Critical Aquifer Recharge Areas may require special protection measures to mitigate water quality degradation. The submitted proposal does not require additional aquifer protection measures. However, during construction the project shall follow the Best Management Practices (BMPs) and facility design standards as identified and defined in the Stormwater Management Manual for the Puget Sound Basin. 2.) The project shall comply with Construction Stormwater Pollution Prevention (SWPP) Elements#1 through#12 of the Department of Ecology's Stormwater Management Manual for Western Washington to control stormwater, erosion and sediment during construction. BMPs shall address permanent measures to stabilize soil exposed during construction, and in the design and operation of stormwater and drainage control systems. 3.) Outdoor residential storage shall be maintained in an orderly manner and shall create no fire, safety, health or sanitary hazard. 4.) Not more than 2 unlicensed vehicles shall be stored on any lot unless totally screened from view of neighboring dwellings and rights-of-way. Such screening shall meet all applicable performance and development standards specific to the district in which the storage is kept, and shall be in keeping with the character of the area. Screening shall meet the requirements of Chapter 18.30 JCC. Outdoor storage of 3 or more junk motor vehicles is prohibited except in those districts where specified as an autormobile wrecking yard or junk (or salvage) yard and allowed as a permitted use in Table 3-1 or Chapter 18.18 JCC, and such storage shall meet the requriements of JCC 18.20.100, Automobile wrecking yards and junk (or salvage) yards. In no case, shall any such junk motor vehicles be stored in a critical area. 5.) A minimum of two (2) on-site parking spaces shall be provided for the single family residence. 6.) The building height is not to exceed 35 feet. 7.) Maximum lot coverage is not to exceed 25%. Lot coverage is defined as amount of impervious surface which includes roof tops, driveways, concrete, etc. 8.) Exterior lighting for residential uses shall not exceed twenty feet (20') in height from the finished grade, excepting when such lighting is an integral part of a building or structure. Ground level lighting is encouraged. 9.) Lighting fixtures shall be designed and hooded to prevent the light source from being directly visible from outside the boundaries of the property. The intensity or brightness of all lighting, during construction and after project completion shall not adversely affect the use of surrounding properties or adjoining rights-of-way. 10.) Minimum setback from Cirque Drive right-of-way shall be 20 feet. Minimum side and rear yard setbacks shall be 5 feet. If an ESA is present, then the more stircter setback(s) shall apply. 11.) ALL WOOD AND TRAILERS TO BE REMOVED FROM DRAINFIELD AND RESERVE AREA. ALL COMPONENTS OF THE SEPTIC SYSTEM ARE TO BE COMPLETELY PROTECTED FROM VEHICULAR TRAFFIC OR MECHANICAL DISTURBANCE. PERMANENT PROTECTIVE BARRIERS ARE REQUIRED AROUND DRAINFIELD. 12.) 10' SEPARATION REQUIRED BETWEEN A WATER LINE AND ALL PORTIONS OF THE ONSITE SEWAGE SYSTEM; EFFLUENT TRANSPORT LINE, TANKS, TREATMENT AND DISPOSAL COMPONENTS. REMOVE ANY EXISTING WATER LINE <10' TO OSS COMPONENTS. 13.) A MINIMUM OF 5' MUST BE MAINTAINED BETWEEN BUILDING FOUNDATION AND EDGE OF SEPTIC TANK. 14.) ANY PORTION OF TRANSPORT LINE UNDER A DRIVEN WAY IS TO BE SLEEVED/CASED OR EQUIVALENT. FINDINGS: 1.) The Administrator finds that this application complies with applicable provisions of the Unified Development Code,all other applicable ordinances and regulations,and is consistent with the Jefferson County Comprehensive Plan and Land Use map. 2.) The application was reviewed by the Jefferson County Department of Community Development staff on July 20, 2007 for the potential presence of Environmentally Sensitive Areas (ESAs) under the provisions of the Unified Development Code (UDC). After an initial Geographic Information Systems mapping review and an investigative site inspection, the following ESAs were confirmed to be present on the subject property: intermediate/unstable shoreline slope stability; spotted owl; landslide hazard area 2; SUSC aquifer recharge area. 3.) Aquifer Recharge Areas in Jefferson County are characterized by porous geological formations that allow percolation of the surface water into the soils and the underlying zone of saturation. Aquifers are geologic formations that contain sufficient saturated permeable material to yield significant quantities of water to wells and springs. Aquifers serve as the source of drinking water within most of the rural portions of Jefferson County. 4.) Susceptible Aquifer Recharge Areas are those with geologic and hydrologic conditions that promote rapid infiltration of recharge waters to groundwater aquifers. 5.) Geologically Hazardous Areas in Jefferson County are characterized by slope, soil type, geologic material, and groundwater that may combine to create problems with slope stability, erosion, and water quality during and after construction or during natural events such as earthquakes or severe rainstorms. 6.) The applicant is proposing to create or add 1200 square feet of impervious surface and 1500 square feet of land disturbing activities. JCC 18.30.060 and 18.30.070 require your proposal comply with Minimum Requirement#2 (Construction Storfrtwater Pollution Prevention)of the Department of Ecology Stormwater Management Manual for Western Washington to control stormwater, erosion and sediment during construction. BMPs shall address permanent measures to stabilize soil exposed during construction, and in the design and operation of stormwater and drainage control systems. 7.) Jefferson County determined that this proposal is categorically exempt from review under the State Environmental Policy Act(SEPA) pursuant to WAC 197-11-800(1)(b)(i). 8.) The site plan as submitted with the building permit application on June 21, 2007 has been reviewed for consistency under the UDC, and has been approved by Jefferson County Department of Community Development. Any modifications, changes, and/or additions to the stamped, approved site plan dated July 23, 2007 shall be resubmitted for review and approval by Jefferson County Department of Community Development. 9.) This approval is for a single family residence only. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits. 10.) The parcel has been designated as RR 1:5 under the Jefferson County Comprehensive Land Use Map effective August 28, 1998. 11.) An address of 172 Cirque Drive, Brinnon has been assigned to the parcel. Cirque Drive is a county local access (C206709). 12.) The lot was created through the Seamount Estates Division 4 on August 22, 1977 under AFN 244177. 13.) The parcel is served by the Seamount Estates public water. 14.) A septic permit(SEP88-0216) was finaled on June 27, 1988 and an EES was conducted by Envirocheck. 15.) According to the county GIS mapping, the landslide hazard area is greater than 200 feet to the west on the adjoining parcel and greater than 200 feet to the east on the other platted parcels. The proposed residence is located 12 feet from the north boundary and 11 feet from the east boundary and is approximately 768 square feet. NOTICE: This permit does not excuse the proponent from complying with other local,state, and federal ordinances, regulations,or statutes applicable to the proposed development. Development pursuant to this permit shall be undertaken subject to the applicable development and performance standards of the Jefferson County Unified Development Code. If during excavation or development of the site an area of potential archaeological significance is uncovered, all activity in the immediate area shall be halted, and the Administrator shall be notified at once. The Federal Endangered Species Act rules to protect threatened Chinook and Summer-run Chum salmon became effective on January 8, 2001. Bull trout have been listed as threatened since early 2000. Under the ESA,any person may bring lawsuit against any individual or agency that"takes"listed species(defined as causing harm, harassing,or damaging habitat for the listed species). In addition,the National Marine Fisheries Service can levy penalties. All areas in Jefferson County are included as"critical habitat"for a listed species. Development of property along any marine shoreline,freshwater shoreline,or floodplains could harm habitat if protective measures are not taken. To minimize the potential to damage habitat,all property owners developing adjacent to marine shoreline,freshwater shoreline, orfloodplains are advised to do the following: -Set back buildings,utilities and roads as far as possible from surface waters(streams, rivers, lakes,marine waters),or at least 150 feet from the edge of the water -All development activities should avoid unstable slopes,wetlands,and forested areas near surface waters -Remove minimal vegetation for site development,especially large trees -Allow trees that have fallen into surface waters to remain there -Infiltrate stormwater from buildings and driveways onsite through drywells rather than discharging directly into surface waters or roadside ditches Any individual, group,or agency can bring suit for a listed species"taking,"even if you are in compliance with Jefferson County development codes. The risk of a lawsuit against you can be reduced by consulting with a professional fisheries habitat biologist, and following the recommendations for site development provided by the biologist. ARTICLE II Trust Estate 2.1 Property Transferred. Concurrently herewith,Trustor has transferred the property set forth in Schedule A to this Trust,receipt of which is acknowledged,which property constitutes the initial Trust Estate. 2.2 Other Property. The Trust Estate shall also consist of any other property hereafter transferred to this Trust and accepted by Trustee for administration hereunder_ ARTICLE III Beneficiaries;Purpose 3.1 Beneficiaries. However, if there are no other liquid assets in the Trust or income-producing assets,Primary Beneficiaries shall have the responsibility to pay the real estate taxes, insurance, utilities,the cost of maintenance and upkeep, and any monetary encumbrances against the Real Property. b. With the approval of the Primary Beneficiaries (if competent) and at least one Secondary Beneficiary,this Trust may be revoked, altered, amended or re-stated. Following the death or permanent incompetency of both Primary Beneficiaries, the Trust may be extended, altered or amended with the approval of the then surviving Secondary Beneficiaries. 7.2 Loans. The Trustee may make loans to the Primary Beneficiaries on terms solely acceptable to Trustee. The Trustee may make loans to Secondary Beneficiaries with the approval of the Primary Beneficiaries. The Trust may incur indebtedness on terms solely acceptable to Trustee and Primary Beneficiaries(if competent),to maintain Trust Real and Personal Property and/or to carry out the primary Trust purposes. 7.3 Spendthrift Provisions. The beneficial interest(in principal and income hereunder)of any Beneficiary of this Trust shall not be subject to claims of the respective Beneficiary's creditors,or others,nor to judicial process and shall not be voluntarily or involuntarily assigned, alienated or encumbered. 7.4 Trustee's Powers. Trustee is authorized and empowered to manage and deal with the Trust Estate in all particulars and in the same manner and to the same extent as an individual prudent person could in the management of their own affairs. Without limiting the generality of the foregoing, Trustee shall have all the powers and authority granted by law to a Trustee. Trustee shall serve without bond and without posting security of any kind. The Trustee shall render annual statements of account to the Primary Beneficiaries during their life or lives so long as they are competent and thereafter to Secondary Beneficiaries. The Trustee,to the extent permitted by law, shall be relieved from compliance with the obligations of any and all Trustees' account statutes now or hereafter in effect in the State of Washington or in any other jurisdiction in which this Trust operates;provided, however, that the Trustee, at Trustee's option,may invoke such statutes at any time. The Trustee may acquire and retain every kind of property, real,personal or mixed and every kind of investment. 7.6 Retention Of Assets;Business Continuation And Incorporation: Delegation Of Discretionary Powers. Every action made in good faith by Trustee in the exercise of any power, authority,judgment or discretion conferred hereunder (including, without limitation,disclaimers,releases or elections with respect to taxes) shall be conclusive and binding upon all persons interested in the assets of any trust established hereunder. If at any time there are two or more trusts under which are to fulfill substantially similar purposes for the same Beneficiary or Beneficiaries, any two or more of such trusts may, in the discretion of the Trustees of such trusts,be merged or consolidated if the probable effect of such merger or consolidation will riot be to the substantial disadvantage of such Beneficiary or Beneficiaries. If the Trustees of the trusts are not the same persons,they shall serve as Co-Trustees of the merged or consolidated trusts,unless it is agreed by such trustees that only one of them should serve as Trustee. Similarly,Trustee shall have the discretionary power to subdivide separate or separable shares of a single trust into separate trusts. These powers to combine and divide trusts may be exercised from time to time and may be used to modify or reverse their prior exercise. In deciding whether and how to exercise this authority,Trustee may(but need not)take into account efficiencies of administration, taxes and any other considerations Trustee may deem appropriate to these decisions. 7.10 Delegation Of Standby Authority. To insure on-going legal authority to administer the Trust during the absence or incompetency of Trustee, Trustee,through the use of a General or Durable Power of Attorney,may delegate Trustee's duties hereunder to a Standby Trustee, so long as such instrument refers to this Trust. Such instrument may specify the duration and/or extent of the powers and authority of the Standby Trustee and all persons dealing with the Standby Trustee may rely on the authority of Standby Trustee subject only to any express restrictions clearly stated herein or in the instrument naming the Standby Trustee. 7.11 Law Governing; Savings Clause- This instrument shall be governed by the laws of the State of Washington. The building height is not to exceed 35 feet. 7.) Maximum lot coverage is not to exceed 25%. After an initial Geographic Information Systems mapping review and an investigative site inspection, the following ESAs were confirmed to be present on the subject property: intermediate/unstable shoreline slope stability; spotted owl; landslide hazard area 2; SUSC aquifer recharge area. 3.) Aquifer Recharge Areas in Jefferson County are characterized by porous geological formations that allow percolation of the surface water into the soils and the underlying zone of saturation. Aquifers are geologic formations that contain sufficient saturated permeable material to yield significant quantities of water to wells and springs. Aquifers serve as the source of drinking water within most of the rural portions of Jefferson County. 4.) Susceptible Aquifer Recharge Areas are those with geologic and hydrologic conditions that promote rapid infiltration of recharge waters to groundwater aquifers. 5.) Geologically Hazardous Areas in Jefferson County are characterized by slope, soil type, geologic material, and groundwater that may combine to create problems with slope stability, erosion, and water quality during and after construction or during natural events such as earthquakes or severe rainstorms. 6.) The applicant is proposing to create or add 1200 square feet of impervious surface and 1500 square feet of land disturbing activities. JCC 18.30.060 and 18.30.070 require your proposal comply with Minimum Requirement#2 (Construction Stormwater Pollution Prevention) of the Department of Ecology Stormwater Management Manual for Western Washington to control stormwater, erosion and sediment during construction. The parcel has been designated as RR 1:5 under the Jefferson County Comprehensive Land Use Map effective August 28, 1998. 11.) An address of 172 Cirque Drive, Brinnon has been assigned to the parcel. Cirque Drive is a county local access (C206709). 12.) The lot was created through the Seamount Estates Division 4 on August 22, 1977 under AFN 244177. 13.) The parcel is served by the Seamount Estates public water. 14.) A septic permit (SEP88-0216)was finaled on June 27, 1988 and an EES was conducted by Envirocheck. 15.) According to the county GIS mapping, the landslide hazard area is greater than 200 feet to the west on the adjoining parcel and greater than 200 feet to the east on the other platted parcels. The proposed residence is located 12 feet from the north boundary and 11 feet from the east boundary and is approximately 768 square feet. NOTICE: This permit does not excuse the proponent from complying with other local,state, and federal ordinances, regulations,or statutes applicable to the proposed development. The Federal Endangered Species Act rules to protect threatened Chinook and Summer-run Chum salmon became effective on January 8, 2001. Bull trout have been listed as threatened since early 2000. Under the ESA,any person may bring lawsuit against any individual or agency that"takes"listed species(defined as causing harm, harassing,or damaging habitat for the listed species). In addition,the National Marine Fisheries Service can levy penalties. All areas in Jefferson County are induded as"critical habitat"for a listed species. Development of property along any marine shoreline,freshwater shoreline,or floodplains could harm habitat if protective measures are not taken. To minimize the potential to damage habitat,all property owners developing adjacent to marine shoreline,freshwater shoreline, or floodplains are advised to do the following: -Set back buildings,utilities and roads as far as possible from surface waters(streams, rivers,lakes,marine waters),or at least 150 feet from the edge of the water -All development activities should avoid unstable slopes,wetlands,and forested areas near surface waters -Remove minimal vegetation for site development,especially large trees -Allow trees that have fallen into surface waters to remain there -Infiltrate stormwater from buildings and driveways onsite through drywells rather than discharging directly into surface waters or roadside ditches Any individual, group,or agency can bring suit for a listed species"taking",even if you are in compliance with Jefferson County development codes.
