BOX 2045 PORT TOWNSEND WA 98368 DATE ISSUED: September 14, 2015 DATE EXPIRES: September 14, 2016 MLA NUMBER: MLA15-00045 PROJECT PLANNER: Joel Peterson PROJECT DESCRIPTION: STORMWATER PERMIT ONLY TO CONVERT FROM FOREST TO PASTURE PROJECT LOCATION: CONDITIONS: 1.) A 30-foot by 30-foot area of Cedar Street and Third Street of 5/5/1888 Irving Park Addition Plat is omitted from the official record of vacation (Resolution 101-93, AFN 365858). Nonetheless, all public rights are vacated by operation of law, whereas the County was divested of its interest by not opening the right-of-way within five years of the plat dedication (5/5/1893), before the 1909 Session Law became effective on March 12, 1909, which included a legislative Act amending Section 32 of Chapter 90, an act entitled "An Act to provide for laying out, establishing, altering, changing the width of, or vacation any county road, and providing for assessment, payment of damages, and providing for appeals," [this act approved March 7, 1890]. The 1909 amendment exempted from vacation by operation of law certain lands dedicated for road purposes. The exceptions are currently codified in RCW 36.87.090. The statutory vacation only vacates public rights. IT IS THE PROPERTY OWNER'S RESPONSIBILITY TO IDENTIFY AND RECTIFY ANY SECURITY INTEREST, CONVEYANCES, ENCUMBRANCES, EASEMENTS OR RESTRICTIONS AFFECTING THE SUBJECT PROPERTY. 2.) The project shall adhere to the Best Management Practices (BMPs) to control stormwater, erosion and sediment during construction. BMPs shall address permanent measures to stabilize soil exposed during construction, and in the design and operation of stormwater and drainage control systems. 3.) The applicant shall meet Minimum Requirements#1 through #5 as applicable, of the Stormwater Management Manual for Western Washingtion, Department of Ecology (2012). A Construction Stormwater Pollution Prevention Plan (SWPPP) has been submitted and approved by the Department of Community Development. Once the subject permit has been issued the applicant shall fully implement the provisions of the submitted plan. Soils must not remain exposed and unworked for more than the following time periods: Dry Season (May 1 --Sept. 30): 7 days Wet Season (Oct. 1 --April 30): 2 days Exposed and unworked soils shall be stabilized by application of effective BMPs that prevent erosion. Applicable BMPs include, but are not limited to: temporary and permanent seeding, sodding, mulching, plastic covering, erosion control fabrics and matting. FINDINGS: 1.) The Administrator finds that this application complies with applicable provisions of the Unified Development Code, all other applicable ordinances and regulations, and is consistent with the Jefferson County Comprehensive Plan and Land Use map. 2.) The total acreage of all parcels adjacent and under the same ownership is approximately 1.64 acres. Forest Practices regulations apply to parcels greater than 2 acres, or if over two acres, regulations provide that up to 5000 board feet may be used without a permit for personal use only. 3.) A SEPA Checklist dated June 1, 2015, was submitted with the application materials. Jefferson County determined that this proposal is categorically exempt from review under the State Environmental Policy Act (SEPA) pursuant to WAC 197-11-800(1)(v) [excavation and fill], with the exemption threshold level established by JCC 18.40.750 (1)(b), 500 cubic yards of material. 4.) The application was reviewed by the Jefferson County Department of Community Development staff on 9/8/2015 for the potential presence of Environmentally Sensitive Areas (ESAs) under the provisions of the Unified Development Code (UDC). After an initial Geographic Information Systems mapping review the following ESAs were confirmed to be present on the subject property: Susceptible Aquifer Recharge Area (SUSC). 5.) Susceptible Aquifer Recharge Areas are those with geologic and hydrologic conditions that promote rapid infiltration of recharge waters to groundwater aquifers. 6.) Aquifer Recharge Areas in Jefferson County are characterized by porous geological formations that allow percolation of the surface water into the soils and the underlying zone of saturation. Aquifers are geologic formations that contain sufficient saturated permeable material to yield significant quantities of water to wells and springs. Aquifers serve as the source of drinking water within most of the rural portions of Jefferson County. 7.) The applicant is proposing to create or add no (zero) square feet of impervious surface and 21,780 square feet of land disturbing activities. Clearing and Grading will move less than 500 cubic yards of material. Sections 18.30.060 and 18.30.070 of the Jefferson County Unified Development Code requires that your proposal submit a Stormwater Pollution Prevention Plan (SWPPP). The applicant submitted a Stormwater Calculation Worksheet and a Stormwater Site Plan Submittal Template with a Construction Stormwater Pollution Prevention Plan (SWPPP). The applicant proposes to use BMP T5.30 Full Dispersion from cleared areas. The topography and soils is such that it appears water will not concentrate prior to discharge. The applicant proposes to use BMP C101/BMP T5.40: Preserving Natural Vegetation, and vegetated filter strips (BMP C102 Buffer Zones) at the perimeter of the pasture clearing activity. Using BMPs for Minimum Requirements#1 through#5 of the Stormwater Management Manual, the problems of construction pollution will be adequately addressed for the proposed project. 8.) The site plan as submitted with the Stormwater Permit application on July 13, 2015 has been reviewed for consistency under the UDC, and has been approved by Jefferson County Department of Community Development. Any modifications, changes, and/or additions to the stamped, approved site plan dated September 8, 2015 shall be resubmitted for review and approval by Jefferson County Department of Community Development. 9.) This approval is for a Stormwater Permit only. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits. 10.) The parcel has been designated as Rural Residential 1:5 (RR1:5) under the Jefferson County Comprehensive Land Use Map effective August 28, 1998. 11.) NOTICE: This permit does not excuse the proponent from complying with other local, state, and federal ordinances, regulations, or statutes applicable to the proposed development, but consistent with RCW 90.58. Development pursuant to this permit shall be undertaken subject to the applicable policies and performance standards of the Jefferson County Shoreline Management Master Program and the Jefferson County Unified Development Code. If during excavation or development of the site an area of potential archaeological significance is uncovered, all activity in the immediate area shall be halted, and the Administrator shall be notified at once. The Federal Endangered Species Act rules to protect threatened Chinook and Summer-run Chum salmon became effective on January 8, 2001. Bull trout have been listed as threatened since early 2000. Under the ESA, any person may bring lawsuit against any individual or agency that"takes" listed species (defined as causing harm, harassing, or damaging habitat for the listed species). In addition, the National Marine Fisheries Service can levy penalties. Portions of Jefferson County, including marine environments are included as "critical habitat"for listed species. Development of property along any marine shoreline, freshwater shoreline, or floodplains could harm habitat if protective measures are not taken. To minimize the potential to damage habitat, all property owners developing adjacent to marine shoreline, freshwater shoreline, or floodplains are advised to do the following: -All development activities should avoid unstable slopes, wetlands, and forested areas near surface waters - Remove minimal vegetation for site development, especially large trees -Allow trees that have fallen into surface waters to remain there - Infiltrate stormwater from buildings and driveways onsite through drywells rather than discharging directly into surface waters or roadside ditches The Federal Bald and Golden Eagle Protection Act requires landowners within 660 feet(1/8th of a mile) of an eagle nest to consult with the US Fish and Wildlife Service. This Eagle Act prohibits anyone from "taking" bald eagles. This federal law defines the term "take" and describes the possible legal consequences when a "take" occurs. Among other actions, "take" includes a disturbance of bald eagles or their habitat. Under federal law a permit may still be required for activities that impact bald eagles or their habitat. Contact the US Fish and Wildlife Service (http://www.fws.gov/pacific/eagle/)to learn more about how this law affects your project. Any individual, group, or agency can bring suit for a listed species "taking", even if you are in compliance with Jefferson County development codes. The risk of a lawsuit against you can be reduced by consulting with a professional fisheries habitat biologist, and following the recommendations for site development provided by the biologist. For more information, contact the National Marine Fisheries Service in Seattle, or the U.S. Fish and Wildlife Service. Thanks. Joel AFN =Auditor's File Number identifying recorded documents. There were three road right of ways (ROW) in the Irving Park Addition plat that were vacated by Board of County Commissioners Resolutions that have become a part of the resulting parcels 001162009 and 963302002: Resolution No. 52-93 (AFN 361406); Resolution No. 101-93 (AFN 365858); and Resolution No. 29-01 (AFN 441906). The 2001 resolution vacated a portion of Second Street and Cedar Street, "and that portion of Cedar St. in the northeast quarter of the intersection of Third St." (Some of the vacations refer to the street as "Cedar Avenue".) The ROW is 60 feet wide, and when the full street is vacated, 30 feet are attached to each adjoining parcel. As the road vacation Resolution No. 29-01 was written, it left the northwest portion alone, as it was adjoining someone else's parcel (the triangle portion of Parcel 001162009). Now, approximately four years later, the triangle portion of Parcel 001162009 was partitioned from the main parcel through a "road segmentation" process and conveyed to Mr. Dwyer through the Lot Certification (AFN 589269). Parenthetically,the triangle is created by South Discovery Road, originally known as County Road No. 38, as it was aligned through the old plat. Along with the transfer of that triangle portion came the 30-foot by 30-foot portion (the northwest portion of the intersection) of the Irving Park Addition that was never vacated. The Statutory Warranty Deed (AFN 589661) references the same road vacation, thus the un-vacated portion remains. This area that was left still clouds the title, and Jefferson County cannot make any permit approvals affecting this portion of property which is not legally owned by the applicant, and technically is not part of the application. In my research, I see that the attachment of vacated ROW to the center line is afforded to "adjacent" properties; or, the term used in the vacations is "adjoining", and is created by the extension of an existing property boundary. However, unless specifically vacated by a process such as a quiet title, there is left a Square of No Man's' Land (my terminology) within the platted street intersections that is not reached by this method of vacating. It is the street intersection portion reached diagonally from the property corner and is not considered adjacent. The County process for road vacations is codified in Chapter 12.10 JCC. Class C roads are defined as roads dedicated on a plat that was filed before March 12, 1904, which remained unopened for public use for a period of five years after authority was granted for opening them. The Irving Plat was dedicated on May 5, 1888. The Department of public works used to handle Class C road vacations like all other road vacations,going through the Board of County Commissioners and a public hearing before vacating by resolution. The road vacation regulations were changed in September, 2001, by Ordinance 05-0924-01. My research on this change revealed the following quoted material from the Staff Report: "History 1 Statutory road vacations were first recognized and adopted the County in the 1992 Road Vacation Ordinance. IN 1996 the Road Vacation Ordinance was amended to take out all language regarding Class C (statutory) road vacations. This meant that all road vacations were handled in the same manner and all went through the public hearing process. The Board of County Commissioners revised the Vacation Ordinance in 1999 to include a modified Class C vacation process which provided that the principal petitioner has the burden of shoeing that the road or right of way which was dedicated in a plat filed before March 1904 and remained unopened for a period of five years following dedication in the plat. This allowed for processing such road vacations differently than standard road vacations, based on the fact that these rights of way have been vacated by operation of law. Issues: • The Class C roads or right-of-ways have been vacated by operation of law. The County is recognizing this fact and clearing the perceived public interest only as a cloud on the title.The County Engineer can only comment on whether or not the road was opened although we recognize that any private easements would still exist. • Consequently, the public perception of the statutory vacation recognition misinterprets this action to include quieting title regarding private easements within the subject rights of way. • If there is any public opposition, the County has no jurisdiction over resolving any private issues. The County only has authority if the road was opened within five years after being platted, if the plat was recorded prior to March 1904. • The County is currently being involuntarily involved in private easement concerns and subsequent litigation, which consume valuable but limited public resources addressing private property concerns. • Based on the current Ordinance, the burden of notification to the abutting property owners is the petitioner's responsibility. Recently the Superior Court has ruled that all property owners abutting any portion of the subject road are to be notified regardless of the abutter's proximity to the specific area to be vacated. Discovery Road was established by Order of Establishment on Novermber 4th of 1874 as the"Port Townsend to Discovery Rd." The road is also shown on the 1915 Road Log Map and on 1949 County Road Plans indicating a total right of way width of 60 feet. The County Road log indicates that this road is 4.84 miles long. 10.) RCW 58.17 requires regulation of the division of land and was passed in 1969. 11.) Jefferson County determined that this proposal is categorically exempt from review under the State Environmental Policy Act (SEPA) pursuant to WAC 197-11-800(6)(a). 12.) The proposal is found to be an exemption under Jefferson County Code (JCC) Section 18.35.040(4): (4) Divisions of land relating to the acquisition of a fee simple interest in land by public agencies, including, but not limited to, divisions made for road or public right-of-way conveyance or widening purposes. Development pursuant to this permit shall be undertaken subject to the applicable policies and performance standards of the Jefferson County Shoreline Management Master Program and the Jefferson County Unified Development Code. If during excavation or development of the site an area of potential archaeological significance is uncovered, all activity in the immediate area shall be halted, and the Administrator shall be notified at once. The Federal Endangered Species Act rules to protect threatened Chinook and Summer-run Chum salmon became effective on January 8, 2001. Bull trout have been listed as threatened since early 2000. Under the ESA, any person may bring lawsuit against any individual or agency that"takes" listed species (defined as causing harm, harassing, or damaging habitat for the listed species). In addition, the National Marine Fisheries Service can levy penalties. All areas in Jefferson County are included as"critical habitat" for a listed species. Development of property along any marine shoreline, freshwater shoreline, or floodplains could harm habitat if protective measures are not taken. To minimize the potential to damage habitat, all property owners developing adjacent to marine shoreline, freshwater shoreline, or floodplains are advised to do the following: -All development activities should avoid unstable slopes, wetlands, and forested areas near surface waters - Remove minimal vegetation for site development, especially large trees -Allow trees that have fallen into surface waters to remain there - Infiltrate stormwater from buildings and driveways onsite through drywells rather than discharging directly into surface waters or roadside ditches The Federal Bald and Golden Eagle Protection Act requires landowners within 660 feet(1/8th of a mile) of an eagle nest to consult with the US Fish and Wildlife Service. This Eagle Act prohibits anyone from "taking" bald eagles. This federal law defines the term "take"and describes the possible legal consequences when a "take" occurs. Among other actions, "take" includes a disturbance of bald eagles or their habitat. Under federal law a permit may still be required for activities that impact bald eagles or their habitat. Contact the US Fish and Wildlife Service (http://www.fws.gov/pacific/eagle/) to learn more about how this law affects your project. Any individual, group, or agency can bring suit for a listed species"taking", even if you are in compliance with Jefferson County development codes. The risk of a lawsuit against you can be reduced by consulting with a professional fisheries habitat biologist, and following the recommendations for site development provided by the biologist.
