CONDITIONS:
1.) The surveyor shall record the legal description with Jefferson County Auditor's office.
2.) To process this segregation, you will need to submit a wrttten request and a copy of the recorded legal
descriptions to the Jefferson County Assessor's Office to have additional parcel numbers assigned. A copy of
this permit will be forwarded to the Assessor's Office. Please contact the Jefferson County Assessor's Office
(360-385-9105) with any questions regarding this process and compensating taxes.
3.) This determination does not guarantee an ability to develop the parcels. All development shall comply with the
on-site sewage code, the building codes and local development regulations.
4.) Based on the finding, parcel number 413124001 can be considered two (2) separate parcel as described in the
legal descriptions submitted with the application.
FINDINGS:
1.) The Administrator finds that this application complies with applicable provisions of the Unified Development Code,all other
applicable ordinances and regulations, and is consistent with the Jefferson County Comprehensive Plan and Land Use map.
2.) The proposal is found to be an exemption under Jefferson County Code (JCC) Section 18.35.040(1):
(1)Divisions of land into lots, tracts or parcels each one of which is one-sixteenth of a section of land or larger,
or 40 acres or larger if the land is not capable of description as a fraction of a section of land; provided, that for
purposes of computing the size of a lot that borders on a street or road, the lot size shall be expanded to include
that area that would be bounded by the center line of the street or road and the side lot lines of the

Land use Map effective August 28, 1998
4.) On November 29, 2010 Pat Perryman in the Assessor's GIS department commented as follows:

5.) On December 27, 2010 Sherrie Shold in the Assessor's office commented as follows: After reviewing the
submitted MLAs, I have no comments concerning this proposed action.
6.) The administrator determined on January 7, 2009 & September 14, 2010 that no survey is required when
following existing section lines.
APPEALS:
Pursuant to RCW 36.70C,the applicant or any aggrieved party may appeal this final decision to Jefferson County Superior Court within
twenty-one (21)calendar days of the date of issuance of this land use decision. For more information related to judical appeals see JCC

Can you please respond with relevant history on these parcels, whether any formal consolidations have been
done and whether it is your offices opinion that this parcel might be segregated?
The surveyor will record new legal description. I will send the Assessor's Office a copy of the approved permit.
The applicant will contact the Assessor's office after new legals are recorded for the additional parcel numbers.
The review process is similar to MLA10-00197 William & Donia Stewart. MLA10-00197 was a consistency
review for a land division exemption which Michelle reviewed.

1). Parcel A: When excepting out Tax 1 they must include the full legal description as well as the reference to
the Tax Number.
How will this be finalized, I assume without a Mylar but will there be something recorded indicating approval
from DCD?

Exempt JCC 18.35.040(1) consistency review only or short plat? 613242002 - Colleen
Decision: The proposal may be exempt from the subdivision section when meeting the criteria
under JCC 18.35.040(1). If meeting the requirements of an exemption from JCC18.35 a
consistency review would be required. If this is the case new legal would be required. A survey
would be required if not following the section lines.
ITEM: Quilcene hotel property zoned RVC 1 existing SFR could he place 2 more man homes on

Decision: 2 man homes would be allowed in RVC zoning. Review the bulk & dimension and
open space standards table 6-1 JCC 18.30.050. RVC zoning has no minimum density.
ITEM: 2 conflicting surveys 1979 & 2001 which survey would we use? In the 2001 survey SFR

Decision: The most recent survey would be used. A new survey could be done to address the 2
different surveys. Could contact an attorney to review and take to Superior court to make a
decision.
ITEM: Require eagle plan on MLA10-00320- Colleen
Decision: Jeff Skriletz, WDFW, can email or call if no eagle plan is required. A finding
identifying no eagle plan required per Jeff can be placed in case.
ITEM: Sea Crest Setbacks - Zoe Ann
Jim Coyne conducted an inspection and discovered the cabin and the deck will not meet the
required 80 ft. setback. This is outside of shoreline jurisdiction. Though there is no mapping,
site inspections indicate this is a geologically hazardous area. No geotechnical report was
required.
Decision: They can either have a geologist address the setbacks and slope stability or they can
enter into a Hold Harmless Indemnification Agreement with the county. Zoe Ann will contact
the owner.

Discussed when a Binding Site Plan is required for Condos. A BSP is an alternative to a formal
'?division—a division of land. Condos are a form of ownership, not a division of land. If condos are
being created, a BSP does not need to be done unless a separate and new lot,tract or parcel is being
created for the condos. LBV has already been subdivided, but Admiralty III has not. The Hearing
Examiners decision on the Resort Revision does not specify or require Condos,just residential units. PLA
is not committed or obligated to create condos.
Decision: A BSP is not required to create condos in the LBV plat since it has already been subdivided. A
BSP, plat or BLA will be required if a separate lot,tract or parcel is necessary to create condos on the
Admiralty III parcel. Since condos were not specified in the decision conditions of approval, they are not
required and therefore a BSP is not required as part of the Resort Revision permitting or to file the SDP
with DOE.
ITEM: PLA Timberton Village—Permit Req Tree Removal Slight Slide—Colleen
Russ Malmgreen common area chair for Timberton Village homeowners association is inquiring if a
permit is required for"Firewise" and landscape maintenance. The removal includes blackberries,
thistles and brush. The removal takes place on common areas, ROW and private property. No large
equipment would be used. The only equipment would be weed eaters, mowers and hand removal. The
removal does take place on slight landslide hazard areas.
Decision: Vegetation removal permit is required.
ITEM: Shoreline/CAO setback requirements—021191002—Colleen
Barbara Blowers is inquiring what the setback would be on a shoreline parcel with associated wetlands.
The existing structure that they may replace or expand is 205 feet from the OHWM
Decision: The structure is outside of the SMP and would require a wetland delineation to determine the
categorization and function of the wetland. This will determine the buffer required, JCC 18.22.300.The
proposed project may require mediation or CASP.
ITEM: Zoning— Lot Seg—977400021—Colleen
Larry Carter is inquiring about a lot seg of the 3 existing lots within 1 parcel. He would propose 2
parcels. Lot 32 as one parcel and lot 33 and 34 as one parcel. It has an existing SPAAD on the parcel.
The assessor commented Lot 31 (South 10') must be attached with lot 32, and Tideland Tax 1 fronts all
of the lots. I would assume a BLA will need to be completed to attach the tidelands to the newly created
lots.
Decision: Check with the Assessor if tax 1 could be attached to one of the proposed parcels and not
both. The SPAAD would be voided if he applies for the lot seg or a BLA. He could apply for a BLA to
divide the tidelands between the 2 parcels. A new SPAAD could be applied for at the same time as the
BLA but SPAAD approval would have to be after the BLA approval. Send for comment to EH and include
comment in response letter.
ITEM: Hoh River Trust—Lot Seg 712331001, 613134001, 613124001—Colleen
Assessor has commented on the lot segs and sent the legals. Do they meet the requirements to be
processed as a subdivision exemption JCC 18.35.040(1)? Would they require a full survey of the existing
parcels or could the survey be only the new parcel line?
ision: A survey of just the new property line would be ok. They will require new legals of the entire
new parcel.
Parcel 712331001 per the assessor can be considered 2 separate parcels. Lot 1 less tax 1 & NW1/4 less
SE NW. The exemption will apply to this parcel as the RF minimum density will be maintained.
Parcel 613134001 per the assessor can be considered 5 separate parcels. Gov lot 8, Gov lot 9, Gov lot
10, Gov lot 14 &W1/2 SE (less R/W). The exemption will apply to this parcel.The density of CF will need
to be maintained. They will need to combine the existing parcels to achieve this. This will allow 3
separate parcels. The new legals for all parcels will need to be submitted with the exemption.
Parcel 613124001 per the assessor can be considered 3 separate parcels. Gov Lot 3, N1/2 SW (less
R/W), and NW SE. Please request that Jodi at the assessor office send a highlight map designating the 3
separate parcels according to the above legals. They may already be separate parcels and not have to
go through the subdivision exemption process.
ITEM: Bollinger 021212015—Donna
The reply to my request to the contractor for a fax number was returned by Barbara Blowers, who
stated that they would not be signing anything.
Decision: Send request for additional information indicating that the contactor needs to state that on
the estimate that his labor is include or send in additional cost estimate for his labor. All of this would
need to be done within the 3-month response time or the application will be cancelled.
ITEM: Shaw 602234009—Donna
Can this old zoning case be cancelled?
Decision: Send email string to Marie, asking her for a response.
ITEM: Joe Daubenburger—Glen Cove—Michelle
Joe asked if a pool hall would be feasible at his property on the corner of SR20 and Seton Road. He also
inquired about a consignment store.
Decision: A pool hall is considered as"indoor entertainment or recreational facility" as defined in the
definitions section of the JCC. It is a "no" in the LI/C zone. A consignment store is also a no use in the
LI/C zone.

When case file for subdivision is finished, planner will forward the case file to Colleen (or planclerk) to
wait for"baby parcel" numbers. Planner can update information in the black file cabinets and notebook
if needed, or people can reference the plat online, in Laserfiche, or in the case file.
