Hello John,
The updated planting area will be brought to the Hearing. I want to clarify a few things beforehand:
1) Is there an updated planting schedule to accompany the increased area?
2) I've attached a markup on the new planting area map to reiterate that the buffer reduction to 50 feet needs to
have a 10-foot building setback added to it. This is the building setback that allows machinery or other
equipment to traverse the area around the house without being in the buffer. The current drawing calls it a 50-
foot"setback", creating confusion that the building can go right up against it. Specifically, it is a 50-foot Buffer,
and adding a 10-foot setback. You may remember us adding that 10-feet to our measurements in the field. I
reiterated this in my staff report too when I saw the building area directly against the 50-foot buffer.
3) I'm going to add another condition to the variance that I didn't have in the report. Currently there is the
condition of following Minimum Requirement#2 of the Storm Water Management Manual for Western
Washington (SWMMWW)—I am adding one of the site planning elements in Requirement#2 as its own
condition: marking the construction limits. The reason for this is that we have recently seen many instances
where the buffers were not protected during construction, and even used as stockpile areas! This additional
condition will stand alone to emphasize the point.
New condition text: "The proponent shall implement all applicable Elements of Minimum Requirement#2 of the
SWMMWW, particularly Element#1: Preserve vegetation/mark clearing limits. Before beginning any land disturbing
activities, including clearing and grading, clearly mark all clearing limits,sensitive area and their buffers, and trees that
are to be preserved within the construction area, using BMP C103: High Visibility Fence, or appropriate substitute."
Please review the attached map and let me know that we're on the same page. Please let me know if there is any
modified planting schedule from Mr. Deming that I can bring to the hearing as an evidentiary record for the Examiner to
use.

Recommended Conditions:
1. Before any ground disturbing activities, the proponent shall comply with clearing and grading standards
of JCC 18.30.060 and JCC 18.30.070. The square footage of proposed impervious surface is such that the
proponent will be required to develop and implement a Storm water Site Plan and Storm water
Pollution Prevention Plan (SWPPP)that complies with Minimum Requirements#2 of the Department of
Ecology 2012 Storm Water Management Manual for Western Washington (SWMMWW).
2. New condition text: "The proponent shall implement all applicable Elements of Minimum Requirement#2
of the SWMMWW, particularly Element #1: Preserve vegetation/mark clearing limits. Before beginning
any land disturbing activities, including clearing and grading, clearly mark all clearing limits, sensitive area
and their buffers, and trees that are to be preserved within the construction area, using BMP C103: High
Visibility Fence, or appropriate substitute."
3. The proponent shall comply with the recommendations of the geotechnical report:
a) No structures should be built on the eastern half of the property and the slopes should remain
forested.
b) The floor of the proposed home should be elevated at least 2 feet above the existing grade to
minimize risk of flooding impacts.
c) Storm water from the roof should either be allowed to drip directly on the ground or should be
directed into storm water dispersion trenches to the north or south side of the building area.
4. The proponent shall implement the Habitat Management Plan for buffer enhancement thereby
protecting the ecological functions of the 10-foot and 50-foot reduced buffers.
5. The proponent shall complete the approval process for the pending 1992 Road Access Permit #1044
with the Jefferson County Department of Public Works.
6. All water wells shall be constructed in accordance with the provisions of Chapter 173-160 WAC by a
driller licensed in the State of Washington. Well reports must be submitted to Ecology within 30 days
after completion of a well.
7. All water wells that may be drilled must be a minimum of 100 feet from any known, suspected, or
potential source of contamination. The proposed water well shall be located where it is not subject to
ponding and is not in the floodway. The well shall be protected from a one hundred year flood and from
any surface or subsurface drainage capable of impairing the quality of the ground water supply.
8. The applicant is required to submit evidence of an adequate water supply before a building permit can
be issued for any building requiring potable water(RCW 19.27.097).
9. The specific features of the proposed home and garage is not known and not reviewed under this
Shoreline Variance permit. Structures shall be evaluated under applicable permit reviews at the time a
building permit is submitted.
10. Before approval for a building permit,the proponent shall record a Hold Harmless Indemnification
Covenant with Jefferson County.
