Prior to the first building inspection, the geologist shall stake the 100 ft. setback from the top of the steep bluff slope. 2.) The project proponent shall apply for and obtain a building permit prior to beginning any work approved under this Site Plan Approval Advance Determination. 3.) The project proponent shall apply for a shoreline exemption for single-family residential development at the time of building application. 4.) The project proponent shall apply for installation of a septic system at the time of building application. 5.) To help prevent seawater from intruding landward into underground aquifers, all new development activity on Marrowstone Island, Indian Island and within 1/4 mile of any marine shoreline shall be required to infiltrate all stormwater runoff onsite. 6.) On-going well monitoring for chloride concentration is required. The property owner shall allow access to Jefferson County PUD or approved contractor to take samples as required. 7.) A vegetative buffer of 100 feet shall be permanently maintained from the top or edge of the Landslide Hazard Area. All buffers shall be measured perpendicularly from the top or toe of the Landslide Hazard Area. 8.) A Geotechnical Report was submitted in conjunction with this application. The report addressed the stability of the geologic hazard area. A setback of 100 feet shall be measured perpendicularly from the top or toe of the geologic hazard to the proposed residential development. All development on this property shall comply with the conclusions and recommendation in the January 27, 2006 Stratum Group report. 9.) Construction activities shall not encroach upon the 100-foot buffer for geologically hazardous areas. This includes the storage or preparation of materials. 10.) Critical Aquifer Recharge Areas may require special protection measures to mitigate water quality degradation. The submitted proposal does not require additional aquifer protection measures. However, during construction the project shall follow the Best Management Practices (BMPs) and facility design standards as identified and defined in the Stormwater Management Manual for the Puget Sound Basin. 11.) The project shall adhere to the Best Management Practices (BMPs)to control stormwater, erosion and sediment during construction. BMPs shall address permanent measures to stabilize soil exposed during construction, and in the design and operation of stormwater and drainage control systems. 12.) Outdoor residential storage shall be maintained in an orderly manner and shall create no fire, safety, health or sanitary hazard. 13.) Not more than 2 unlicensed vehicles shall be stored on any lot unless totally screened from view of neighboring dwellings and rights-of-way. Such screening shall meet all applicable performance and development standards specific to the district in which the storage is kept, and shall be in keeping with the character of the area. Screening shall meet the requirements of Chapter 18.30 JCC. Outdoor storage of 3 or more junk motor vehicles is prohibited except in those districts where specified as an automobile wrecking yard or junk(or salvage) yard and allowed as a permitted use in Table 3-1 or Chapter 18.18 JCC, and such storage shall meet the requirements of JCC 18.20.100, Automobile wrecking yards and junk (or salvage)yards. In no case, shall any such junk motor vehicles be stored in a critical area. 14.) A minimum of two (2) on-site parking spaces shall be provided for the single family residence. 15.) Duration of Approval -Several of the included findings shall become conditions upon the submittal of a building and septic permit. The duration of approval of the Site Plan shall be effective for five (5)years from the date of original approval by the Administrator. If a building permit has not been issued within the five(5) year period, the Site Plan Approval Advance Determination (SPAAD) cannot be revived or extended except by new application that must meet all the existing criteria and conditions listed in this Section. Knowledge of the expiration date shall be the responsibility of the applicant. The county will not provide notification prior to expiration. Limitations of Approval -Approval of the site plan shall not guarantee the performance of specific site features or improvements (e.g. wells, septic systems, stormwater drainage facilities, etc.) and shall not be immune from changes in state or federal law which are enacted or have an effective date after the date of this Site Plan Approval Advance Determination (SPAAD) and which may affect the performance and implementation of the site plan and associated use or activity. Any subsequent land division or boundary line adjustment of a parcel or lot which has received site plan approval advance determination under this Article VII, Chapter 18.40 JCC shall void such site plan approval and require a new site plan approval advance determination application. Approval of a site plan under this section does not constitute authority to commence any development or building activity until such time as final authorizing permits are issued (e.g., septic, wells, stormwater management, or building permit, etc.). Modification to an approved site plan may be required by the applicant and approved by the Administrator subject to the provisions for Type I decisions. (Please request a copy of Article VII, Chapter 18.40 JCC for criteria pertaining to modifications). 16.) Maximum lot coverage is not to exceed 25%. Lot coverage is defined as amount of impervious surface, which includes roof tops, driveways, concrete, etc. 17.) The setback from Porter Lane is 20 feet, the side setbacks from adjacent properties is 5 feet, and the shoreline setback is 100 feet. 18.) The building height is not to exceed 35 feet. 19.) At the time of building application, the project proponent shall submit a stormwater plan prepared by a licensed engineer that complies with the recommendations in the geotechnical report prepared by Stratum Group (dated January 27, 2006). The submitted stormwater plan shall also comply with the Stormwater Management Manual for Western Washington (current edition). If the proposal cannot comply with a prescriptive method of stormwater management, the applicant shall submit an engineered stormwater plan. 20.) The project proponent shall provide proof of potable water at the time of building permit application. This permit does not vest the parcel for potable water. 21.) VOLUNTARY MEASURES OF COASTAL &AT RISK SIPZ: 1. Installation of a flow meter. 2. On-going well monitoring for chloride concentration. 3. Submittal of monitoring data to County. 22.) MANDATORY MEASURES FOR COASTAL SIPZ: 1. For proof of potable water on a building permit application, applicant must utilize DOH-approved public water system if available. 2. If public water is unavailable, a qualifying alternative system may be used as proof of potable water or an individual well may be used as proof of potable water subject to the following requirement: a. Chloride concentration of a laboratory-certified well water sample submitted with building permit application. 3. If public water is unavailable, a qualifying alternative system may be used as proof of potable water. 23.) VOLUNTARY MEASURES OF COASTAL &AT RISK SIPZ: Water conservation measures: 1. Roof and other intercepted precipitation shall be routed to on-site detention ponds and/or other approved means and allowed to be released to the soil slowly. 2. Water collected from Storm water and roof catchments may be used for watering lawns and gardens. Unless catchment water has been treated to meet drinking water standards, there shall be no cross connections allowed between the potable supply and impounded water. 3. Water withdrawn from wells on each property shall not be used for watering of lawns and/or gardens. 4. Ground water withdrawn from each property shall be restricted to a rate of three (3)gallons per minute. 5. Installation of water conserving fixtures such as low flow toilets, faucets and shower restrictors and other water saving plumbing fixtures. 6. Landscaping plan (xeriscaping, native vegetation with minimal amounts of irrigation). Please NOTE that the above listed measures are not intended to be exhaustive, but rather is intended to be illustrative of the types of water conservation measures. FINDINGS: 1.) The Administrator finds that this application complies with applicable provisions of the Unified Development Code,all other applicable ordinances and regulations,and is consistent with the Jefferson County Comprehensive Plan and Land Use map. 2.) The soils report enclosed with the SPAAD application supports a finding that an onsite sewage system can be installed on the property in the area evaluated. SPAAD approval DOES NOT constitute an onsite sewage system design or capacity approval. 3.) Any removal or disturbance of soil in the area evaluated may create site conditions that are unacceptable for the installation of an onsite sewage system and may invalidate this approval. 4.) SEPTIC SYSTEM COMPONENT SETBACKS TO STORMWATER MANAGEMENT FACILITIES- Any stormwater component: dry well, infiltration trench/pond, foundation drains, or any other source of water that is upgradient (above) or on the same contour MUST be setback a minimum of 10' from any septic system dispersal area (drainfield) and 5' from any septic tanks. Any stormwater component: dry well, infiltration trench/pond, foundation drains, or any other source of water that is downgradient or lower MUST be setback a minimum of 30'from any septic system dispersal area (drainfield) and 5' from any septic tanks. Surface drainage, roof run-off, splash blocks, etc. must be directed away from ALL septic components. 5.) This Site Plan Approval Advance Determination is for proposed future residential development on a parcel along Strait of Juan de Fuca. This portion of Strait of Juan de Fuca is designated as Natural/Suburban. This permit vests the proposal to shoreline requirements in JCC 18.25, but is not a shoreline permit. The project proponent shall apply for a shoreline exemption for single-family residential development at the time of building application. 6.) An April 14, 2010 Jefferson County Code Interpretation for EHB 1653, codes in effect, including critical areas ordinances retroactive to July 27, 2003, shall apply to development within shoreline jurisdiction with a vesting date on or after March 18, 2010, which is the effective dated of EHB 1653. Based on this, critical area requirements apply to this application. 7.) A well exists on the parcel. The location is shown on the approved site plan. A portion of the parcel is mapped within a High Risk Seawater Intrusion Protection Zone. The applicant submitted a letter from Van Aller Surveying dated April 19, 2006 which states, "The distance between the existing water well at tax parcel# 001063008 (Porter Lane)and the existing salt water well at tax parcel#001063003 (3394 W. Hastings Avenue; is 1114 feet." Based on this letter staff determined a hydrogeologic assessment is not required. 8.) The application was reviewed by the Jefferson County Department of Community Development staff for the potential presence of Critica Areas under the provisions of the Jefferson County Code (JCC). After an initial Geographic Information Systems mapping review and an investigative site inspection, the following Critical Areas were confirmed to be present on the subject property: geologically hazardous areas(unstable old slides, seismic hazards, high landslide hazard); fish and wildlife habitat conservation areas (listed species in marine water); aquifer recharge areas (susceptible); and seawater intrusion protection zone (high risk). 9.) A Special Report was submitted to address geologically hazardous areas for MLA06-00092 (ZON06-00014). This report was prepared by Stratum Group (dated January 27, 2006), and provides conclusions and recommendations for site development, including locating the residential structures at least 100 feet from the top of the bluff. As part of the current SPAAD application, a letter from Stratum Group (dated March 15, 2011) was submitted. This letter states that the conclusions and recommendations in the January 27, 2006 report still apply to residential development on this parcel. 10.) Geologically Hazardous Areas in Jefferson County are characterized by slope, soil type, geologic material, and groundwater that may combine to create problems with slope stability, erosion, and water quality during and after construction or during natural events such as earthquakes or severe rainstorms. 11.) Aquifer Recharge Areas in Jefferson County are characterized by porous geological formations that allow percolation of the surface water into the soils and the underlying zone of saturation. Aquifers are geologic formations that contain sufficient saturated permeable material to yield significant quantities of water to wells and springs. Aquifers serve as the source of drinking water within most of the rural portions of Jefferson County. 12.) Susceptible Aquifer Recharge Areas are those with geologic and hydrologic conditions that promote rapid infiltration of recharge waters to groundwater aquifers. 13.) Marine shorelines and islands are susceptible to a condition that is known as seawater intrusion. Seawater intrusion is a condition in which the saltwater/freshwater interface in an aquifer moves inland so that wells drillec on upland areas cannot obtain freshwater suitable for public consumption without significant additional treatment and cost. Maintaining a stable balance in the saltwater/freshwater interface is primarily a function of the rate of aquifer recharge (primarily through rainfall) and the rate of groundwater withdrawals (primarily through wells). The Washington Department of Ecology is the agency with statutory authority to regulate groundwater withdrawal for individual wells in Jefferson County. New development, redevelopment, and land use activities on islands and in close proximity to marine shorelines in particular should be developed in such a manner to maximize aquifer recharge and maintain the saltwater/freshwater balance to the maximum extent possible by infiltrating stormwater runoff so that it recharges the aquifer. 14.) The building envelope shows the proposed development more than 155 feet(150-foot setback plus 5-foot building setback)from the fish and wildlife habitat conservation area. 15.) Jefferson County determined that this proposal is categorically exempt from review under the State Environmental Policy Act(SEPA) pursuant to WAC 197-11-800(1)(b)(i). 16.) The site plan, as submitted with the SPAAD application on March 23, 2011, has been reviewed for consistency under the JCC, and has been approved by Jefferson County Department of Community Development. Any modifications, changes, and/or additions to the stamped, approved site plan dated July 18, 2011 shall be resubmitted for review and approval by Jefferson County Department of Community Development. 17.) This approval is fora Site Plan Approval Advance Determination only. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits. 18.) The proposal was reviewed against the site plan determination criteria specified in Chapter 18.40 of the Jefferson County Code. The criteria for approval are as follows: 1. The proposed site plan conforms to all applicable county, state, and federal land use, environmental and health regulations and plans, including but not limited to the following: The Jefferson County Comprehensive Plan, the Shoreline Management Master Program, and the provisions of the Jefferson County Code. Staff comment: The application was reviewed for consistency under the provisions of the Unified Development Code, Comprehensive Plan, and Shoreline Master Program. The application was found in compliance with all ordinances pertaining to the proposed development. 2. Adequate provisions for utilities and other public services necessary to serve the needs of the proposed site plan have been demonstrated, including open spaces, drainage ways, roads, and other public ways, potable water, sewerage disposal, fire flow and other improvements. Staff comment: The parcel totals 3.16 acres in size, and the site plan submitted on March 23, 2011 and stamped approved on September 1, 2011 complies with Table 6-1: Density, Dimension and Open Space Standards. This SPAAD application is for future single-family residential development. Jefferson County Department of Environmental Health commented on the application adding the finding "The soils report enclosed with the SPAAD application supports a finding that an onsite sewage system can be installed on the property in the area evaluated. This SPAAD was not reviewed for fire flow due to the application as proposed identifies the parcel as using an individual well. Jefferson County has no specific adopted fire flow requirements for utilization in permitting. Application of Coordinated Water System Plan (CWSP)fire flow requirements for individual projects is inappropriate since the primary purpose is for water system design to assure adequate pipe size, source and storage. The applicant shall provide proof of potable water at the time of building permit application. This application does not vest the parcel for potable water. Access to this parcel is provided by Porter Lane(P135)which is a private local access road. A road approach permit is not required. An address of 313 Porter Lane has been assigned to the parcel. This application is for Site Plan Approval Advance Determination to eventually construct a single-family Y residence using an individual on-site septic system, and the approved site plan has not been reviewed for stormwater requirements. Sections 18.30.060 and 18.30.070 of the Jefferson County Code require the project applicant to prepare a stormwater plan in compliance with the Department of Ecology Stormwater Management Manual for Western Washington to control stormwater, erosion and sediment during construction, to address permanent measures to stabilize soil exposed during construction, and in the design and operation of stormwater and drainage control systems. At the time of building application, a stormwater plan in compliance with the Stormwater Management Manual for Western Washington shall be submitted. If the proposal cannot meet the prescriptive requirements of the stormwater manual, an engineered stormwater plan shall be required. 3. The probable significant adverse environmental impacts of the proposed site plan, together with any practical means of mitigating adverse impacts, have been considered such that the proposal will not have an unacceptable adverse effect upon the quality of the environment, in accordance with the State Environmental Policy Act (SEPA) implementing the provisions contained within Chapter 18.40 of this Code and Chapter 43.21C RCW. Staff comment: Single family residences are EXEMPT from the State Environmental Policy Act(SEPA). WAC 197-11-800(1)(b)(i) identifies the construction of any residential structure of four(4)dwelling units. 4. Approving the proposed site plan will serve the public use and interest and adequate provision has been made for the public health, safety and general welfare. Staff comment: The proposal will not affect the public health, safety, and general welfare. 19.) The parcel has been designated as rural residential one dwelling unit per five acreas (RR 1:5) under the Jefferson County Comprehensive Land Use Map effective August 28, 1998. 20.) The property is located at 313 Porter Lane. 21.) The parcel is located within a coastal SIPZ(seawater intrusion protection zone) according to the County GIS map. There are voluntary and mandatory measures identified in the Jefferson County Seawater Intrusion Polic) (Resolution 44-22, effective September 23, 2002)that apply to well drilling proposals and building permit applications on existing lots of record. A Coastal SIPZ is defined as: all islands and area within one-quarter mile of marine shoreline, but no history of chloride concentration above 100 mg/L in groundwater sources within 1000 feet. 22.) NOTICE: This permit does not excuse the proponent from complying with other local, state, and federal ordinances, regulations, or statutes applicable to the proposed development, but consistent with RCW 90.58. Development pursuant to this permit shall be undertaken subject to the applicable policies and performance standards of the Jefferson County Shoreline Management Master Program and the Jefferson County Unified Development Code. If during excavation or development of the site an area of potential archaeological significance is uncovered, all activity in the immediate area shall be halted, and the Administrator shall be notified at once. The Federal Endangered Species Act rules to protect threatened Chinook and Summer-run Chum salmon became effective on January 8, 2001. Bull trout have been listed as threatened since early 2000. Under the ESA, any person may bring lawsuit against any individual or agency that"takes" listed species (defined as causing harm, harassing, or damaging habitat for the listed species). In addition, the National Marine Fisheries Service can levy penalties. All areas in Jefferson County are included as"critical habitat"for a listed species. Development of property along any marine shoreline, freshwater shoreline, or floodplains could harm habitat if protective measures are not taken. To minimize the potential to damage habitat, all property owners developinc adjacent to marine shoreline, freshwater shoreline, or floodplains are advised to do the following: -All development activities should avoid unstable slopes, wetlands, and forested areas near surface waters - Remove minimal vegetation for site development, especially large trees -Allow trees that have fallen into surface waters to remain there - Infiltrate stormwater from buildings and driveways onsite through drywells rather than discharging directly into surface waters or roadside ditches The Federal Bald and Golden Eagle Protection Act requires landowners within 660 feet(1/8th of a mile) of an eagle nest to consult with the US Fish and Wildlife Service. This Eagle Act prohibits anyone from "taking" bald eagles. This federal law defines the term "take"and describes the possible legal consequences when a"take" occurs. Among other actions, "take" includes a disturbance of bald eagles or their habitat. Under federal law a permit may still be required for activities that impact bald eagles or their habitat. Contact the US Fish and Wildlife Service (http://www.fws.gov/pacificeagle/) to learn more about how this law affects your project. Any individual, group, or agency can bring suit for a listed species"taking", even if you are in compliance with Jefferson County development codes. The risk of a lawsuit against you can be reduced by consulting with a professional fisheries habitat biologist, and following the recommendations for site development provided by the biologist. For more information, contact the National Marine Fisheries Service in Seattle, or the U.S. Fish and Wildlife Service. APPEALS: Pursuant to RCW 36.70C,the applicant or any aggrieved party may appeal this final dedsion to Jefferson County Superior Court within twenty-one (21)calendar days of the date of issuance of this land use decision. On the same date, I visited the site to review the soils, vegetation, surface water hydrology, and land within 100' of the proposed drainfield and reserve area as depicted on the site plan/ soil test pit location sketch dated 1/26/2006. From the web site, for the lot to the east of the subject, I found USR06-17 that was inspected 2/28/2006 by the County. I found a well log for that site for assessor parcel number 001-063- 021, drilled for Emmet Wolfe on 5/4/2006. I located this well later in the day, and found it approximately 104' from a flag I had left around a cedar tree along the east property line labeled "100' +/- to proposed well to north". So the well described as "area of proposed neighbor's well" on the 2006 site plan may now be updated to read "area of neighbor's well,USR06-17". On the ground, I located the other two wells shown on the 2006 site plan. I located the open soil test pits. Several had either sloughed in, or had forest litter, branches or trees covering them. I refreshed the flags for the test pits found. I found no recent disturbance of vegetation or altering of surface drainage patterns on the subject site or within 100' of the proposed drainfield and reserve area. In conclusion, I believe that the site plan issued by this office on 1/25/2006 with the above noted updates still adequately portrays the site features. I believe that the proposed drainfield and reserve areas are still adequate for the approvals originally given. All buffers shall be measured perpendicularly from the top or toe of the Landslide Hazard Area. 9.) A Geotechnical Report was submitted in conjunction with this application. The report addressed the stability of the geologic hazard area. A setback of 100 feet shall be measured perpendicularly from the top or toe of the geologic hazard to the proposed residential development. All development on this property shall comply with the conclusions and recommendation in the January 27, 2006 Stratum Group report. 10.) Construction activities shall not encroach upon the 100-foot buffer for geologically hazardous areas. This includes the storage or preparation of materials. 11.) Critical Aquifer Recharge Areas may require special protection measures to mitigate water quality degradation. The submitted proposal does not require additional aquifer protection measures. However, during construction the project shall follow the Best Management Practices (BMPs) and facility design standards as identified and defined in the Stormwater Management Manual for the Puget Sound Basin. 12.) The project shall adhere to the Best Management Practices (BMPs) to control stormwater, erosion and sediment during construction. BMPs shall address permanent measures to stabilize soil exposed during construction, and in the design and operation of stormwater and drainage control systems. 13.) Outdoor residential storage shall be maintained in an orderly manner and shall create no fire, safety, health or sanitary hazard. 14.) Not more than 2 unlicensed vehicles shall be stored on any lot unless totally screened from view of neighboring dwellings and rights-of-way. Such screening shall meet all applicable performance and development standards specific to the district in which the storage is kept, and shall be in keeping with the character of the area. Screening shall meet the requirements of Chapter 18.30 JCC. Outdoor storage of 3 or more junk motor vehicles is prohibited except in those districts where specified as an automobile wrecking yard or junk (or salvage) yard and allowed as a permitted use in Table 3-1 or Chapter 18.18 JCC, and such storage shall meet the requirements of JCC 18.20.100, Automobile wrecking yards and junk(or salvage) yards. In no case, shall any such junk motor vehicles be stored in a critical area. 15.) A minimum of two (2) on-site parking spaces shall be provided for the single family residence. 16.) Duration of Approval-Several of the included findings shall become conditions upon the submittal of a building and septic permit. The duration of approval of the Site Plan shall be effective for five (5)years from the date of original approval by the Administrator. If a building permit has not been issued within the five (5)year period, the Site Plan Approval Advance Determination (SPAAD) cannot be revived or extended except by new application that must meet all the existing criteria and conditions listed in this Section. Knowledge of the expiration date shall be the responsibility of the applicant. The county will not provide notification prior to expiration. Limitations of Approval -Approval of the site plan shall not guarantee the performance of specific site features or improvements (e.g. wells, septic systems, stormwater drainage facilities, etc.) and shall not be immune from changes in state or federal law which are enacted or have an effective date after the d- - of the Site Plan Approval Advance Determination (SPAAD) and which may affect the performance,. - • entation of the site plan and associated use or activity. The setback from Porter Lane is 20 feet, the side setbacks from adjacent properties is 5 feet, and the shoreline setback is 100 feet. 19.) The building height is not to exceed 35 feet. 20.) At the time of building application, the project proponent shall submit a stormwater plan prepared by a licensed engineer that complies with the recommendations in the geotechnical report prepared by Stratum Group (dated January 27, 2006). The submitted stormwater plan shall also comply with the Stormwater Management Manual 1 for Western Washington. 21.) The project proponent shall provide proof of potable water at the time of building permit application. This permit does not vest the parcel for potable water. FINDINGS: 1.) The Administrator finds that this application complies with applicable provisions of the Unified Development Code, all other applicable ordinances and reg ulations,and is consistent with the Jefferson County Comprehensive Plan and Land Use map. 2.) The soils report enclosed with the SPAAD application supports a finding that an onsite sewage system can be installed on the property in the area evaluated. SPAAD approval DOES NOT constitute an onsite sewage system design or capacity approval. 3.) Any removal or disturbance of soil in the area evaluated may create site conditions that are unacceptable for the installation of an onsite sewage system and may invalidate this approval. 4.) SEPTIC SYSTEM COMPONENT SETBACKS TO STORMWATER MANAGEMENT FACILITIES - Any stormwater component: dry well, infiltration trench/pond, foundation drains, or any other source of water that is upgradient(above)or on the same contour MUST be setback a minimum of 10' from any septic system dispersal area (drainfield) and 5' from any septic tanks. Any stormwater component: dry well, infiltration trench/pond, foundation drains, or any other source of water that is downgradient or lower MUST be setback a minimum of 30' from any septic system dispersal area (drainfield) and 5' from any septic tanks. Surface drainage, roof run-off, splash blocks, etc. must be directed away from ALL septic components. 5.) This Site Plan Approval Advance Determination is for proposed future residential development on a parcel along Strait of Juan de Fuca. This portion of Strait of Juan de Fuca is designated as Natural/Suburban. This permit vests the proposal to shoreline requirements in JCC 18.25, but is not a shoreline permit. The project proponent shall apply for a shoreline exemption for single-family residential development at the time of building application. 6.) An April 14, 2010 Jefferson County Code Interpretation for EHB 1653, codes in effect, including critical areas ordinances retroactive to July 27, 2003, shall apply to development within shoreline jurisdiction with a vesting date on or after March 18, 2010, which is the effective dated of EHB 1653. Based on this, critical area requirements apply to this application. 7.) The application was reviewed by the Jefferson County Department of Community Development staff for the potential presence of Critica Areas under the provisions of the Jefferson County Code (JCC). After an initial Geographic Information Systems mapping review and an investigative site inspection, the following Critical Areas were confirmed to be present on the subject property: geologically hazardous areas (unstable old slides, seismic hazards, high landslide hazard); fish and wildlife habitat conservation areas (listed species in marine water); aquifer recharge areas (susceptible); and seawater intrusion protection zone (high risk). 8.) A Special Report was submitted to address geologically hazardous areas for MLA06-00092 (ZON06-00014). This report was prepared by Stratum Group (dated January 27, 2006), and provides conclusions and recommendations for site development, including locating the residential structures at least 100 feet from the top of the bluff. As part of the current SPAAD application, a letter from Stratum Group (dated March 15, 2011) was submitted. This letter states that the conclusions and recommendations in the January 27, 2006 report still apply to residential development on this parcel. 9.) Geologically Hazardous Areas in Jefferson County are characterized by slope, soil type, geologic material, and groundwater that may combine to create problems with slope stability, erosion, and water quality during and after construction or during natural events such as earthquakes or severe rainstorms. 10.) Aquifer Recharge Areas in Jefferson County are characterized by porous geological formations that allow percolation of the surface water into the soils and the underlying zone of saturation. Aquifers are geologic formations that contain sufficient saturated permeable material to yield significant quantities of water to wells and springs. Aquifers serve as the source of drinking water within most of the rural portions of Jefferson County. 11.) Susceptible Aquifer Recharge Areas are those with geologic and hydrologic conditions that promote rapid infiltration of recharge waters to groundwater aquifers. 12.) Marine shorelines and islands are susceptible to a condition that is known as seawater intrusion. Seawater intrusion is a condition in which the saltwater/freshwater interface in an aquifer moves inland so that wells drillec on upland areas cannot obtain freshwater suitable for public consumption without significant additional treatment and cost. Maintaining a stable balance in the saltwater/freshwater interface is primarily a function of the rate of aquifer recharge(primarily through rainfall) and the rate of groundwater withdrawals (primarily through wells). The Washington Department of Ecology is the agency with statutory authority to regulate groundwater withdrawal for individual wells in Jefferson County. New development, redevelopment, and land use activities on islands and in close proximity to marine shorelines in particular should be developed in such a manner to maximize aquifer recharge and maintain the saltwater/freshwater balance to the maximum extent possible by infiltrating stormwater runoff so that it recharges the aquifer. 13.) The parcel is located within a High Risk SIPZ (seawater intrusion protection zone) according to the County GIS map. There are mandatory measures identified in the Jefferson County Seawater Intrusion Policy(Resolution 44-22, effective September 23, 2002)that apply to well drilling proposals and building permit applications on existing lots of record. A High Risk SIPZ is defined as: areas within 1,000 feet of a groundwater source with a history of chloride analyses above 200 milligrams per liter(mg/L). 14.) The building envelope shows the proposed development more than 155 feet (150-foot setback plus 5-foot building setback)from the fish and wildlife habitat conservation area. 15.) Jefferson County determined that this proposal is categorically exempt from review under the State Environmental Policy Act(SEPA) pursuant to WAC 197-11-800(1)(b)(i). 16.) The site plan, as submitted with the SPAAD application on March 23, 2011, has been reviewed for consistency under the JCC, and has been approved by Jefferson County Department of Community Development. Any modifications, changes, and/or additions to the stamped, approved site plan dated July 18, 2011 shall be resubmitted for review and approval by Jefferson County Department of Community Development. 17.) This approval is for a Site Plan Approval Advance Determination only. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits. 18.) The proposal was reviewed against the site plan determination criteria specified in Chapter 18.40 of the Jefferson County Code. The criteria for approval is as follows: 1. The proposed site plan conforms to all applicable county, state, and federal land use, environmental and health regulations and plans, including but not limited to the following: The Jefferson County Comprehensive Plan, the Shoreline Management Master Program, and the provisions of the Jefferson County Code. Staff comment: The application was reviewed for consistency under the provisions of the Unified Development Code, Comprehensive Plan, and Shoreline Master Program. The application was found in compliance with all ordinances pertaining to the proposed development. 2. Adequate provisions for utilities and other public services necessary to serve the needs of the proposed site plan have been demonstrated, including open spaces, drainage ways, roads, and other public ways, potable water, sewerage disposal, fire flow and other improvements. Staff comment: The parcel totals 3.16 acres in size, and the site plan submitted on March 23, 2011 and stamped approved on July 18, 2011 complies with Table 6-1: Density, Dimension and Open Space Standards. This SPAAD application is for future single-family residential development. Jefferson County Environmental Health has reviewed the application and approved it based on the site plan received March 23, 2011. This SPAAD was not reviewed for fire flow due to the application as proposed identifies the parcel as using an individual well. Jefferson County has no specific adopted fire flow requirements for utilization in permitting. Application of Coordinated Water System Plan (CWSP)fire flow requirements for individual projects is inappropriate since the primary purpose is for water system design to assure adequate pipe size, source and storage. The applicant shall provide proof of potable water at the time of building permit application. This application does not vest the parcel for potable water. Access to this parcel is provided by Porter Lane (P135)which is a private local access road. A road approach permit is not required. An address of 313 Porter Lane has been assigned to the parcel. This application is for Site Plan Approval Advance Determination to eventually construct a single-family residence using an individual on-site septic system, and the approved site plan has not been reviewed for stormwater requirements. Sections 18.30.060 and 18.30.070 of the Jefferson County Code require the project applicant to prepare a stormwater plan in compliance with the Department of Ecology Stormwater Management Manual for Western Washington to control stormwater, erosion and sediment during construction, to address permanent measures to stabilize soil exposed during construction, and in the design and operation of stormwater and drainage control systems. At the time of building application, a stormwater plan in compliance with the Stormwater Management Manual for Western Washington shall be submitted. If the proposal cannot meet the prescriptive requirements of the stormwater manual, an engineered stormwater plan shall be required. 3. The probable significant adverse environmental impacts of the proposed site plan, together with any practical means of mitigating adverse impacts, have been considered such that the proposal will not have an unacceptable adverse effect upon the quality of the environment, in accordance with the State Environmental Policy Act (SEPA) implementing the provisions contained within Chapter 18.40 of this Code and Chapter 43.21C RCW. Staff comment: Single family residences are EXEMPT from the State Environmental Policy Act (SEPA). WAC 197-11-800(1)(b)(i) identifies the construction of any residential structure of four(4) dwelling units. 4. Approving the proposed site plan will serve the public use and interest and adequate provision has been made for the public health, safety and general welfare. Staff comment: The proposal will not affect the public health, safety, and general welfare. 19.) The parcel has been designated as rural residential one dwelling unit per five acreas (RR 1:5) under the Jefferson County Comprehensive Land Use Map effective August 28, 1998. 20.) The property is located at 313 Porter Lane. 21.) NOTICE: This permit does not excuse the proponent from complying with other local, state, and federal ordinances, regulations, or statutes applicable to the proposed development, but consistent with RCW 90.58. Development pursuant to this permit shall be undertaken subject to the applicable policies and performance standards of the Jefferson County Shoreline Management Master Program and the Jefferson County Unified Development Code. If during excavation or development of the site an area of potential archaeological significance is uncovered, all activity in the immediate area shall be halted, and the Administrator shall be notified at once. The Federal Endangered Species Act rules to protect threatened Chinook and Summer-run Chum salmon became effective on January 8, 2001. Bull trout have been listed as threatened since early 2000. This Eagle Act prohibits anyone from "taking" bald eagles. This federal law defines the term "take" and describes the possible legal consequences when a"take" occurs. After an initial Geographic Information Systems mapping review and an investigative site inspection, the following ESAs were confirmed to be present on the subject property: Natural/Suburban Shoreline Designation, Bald Eagle Habitat Area, Wetlands (associated with the shoreline), Seismic Hazard, High Landslide Hazard Area, Susceptible Aquifer Recharge Area(SUSC), Coastal and High Risk Seawater Intrusion Protection Zone (SIPZ). 3.) Aquifer Recharge Areas in Jefferson County are characterized by porous geological formations that allow percolation of the surface water into the soils and the underlying zone of saturation. Aquifers are geologic formations that contain sufficient saturated permeable material to yield significant quantities of water to wells and springs. Aquifers serve as the source of drinking water within most of the rural portions of Jefferson County. 4.) Susceptible Aquifer Recharge Areas are those with geologic and hydrologic conditions that promote rapid infiltration of recharge waters to groundwater aquifers. 5.) Geologically Hazardous Areas in Jefferson County are characterized by slope, soil type, geologic material, and groundwater that may combine to create problems with slope stability, erosion, and water quality during and after construction or during natural events such as earthquakes or severe rainstorms. 6.) Among the native conifer species which may be used in buffers or for re-vegetation include, but are not limited to: Grand Fir(Aibes grandis), Sitka Spruce (Picea Sitchensis), Shore Pine (Pinus Contorta), Douglas Fir(Pseudotsuga Menziesii), Western Red Cedar(Thuja Plicata), and Western Hemlock(Tsuga Heterophylla). Marine shorelines and islands are susceptible to a condition that is known as seawater intrusion. Seawater intrusion is a condition in which the saltwater/freshwater interface in an aquifer moves inland so that wells drilled on upland areas cannot obtain freshwater suitable for public consumption without significant additional treatment and cost. Maintaining a stable balance in the saltwater/freshwater interface is primarily a function of the rate of aquifer recharge (primarily through rainfall) and the rate of groundwater withdrawals (primarily through wells). The Washington Department of Ecology is the agency with statutory authority to regulate groundwater withdrawal for individual wells in Jefferson County. New development, redevelopment, and land use activities on islands and in close proximity to marine shorelines in particular should be developed in such a manner to maximize aquifer recharge and maintain the saltwater/freshwater balance to the maximum extent possible by infiltrating stormwater runoff so that it recharges the aquifer. 8.) The parcel is located within a coastal SIPZ(seawater intrusion protection zone) according to the County GIS map. There are voluntary and mandatory measures identified in the Jefferson County Seawater Intrusion Policy (Resolution 44-22, effective September 23, 2002) that apply to well drilling proposals and building permit applications on existing lots of record. A Coastal SIPZ is defined as: all islalnds and area within one-quarter mile of marine shoreline, but no history of chloride concentration above 100 mg/L in groundwater sources within 1000 feet. 1 of 4 Cases Name Review Tyne Status Planner 9.) .The parcel is located within a High Risk SIPZ(seawater intrusion protection zone) according to the County GIS map. A High Risk SIPZ is defined as: areas within 1,000 feet of a groundwater source with a history of chloride analyses above 200 milligrams per liter(mg/L). 10.) A vegetative buffer of 100-feet shall be permanently maintained from the top or edge of the Landslide Hazard Area. All buffers shall be measured perpendicularly from the top or toe of the Landslide Hazard Area. 11.) A Geotechnical Report was submitted in conjunction with this application. The report addressed the stability of the geologic hazard area. A setback of 100-feet shall be measured perpendicularly from the top or toe of the geologic hazard to the proposed building envelope (single-family residence or accessory structure). 12.) Landslide Hazard Areas and their associated buffers shall remain naturally vegetated. Should buffer disturbance occur during construction, the Unified Development Code (UDC)Administrator shall require replanting with native vegetation. No alterations shall be made to the Landslide Hazard Area or its associated buffer without prior authorization by the UDC Administrator. 13.) Prior to and during approved construction activities, the perimeter of the landslide hazard area buffer shall be marked with a temporary sign. The sign shall be placed in such a manner that it can be directly observed from the construction area. The sign shall contain the following statement: "Landslide Hazard Area and Buffer- Do not Remove or Alter Existing Vegetation." 14.) All construction activities shall not encroach upon the buffer. This includes the storage or preparation of materials. 15.) The applicant shall permanently separate the boundary of the Landslide Hazard Area Buffer from the remainder of the subject property through installing logs, trees, a hedge row, or any other prominent physical marking approved by the UDC Administrator. 16.) Critical Aquifer Recharge Areas may require special protection measures to mitigate water quality degradation. The submitted proposal does not require additional aquifer protection measures. However, during construction the project shall follow the Best Management Practices(BMPs) and facility design standards as identified and defined in the Stormwater Management Manual for the Puget Sound Basin. 17.) To help prevent seawater from intruding landward into underground aquifers, all new development activity on Marrowstone Island, Indian Island and within 1/4 mile of any marine shoreline shall be required to infiltrate all stormwater runoff onsite. 18.) VOLUNTARY MEASURES OF COASTAL &AT RISK SIPZ: Water conservation measures: 1. Roof and other intercepted precipitation shall be routed to on-site detention ponds and/or other approved means and allowed to be released to the soil slowly. 2. Water collected from Storm water and roof catchments may be used for watering lawns and gardens. Unless catchment water has been treated to meet drinking water standards, there shall be no cross connections allowed between the potable supply and impounded water. 3. Water withdrawn from wells on each property shall not be used for watering of lawns and/or gardens. 4. Ground water withdrawn from each property shall be restricted to a rate of three (3) gallons per minute. 5. Installation of water conserving fixtures such as low flow toilets, faucets and shower restrictors and other water saving plumbing fixtures. 6. Landscaping plan (xeriscaping, native vegetation with minimal amounts of irrigation). Please NOTE that the above listed measures are not intended to be exhaustive, but rather is intended to be illustrative of the types of water conservation measures. 19.) VOLUNTARY MEASURES OF COASTAL &AT RISK SIPZ: • 1. Installation of a flow meter. 2. On-going well monitoring for chloride concentration. 3. Submittal of monitoring data to County. 20.) MANDATORY MEASURES FOR COASTAL SIPZ: 1. For proof of potable water on a building permit application, applicant must utilize DOH-approved public water system if available. 2. If public water is unavailable, a qualifying alternative system may be used as proof of potable water or an individual well may be used as proof of potable water subject to the following requirement: a. Chloride concentration of a laboratory-certified well water sample submitted with building permit application. 3. If public water is unavailable, a qualifying alternative system may be used as proof of potable water. 21.) At the time of building permit application submisson the applicant shall submit a stormwater plan prepared by a licensed engineer which complies with the recommendations in the geotechnical report prepared by Stratum Group dated January 27, 2006. 22.) The applicant shall fully adhere to all conditions and requirements of the approved Eagle Habitat Management Plan. 2 of 4 Cases Name Review Type Status Planner 23.) .As per the approved Eagle Plan signed by Janet McKinnon on June 15, 2006, the applicant shall retain all known perch trees and conifers>/=24 inches diameter at breast height(d.b.h.). The applicant shall also retain >1=50% of pre-clearing or pre-construction conifer stand with diameter distributions representative of the original stand (>6 feet tall). Windowing and low limbing of trees is acceptable provided no more than 30% of the live crown is removed. 24.) The proposal was reviewed against the site plan determination criteria of the Jefferson County Code Chapter 18.40 Article VII. (Site Plan Approval Advance Determinations). The criteria for approval is as follows: 1. The proposed site plan conforms to all applicable county, state and federal, land use, environmental and health regulations and plans, including, but not limited to the following: (a)The Jefferson County Comprehensive Plan; and (b)The provisions of this code, including any incorporated standards. Staff comment: The application was reviewed for consistency under the provisions of the Unified Development Code and Comprehensive Plan. The application was found in compliance with all ordinances pertaining to the proposed development. 2. Adequate provisions for utilities and other public services necessary to serve the needs of the proposed site plan have been demonstrated, including open spaces, drainage ways, roads, and other public ways, potable water, sewage disposal, fire flow and other improvements. Staff comment: The parcel totals approximately 3.16 acres in size, and the site plan as submitted on March 3, 2006 and stamped approved on June 27, 2006 complies with UDC Table 6-1: Density, Dimension and Open Space Standards. Jefferson County Department of Environmental Health commented on the application March 30, 2006 adding the finding "The soils report enclosed with the SPAAD application supports a finding that an onsite sewage system can be installed on the property in the area evaluated. SPAAD approval DOES NOT constitute an onsite sewage system design approval." A well exists on the parcel. The location is shown on the approved site plan. A portion of the parcel is mapped within a High Risk Seawater Instrusion Protection Zone. The applicant submitted a letter from Van Aller Surveying dated April 19, 2006 which states, "The distance between the existing water well at tax parcel# 001063008 (Porter Lane) and the existing salt water well at tax parcel#001063003 (3394 W. Hastings Avenue) is 1114 feet." Based on this letter staff determined a hydrogeologic assessment is not required. The applicant shall provide proof of potable water at the time of building permit application. This application does not vest the parcel for potable water. Access to this parcel is provided by Porter Lane(P135)which is a private local access road. A road approach permit is not required. An address of 313 Porter Lane has been assigned to the parcel. This application is for Site Plan Approval Advance Determination to eventually construct a single-family residence utilizing an individual on-site septic system. Sections 18.30.060 and 18.30.070 of the Jefferson County Code requires the project applicant prepare a stormwater plan in compliance with the Department of Ecology Stormwater Management Manual for Western Washington to control stormwater, erosion and sediment during construction, to address permanent measures to stabilize soil exposed during construction, and in the design and operation of stormwater and drainage control systems. This SPAAD was not reviewed for fire flow due to the application as proposed identifies the parcel as utilizing an individual well. Jefferson County has no specific adopted fire flow requirements for utilization in permitting. Application of Coordinated Water System Plan (CWSP)fire flow requirements for individual projects is inappropriate since the primary purpose is for water system design to assure adequate pipe size, source and storage. 3. The probable significant adverse environmental impacts of the proposed site plan, together with any practical means of mitigating adverse impacts, have been considered such that the proposal will not have an unacceptable adverse effect upon the quality of the environment, in accordance with the State Environmental Policy Act(SEPA) implementing provisions contained within this chapter and Chapter 43.21C RCW. Staff comment: Single-family residences are EXEMPT from the State Environmental Policy Act(SEPA). WAC 197-11-800(1)(b)(i) identifies the construction of any residential structure of four(4) dwelling units. 4. Approving the proposed site plan will serve the public use and interest and adequate provision has been made for the public health, safety and general welfare. Staff comment: The proposal will not affect the public health, safety, and general welfare. 25.) The following shall be stated as a condition on future building permits, "The geotechnical report prepared by stratum group, dated January 27, 2006, requires a minimum 100 foot setback from the edge of the steep shoreline bluff. Prior to scheduling the first inspection the licensed geologist shall stake the 100 ft. Minimum required setback." 26.) Future development of this site including buildings, septic and all land disturbing activities shall comply with all recommendations within the geotechnical report prepared by Stratum Group, dated January 27, 2006 and any subsequent amendments or addendums to this report. 3 of 4 Cases Name Review Tyne Status Planner 27.) -This is a legal nonconforming parcel designated as Rural Residential 1:5 under the Jefferson County Comprehensive Plan Land Use Map effective August 28, 1998. 28.) A minimum of two (2) on-site parking spaces is required for the single-family residence. 29.) The building height is not to exceed 35 feet. 30.) Minimum setback from Porter Lane right-of-way shall be 20 feet. Minimum side yard setbacks shall be 5 feet. Minimum setback from the top edge of the bluff to the foundation is 100 feet per geotechnical report dated January 27, 2006 prepared by Stratum Group. 31.) Outdoor residential storage shall be maintained in an orderly manner and shall create no fire, safety, health or sanitary hazard. 32.) Not more than two (2) unlicensed or inoperable vehicles shall be stored on any lot less than one-half acre unless totally screened from view of neighboring dwellings and rights-of-way. Such screening shall meet all applicable performance and development standards specific to the district in which the storage is kept, and shall be in keeping with the character of the area. Screening shall meet the requirements of Unified Development Code (UDC) Section 6. Outdoor storage of thirteen (13) or more unlicensed or inoperable vehicles is prohibited except in those districts where specified as an automobile wrecking yard or junk(or salvage)yard and allowed as a Permitted Use in Table 3-1 of the UDC, and such storage shall meet the requirements of UDC Section 4.10. In no case, shall any such unlicensed or inoperable vehiclesbe stored in an Environmentally Sensitive Area (ESA). 33.) The applicant shall provide proof of potable water at the time of building permit application. This application does not vest the parcel for potable water. 34.) Maximum lot coverage is not to exceed 25%. Lot coverage is defined as the amount of impervious surface which includes roof tops, driveways, concrete, etc. 35.) The project applicant shall prepare a stormwater plan in compliance with the Department of Ecology Stormwater Management Manual for Western Washington to control stormwater, erosion and sediment during construction, to address permanent measures to stabilize soil exposed during construction, and in the design and operation of stormwater and drainage control systems. 36.) This approval is for a Site Plan Approval Advanced Determination (SPAAD) only. Any future permits on this site are subject to review for consistency with applicable codes and ordinances and does not preclude review and conditions which may be placed on future permits. 37.) The proposal was reviewed for consistency with the Shoreline Management Master Program Section 3.402.5 and found to be consistent. The proposal is (1) a buildable area for a single family residence, (2) does not exceed 35 feet in height, (3)does not involve over-water construction and is located landward of the OHWM, and (4) meets or exceeds all required setbacks as set forth in said SMMP. 38.) Duration of Approval -Several of the included findings shall become conditions upon the submittal of a building and septic permit. The duration of approval of the Site Plan shall be effective for five (5) years from the date of original approval by the Administrator. If a building permit has not been issued within the five (5) year period, the Site Plan Approval Advance Determination (SPAAD) cannot be revived or extended except by new application that must meet all the existing criteria and conditions listed in this Section. Knowledge of the expiration date shall be the responsibility of the applicant. The county will not provide notification prior to expiration. Limitations of Approval -Approval of the site plan shall not guarantee the performance of specific site features or improvements (e.g. wells, septic systems, stormwater drainage facilities, etc.) and shall not be immune from changes in state or federal law which are enacted or have an effective date after the date of the Site Plan Approval Advance Determination (SPAAD) and which may affect the performance and implementation of the site plan and associated use or activity. Any subsequent land division or boundary line adjustment of a parcel or lot which has received site plan approval advance determination under this Section 8.7 shall void such site plan approval and require a new site plan approval advance determination application. Approval of a site plan under this section does not constitute authority to comence any development or building activity until such time as final authorizing permits are issued (e.g., septic, wells, stormwater management, or building permit, etc.). Additionally, 2 soil test pits were mistakenly dug just over the property line to the east. Those 2 pits were evaluated without entering them. Attached is a detailed soil log which describes the soil observed, and a soil test pit location sketch. The sketch was drawn over an enlargement of a compilation of two surveys that were performed in 1985 and 1996. It appears that the soil exposed has sufficient texture, structure, & depth to restrictive layer to support a drainfield and reserve area for at least a 5 bedroom residence. This number of bedrooms may be distributed between a 3 bedroom main residence and up to a 2 bedroom accessory dwelling unit. The type of septic system would have to be a pressure distribution drainfield due to the coarse sand (type 2A soil texture) present in test pits 2 and 5. Installation costs can vary greatly between contractors, and season. Site difficulties will add to the base cost of the sewage disposal system described above. Site,difficuities may include: i) remoteness to supplies, ii) access to construction areas, iii)confined space if working between trees, iv)clearing of the site, v)steepness of ground slope. Installation costs are best determined by a licensed installer that has seen the site, and knows the specification for the disposal system. There are about 34 licensed installers in Jefferson County that can install this type of septic system. I have attached the list of installers. The purpose of the site visit was to assess the slope and shoreline and determine an appropriate minimum setback distance for the construction of a home on the site as well as other development recommendations. Based on my assessment of the geology and geologic processes at the subject property a home sited on the property should be set back at least 100 feet from the top of the steep bluff slope. I have been to the shoreline and investigated stigated the steep shoreline slope below the subject property on numerous occasions over the past several years including as recently as January 2011. The conclusions and recommendations made in the GeologyHazard Assessment report dated January 27, 2006 have not changed based on my recent visit to the subject property shoreline bluff and shoreline area. On January 12, 2006, I evaluated 7 soil test pits on the above referenced parcel in accordance with ASTM D 5921, and WAC chapter 246-272, On-site Sewage Systems. Additionally, 2 soil test pits were mistakenly dug just over the property line to the east. Those 2 pits were evaluated without entering them. Attached is a detailed soil log which describes the soil observed, and a soil test pit location sketch. The sketch was drawn over an enlargement of a , J 7 compilation of two surveys that were performed in 1985 and 1996. It appears that the soil exposed has sufficient texture, structure, & depth to restrictive layer to support a drainfiel and reserve area for at least a 5 bedroom residence. This number of bedrooms may be distributed between a 3 of j bedroom main residence and up to a 2 bedroom accessory dwelling unit The type of septic system would have to be a pressure distribution drainfield due to the coarse sand (type 2A soil texture) present in test pits 2 and 5. ! Installation costs can vary greatly between contractors, and season. Site difficulties will add to the base cost of the sewage disposal system described above. Site/difficulties may include i) remoteness to supplies, ii) access to construction areas, iii)confined space if working between trees, iv)dealing of the site, v) steepness of ground slope. Installation costs are best determined by a licensed installer that has seen the site, and knows the specification for the disposal system.. There are about 34 licensed installers in Jefferson County that can install this type of septic system. I have attached the list of installers. On the same date, I visited the site to review the soils, vegetation, surface water hydrology, and land within 100' of the proposed drainfield and reserve area as depicted on the site plan/ soil test pit location sketch dated 1/26/2006. From the web site, for the lot to the east of the subject, I found USR06-17 that was inspected 2/28/2006 by the County. I found a well log for that site for assessor parcel number 001-063-021, drilled for Emmet Wolfe on 5/4/2006. I located this well later in the day, and found it approximately 104' from a flag I had left around a cedar tree along the east property line labeled "100' +/- to proposed well to north". So the well described as "area of proposed neighbor's well" on the 2006 site plan may now be updated to read "area of neighbor's well, USR06-17". On the ground, I located the other two wells shown on the 2006 site plan. I located the open soil test pits. Several had either sloughed in, or had forest litter, branches or trees covering them. I refreshed the flags for the test pits found. I found no recent disturbance of vegetation or altering of surface drainage patterns on the subject site or within 100' of the proposed drainfield and reserve area. In conclusion, I believe that the site plan issued by this office on 1/25/2006 with the above noted updates still adequately portrays the site features. I believe that the proposed drainfield and reserve areas are still adequate for the approvals originally given. 1 I can provide you with a paper copy of these findings on my letterhead, signed and stamped, if you need for your records, Zoe Ann. Additionally, 2 soil test pits were mistakenly dug just over the property line to the east. Those 2 pits were evaluated without entering them. Attached is a detailed soil log which describes the sod observed, and a soil test pit location sketch. The sketch was drawn over an enlargement of a compilation of two surveys that were performed in 1985 and 1996. It appears that the soil exposed has sufficient texture, structure, & depth to restrictive layer to support a drainfield and reserve area for at least a 5 bedroom residence. This number of bedrooms may be distributed between a 3 bedroom main residence and up to a 2 bedroom accessory dwelling unit. The type of septic system would have to be a pressure distribution drainfield due to the coarse sand (type 2A soil texture) present in test pits 2 and 5. Installation costs can vary greatly between contractors, and season. Site difficulties will add to the base cost of the sewage disposal system described above. Site difficulties may include: i) remoteness to supplies, ii) access to construction areas, iii) confined space if working between trees, iv) clearing of the site, v) steepness of ground slope. Installation costs are best determined by a licensed installer that has seen the site, and knows the specification for the disposal system. There are about 34 licensed installers in Jefferson County that can install this type of septic system. I have attached the list of installers. Janet McKinnon and Peter Brown 1900 Alaska Way #416 Seattle, WA 98101 Re: Geology Hazard Assessment Tax Parcel 001063008, Porter Lane Jefferson County, Washington Dear Ms McKinnon and Mr. Brown: I visited Jefferson County Tax Parcel 001063008 on Porter Lane in January 2006 to evaluate the slope stability of the steep shoreline bluff on the northwest side of the subject property. The purpose of the site visit was to assess the slope and shoreline and determine an appropriate minimum setback distance for the construction of a home on the site as well as other development recommendations. Based on my assessment of the geology and geologic processes at the subject property a home sited on the property should be set back at least 100 feet from the top of the steep bluff slope. SCOPE OF SERVICES The scope of our services included the following: 1) Conducted a site visit to visually inspect the subject property including the bluff face slope conditions, shoreline conditions,and relevant conditions in the vicinity of the property. 2) Observed surface soil conditions on the bluff face and on the uplands above the bluff by excavating shallow hand dug test pits and observing test pits excavated for septic drain field evaluation. 3) Prepared this report summarizing our findings, including an evaluation of the feasibility of building a residence on the subject property, an evaluation of the shoreline bluff stability, recommendations for site development, and recommendations for further investigation, if necessary. = 1 V. January 27,2006 Tax Parcel 001063013,Porter Lane MAR - 3 2006 • Geology Assessment t ::, ^ra,NTY GENERAL GEOLOGY Northwestern Washington has been occupied by continental glaciers at least four times during the Pleistocene Epoch(1.6 million to 10,000 years ago). During these glacial and accompanying interglacial periods,the underlying bedrock was deeply eroded. The Surficial Geologic Map of the Port Townsend 30-by 60-Minute Quadrangle, Puget Sound Region, Washington(Pessl, Dethier, Booth and Minard, 1989)indicates the upland portion of the subject property is underlain by glacial till from the Vashon-age ice sheet. The mapping indicates that the shoreline bluff slope on the subject property is underlain by undifferentiated non-glacial and glacial sediments. The Geologic Map of Northeastern Jefferson County(Gayer, 1976) indicates that the top of the shoreline bluff is underlain Vashon ablation till. The shoreline slopes are mapped as consisting of pre-Vashon stratified deposits. In addition, Gayer(1976)provides a profile of the stratigraphy of the bluff to the southeast of the subject property. The stratigraphic profile from the top of the bluff to the shoreline is Vashon till, Kitsap Formation, Possession Till, Whidbey Formation and Double Bluff Formation. Site observations on the subject property,bluff face,and in the vicinity are generally consistent with the above-described mapping. However,the upland portion of the property is underlain by compact sand and gravel stratified sediments not the glacial till indicated by the mapping. The shoreline bluff slope on the subject property is primarily underlain stratified sand and gravel with very minor silt. My site observations are consistent with these units being advance outwash near the upper part of the bluff and interglacial alluvial deposits in a river environment on the rest of the slope. A glacial till unit is present approximately half way down the slope just to the southwest of the subject property,but was not observed on the subject property itself or on the shoreline slope to the northeast of the subject property. Glacial till is present at the base of the slope at the subject property and along portions of the shoreline northeast of the subject property. The till is not present along the toe of the slope southwest of the subject property although it reappears further to the southwest. SPECIFIC SITE OBSERVATIONS The subject property consists of a gently sloping upland area bounded on the northwest by a very steep shoreline bluff that is approximately 145 feet high. The upland area of the property slopes gently towards the top of the steep shoreline bluff. The top edge of the bluff is very abrupt and very steep. The overall bluff slope on the subject property is approximately 45 degrees with steeper areas particularly on the upper part and lower part with some slopes of approximately 35 degrees on the mid sections of the slope. The upland area is underlain by sand and gravel. A grass-covered clearing is located between Porter Road and the top edge of the bluff. The steep shoreline slope is covered with a mix of alders and - Douglas fir with grasses and other brush within the understory. A few areas of bare soil are present on steeper slopes. The beach at the base of the bluff consists of a cobble beach with areas of sand and a few scattered boulders. At the time of my site visit, which coincided with a fairly high tide, waves were reaching the base of the bluff at a few places. It has been my observations that waves reach the toe of the slope along this section of shoreline on a fairly regular basis during periods of higher tides. Wave action on the lower part of the bluff has been causing the bluff to become over steep triggering periodic landslides. Shallow soil landslides are evident all along this section of shoreline. Where the bluff is underlain by more cohesive sediments to the northeast, the bluff is very nearly vertical. The predominance sand and gravel units with little silt and clay and hence lower overall cohesion has led to the shoreline near the subject property sloping less steeply than the vertical shore to the northeast. The geologic units underlying the bluff at the subject property consist of very compact sand and gravel from the top of the bluff to the approximately 10 feet above the shoreline. The lower most 10 feet of the bluff is underlain by glacial till consisting of sandy silt with cobbles and boulders. A till unit may be present along the mid section of the bluff as till was observed on the midsection of the bluff slope to the northeast and southwest; however,the till was not directly observed on the subject property.No seeps or springs were observed anywhere on the bluff slope on the subject property. A rotational failure has taken place in the past on the shoreline bluff southwest of the subject property. Although this slide is not on the subject property, I spent some time evaluating the slide because of its proximity to the subject property. The lower third of the shoreline southwest of the subject property is underlain by a uniform sand unit. Immediately above this sand unit is a layer of glacial till. It appears that the sand unit was oversteepened due to shoreline erosion and subsequently failed in a rotational collapse. This rotational collapse caused the overlying units to collapse as cohesive blocks onto the failed slope below. Hence,there is a fairly distinct bench at the top of the slump. As noted above,the same conditions are not present on the subject property. There are minor seeps of water in a few places on the slope southwest of the subject property,but otherwise no springs or seeps are evident on the slope despite the fairly heavy rainfall that had impacted the area the over the previous month. Heavy rainfall may play a role in slope failures but the main driving force of the rotational slide area appears to be the shoreline erosion. Stratum Group File:1.10.06 3 '� January 27,2006 MAR 1 Tax Parcel 001063013,Porter Lane l 3 2006 Geology Assessment L ASSESSMENT OF GEOLOGIC RISK Observations along the shore and the top of the bluff indicate that the primary cause of slope instability is the undermining of the base of the bluff by wave action. As wave action erodes the base of the bluff the lower slopes fail and the failed material with the exception of boulders is readily washed away by the large waves that periodically hit the shoreline. As the base of the bluff fails and the bluff becomes over steep the slope failures progressively move up the slope until the uppermost part of the slope fails as well and the process repeats itself. This stretch of shoreline bluff is in various stages of this process. Most sections of the shoreline in this area have very little or no landslide debris along the base of the bluff. Overall though the bluff is very steep and erosion at the toe of the bluff should be expected to continue. As the very steep slope weathers shallow slab type failures are likely to occur. Based on my observations along the top of the bluff at the subject property and all along the top of the bluff northeast and southwest of the bluff, it is my opinion that these slab type failures will be on the order of a 5 feet. Erosion rates along the eastern end of the Strait of Juan de Fuca are estimated to be on the order of 6 inches per year. Because of the protection afforded by Protection Island and the height of the bluff(the higher bluff height means a greater volume of soil would need to be eroded), I estimate that erosion rates along this section of coast to be somewhat less—on the order of 4 inches per year. The top of the bluff will not systematically retreat 4 inches per year, but the bluff will progressively get steeper and mid slope failures will take place and eventually another failure will take place at the top of the bluff. As noted above the size of top of bluff failures should be expected to be on the order of 5 feet. The recurrence interval of top of bluff failures that send material to the base of the bluff appears to be on the order of 25 to 30 years based on the age of tree stands along the steep shoreline slopes. This estimate is complicated by a several factors: 1)the bluff height varies, 2) clearing of trees on the slope and at the top of the slope varies, 3)drainage and slope management on the developed properties and undeveloped properties likely has varied, and 4)variability in the underlying geologic units causes some slopes to have more frequent small slides and other slopes to have larger less frequent failures. Stratum Group File:1.10.06 4 1 MAR - 3 2006 January 27,2006 L Tax Parcel 001063013,Porter Lane Geology Assessment k ' CONCLUSION AND RECOMMENDATIONS I recommend that all occupancy structures sited on the property should be set back at least 100 feet from the top of the steep shoreline bluff. The septic tanks and drain field should be set back at least 100 feet from the top of the steep shoreline slope.Decks may be closer as long as they are not structurally attached to the home. The setback of 100 feet would allow for an erosion rate of 1 foot per year. This rate is substantially greater than the estimated rate of 4 inches per year. The setback of 100 feet will also provide protection of the building site in the remote event a sand on the bluff face rotationally fails in a similar manner to the failure observed on the bluff slope southwest of the subject property. I am of the opinion that due to the differences in the soil units on the slope this risk is very small. Although this setback distance is very conservative, it should be kept in mind that stabilizing erosion at the base of the bluff is not practical given the size of the waves, frequency of toe erosion and the need to coordinate shoreline works with multiple property owners. As describe above most of the factors impacting the bluff stability over time are beyond the control of a property owner. However, some actions can be taken to reduce the frequency of slope failures. Based on site observations and my assessment of the geologic risk, I make the following recommendations: • Native vegetation,particularly tress and low native brush on the slope should be disturbed as little as possible.No grading should be performed on the bluff face. If a trail is constructed, the trail layout and support structures should be approved by a qualified engineering geologist before construction. • Waste and other deleterious material should not be placed on or over the slope. Such material smothers vegetation,retains water and acts to destabilize the slope. • Storm water from roof run-off and driveway run-off should be dispersed as much as possible through allowing sheet run off and lateral dispersion spreaders such that storm water is not concentrated anywhere on the property and onto the bluff face.
