Parcel numbers are assigned upon recording of Statement of Intent. 2.) The Lot Certification statement of intent legal descriptions shall be recorded with Jefferson County Auditor's office. 3.) CONSISTENT WITH RCW 84.56.345, CURRENT YEAR AND ALL DELINQUENT PROPERTY TAXES INCLUDING COMPENSATING TAX FROM OPEN SPACE PROGRAM SHALL BE PAID IN FULL PRIOR TO RECORDING THE STATEMENT OF INTENT. FINDINGS: 1.) The Administrator finds that this application complies with applicable provisions of the Unified Development Code, all other applicable ordinances and regulations, and is consistent with the Jefferson County Comprehensive Plan and Land Use map. 2.) As the Parcels are found exempt from RCW 58.17 and Jefferson County Code 18.35, a title report is not required. It is the property owner's responsibility to identify and rectify any security interest conveyances, encumbrances, easements or restrictions affecting the subject properties involved in this county reviewed exemption. 3.) This determination does not guarantee an ability to develop the parcels. All development shall comply with the on-site sewage code, the building codes and local development regulations in effect at the time of application. 4.) Based on the findings, parcel number 702111023 can be considered two (2) separate parcels as described in the legal descriptions submitted with the application. This Parcel is segregated by Lords Lake Loop Road. 5.) The parcel has been designated as RR 1:5 Rural Residential under the Jefferson County Comprehensive Land use Map effective August 28, 1998. 6.) On February 27, 2015, Sherrie Shold in the Assessor's Office commented as follows: "This parcel was purchased and created in May of 1968. So I would assume the defining factor if this may be a road division or not would be the date that Lords Lake Loop Road became a County Road or how it became a County Road." 7.) On February 23, 2015, Pat Perryman in the Assessor's GIS department commented as follows: "I have no problems with the proposed lot certification." 8.) On February 20, 2015, Mara Dotson of Public Works commented on the proposal as follows: "This portion of Lords Lake Loop Road (#C342309 &APN 702111023) was granted by an easement to the Forest Service through the USDA June 1950. The easement was later transferred to the county and is first listed on our county road system in 1956. The easement states the road is 66 feet wide." 9.) RCW 58.17, requiring regulation of division of land, was enacted August 11, 1969. Upon its passage, all future land subdivision would be regulated. The road segregation provision applies to lots in existence prior to 1969. Parcel 702111023 was created "May of 1968". The road segregation provision applies to this parcel. 10.) The proposal is found to be an exemption under Jefferson County Code (JCC) Section 18.35.040(4): (4) Divisions of land relating to the acquisition of a fee simple interest in land by public agencies, including, but not limited to, divisions made for road or public right-of-way conveyance or widening purposes. This exemption shall not be construed to include acquisitions of easements. 11.) Jefferson County determined that this proposal is categorically exempt from review under the State Environmental Policy Act(SEPA) pursuant to WAC 197-11-800(6)(a). 12.) NOTICE: This permit does not excuse the proponent from complying with other local, state, and federal ordinances, regulations, or statutes applicable to the proposed development, but consistent with RCW 90.58. Development pursuant to this permit shall be undertaken subject to the applicable policies and performance standards of the Jefferson County Shoreline Management Master Program and the Jefferson County Unified Development Code. If during excavation or development of the site an area of potential archaeological significance is uncovered, all activity in the immediate area shall be halted, and the Administrator shall be notified at once. The Federal Endangered Species Act rules to protect threatened Chinook and Summer-run Chum salmon became effective on January 8, 2001. Bull trout have been listed as threatened since early 2000. Under the ESA, any person may bring lawsuit against any individual or agency that"takes" listed species (defined as causing harm, harassing, or damaging habitat for the listed species). In addition, the National Marine Fisheries Service can levy penalties. Portions of Jefferson County, including marine environments are included as "critical habitat"for listed species. Development of property along any marine shoreline, freshwater shoreline, or floodplains could harm habitat if protective measures are not taken. To minimize the potential to damage habitat, all property owners developing adjacent to marine shoreline, freshwater shoreline, or floodplains are advised to do the following: -All development activities should avoid unstable slopes, wetlands, and forested areas near surface waters - Remove minimal vegetation for site development, especially large trees -Allow trees that have fallen into surface waters to remain there - Infiltrate stormwater from buildings and driveways onsite through drywells rather than discharging directly into surface waters or roadside ditches The Federal Bald and Golden Eagle Protection Act requires landowners within 660 feet(1/8th of a mile)of an eagle nest to consult with the US Fish and Wildlife Service. This Eagle Act prohibits anyone from"taking" bald eagles. This federal law defines the term "take" and describes the possible legal consequences when a"take" occurs. Among other actions, "take" includes a disturbance of bald eagles or their habitat. Under federal law a permit may still be required for activities that impact bald eagles or their habitat. Contact the US Fish and Wildlife Service (http://www.fws.gov/pacific/eagle/)to learn more about how this law affects your project. Any individual, group, or agency can bring suit for a listed species"taking", even if you are in compliance with Jefferson County development codes. The risk of a lawsuit against you can be reduced by consulting with a professional fisheries habitat biologist, and following the recommendations for site development provided by the biologist. For more information, contact the National Marine Fisheries Service in Seattle, or the U.S. Fish and Wildlife Service. APPEALS: Pursuant to RCW 36.70C, the applicant or any aggrieved party may appeal this final decision to Jefferson County Superior Court within twenty-one (21)calendar days of the date of issuance of this land use decision. The final steps for Mr. Connolly's project can be accomplished between the two of you, Jim and Sherrie, and I can step out at this point. The permit was issued on April 9, 2015.The Lot Certification was recorded on April 9, 2015. I thought we needed the new parcel number so the Connolly's could sell the new parcel. Jim, please work directly with Sherrie on the Quit Claim Deed document and for getting a different parcel number so the new parcel can be sold to the neighbors. All I will need is the new parcel number from Sherrie when it is available, so I can finalize the permit notes and maintain concurrency in the database between parcels and cases. I've sent the permit, recorded document and receipts to the Connolly's at their return address in Tacoma. 1 I'll be in touch again when I get the parcel number from the Assessor's Office. This can take up to two weeks when they're busy. The new parcel number will be used when conveying the segmented portion. Thanks. The process would be done like this: 1) Lot Certification for a road segmentation—you will provide a Statement of Intent, Legal Descriptions for before & after conditions, site plan a. We will do a Consistency Review b. Public Works does a review because it's a County Road that segments the parcel c. The Assessor reviews the legal descriptions d. Environmental Health Department has a review 2) These reviews do not guarantee that the parcel split will be approved, but we do not see any problems at this cursory stage. 3) The Lot Certification document is recorded with the Assessor. This shows your remainder of the tax parcel and provides a separate tax ID to the part split off. 4) The split portion is sold and consolidated to an adjacent lot. The buyer can do this without a survey, with a lot certification providing new legal descriptions and recorded with the Assessor, or could be done with a Boundary Line Adjustment and survey. We make every attempt to reply within 14 days, however we have a disproportionate amount of work per staff at this point in time. I did not wish to ignore your emails and telephone messages. Road Segmentation The zoning is Rural Residential 1:5--one residence per five acres. The segmented portion to the west is approximately 1.2 acres—would be substandard size to zoned density, minimum of 5 acres. The split parcel is created by Lords Lake Loop Road—a "road segmentation". See attached memo regarding subdivision by roads. The split is documented by a Lot Certification (see attachment) and recorded with the County Assessor. Boundary Line Adjustment In your telephone message,you suggested selling the small portion to a neighbor to add to their parcel. The owner would combine the small parcel to a larger parcel with a Boundary Line Adjustment—see document attached.
