The Lot Certification statement of intent legal descriptions shall be recorded with Jefferson County Auditor's office. 3.) CONSISTENT WITH RCW 84.56.345, CURRENT YEAR AND ALL DELINQUENT PROPERTY TAXES INCLUDING COMPENSATING TAX FROM OPEN SPACE PROGRAM SHALL BE PAID IN FULL PRIOR TO RECORDING THE STATEMENT OF INTENT. 4.) This parcel is within a no shooting area per JCC 8.50. FINDINGS: 1.) The Administrator finds that this application complies with applicable provisions of the Unified Development Code, all other applicable ordinances and regulations, and is consistent with the Jefferson County Comprehensive Plan and Land Use map. 2.) As the Parcels are found exempt from RCW 58.17 and Jefferson County Code 18.35, a title report is not required. It is the property owner's responsibility to identify and rectify any security interest conveyances, encumbrances, easements or restrictions affecting the subject properties involved in this county reviewed exemption. 3.) This determination does not guarantee an ability to develop the parcels. All development shall comply with the on-site sewage code, the building codes and local development regulations in effect at the time of application. 4.) Based on the findings, parcel number 502104004 can be considered two (2) separate parcel as described in the legal descriptions submitted with the application. This Parcel is segregated by Highway 101. 5.) The parcel has been designated as RR 1:5 Rural Residential under the Jefferson County Comprehensive Land use Map effective August 28, 1998. 6.) On July 17, 2015, Sherrie Shold in the Assessor's Office commented as follows: I have reviewed this division and have no objections. 7.) On 3-23-15 Washington State Department of Transportation office commented as follows: The Olympic Highway was authorized by LegislativeAct in 1917. This section of US 101 in its present location was deeded to the State of Washington in 1931 8.) RCW 58.17 requires regulation of the division of land and was passed in 1969. 9.) The proposal is found to be an exemption under Jefferson County Code (JCC) Section 18.35.040(4): (4) Divisions of land relating to the acquisition of a fee simple interest in land by public agencies, including, but not limited to, divisions made for road or public right-of-way conveyance or widening purposes. This exemption shall not be construed to include acquisitions of easements. 10.) Jefferson County determined that this proposal is categorically exempt from review under the State Environmental Policy Act(SEPA) pursuant to WAC 197-11-800(6)(a). 11.) The application was reviewed by the Jefferson County Department of Community Development staff on 3-23-15 for the potential presence of Environmentally Sensitive Areas (ESAs) under the provisions of the Unified Development Code (UDC). After an initial Geographic Information Systems mapping review the following ESAs were confirmed to be present on the subject property: shoreline slope stability; intermendiate, fish and wildlife conservation area, welands; shoreline, landside hazardous area; slight, Fema flood hazardous area; shoreline, susceptible aquifer recharge area. APPEALS: Pursuant to RCW 36.70C, the applicant or any aggrieved party may appeal this final decision to Jefferson County Superior Court within twenty-one(21)calendar days of the date of issuance of this land use decision. The judgment of court cause 6141 dated June 1954, all of the East 100 feet of Government Lot 3 adjacent to Government Lot 2 lying southerly of the highway created the parcel identified as Tax 5. Both parcels are owned by Kottsick but as separate parcels. Since we cannot ignore the overlap of the parcels, we will need to have the owners address the overlap in a manner that meets both the approval of all parties and all land description legalities. Until this issue is addressed, we are unable to continue any review. • Please revise survey and statement of intent. 2015 taxes must be paid, JCC 18.25.070(6): Pursuant to RCW 86.56.345, current year and any delinquent taxes shall be paid before approval of any boundary line adjustment. • Pay taxes in at the treasurers office. Jefferson County Code provides that the Department of Community Development shall not be responsible for notifying the applicant of an impending expiration, thus any further notification would not be forthcoming. The judgment of court cause 6141 dated June 1954, all of the East 100 feet of Government Lot 3 adjacent to Government Lot 2 lying southerly of the highway created the parcel identified as Tax 5. Both parcels are owned by Kottsick but as separate parcels. Since we cannot ignore the overlap of the parcels,we will need to have the owners address the overlap in a manner that meets both the approval of all parties and all land description legalities. Until this issue is addressed,we are unable to continue any review.
