To process this segregation, you will need to submit a wrttten request and a copy of the recorded legal descriptions to the Jefferson County Assessor's Office to have additional parcel numbers assigned. A copy of this permit will be forwarded to the Assessor's Office. Please contact the Jefferson County Assessor's Office (360-385-9105)with any questions regarding this process. 2.) Based on the findings, parcel number 901311001 can be considered three (3) separate parcel as described in the legal descriptions submitted with the application. 3.) The Lot Certification statement of intent legal descriptions shall be recorded with Jefferson County Auditor's office. 4.) As the Parcels are found exempt from RCW 58.17 and Jefferson County Code 18.35, a title report is not required. It is the property owner's responsibility to identify and rectify any security interest, conveyances, encumbrances, easements or restrictions affecting the subject properties involved in this county reviewed exemption. FINDINGS: 1.) The Administrator finds that this application complies with applicable provisions of the Unifed Development Code, all other applicable ordinances and regulations, and is consistent with the Jefferson County Comprehensive Plan and Land Use map. 2.) The administrator determined on January 7, 2009 & September 14, 2010 that no survey is required when following existing section lines. 3.) The proposal is found to be an exemption under Jefferson County Code (JCC) Section 18.35.040(1): (1)Divisions of land into lots, tracts or parcels each one of which is one-sixteenth of a section of land or larger, or 40 acres or larger if the land is not capable of description as a fraction of a section of land; provided, that for purposes of computing the size of a lot that borders on a street or road, the lot size shall be expanded to include that area that would be bounded by the center line of the street or road and the side lot lines of the 4.) This determination does not guarantee an ability to develop the parcels. All development shall comply with the on-site sewage code, the building codes and local development regulations. 5.) The parcel has been designated as RF 1:40 Rural Forest under the Jefferson County Comprehensive Land use Map effective August 28, 1998 6.) NOTICE: This permit does not excuse the proponent from complying with other local, state, and federal ordinances, regulations, or statutes applicable to the proposed development, but consistent with RCW 90.58. Development pursuant to this permit shall be undertaken subject to the applicable policies and performance standards of the Jefferson County Shoreline Management Master Program and the Jefferson County Unified Development Code. If during excavation or development of the site an area of potential archaeological significance is uncovered, all activity in the immediate area shall be halted, and the Administrator shall be notified at once. The Federal Endangered Species Act rules to protect threatened Chinook and Summer-run Chum salmon became effective on January 8, 2001. Bull trout have been listed as threatened since early 2000. Under the ESA, any person may bring lawsuit against any individual or agency that"takes" listed species (defined as causing harm, harassing, or damaging habitat for the listed species). In addition, the National Marine Fisheries Service can levy penalties. All areas in Jefferson County are included as"critical habitat"for a listed species. Development of property along any marine shoreline, freshwater shoreline, or floodplains could harm habitat if protective measures are not taken. To minimize the potential to damage habitat, all property owners developinc adjacent to marine shoreline, freshwater shoreline, or floodplains are advised to do the following: -All development activities should avoid unstable slopes, wetlands, and forested areas near surface waters - Remove minimal vegetation for site development, especially large trees -Allow trees that have fallen into surface waters to remain there - Infiltrate stormwater from buildings and driveways onsite through drywells rather than discharging directly into surface waters or roadside ditches The Federal Bald and Golden Eagle Protection Act requires landowners within 660 feet(1/8th of a mile)of an eagle nest to consult with the US Fish and Wildlife Service. This Eagle Act prohibits anyone from"taking" bald eagles. This federal law defines the term"take"and describes the possible legal consequences when a"take" occurs. Among other actions, "take" includes a disturbance of bald eagles or their habitat. Under federal law a permit may still be required for activities that impact bald eagles or their habitat. Contact the US Fish and Wildlife Service (http://www.fws.gov/pacific/eagle/)to learn more about how this law affects your project. Any individual, group, or agency can bring suit for a listed species"taking", even if you are in compliance with Jefferson County development codes. The risk of a lawsuit against you can be reduced by consulting with a professional fisheries habitat biologist, and following the recommendations for site development provided by the biologist. For more information, contact the National Marine Fisheries Service in Seattle, or the U.S. Fish and Wildlife Service. 7.) On February, 27, 2012, Sherrie Shold's in the Assessor's Office commentd as follows: I have completed my review on this lot certification and have no comments. 8.) On Febuary 17, 2012, Pat Perry man in the Assessor's GIS department commented as follows: After reviewing the revisions submitted to us on February 17, 2012 by interoffice email, I have no further comments concerning this proposed action. All of my previous concerns pertaining to the action have been addressed. 9.) Contact the Jefferson county Environmental Health Department at(360) 379-9444 to determine potential limitations with regard to wells and on-site sewage requirements. 10.) RCW 58.17 requires regulation of the division of land and was passed in 1969 11.) The application was reviewed by the Jefferson County Department of Community Development staff on 12-22-11 for the potential presence of Environmentally Sensitive Areas (ESAs) under the provisions of the Unified Development Code (UDC). After an initial Geographic Information Systems mapping review, the following ESAs were confirmed to be present on the subject property: Fish and wildlife habitat conservation area, DNR"N"waterbody, "F"fish bearing stream, wetlands, susceptible aquifer recharge area, seismic hazard. slight landslide hazardous area, FEMA flood hazardous area. I have checked with the treasurer's office and parcel 802144005 owes $105.36 and parcel 901311001 owes$104.38. I have forwarded the revised legal description to Pat& Sherrie for comment. I currently have no record of either of them signing off on MLA11-00090. It should be a quick review if they have looked at the document before. They have both signed off on MLA11-00089 in November of 2011. I still have not received the recording fees for either statement of intent. Please submit$129 for recording when you submit the signed and notarized statement of intent. Recording fees are$63 dollars for the first page a $1 for each additional page. The deed (Aff 48788)from Crown Zee to Puget Southern Properties, Inc has roads identified as F-2J and E-2G that pertain to this parcel. I haven't been able to confirm that the road identification alpha/numbers are the accurate roads. 2. One item that I do have a comment on is that Parcel 2 needs to also except out anyportion of the Southwest'/ of the Northwest Y lyingEast of Old Eaglemount g Road. That portion of the Southwest Y4 of the Northwest A lying East of the road was deeded to Puget Southern Properties as Parcel 3 (provided the road numbers are correct)and as such needs to be excepted from the legal description for the property identified as Parcel 2 in MLA11-oo006. 3. Even if the road numbers(F-2J and E-2G)are track-able by Public Works, I would like to have Pope Resources use the current road numbers(or road names)since this is a revision to the existing parcel descriptions.
