JEFFERSON COUNTY DEPARTMENT OF COMMUNITY DEVELOPMENT UNIFIED DEVELOPMENT CODE TYPE I LAND USE PERMIT APPLICANT: GEORGE R HANSBERRY PO BOX 424 QUILCENE WA 98376-0424 DATE ISSUED: January 28, 2013 DATE EXPIRES: January 28, 2014 MLA NUMBER: MLA12-00185 PROJECT PLANNER: Colleen Zmolek PROJECT DESCRIPTION: LOT CERTIFICATION -to create two (2) parcels, JCC 18.35.040(4) PROJECT LOCATION: Parcel number 701 182 015, Section 18, Township 27N, Range 1W, WM, located 51 McInnis Rd, Quilcene, WA 98376 CONDITIONS: 1.) Based on the findings, parcel number 701182015 can be considered two (2) separate parcel as described in the legal descriptions submitted with the application. 2.) To process this segregation, you will need to submit a wrttten request to the Jefferson County Assessor's Office to have additional parcel numbers assigned. A copy of this permit will be forwarded to the Assessor's Office. Please contact the Jefferson County Assessor's Office (360-385-9105) with any questions regarding this process. 3.) Contact the Jefferson county Environmental Health Department at (360) 379-9444 to determine potential limitations with regard to wells and on-site sewage requirements. 4.) The survey and legal descriptions shall be recorded with Jefferson County Auditor's office. 5.) This determination does not guarantee an ability to develop the parcels. All development shall comply with the on-site sewage code, the building codes and local development regulations. FINDINGS: 1.) The Administrator finds that this application complies with applicable provisions of the Unified Development Code, all other applicable ordinances and regulations, and is consistent with the Jefferson County Comprehensive Plan and Land Use map. 2.) The proposal is found to be an exemption under Jefferson County Code (JCC) Section 18.35.040(4): (4) Divisions of land relating to the acquisition of a fee simple interest in land by public agencies, including, but not limited to, divisions made for road or public right-of-way conveyance or widening purposes. This exemption shall not be construed to include acquisitions of easements. 3.) The parcel has been designated as RR 1:5 Rural Residential (1 unit/5 acres) under the Jefferson County Comprehensive Land use Map effective August 28, 1998 4.) As the Parcels are found exempt from RCW 58.17 and Jefferson County Code 18.35, a title report is not required. It is the property owner's responsibility to identify and rectify any security interest conveyances, encumbrances, easements or restrictions affecting the subject properties involved in this county reviewed exemption. 5.) RCW 58.17 requires regulation of the division of land and was passed in 1969. 6.) The application was reviewed by the Jefferson County Department of Community Development staff on October 10, 2012 for the potential presence of Environmentally Sensitive Areas (ESAs) under the provisions of the Unified Development Code (UDC). After an initial Geographic Information Systems mapping review the following ESAs were confirmed to be present on the subject property: wetlands, FEMA flood hazardous area, "F" fish bearing stream and "N" non fish bearing stream, seismic hazardous area, susceptible aquifer recharge area. 7.) On September 12, 2012, Pat Perryman in the Assessor's Office GIS department commented as follows: I have no problem pertaining to this proposed Action. 8.) On October 5, 2012, Sherrie Sholds in the Assessor's Office commented as follows: Once the names are removed off the survey I have no problem with this proposed action. Full comments can be found in MLA12-00185. 9.) NOTICE: This permit does not excuse the proponent from complying with other local, state, and federal ordinances, regulations, or statutes applicable to the proposed development, but consistent with RCW 90.58. Development pursuant to this permit shall be undertaken subject to the applicable policies and performance standards of the Jefferson County Shoreline Management Master Program and the Jefferson County Unified Development Code. If during excavation or development of the site an area of potential archaeological significance is uncovered, all activity in the immediate area shall be halted, and the Administrator shall be notified at once. The Federal Endangered Species Act rules to protect threatened Chinook and Summer-run Chum salmon became effective on January 8, 2001. Bull trout have been listed as threatened since early 2000. Under the ESA, any person may bring lawsuit against any individual or agency that"takes" listed species(defined as causing harm, harassing, or damaging habitat for the listed species). In addition, the National Marine Fisheries Service can levy penalties. All areas in Jefferson County are included as"critical habitat"for a listed species. Development of property along any marine shoreline, freshwater shoreline, or floodplains could harm habitat if protective measures are not taken. To minimize the potential to damage habitat, all property owners developing adjacent to marine shoreline, freshwater shoreline, or floodplains are advised to do the following: -All development activities should avoid unstable slopes, wetlands, and forested areas near surface waters - Remove minimal vegetation for site development, especially large trees -Allow trees that have fallen into surface waters to remain there - Infiltrate stormwater from buildings and driveways onsite through drywells rather than discharging directly into surface waters or roadside ditches The Federal Bald and Golden Eagle Protection Act requires landowners within 660 feet(1/8th of a mile)of an eagle nest to consult with the US Fish and Wildlife Service. This Eagle Act prohibits anyone from"taking" bald eagles. This federal law defines the term "take" and describes the possible legal consequences when a"take" occurs. Among other actions, "take" includes a disturbance of bald eagles or their habitat. Under federal law a permit may still be required for activities that impact bald eagles or their habitat. Contact the US Fish and Wildlife Service (http://www.fws.gov/pacific/eagle/)to learn more about how this law affects your project. Any individual, group, or agency can bring suit for a listed species"taking", even if you are in compliance with Jefferson County development codes. The risk of a lawsuit against you can be reduced by consulting with a professional fisheries habitat biologist, and following the recommendations for site development provided by the biologist. For more information, contact the National Marine Fisheries Service in Seattle, or the U.S. Fish and Wildlife Service. 10.) Jefferson County determined that this proposal is categorically exempt from review under the State Environmental Policy Act(SEPA) pursuant to WAC 197-11-800(6)(a). APPEALS: Pursuant to RCW 36.70C,the applicant or any aggrieved party may appeal this final decision to Jefferson County Superior Court within twenty-one(21)calendar days of the date of issuance of this land use decision. The current year and all delinquent property taxes must be paid to meet the requirements in RCW 84.56. 345. I am sorry if I did not make this clear in our earlier conversations. RCW 84.56.345 Alteration of property lines - Payment of taxes and assessments. Every person who offers a document to the auditor of the proper county for recording that results in any division, alteration, or adjustment of real property boundary lines, except as provided for in RCW 58.04.007(1) and84.40.042 (1) (c), shall present a certificate of payment from the proper officer who is in charge of the collection of taxes and assessments for the affected property or properties. All taxes and assessments, both current and delinquent must be paid. For purposes of chapter 502, Laws of 2005, liability shall begin on January 1st. Taxes not yet levied and certified shall be collected as an advance tax under RCW 58.08.040. Mr. Hansberry will have to pay the taxes for 2013. I take it DCD will approve the parcel division and that the survey needs to have George's notarized signature and be recorded as part of that process. The JLT sequence is to get approval of the parcel division, then get an appraisal (which is almost done), and then get a purchase and sale agreement (PSA) between the landowner and JLT. If we come to agreement, then we can go ahead and complete the transaction. While I think the likelihood of agreement is high, we won't be sure until we have the appraisal and successfully negotiate a PSA. It seems like it could be awkward if the survey is recorded (and the parcel division completed), and then deal falls through, especially since I gather DCD approves the division based on 7LT ownership. What do you suggest as a sequence? The application was reviewed by the Jefferson County Department of Community Development staff on February 29, 2012 for the potential presence of Environmentally Sensitive Areas (ESAs) under the provisions of the Unified Development Code (UDC). After an initial Geographic Information Systems mapping review and an investigative site inspection, the following ESAs were confirmed to be present on the subject property: Type"F" Stream; Wetlands; Seismic Zone; Flood Zone; Susceptible Aquifer Recharge Area; Coastal SIPZ. 2.) Aquifer Recharge Areas in Jefferson County are characterized by porous geological formations that allow percolation of the surface water into the soils and the underlying zone of saturation. Aquifers are geologic formations that contain sufficient saturated permeable material to yield significant quantities of water to wells and springs. Aquifers serve as the source of drinking water within most of the rural portions of Jefferson County. 3.) Susceptible Aquifer Recharge Areas are those with geologic and hydrologic conditions that promote rapid infiltration of recharge waters to groundwater aquifers. 4.) Geologically Hazardous Areas in Jefferson County are characterized by slope, soil type, geologic material, and groundwater that may combine to create problems with slope stability, erosion, and water quality during and after construction or during natural events such as earthquakes or severe rainstorms. 5.) A Type "F" Stream (Fish and Wildlife Habitat Conservation Area) has been identified on the subject property. The stream will require a buffer of 150-feet. The buffer shall be measured horizontally from the Ordinary High Water Mark (OHWM). Fish and Wildlife Habitat Areas shall also have Buffers and Building Setbacks established. This project is exempt from buffer requirements under JCC 18.22.070 6.) Wetland & Stream Buffers are areas that shall be maintained in their natural condition, however, minor pruning or alteration of vegetation may be permitted as long as the function and character of the buffer are not diminished. 7.) Marine shorelines and islands are susceptible to a condition that is known as seawater intrusion. Seawater intrusion is a condition in which the saltwater/freshwater interface in an aquifer moves inland so that wells drilled on upland areas cannot obtain freshwater suitable for public consumption without significant additional treatment and cost. Maintaining a stable balance in the saltwater/freshwater interface is primarily a function of the rate of aquifer recharge (primarily through rainfall) and the rate of groundwater withdrawals (primarily through wells). The Washington Department of Ecology is the agency with statutory authority to regulate groundwater withdrawal for individual wells in Jefferson County. New development, redevelopment, and land use activities on islands and in close proximity to marine shorelines in particular should be developed in such a manner to maximize aquifer recharge and maintain the saltwater/freshwater balance to the maximum extent possible by infiltrating stormwater runoff so that it recharges the aquifer. 8.) The parcel is located within a coastal SIPZ (seawater intrusion protection zone) according to the County GIS map. There are voluntary and mandatory measures identified in the Jefferson County Seawater Intrusion Policy(Resolution 44-22, effective September 23, 2002) that apply to well drilling proposals and building permit applications on existing lots of record. A Coastal SIPZ is defined as: all islands and area within one-quarter mile of marine shoreline, but no history of chloride concentration above 100 mg/L in groundwater sources within 1000 feet. 9.) This project is exempt from Critical Area protection standards under JCC 18.22.070(3) (4) (10) (11) &(21) 10.) The project shall adhere to the Best Management Practices (BMPs) to control stormwater, erosion and sediment during construction. BMPs shall address permanent measures to stabilize soil exposed during construction, and in the design and operation of stormwater and drainage control systems. 11.) The applicant is proposing to create or add 36 square feet of impervious surface and 60,147 square feet of land disturbing activities. JCC 18.30.060 and 18.30.070 require the project applicant submit a stormwater plan meeting Minimum Requirements#1 through #5 of the Department of Ecology Stormwater Management Manual for Western Washington.
