Summary of Proceedings Subdivision Exemption application submitted on October 21, 1998. Application complete date December 15, 1998. Findings of Fact (1)The proposal is to adjust the existing boundary lines to the"Master Planned Resort"boundary line. Resultant Parcel A will become approximately 121 acres,resultant Parcel B will become approximately 81 acres,resultant Parcel C will become approximately 281 acres,resultant Parcel D will become approximately 32 acres,resultant Parcel E will become approximately 169 acres, and resultant Parcel F will become approximately 109 acres. (2)All parcels are within the Port Ludlow sewer district. (3) October 20, 1999 legal descriptions were reviewed by the Jefferson County Assessor's Office for accuracy and found complete. III. Criteria for Review (1)Ordinance No. 04-0526-92 "Jefferson County Subdivision Ordinance" Subsection 3.40(4), "Exemptions" states"A division made for the purpose of alteration by adjusting boundary lines between platted or unplatted lots or both,which does not create any additional lot,tract,parcel, site or division which contains insufficient area and dimension to meet the County's minimum requirements for width and area for a building site." RCW 58.17.040 Chapter inapplicable, when. (6) "A division made for the purpose of alteration by adjusting boundary lines,between platted or unplatted lots or both,which does not create any additional lot,tract,parcel, site or division nor create any lot,tract,parcel, site,or division which contains insufficient area and dimension to meet minimum requirements for width and area for a building site." (2)Chapter 246-272 WAC "On-Site Sewage Systems"requires minimum lot sizes of 1 acre up to 2.5 acres depending on soil types with individual wells. (3)There are no criteria in Jefferson County Codes or Ordinances that require the Assessor's Office review the legal descriptions. IV. Conclusions The proposed boundary line adjustment will not create any additional lots,tracts,parcels or site that contains insufficient area to meet minimum County requirements for a building site. V. Decision Based on the Findings, Review Criteria, and Conclusions, it is my administrative decision to APPROVE the application for a Boundary Line Adjustment(EXM98-0043)for Pope Resources. VI. Appeal Any person may appeal an Administrative(Type A)decision. The Hearing Examiner shall decide all appeals of administrative(Type A)decisions. 1. An appeal of an administrative decision shall be filed in writing with the Clerk of the Board of County Commissioners fourteen(14)calendar days after the date of the decision or no later than 4:30 p.m.on November 5, 1999. 2. Appeals shall identify the decision appealed and the date of the decision, and shall contain a summary of the grounds for the appeal. 3. The appropriate fee as established by County resolution must be paid upon filing of the notice of appeal. No appeal will be processed without receipt of the appropriate fee before expiration iration of the period for filing the appeal. The current appeal fee is$233.00. 4. Following receipt of a notice of appeal and payment of the appropriate fee,the Hearing Examiner shall conduct an open record appeal hearing. Dated this 22nd day of October 1999. These proposed adjustments will expand the MPR boundaries and densities beyond what was intended in the Jefferson County Comprehensive Plan and without the required public participation . It appears that ORM is using a boundary line adjustment process to make major land use changes . The requested boundary adjustments have not had proper review as to the impacts to critical areas , forest lands , density, infrastructure and environmental impacts let alone mapping changes to the MPR . These are major impacts and beyond the intent of a boundary line adjustment . It is inappropriate to make such changes without proper public review and while the interim emergency ordinance is in place . The purpose of an emergency ordinance is to maintain the status quo to prevent probable development from preempting planning options . It is important that the county honor the collaborative process it has established to help resolve already existing disputes about the MPR , rather than exacerbate the problems with this type of back door land use/zoning change . Standards for Review The determination of completeness initiates the review period for the application and entitles the Applicant to have the application considered and reviewed pursuant to the substantive laws, regulations and standards in effect on the date a complete application was submitted. Section 12: Application Time Frames A. Final Decision The County shall issue a final decision on a land use application within one-hundred-twenty (120) calendar days from the date the application is determined to be complete. B. Calculation of Time For purposes of calculating the time period for issuance of a final decision, the time period shall begin on the first day following the date the application is determined to be complete. The following periods shall be excluded from the calculations: 1. Any period during which the Applicant has been requested by the Director or Project Planner to correct plans, perform required studies, or provide additional information; 2. Any period during which an environmental impact statement is being prepared following a determination of significance pursuant to SEPA; 3. Any period during which an appeal is being reviewed; and 4. Any extension of time mutually agreed upon by the Applicant and the Director or Project Planner. • C. Exceptions to Time Limits The time limits established by this section do not apply if a land use application includes one of the following: 1. An amendment to the Comprehensive Plan or an amendment to a land use development regulation: 2. Siting of an essential public facility as provided in RCW 36.70A.200; or 3. An application substantially revised by the Applicant, in which case the time period shall start from the date at which the revised project application is determined to be complete pursuant to this Chapter. D. County Failure to Adhere to Applicable Time Periods If the County is unable to issue its final decision on a land use application within 120 days from the date the application is determined to be complete, the County shall provide written notice of this fact to the project Applicant prior to the expiration of the 120 day time period. Until final regulations are adopted that address the areas displayed on the map, it is not a legal description.
