Development shall not be responsible for notifying the applicant of an impending expiration. 5. The county may modify an approved conditional use permit as follows: the county may delete, modify or impose additional conditions upon finding that the use for which the approval was granted has been intensified, changed or modified by the property owner or by person(s)who control the property without approval so as to significantly impact surrounding land uses. A modification will be processed as a Type II land use decision pursuant to JCC 18.40.270 of this Code. 6. A conditional use permit granted under this JCC 18.40 shall continue to be valid upon a change of ownership of the site, business, service, use or structure that was the subject of the permit application. No other use is allowed without approval of an additional conditional use permit. 7. The County may suspend or revoke an approved conditional use permit pursuant to JCC 18.50 of this Code only upon finding that: a. The use for which the approval was granted has been abandoned for a period of at least one (1) year; b. Approval of the permit was obtained by misrepresentation of material fact; or c. The permit is being exercised contrary to the terms of approval. 8. In appropriate circumstances, the Administrator may require a reasonable performance or maintenance assurance device, in a form acceptable to the county prosecutor, to assure compliance with the provisions of this Code and the conditional use permit as approved. Olympia, WA 98504 PROJECT PLANNER: David Wayne Johnson, Associate Planner SUMMARY OF REQUEST: TYPE III CONDITIONAL USE "C" PERMIT to allow construction of a 550 square foot addition to a legal, non-conforming, office use in a Rural Residential zone. The property is located at 5310 Eaglemount Road, Chimacum. Access to the parcel is from Eaglemount Road via Center or West Valley Road. SUMMARY OF DECISION: Request granted, subject to conditions. PUBLIC HEARING: After reviewing the Jefferson County Department of Community Development Staff Report and examining available information on file with the application, the Examiner conducted a public hearing on the request as follows: The hearing was opened on August 25, 2015, at 2:15 p.m. and adjourned at 2:30 p.m. Parties wishing to testify were sworn in by the Examiner. The following exhibits were submitted and made a part of the record as follows: SEE ATTACHED INDEX LIST 1X DAVID JOHNSON appeared, presented the Department of Community Development Staff Report, and introduced Log Item 9, a revised Staff Report reflecting that the existing DNR office building was not converted from a single-family dwelling. The applicant originally applied for a building permit, but when staff reviewed the checklist, they determined that the applicant proposed a government use in a RR zone classification. The code prohibits such a use in the RR zone. The only way to accomplish the applicant's goal was to expand the existing nonconforming use on the site, which in turn requires a conditional use permit. They are expanding a building that is housing a legal, nonconforming use. The proposed 550 foot addition is more than ten percent of the size of the existing building and therefore does not qualify for an exemption. The addition is to an existing office and will generate no new traffic, and therefore no additional impacts will occur to services. Staff recommends approval and notes that the County cannot final the building permit until the conditional use permit is approved. ERIN MULDOON appeared on behalf of the request and testified that the office space is there now and the structure was built in the late 1950s. Eleven employees work at the site and they do not anticipate additional employees. They will use the building for additional office space for existing employees. He has read the conditions of approval and has no concerns. JOSH PETERS, DNR district manager, appeared and testified that he is present to support the application and had no questions or concerns. No one spoke further in this matter and the Examiner took the matter under advisement. The hearing was concluded. NOTE: A complete record of this hearing is available in the office of Jefferson County Department of Community Development. FINDINGS, CONCLUSIONS, AND DECISION: FINDINGS: 1 . The Hearing Examiner has heard testimony, admitted documentary evidence into the record, and taken this matter under advisement. 2. This application is exempt from review pursuant to the State Environmental Policy Act (SEPA). 3. A Public Hearing before the Hearing Examiner was scheduled for August 25, 2015 at 2 p.m. in the First Floor Conference Room of the Jefferson County Courthouse. The Notice of Public Hearing was published in the Port Townsend/Jefferson County Leader on August 12, 2015. Agencies and adjacent property owners were sent 2X notice of the public hearing on August 11, 2015. The property was posted by Staff on August 11, 2015. 4. The applicant, Washington State Department of Natural Resources (DNR), has a possessory ownership interest in two abutting parcels of property located at the southwest quadrant of the intersection of Eaglemount Road and Center Valley Road in the Chimacum area of unincorporated Jefferson County. The applicant desires to construct a 550 square foot, office building on the western parcel that consists of .83 acres and has a square configuration. The site has generally flat topography and slopes downward to the north. Eaglemount Road abuts the north property line and Center Valley Road the east property line. Abutting parcels to the south and west are vacant. 5. Improvements on the western parcel include the existing DNR office building that contains 1,440 square feet and a parking area. Two accessory structures containing 1 ,380 square feet and 160 square feet are on the overall site as well. The applicant desires to construct a new, 550 square foot addition to the west of the existing office building near its southwest corner. Breezeways will connect the new addition to the existing building. The building will provide additional office space for existing staff, and the applicant anticipates no new staff at the site. Therefore, the project will not generate additional traffic or demands on public facilities and services. 6. The parcel is located within the Rural Residential designation of the Jefferson County Comprehensive Plan that contemplates residential development with a density of one dwelling unit per 20 acres. The parcel is also located within the Rural Residential 1:20 zone classification of the Jefferson County Code that authorizes single-family residential homes but prohibits "government offices" (see page 6, Log Item 1). The present, DNR office building was constructed in the late 1950s, and DNR's use of the parcel and structures are considered a legal, nonconforming use. 7. The applicant desires to expand the office use by more than ten percent or 200 square feet. Section 18.20.260(1)(c)JCC authorizes expansion of a nonconforming use beyond the ten percent limit subject to obtaining approval of a discretionary conditional use permit and by meeting the additional criteria set forth in said section. For the reasons set forth on pages 4-9 of the Staff Report, the request satisfies all criteria set forth in all applicable sections of the JCC. The Examiner adopts herein by this reference all of staff's Findings as if set forth in full. The new structure will complement the existing building, will not exceed a height of 17 feet to the peak of the roof, and will utilize siding that is both durable and appropriate in type and color to the surrounding area. The office will use the same access onto Eaglemount Road that is presently used to access the existing DNR office building. The new structure will measure 80 feet from the Eaglemount Road right-of-way, and according to photographs in the file, the site is wooded and attractive. The applicant will install no signs on the building and will retain existing vegetation. The existing 3X parking lot will serve the new structure. CONCLUSIONS: 1. The Hearing Examiner has jurisdiction to consider and decide the issues presented by this request. 2. The applicant has shown that the request for a conditional use permit satisfies all criteria set forth in JCC 18.40.520(2) as well as the criteria set forth in JCC 18.20.260(1)(c), and therefore said permit should be approved subject to the following conditions: 1. The applicant shall apply for and have approved a building permit to construct the 550 square foot addition. 2. Lighting shall be required to conform to JCC 18.30.140 standards. Expansions of structures housing legal non-conforming uses greater than 10% or 200 square feet shall requires a Type III Condition Use Permit with public notice, a public hearing and decision by the Jefferson County Hearing Examiner per JCC 18.20.260(3)(c). This proposal also requires a building permit and is exempt from SEPA review. LOG ITEM 9 DNR Office Expansion Conditional Use Permit(ZON15-00019) Page 2 Legal Description: Parcel 801 102 008 in Section 10, Township 20, Range 01W, located at 5310 Eaglemount Road, Chimacum, WA 98325 Property Description: The subject parcel encompasses approximately .83 acres and is square in configuration. The site was formerly a single family residence and is currently developed with offices for the Department of Natural Resources. The parcel is generally flat in topography with a gradual slope down to the north (roadway). A pasture and mapped wetland is location on the adjacent parcel to the west and south. The subject parcel contains native scrub and mature native trees interspersed between buildings and parking areas. Surrounding Area: The property is bordered to the south and west by a single family residence and undeveloped pasture, to the east by largely undeveloped land with a building owned by the applicant, and to the north by single family residential use and undeveloped land. Comprehensive Plan Designation: The Jefferson County Comprehensive Plan (adopted August 28, 1998) designates the site and area north of Eaglemount Road as Rural Residential 1 dwelling per 20 acres (RR 1:20), and the area directly west and south of the proposed site as Agricultural Land (AP 1:20). Date of Pre-application Conference: The required pre-application conference was held on March 3, 2015 (log item 1) Date of application: Application for a Type Ill Conditional Use permit to expand a legal non-conforming use beyond 10% or 200 square feet was submitted on June 3, 2015, and deemed substantially complete on June 19, 2015. Notice of Application: The Notice of Application was published in the Port Townsend/Jefferson County Leader on June 24, 2015. Agencies and adjacent property owners were sent notice of the proposal on June 23, 2015. The property was posted by Staff on June 24, 2015. The 14 day comment period for the application expired on July 8, 2015. No written comments were received. Notice of Public Hearing: A Public Hearing before the Hearing Examiner was scheduled for August 25, 2015 at 2 p.m. in the First Floor Conference Room of the Jefferson County Courthouse. The Notice of Public Hearing was published in the Port Townsend/Jefferson County Leader on August 12, 2015. Agencies and adjacent property owners were sent notice of the public hearing on August 11, 2015. The property was posted by Staff on August 11, 2015. Site Visit: Staff conducted a site visit on June 24, 2015. CRITICAL AREA REVIEW: This proposal received consistency review pursuant to the Jefferson County Code Title 18 Unified Development Code, including consideration of LOG ITEM 4-5-79- 4.31T . DNR Office Expansion Conditional Use Permit(ZON15-00019) Page 3 Critical Areas (JCC 18.22). GIS mapping indicated the project site is beyond the 100 foot buffer required for the Category II Wetland delineated on the adjacent property (MLA14-00093) to the southwest. No other critical areas have been identified. JEFFERSON COUNTY DEVELOPMENT APPROVALS AND PERMITS REQUIRED: 1. Type III Conditional Use Permit 2. Building Permit APPLICABLE JEFFERSON COUNTY ORDINANCES: • Jefferson County Comprehensive Plan, adopted August 28, 1998, as amended • Unified Development Code for Jefferson County, Washington; effective January 16, 2001, as amended and codified as Jefferson County Code Title 18 PROPOSED FINDINGS, CONCLUSIONS, AND RECOMMENDATIONS: The following section constitutes staff's findings and conclusions regarding the applicant's consistency with the Jefferson County Comprehensive Plan, the Unified Development Code, and the Jefferson County Shoreline Management Master Program. Following these findings and conclusions are a series of conditions recommended for consideration by the Hearing Examiner. Any of the findings, conclusions and recommendations may be adopted, rejected, or modified by the Hearing Examiner based on testimony or evidence presented during the course of review. The proposal is subject to review to determine consistency with the Jefferson County Comprehensive Plan and the Jefferson County Unified Development Code. The following sections of the Plan and Code are applicable to the proposal and are specifically addressed below: The Jefferson County Comprehensive Plan, 1998 - the following sections of the Comprehensive Plan are applicable to the proposal: Land Use and Rural Element, Legal Existing Uses, Goal 8.0 (p. 3-54) states: "Support the continued existence and economic viability of legally established land uses which become nonconforming as a result of Comprehensive Plan Adoption." Staff Comment: The proposal is consistent with this goal. Land Use and Rural Element, Legal Existing Uses, Policy LNP 8.5.2 & 8.5.2(a) (p. 3-55 & 56) states: "A structure housing a legal nonconforming use may be enlarged and/or expanded if it meets all applicable bulk, dimensional and lot coverage requirements for the zoning district in which the use is located." LNP 8.5.2(a) states: "Expansion of structures housing legal nonconforming uses up to 10% of the existing building size or 200 square feet, whichever is greater, shall be subject to an administrative approval LOG ITEM ct g of is DNR Office Expansion Conditional Use Permit(ZON15-00019) Page 4 process. More substantial expansions, up to a cap of 3,999 square feet shall be subject to a public hearing process to ensure notification of adjacent property owners." Staff Comment: The proposal is consistent with this policy. JCC 18.15.040 Categories of Land Use — Table 3-1 Allowable and Prohibited Uses The proposal to expand a government office on land zoned Rural Residential 1:20 was reviewed to determine whether that use was allowed under JCC 18.15.040 Categories of Land Use. Table 3-1 Allowable and Prohibited Uses indicates that government offices in the RR 1:20 zone are not allowed. The subject office would therefore be considered a legal non-conforming use since it was legally established and permitted before the current zoning took effect (JCC 18.20.260(1)). JCC 18.20.260 Nonconforming uses and structures Expansion of a structure (office) that houses the non-conforming use (government office in a RR 1:20 zone) would require a Type Ill Conditional Use permit for expansions over 10% of the existing structure's square footage or over 200 square feet (JCC 18.20.260(3)(c)). The proposed expansion is 550 square feet which is over the 10% of the existing structures square footage of 1,440 (1440 x .10 = 144) and over the 200 square foot limit. JCC 18.40.040 Permit Project application framework Type Ill permit applications for full Conditional Use permits require a notice and an open record public hearing before the hearing examiner who has final decision-making authority. The required public hearing was scheduled for August 25, 2015. Appeals of Type Ill permits are made to Superior Court. JCC 18.40.530 - Approval Criteria for All Conditional Uses The County may approve or approve with modifications an application for a conditional use permit if all of the following criteria are satisfied: JCC 18.40.530(1)(a) The conditional use is harmonious and appropriate in design, character and appearance with the existing or intended character and quality of development in the vicinity of the subject property and with the physical characteristics of the subject property; Applicant Comment: The new addition will be the same height as the existing building, approximately 17' to the highest point of the roof. The new addition will be cladded in siding that is both durable and appropriate in type & color to the surrounding context. The shed roof will be pitched to maximize the daylight into the space. Staff Comment: Staff agrees with the applicant's comments. See site plans (log item 4) for existing and future building design. The proposal is consistent with this criterion. DNR Office Expansion Conditional Use Permit(ZON 15-00019) Page 5 JCC 18.40.530(1)(b) The conditional use will be served by adequate infrastructure including roads, fire protection, water, wastewater disposal, and storm water, wastewater disposal, and storm water control; Applicant Comment: Roads: the new addition is located off of Eaglemount Road. Water: On an existing well. Wastewater: there is an existing septic tank on-site. No additional plumbing is being proposed. Stormwater: the site will not be disturbed/altered other than the footprint of the new addition, the stormwater control will be maintained and remain as it currently exists. Staff Comment: All existing infrastructure on-site is adequate to serve the expansion. The proposal is consistent with this criterion. JCC 18.40.530(1)(c) The conditional use will not be materially detrimental to uses or property in the vicinity of the subject parcel; Applicant Comment: The existing property is large and screened by existing trees. The small (550 st) addition will be set back approximately 80'from the street and will be in the same character as the existing building. Staff Comment: The proposal is for a 550 square foot addition to an existing structure which will be screened from surrounding properties and fit into the existing development scheme without requiring additional services. The proposal is consistent with this criterion. JCC 18.40.530(1)(d) The conditional use will not introduce noise, smoke, dust, fumes, vibrations, odors, or other conditions or which unreasonably impact existing uses in the vicinity of the subject parcel; Applicant Comment: There will be no noise generated by this conditional use. Outdoor lights (less than 30'in height, shielded, and energy efficient) may be located on the exterior of the building Staff Comment: There will be the normal short term construction impacts, but no long term impacts from noise, smoke, dust, fumes, vibrations or odors. The building permit will be reviewed for lighting and will require the current development standards to protect adjacent properties from light. The proposal will not unreasonably impact uses in the vicinity. The proposal is consistent with this criterion. JCC 18.40.530(1)(e) The location, size, and height of buildings, structures, walls, and fences, and screening vegetation for the conditional use will not unreasonably interfere with allowable development or use of neighboring properties; Applicant Comment: A new 550 square foot addition to the existing 1,440 sf Washington State DNR Work Center building. The addition will include open and enclosed office space with an enclosed breezeway connecting the existing building to the new addition. There will be no signage on the building. Existing screening and vegetation will remain, no additional sitework is planned. Staff Comment: The proposal in a small addition to a legally establish office building, the size, design and appearance of which is consistent with development patterns in the area. Existing landscaping and screening is deemed sufficient under JCC 18.30.130(2)(a). The proposal will not impact or interfere with uses of the surrounding area. The proposal is consistent with this criterion. JCC 18.40.530(1)(f) The pedestrian and vehicular traffic associated with the conditional use will not be hazardous to existing and anticipated traffic in the vicinity of the subject parcel; Applicant Comment: There is an existing parking lot located on site that is sufficient and won't be altered with this addition. There will be no additional employees added to this office. Staff Comment: There will be no pedestrian traffic associated with the proposal. Table 3-1 Allowable and Prohibited Uses indicates that government offices in the RR 1:20 zone are not allowed. The subject office would therefore be considered a legal non-conforming use since it was legally established and permitted before the current zoning took effect (JCC 18.20.260(1)). JCC 18.20.260 Nonconforming uses and structures Expansion of a structure (office) that houses the non-conforming use (government office in a RR 1:20 zone) would require a Type III Conditional Use permit for expansions over 10% of the existing structure's square footage or over 200 square feet (JCC 18.20.260(3)(c)). The proposed expansion is 550 square feet which is over the 10% of the existing structures square footage of 1,440 (1440 x .10 = 144) and over the 200 square foot limit. JCC 18.40.040 Permit Project application framework Type III permit applications for full Conditional Use permits require a notice and an open record public hearing before the hearing examiner who has final decision-making authority. No other use is allowed without approval of an additional conditional use permit. 7. A legal nonconforming use or structure is one that conformed to all applicable codes in effect on the date of its creation, but no longer complies due to subsequent changes in the code. Nonconformity is different than and is not to be confused with illegality (see the definitions of"nonconforming," "nonconforming use," and "illegal use in Chapter 18.10 JCC). Legal nonconforming uses and structures are commonly referred to as "grandfathered." (1) Nonconforming uses of land are uses which currently exist and were lawfully established prior to the enactment of this code. Legally established uses may continue as long as they remain otherwise lawful, provided: (a) The nonconforming use of land is not discontinued or abandoned for a period more than two years. A property owner may be allowed three years if they demonstrate a bona fide intention to sell or lease the property. For purposes of calculating this time period, a use is discontinued or abandoned upon the occurrence of the first of any of the following events: (i) On the date when the land was physically vacated; (ii) On the date the use ceases to be actively involved in the sale of merchandise or the provision of services; or (iii) On the date of termination of any lease or contract under which the nonconforming use has occupied the land. (b)A legal existing nonconforming use can be expanded up to 10 percent subject to a Type I permit approval process. (c)A nonconforming use may be expanded beyond 10 percent through the approval of a Type II C(d) discretionary conditional use permit process. In addition to meeting the criteria set forth through the conditional use permit process, the department shall determine the expansion proposal has met the following: (i) The proposed area for expansion is contiguous to the nonconforming use; (ii) The area for expansion of the use complies with all applicable bulk and dimensional standards, performance provisions, and environmental and shoreline (WAC 173-27-080) regulations; (iii) The area for expansion shall not increase the land area devoted to the nonconforming use by more than 100 percent of that use at the effective date of the nonconformance; (iv) The expansion shall not be granted if it would result in a significant increase in the intensity of the use of the nonconformity (e.g., hours of operation, traffic). LOGS EM Page 7 of Cc (d) A nonconforming use of land may be changed to another nonconforming use; provided, that the proposed use is equally or more appropriate to the district than the existing nonconforming use. Such change shall not be more intensive or have greater impacts than the existing use. The proposed change shall be required to undergo a Type III conditional use approval process. If the proposal encompasses structural or use expansion, refer to subsections (2) and (3) of this section. (2) Nonconforming structures are those that are out of compliance with the development standards set forth through this code or other applicable federal, state or local regulation. (a)Any legally established nonconforming structure is permitted to remain in the form and location in which it existed on the effective date of the nonconformance. (b) Nonconforming structures may be structurally altered or enlarged only if all applicable environmental and development standards are met. (c) Repairs to existing nonconforming structures including ordinary maintenance or replacement of walls, fixtures, or plumbing shall be permissible so long as the exterior dimensions of the structure are not increased. (d) Nonconforming structures under the jurisdiction of the Shoreline Master Program shall be subject to the nonconforming provisions stipulated through WAC 173-27-080. (e)A legal existing nonconforming structure damaged or destroyed by fire, earthquake, explosion, wind, flood, or other calamity may be completely restored or reconstructed. A structure shall be considered destroyed for purposes of this section if the restoration costs exceed 75 percent of the assessed value of record when the damage occurred. A structure can be completely restored or reconstructed if all the following criteria are met: (i)The restoration and reconstruction shall not serve to extend or increase the nonconformance of the original structure or use with existing regulations; and (ii) The reconstruction or restoration shall, to the extent reasonably possible, retain the same general architectural style as the original destroyed structure, or an architectural style that more closely reflects the character of the surrounding area; and (iii) Permits shall be applied for within one year of damage, an extension for permit application may be requested from the administrator. Restoration or reconstruction must be substantially completed within two years of permit issuance; and (iv) Any modifications shall comply with all current regulations and codes (other than use restrictions) including, but not limited to, lot coverage, yard, height, open space, density �LOG �� ITEM Pag C -S of provisions, or parking requirements unless waived by the appropriate county official through the granting of a variance. (f) A legal existing nonconforming structure can be expanded up to 10 percent subject to a Type I permit approval process. (g)A legal existing nonconforming structure may be expanded beyond 10 percent through the approval of a Type II C(d) discretionary conditional use permit. The expansion shall not increase the structure by more than 100 percent of total square footage calculated from the effective date of the nonconformance. Proposals for expanding structures which house or contain a nonconforming use are subject to subsection (3) of this section. (3) Nonconforming uses of structures apply to structures, whether conforming or nonconforming, that house or contain nonconforming uses; (a)A structure which houses or contains a nonconforming use cannot be expanded or enlarged if the structure (in its enlarged or expanded state) does not meet all applicable performance and use standards, or environmentally sensitive area requirements for the land use district in which it is located. (b)A structures housing an existing legal nonconforming uses can be expanded up to 10 percent or 200 square feet, whichever is greater, subject to a Type I permit approval process. (c) Substantial expansions which exceed either 10 percent or 200 square feet shall be subject to a Type III conditional use permit approval process. The expansion cannot increase the structural portion of the nonconforming use by more than 3,999 square feet. The expansion is calculated from the effective date of the nonconformance. (d)A legal existing structure containing a nonconforming use may be repaired or maintained subject to all applicable building and health codes. (e)A nonconforming use contained within a nonconforming structure which is damaged or destroyed by fire, earthquake, explosion, wind, flood, or other calamity may be reestablished pursuant to subsection (2)(e) of this section. (f) Nonconforming uses contained or housed in a structure cease to retain their legal nonconforming status if the use is discontinued or abandoned for any reason for a period more than two years. A property owner may be allowed three years if they demonstrate a bona fide intention to sell or lease the property. [Ord. 8-06 § 1] LOG ITEM Paa ( bofL . Conditional Uses 18.40.490 Purpose. The purpose of the conditional use permit process is to provide flexibility in the application of the use regulations contained in this code in order to accommodate uses that may be appropriate in an established district under certain circumstances, but inappropriate in the same district under others. At the time of application, a review of the location, design, configuration, and potential impact of the proposed use shall be conducted by comparing the use to the goals and policies established in the Jefferson County Comprehensive Plan and to adopted development standards. This review shall determine whether the proposed use should be permitted by weighing the public need or the benefit to be derived from the use against the impact that it may cause. [Ord. 8-06 § 1] 18.40.500 Scope. This article shall apply to each application for a conditional use permit. Only those uses indicated by a "C(a)," "C(d)" or"C" opposite the use in Table 3-1 in JCC 18.15.040 will be considered for a conditional use permit. [Ord. 8-06 § 1] 18.40.510 Application submittal and contents. (1) The application for a conditional use permit shall be submitted to DCD on forms provided by the department, along with the appropriate fees established under the Jefferson County fee ordinance. The application shall include all materials required pursuant to JCC 18.40.100. (2) The administrator may waive specific submittal requirements determined to be unnecessary for review of an application. [Ord. 8-06 § 1] 18.40.520 Conditional use permit types— Review processes. (1) Applications for uses listed as an administrative conditional use permit(i.e., "C(a)") in Table 3-1 in JCC 18.15.040 shall be processed according to the procedures for Type II land use decisions established in Article IV of this chapter. (2)Applications for uses listed as discretionary conditional use permits (i.e., "C(d)") in Table 3-1 in JCC 18.15.040 shall, at a minimum, be processed according to the procedures for Type II land use decisions established in Article IV of this chapter. However, in accordance with this subsection, the administrator may on a case-by-case basis refer a discretionary conditional use permit application to the hearing examiner to be processed according to the procedures for Type III land use decisions established in Article IV of this chapter. LOG ITEM a ( ( of /B . (a) Required Findings. Prior to referring an application for a use listed as"C(d)" in Table 3-1 in JCC 18.15.040 to the hearing examiner, the administrator shall make one or both of the following findings: (i) In the exclusive, discretionary judgment of the administrator, the application involves potentially significant issues relating to location, design, configuration, and potential impacts to surrounding properties and the community that can be more appropriately considered and addressed through an open public record pre-decision hearing before the Jefferson County hearing examiner; or (ii) In the exclusive, discretionary judgment of the administrator, the application seeks approval of a use involving complex legal issues necessitating special expertise in the decision-maker. (b)Timing. The administrator shall determine whether or not to refer an application to the hearing examiner, for a public hearing, concurrent with the determination of completeness required under JCC 18.40.110(1). (c) Discretion of the Administrator. The administrator's decision to refer an application to the hearing examiner under this subsection to be processed as a Type III application shall be for the purpose of affording maximum fairness in decision-making and procedural due process protection, and shall not affect the substantive applicability of local, state or federal policies or law applicable to any permit application. The decision to refer any application to the hearing examiner to be processed as a Type III application rests exclusively within the discretion of the administrator. (d) No Notice or Hearing Required. Because the administrator's decision to refer(or not to refer) an application for a use listed as "C(d)" in Table 3-1 in JCC 18.15.040 to the hearing examiner for a public hearing rests solely in the administrator's discretion, the county is not required to provide prior notice of the administrator's decision. The administrator shall not be required to hold a public hearing on such a decision. The decision of the administrator made pursuant to this subsection (2) shall not constitute an appealable administrative decision. (3)Applications for uses listed as a "C" in Table 3-1 in JCC 18.15.040 shall be processed according to the procedures for Type III land use decision established in Article IV of this chapter. [Ord. 8-06 § 1] 18.40.530 Approval criteria for all conditional uses. (1) The county may approve or approve with modifications an application for a conditional use permit (i.e., uses listed in Table 3-1 in JCC 18.15.040 as"C(a)," "C(d)" or"C") if all of the following criteria are satisfied: LOG ITEM (a) The conditional use is harmonious and appropriate in design, character and appearance with the existing or intended character and quality of development in the vicinity of the subject property and with the physical characteristics of the subject property; (b) The conditional use will be served by adequate infrastructure including roads, fire protection, water, wastewater disposal, and stormwater control; (c) The conditional use will not be materially detrimental to uses or property in the vicinity of the subject parcel; (d) The conditional use will not introduce noise, smoke, dust, fumes, vibrations, odors, or other conditions or which unreasonably impact existing uses in the vicinity of the subject parcel; (e) The location, size, and height of buildings, structures, walls and fences, and screening vegetation for the conditional use will not unreasonably interfere with allowable development or use of neighboring properties; (f)The pedestrian and vehicular traffic associated with the conditional use will not be hazardous to existing and anticipated traffic in the vicinity of the subject parcel; (g) The conditional use complies with all other applicable criteria and standards of this code and any other applicable local, state or federal law; and more specifically, conforms to the standards contained in Chapters 18.20 and 18.30 JCC; (h) The proposed conditional use will not result in the siting of an incompatible use adjacent to an airport or airfield; (i) The conditional use will not cause significant adverse impacts on the human or natural environments that cannot be mitigated through conditions of approval; (j) The conditional use has merit and value for the community as a whole; (k)The conditional use is consistent with all relevant goals and policies of the Jefferson County Comprehensive Plan; and (I) The public interest suffers no substantial detrimental effect. Consideration shall be given to the cumulative effect of similar actions in the area. (2) In instances where all of the above findings cannot be made, the application shall be denied. (3) The administrator may consider applications for modifications of lawfully established conditional uses and developments approved under this code and conditional uses in existence on December 18, 2000, when the application proposes to bring the existing use substantially closer to compliance with the standards of this code. The administrator may approve, conditionally approve, or deny the modification application. A site plan conforming to the provisions of this chapter and Article II, Project Permit Applications (Type I — IV), of this chapter LOG ITEM C.3 of L3 shall accompany the application showing the location, size and type of modification proposed by the applicant. (4) Modifications may be approved by the administrator under Type I review procedures; provided, that the cumulative modifications of the approved use will not exceed the following limitations: (a) The modification will not increase residential use by more than one unit, if allowed by the land use district; (b) The modification will not increase the required amount of parking by more than 20 percent or 20 spaces (whichever is less); (c) The proposed modification will not expand the total square footage of all structures and/or outdoor use areas, excluding parking, by more than 20 percent. In addition, the proposed expansion of the structure shall not result in total size of the structure exceeding the maximum building size limits in Chapter 18.30 JCC; (d) The modification will not change or modify any special condition imposed under any previous official review; (e) The modification will not significantly reduce the amount or location of required site screening; (f) The modification will not expand an existing nonconforming use or structure, or render a conforming use or structure nonconforming; (g) The modification will not establish a new use; (h) The modification will not expand a mining/site operation, mineral processing or mineral batching activity; (i) In the determination of the administrator, the modification will not create or materially increase any adverse impacts or undesirable effects of the project, or cause the use or structure to become inconsistent with the Comprehensive Plan or the purpose of the land use class and district. (5) All proposed uses, structures and site improvements (and modifications thereof) shall comply with the development standards of this code. (6) Any proposed modification that does not meet all the requirements of this subsection shall not be approved through this process, but shall be reviewed through the current review procedures as outlined by this chapter. The county may impose additional conditions on a particular use if it is deemed necessary for the protection of the surrounding properties, the neighborhood, or the general welfare of the public. The conditions may: (1) Increase requirements in the standards, criteria or policies established by this code; (2) Stipulate an exact location for the conditional use on the subject property as a means of minimizing hazards to life, limb, property damage, erosion, landslides or traffic; (3) Require structural features or equipment as a means of minimizing hazards to life, limb, property damage, erosion, landslides or traffic; or (4) Contain restrictions or provisions deemed necessary to establish parity with uses permitted in the same zone with respect to avoiding nuisance generating features in matters of noise, odors, air pollution, wastes, vibration, traffic and physical hazards. No building permit shall be issued for any use involved in an application for approval for a conditional use permit until the conditional use permit is approved and becomes effective. (1)A conditional use permit automatically expires and becomes void if the applicant fails to file for a building permit or other necessary development permit within three years of the effective date (the date of the decision granting the permit) of the permit unless the permit approval provides for a greater period of time. (2) Extensions to the duration of the original permit approval are prohibited. (3) The department of community development shall not be responsible for notifying the applicant of an impending expiration. [Ord. 8-06 § 1] 18.40.570 Modification of a conditional use permit. No conditional use permit can be granted unless consistency with the performance standards of JCC 18.20, the development standards of JCC 18.30, the procedural requirements of JCC 18.40.280, and the approval criteria of JCC 18.40.530, and other applicable requirements of the UDC have been satisfied. Approval of the conditional use is effective for three (3) years from the date of original approval. If a building permit has not been issued within the three (3) year period, the conditional use approval will expire. The following questions will assist in the evaluation of the conditional use request: 1 Describe the requested conditional use. A 550 sf addition is proposed to an existing office building located in a Residential Zone. Currently a permitted temporary trailer office exists next to the building. This trailer will be removed prior to new construction. The existing office building is grandfathered into the Residential Zone, and the addition is a requested Conditional Use. 2. Explain how the conditional use is harmonious and appropriate in design, character and appearance with the existing or intended character and quality of development in the vicinity and with the physical characteristics of the subject property. The new addition will be the same height as the existing building, approximately 17' to the highest point of the roof. The new addition will cladded in siding that is both durable and appropriate in type&color to the sur- rounding context. The shed roof will be pitched to maximize the daylight into the space. 3. Describe the infrastructure including but not limited to roads, fire protection, water, wastewater disposal, and stormwater control which will serve the requested conditional use. Roads: the new addition is located off of Eaglemount Road. Water: On an existing well. Wastewater: there is an existing septic tank on-site. No additional plumbing is being proposed. Stormwater: the site will not be disturbed/altered other than the footprint of the new addition, the stormwater control will be maintained and remain as it currently exists. 4. Describe the location,size, and height of buildings,structures,signage,walls and fences, and screening vegetation for the use. A new 550 square foot addition to the existing 1,440 sf Washington State DNR Work Center building. The ad- dition will include open and enclosed office space with an enclosed breezeway connecting the existing building to the new addition. There will be no signage on the building. Existing fence surrounding property will remain. Existing screening and vegetation will remain, no additional sitework is planned. 5. Describe any noise, smoke, dust, fumes, vibrations, odors, outdoor lights or other impacts will be generated by the conditional use. There will be no noise generated by this conditional use. Outdoor lights (less than 30' in height, shielded, and energy efficient) may be located on the exterior of the building. 6. Describe the pedestrian and vehicular traffic and parking area associated with the conditional use. There is an existing parking lot located on site that is sufficient and won't be altered with this addition. There will be no additional employees added to this office. The new addition will provide essential additional space for the DNR staff to serve the public. The addition is on an existing developed site, reducing additional land development within the County.
