The following notice shall be placed on the final survey mylar: JEFFERSON COUNTY NOTICE TO PUBLIC Current Jefferson County Geographic Information System (GIS) maps identify the presence of an Environmentally Sensitive Area (ESA) such as stream, wetland, flood, landslide hazard area, erosion, aquifer recharge area, SIPZ, fish and wildlife habitat, shoreline, etc., lying within and/or adjacent to the revised parcels encompassed by this Boundary Line Adjustment. Prior to any land disturbing activity or construction activity, applicant/owner shall contact the Jefferson County Department of Community Development regarding compliance for such ESA's. Approval of this Boundary Line Adjustment does not guarantee issuance of a building permit within said parcel(s). Such determination is dependent on approvals of water, septic, bulk and dimensional setbacks, and ESA requirements. 9.) The following notice shall be placed on the final survey mylar: JEFFERSON COUNTY NOTICE TO PUBLIC Approval of this Boundary Line Adjustment does not guarantee a buildable site within said parcel(s). Such determination is dependent on approvals of water, septic, bulk and dimensional setbacks, and ESA requirements. Applications for septic and building permits will be reviewed at time of submittal of such application for consistency with current state and county codes and ordinances. 10.) This parcel is within a no shooting area per JCC 8.50. FINDINGS: 1.) The Administrator finds that this application complies with applicable provisions of the Unified Development Code, all other applicable ordinances and regulations, and is consistent with the Jefferson County Comprehensive Plan and Land Use map. 2.) Consistent with JCC Title 18.35.060.2(a), the proposal will not create an additional lot, tract, or parcel. Consistent with JCC Title 18.35.060.2(b), the proposal is not within a binding site plan. Consistent with JCC Title 18.35.060.2(c), the proposal will not relocate an entire lot, tract, or parcel from one parent parcel into another parent parcel. Consistent with JCC Title 18.35.060.2(d), the proposal does not cross zoning district boundaries. Each parcel is zoned MPR SF-4. Consistent with JCC Title 18.35.060.2 (e), the proposal is not inconsistent with any restrictions or conditions of approval for a recorded short plat or long plat. The proposal will not circumvent the short subdivision or long subdivision procedures. Consistent with JCC Title 18.35.060.2 (f), the proposal will not separate an Accessory Dwelling Unit from the primary use of the property. Consistent with JCC Title 18.35.060.6, the proposal does not involve more than two lots, tracts or parcels that have been subject to a boundary line adjustment process within five years. 3.) Consistent with JCC title 18.30.060(1)(d) Correct situations wherein an established use is located across a lot line. 4.) Jefferson County determined that this proposal is categorically exempt from review under the State Environmental Policy Act(SEPA) pursuant to WAC 197-11-800(2)(i). 5.) This approval is for a boundary line adjustment only. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits. 6.) The parcel has been designated as MPR SR 4:1 under the Jefferson County Comprehensive Land Use Map effective August 28, 1998. 7.) NOTICE: This permit does not excuse the proponent from complying with other local, state, and federal ordinances, regulations, or statutes applicable to the proposed development, but consistent with RCW 90.58. Development pursuant to this permit shall be undertaken subject to the applicable policies and performance standards of the Jefferson County Shoreline Management Master Program and the Jefferson County Unified Development Code. If during excavation or development of the site an area of potential archaeological significance is uncovered, all activity in the immediate area shall be halted, and the Administrator shall be notified at once. The Federal Endangered Species Act rules to protect threatened Chinook and Summer-run Chum salmon became effective on January 8, 2001. Bull trout have been listed as threatened since early 2000. Under the ESA, any person may bring lawsuit against any individual or agency that"takes" listed species (defined as causing harm, harassing, or damaging habitat for the listed species). In addition, the National Marine Fisheries Service can levy penalties. Portions of Jefferson County, including marine environments are included as "critical habitat" for listed species. Development of property along any marine shoreline, freshwater shoreline, or floodplains could harm habitat if protective measures are not taken. To minimize the potential to damage habitat, all property owners developing adjacent to marine shoreline, freshwater shoreline, or floodplains are advised to do the following: -All development activities should avoid unstable slopes, wetlands, and forested areas near surface waters - Remove minimal vegetation for site development, especially large trees -Allow trees that have fallen into surface waters to remain there - Infiltrate stormwater from buildings and driveways onsite through drywells rather than discharging directly into surface waters or roadside ditches The Federal Bald and Golden Eagle Protection Act requires landowners within 660 feet(1/8th of a mile)of an eagle nest to consult with the US Fish and Wildlife Service. This Eagle Act prohibits anyone from "taking" bald eagles. This federal law defines the term "take" and describes the possible legal consequences when a"take" occurs. Among other actions, "take" includes a disturbance of bald eagles or their habitat. Under federal law a permit may still be required for activities that impact bald eagles or their habitat. Contact the US Fish and Wildlife Service (http://www.fws.gov/pacific/eagle/)to learn more about how this law affects your project. Any individual, group, or agency can bring suit for a listed species "taking", even if you are in compliance with Jefferson County development codes. The risk of a lawsuit against you can be reduced by consulting with a professional fisheries habitat biologist, and following the recommendations for site development provided by the biologist. For more information, contact the National Marine Fisheries Service in Seattle, or the U.S. Fish and Wildlife Service. It was apparent that these two letters were sent by people who did not receive our initial fax....) have talked to at least 5 different people in two states, New York and Delaware, and have yet to communicate with anyone who understands the situation...that the two lots are in sale contracts and expect to close by October 19....this year .... Colleen and I had a discussion of the word "dispute" and what its meaning could be as used in the statute. In the matter of the definition of"dispute", I Googled the phrase "legal definition for dispute" and got a response from Wikipedia which states that a dispute is 1)...a conflict, 2) ...an assertion of a right, claim...by one side met by contrary claims ...on the other" ...3)...the subject of litigation. However, when the two parties, Pedersen and Follett, learned of the encroachment shown on the survey by Van Aller which was ordered by the buyer of the Follett property, they met and decided that they would settle any"dispute" over the boundary line by using the Boundary Line Agreement procedure as outlined in the RCW 58.04.007 (as copied below). They did not want a dispute....only an agreement which was afforded by the State law procedure. And since both parties had buyers under contract, their agreement would expedite the legal change to the lot line and allow them to complete the sale of their properties. Please re-read the statute and then read our interpretation of the wording below: RCW 58.04.007 Affected landowners may resolve dispute over location of a point or line — Procedures. Whenever a point or line determining the boundary between two or more parcels of real property cannot be identified from the existing public record, monuments, and landmarks, or is in dispute, the landowners affected by the determination of the point or line may resolve any dispute and fix the boundary point or line by one of the following procedures: (1) If all of the affected landowners agree to a description and marking of a point or line determining a boundary, they shall document the agreement in a written instrument, using appropriate legal descriptions and including a survey map, filed in accordance with chapter 58.09 RCW. The written instrument shall be signed and acknowledged by each party in the manner required for a conveyance of real property. The agreement is binding upon the parties, their successors, assigns, heirs and devisees and runs with the land. The agreement shall be recorded with the real estate records in the county or counties in which the affected parcels of real estate or any portion of them is located; (2) If all of the affected landowners cannot agree to a point or line determining the boundary between two or more parcels of real estate, any one of them may bring suit for determination as provided in RCW 58.04.020. LINE BY ONE OF THE FOLLOWING PROCEDURES: " I have underlined in red the above portion and the portion of the RCW that states that the agreement is binding and runs with the land. That is a common phrase applicable to all legal transactions that affect properties. [1996 c 160 § 3.] In summary, what we have proposed by this BOUNDARY LINE AGREEMENT survey, that is signed by both owners and notarized, on the properties that are unencumbered by any loans, is a legal transaction that should be allowed to proceed in conformance with the State RCW's. By the adverse possession laws of Washington, the ownership of that portion of the Follett property has satisfied the ten year rule in that the encroachment has been in place for that period and the encroachment area now belongs to the Pedersen site not withstanding any other viewpoint. A review of the County through the BLA procedure is a redundant act only resulting in a recorded survey which could be more easily be accomplished by our Boundary Line Agreement survey as submitted. It is hereby requested that the survey and quitclaim deed be approved for recordation as submitted.Thanks for your consideration. Attached is the survey showing the agreement with the signatures of the owners in place. As we discussed,there was no formal agreement other than a "handshake" to move the common property line. The principal residence for the Follett property on Lot 10 is located 60 feet above the Pedersen residence and it was not known that the patio for the Pedersen property encroached into the slope at the bottom of the hill. Ms. Follett agreed to move the property line in accordance with the RCW cited and to record a record of survey with their signatures to make this change. At the request of the County, a quitclaim deed was also prepared and will be recorded concurrent with the survey. This agreement was prompted by a survey made by Brian Van Eller for Ms. Follett in regards to a sale and disclosed the problem. Both properties are in sale agreements that are pending the recording of this agreement. Please note that the Pedersens are in Louisiana at this time and Ms. Follett is in Arizona. Please indicate if the County has adopted a "hardship case" rule that could apply to this permit application as time is of the essence and we would appreciate a reply as soon as possible, with the understanding that the County has many priorities.
