JEFFERSON COUNTY SHORT SUBDIVISION SUMMARY APPROVAL GERALDINI SHORT PLAT Short Subdivision SUB99-0001 AMEDEO GERALDINI Parcel #001203012 Section , Township North, Range W West , WM. DATE OF APPROVAL: May 25, 1999 DATE OF EXPIRATION: November 25, 1999 CONDITIONS OF APPROVAL: Preliminary approval by Jefferson County has been granted subject to the requirements of the Jefferson County Subdivision Ordinance and the following conditions : Department of Public Works: 1) A right-of-way 30 feet f om the centerline of South Discovery Road shall be conveyed to Jefferson County by either statutory warranty deed or dedication on the plat, ' f such right-of-way has nOt been previously conveyed. 2) The following notice shall be placed on the final mylar under "Notice to Potential Purchasers" : A road approach permit for Lot 2 will be required at time of building permit application. The approach shall be constructed to the standards as set forth in the permit . Any additional road approaches from South Discovery Road to these lots will not be approved. If road approaches have been approved, said approach (s) shall be graphically portrayed on the face of the final plat . 3) South Discovery Road shall be shown on the face of the final mylar. 4) In accordance with Chapter 486, Washington Laws of 1993 [amending RCW 58 . 17 .2801 , addresses shall be assigned to all lots . Addresses may be shown on the final plat or may be applied for at the time of buidling permit application. Address plates for the lots shall be located in accordance with the provisions of the Jefferson County 911 Emergency Locator System Ordinance provisions . 5) In accordance with the Jefferson County Department Of Public Works Fee Schedule, the applicant shall pay all costs of work lincidental to review of the subdivision before final approval is granted. The Department ' s development review fee i- currently $49 per hour. 6) The applicant shall subm`t a blue line copy of the site plan and lot closure information prep- red by a licensed surveyor to the Department for review. The applicant s all make any corrections or additions prior to final approval . 7) Upon all conditions bein• met, the applicant shall submit a final mylar of the plat to the Depar.ment THREE DAYS in advance of approval by the Director of Public Works . Health Department: 1) The location of soil test pits shall be graphically portrayed on the final plat . LOG ITEM I Fire District None PUD Comments None Development Review Division: 1) Based on requirements of Subsection 5 . 211, Final Short Plat and Appendix B, Final Short Plat Checklist, the final plat shall be prepared in accordance with the final short plat checklist . A copy is attached. 2) All easements of record shall be graphically portrayed on the face of the final mylar with the Auditor' s File Number (AFN) of the easement (s) also referenced on the face of the plat . 3) An accurate vicinity map shall be shown on the face of the final plat . 4) Based on the requirements of Subsection 5 . 305 , Open Space Land and Appendix F Open Space Standards, prior to final plat approval the proponent shall dedicate 10 percent open space lands for the life of the project by recording of a separate instrument or by declaration of dedication graphically portrayed on the final plat . 5) Based on the requirements of Subsection 5 . 305 (b) , Open Space Land, the applicant may elect to pay a fee-in-lieu of dedication of land for open space . Fees-in-lieu shall be equal to the average fair market value of the land in the proposed short subdivision which the applicant would have been required to dedicate . This fee shall be based on either an appraisal performed by the Jefferson County Assessor' s Office or an independent professional appraiser. If the applicar)t does not elect to pay a fee-in-lieu of open space, then an open space tract shall be dedicated as originally proposed. 6) An agreement for the operation and maintenance of the open space shall be graphically portryaed on the face of the final plat or by recording of a separate instrument and referencing said instrument on the face of the final plat . The following notice shall be placed on the final mylar under "Notice to Potential Purchasers" : The operation and maintenance of the open space shall be the responsibility of the lot owners with this 1 subdivision. NOTICE TO POTENTIAL PURCHASERS: 1) The lots, parcels or tracts contained within this subdivision were approved based on design standards and regulatory requirements in effect at the time of final approval . Sewage disposal systems have not been approved for the lots, parcels or tracts contained within the subdivision. Onsite sewage disposal systems shall meet design standards and regulatory requirements in effect at the time of application for a sewage disposal permit . Purchaser should contact the Jefferson County Health Department for p ocedures concerning permit applications . Any removal of or major dist rbances of soil within the proposed drainfield areas may create site co ditons that are unacceptable for the installation of sewage d' sposal systems . 2) If potable water is supplied by means of individual wells, when drilled, wells shall not encumber adjacent properties withou prior written consent of the adjacent •roperty owner. 3) Wells shall not be locat:d closer than 100 feet to 4ny sewage disposal system or any area appro ed for future sewage disposal system, including reserve drainfield areas . 4) Based on the requirement- of Subsection 5 . 406 (a) , Water Supply, in any instance where potable w-ter supply is not provided to a lot within a short subdivision, the applicant shall specifically identify each such lot by including the fol owing NOTICE TO POTENTIAL PURCHASERS on the final plat : WARNING TO PURCHASERS THE LOTS, PARCELS, OR TRACTS CONTAINED WITHIN THIS SHIRT SUBDIVISION HAVE NOT BEEN PROVIDED WITH A POTABLE WATER SUPPLY. 0 BUILDING PERMIT WILL BE ISSUED BY JEFFERSON COUNTY WITHOUT FIRST SA ISFYING THE POTABLE WATER REQUIREMENTS ESTABLISHED BY THE JEFF RSON COUNTY HEALTH DEPARTMENT. 5) Approval of this subdivi ion does not constitute approval of building or sewage disposal permits n each lot . Permit approvals will be subject to building lot plans, type of use, contours, and soils on individual lots . Permits will be reviewed in accordance with site conditions and regulations existing on the date the permit is applied for. 6) Lots created herein shall not be further divided in any manner within a period of five (5) years without the filing of a final long plat . 7) Any further subdivision Of the lots within this plat will be subject to the densities permitted in the Jefferson County Ordinances and Codes in effect at time of such application. These lots may or may not be further subdivided in the future. NOTICE: The sale of lots prior to final short subdivision appro al is unlawful . NOTICE: When the short plat consists ,of fewer than four (4) lot , nothing in the Subdivision Ordinance, Subsedtion 5 . 212 , shall prevent the owner who filed the short plat from filing ah alteration within the five (5) year period to create up to a total of four 1 (4) lots within the original short plat boundaries . APPEALS : Any administrative decision made by the Development Rev' ew Division regarding a preliminary shore subdivision application m y be appealed to the Hearing Examiner by the applicant, a public agency, or ny interested person, not later than fourteen (14) days following the decisio of the Planning Department . The notice of a.peal shall be on a form pr vided by the Planning Department and shall be fill:d with the Planning Depart ent . The Planning Department should be contact:d regarding information to be included as part of the written notice of app:al . EXPIRATION: Summary approval will expire on November 25, 1999 unless an extension is requested at least thirty da s before the date of expiration. A one time extension may be •ranted for a period of six (6) months . If summary approval expires, reapplication may be made . SUBMISSION: It is the responsibility of he applicant or authorized representative to ensure the final short plat is submitted in accordance ith the conditions of summary approval . V.Decision Based on the Findings,Criteria for ' -view,and Conclusions,it is my administrative decision to APPROVE subject to conditions,the short subdi ision application for a 2 lot residential short plat(SUB99-0001)for Adelina&Amedeo Geraldini. VI.Appeal Any person may appeal an Adminis+ .tive(Type A)decision. The Hearing Examiner shall decide all appeals of administrative(Type A)decisions. 1. An appeal of an administrative decision shall be filed in writing with the Clerk of the Board of County Commissioners fourteen(14)calendar days after the date of the decision or no later than 4:30 p.m.on May 21, 1999. 2. Appeals shall identify the decision appealed and the date of the decision, and shall contain a summary of the grounds for the appeal. 3. The appropriate fee as established by County resolution must be paid upon filing of the notice of the appeal. No appeal will be processed without receipt of the appropriate fee before expiration of the period for filing the appeal. The current appeal fee is$225.50. 4. Property Location: The proposal site is located at 1930 South Discovery Road,Port Townsend. Legal Description: Tax 15 within Section 20,Township 30,Range 1 West, WM. (Parcel #001203012). Property Description: The property is rectangular in shape with the eastern boundary abutting South Discovery Road. The parcel is relatively flat with a gradual slope to the west. Access for both parcels are from South Discovery Road. There is currently an existing residence on the southern portion of the parcel. Community Plan: The Jefferson County Comprehensive Plan Land Use Map designates the site as RR5. Surrounding Area: The majority of the surrounding parcels are five acres and larger. There is an existing subdivision east of South Discovery Road where the lots consist of one acre to 2.17 acres in size. Access to surrounding parcels is via South Discovery Road and private easements. Applicable Goals and Policies: Jefferson County Comprehensive Plan Chapter 3, "Rural Residential Land Use Policies",pages 3-67 to 3-68. Chapter 3, "Transportation Policies",page 3-87. Chapter 3, "Rural Character Policies",3-88 to 3-90. Applicable Ordinances: Ordinance No. 04-0526-92,Jefferson County Subdivision Ordinance. Staff Findings and Conclusions: 1. The proposal is to subdivid=an 11.90-acre parcel into two(2)residential lots. 2. The proposed short subdiv'.ion is subject to the policies of the Jefferson County Comprehensive Plan. The applicable polici:s are discussed below. 3. The proposed short subdi ision is subject to the requirements of Section 5 of the County Subdivision Ordinance. I ere are several ordinance requirements that apply to the proposed subdivision: Subdivisio Ordinance Design Criteria 5.301; Easement Criteria, 5.302; Transit/School Bus Stops riteria, 5.303; Sidewalk Criteria, 5.304; Open Space Land Criteria, 5.305; Road Design Criteri , 5.308; Subdivision Ordinance Road Improvement Criteria 5.401(1), (3), and(4); Sign Criteria, 5.404; Drainage Criteria, 5.405; Water Supply Criteria 5.406(1); Sewage Disposal Criteria 5.407;Fir Protection Criteria, 5.408 and Survey Criteria Requirement 5.410. The applicable criteria and requ' ements are discussed below. The Jefferson County Comprehensi e Plan Rural Residential Land Use Policy LNP 3.3 states: "Rural residential densities hown on the Land Use Map shall be designated by three (3)residential land use densities: one dw ling unit per five(5)acres,one dwelling unit permit ten(10) acres, and one dwelling unit per twen (20)acres in size and subject to the following criteria: LNP 3.3.1 A residenti 1 land use designation of one dwelling unit per 5 acres(RR 1:5)shall be assigned to those areas throughout the County with: a. an -stablished pattern of the same or similar sized parcels (i.e., 5 acres) or s :Her sized existing lots of record; b. pa els of similar size (i.e., 5 acres) or pre-existing smaller parcels along the coastal areas; c. p. els immediately adjacent to the boundaries of the Rural Village C- ters;and d. as overlay to pre-existing developed"suburban:platted subdivisions. The proposal is consistent with this policy. The parcel is 11.90 acres and is consistent with a. and d. above. The parcel is not along a coastal are . The parcel is not adjacent to an Urban Growth Area. Port Townsend is currently the only UGA in Jeffer•on County. The parcel was identified as "suburban" (one unit per one acre)under the 1979 Comprehensiv: Plan. The Jefferson County Comprehensi e Plan Rural Residential Land Use Policy LNP 14.1 states: "Ensure that land use decisions are based on land use ordinances which are in compliance with the Critical Areas Ordinance anall applicable state and federal environmental laws." The proposal was subject to critica area review and found that the parcel is located within a susceptible aquifer recharge area. Section 7.40 of the Critical Areas Ordinance states that critical area review is only required for subdivisions that would reate parcels of less than one gross acre in size. Both proposed parcels are over 5 acres in size. 2 The Jefferson County Comprehensive Plan Transportation Policy LNP 17.1 state : "Encourage development and land use proposals that utilize existing transportation systems and provide non-motorized transportation opportunities." The proposal will utilize the existing county road (South Discovery Road). The proposal is located just north of the Chevy Chase golf course. The County is currently working on a trail system known as the Larry Scott Trail. The Subdivision Design Requirements of Subsection 5.301(1)state: "Residential densities shall conform with the Jefferson County Comprehensive Plan and/or applicable community development plan,the Jefferson County Development Code,No. 3-89, and conform to the lot size standards and requirements of the Health Department and the Washington State Department of Jefferson County Health Department has stated that both septic systems have been approved and permitted and have identified reserve areas The proposal is consistent with the residential density standards of the Comprehensive Plan. Proposed Lot 1 is served by an existing permitted oh-site sewage system. Proposed Lot 2 has sifficient area with suitable soils for the use of an on-site sewage system. The Subdivision Design Requirements of Subsection 5.301(2)state: "The design, shape, size, and orientation of lots shall be appropriate to the use for which the lots are intended and the character of the area in which they are located. If any portion of a lot is less than one hundred (100) feet in width, the average length of said lot shall not exceed three times its average width. Lot areas in excess of minimum standards may be required for reason of sanitation, steep slopes, slide hazards, poor drainage, flood hazards or other unique conditions or features which may warrant protection of the public interest." The proposed lots are consistent with the design, shape, size, and orientation requirements. Neither of the proposed lots are less than 100 feet in width. The proposal is consistent with the above criteria. The Subdivision Design Requirements of Subsection 5.302(1)state: "Easements for the purpose of ingress and egress, and/or utility installation and maintenance, shall be established by recording a separate instrument, or by declaration of easement dedication, and shall be graphically portrayed on the fmal short plat." Proposed Lot 1 has an existing access off of South Discover Road. No ease#nents are proposed. The proposal is consistent with the above criteria. The Subdivision Design Requiremen s of Subsection 5.303 state: "Applications for short sub ivisions shall be reviewed to determine whether transit or school bus stops are necessary to prom e public access to safe and convenient travel." No response was received from Jeffe son Transit or School District 50. The Subdivision Design Requiremen of Subsection 5.304 state: "Applications for short subdivisions shall be reviewed in order that provisions necessary to ensure safe walking conditions for pedestrians,and students who only walk to and from school,receive 3 I adequate consideration. Construction of sidewalks or similar planning f attires may be required for final short subdivision approval." No sidewalks are proposed due to the distance the proposal is in relation to the Po Townsend School. The Subdivision Design Requiremerts of Subsection 5.305(1)state: "Minimum area for open space shall be provided as ten (10) percent of the total gross area of the short subdivision,consistent with the Open Space Standards in Appendix,G of this ordinance. Open space dedications shall be established by recording a separate instrument, or by declaration of dedication, and shall be graphically portrayed on the final short plat. All open space dedications shall be in perpetuity." a. Exceptions to this requirement may be granted by the Board if the short subdivision is: (a) adjacent to, or near, existing open space land sufficient to accommodate the increased public need; or (b) when previous dedications have been made that adequately serve the public need. 1 b. Fees-in-lieu of dedication of land for open space may be permitted by the Board PROVIDED: (a)the amount of the fee shall be equal to the average fair market value of the land in the short subdivision which the applicant would have been required to dedicate; and (b)the use of fees shall only be for the purpose of acquisition or development of open space land in sufficient proximity to the short subdivision which contributes the fee to reasonably benefit the future h-esidents of the short subdivision. All fees-in-lieu shall meet the requirements of R82.02.020. The applicant is required to provi a ten percent or 1.19 acres open space. The open space shall be graphically portrayed on the face of the final mylar. Conditioned appropriately, the proposal is consistent with the above criteria. The Subdivision Design Requirements of Subsection 5.308(1)state: "Roads shall be designed with appropriate consideration for existing and projected roads, anticipated traffic patterns, topographic and drainage conditions,public convenience and safety, and the proposed uses of the land served." The site is accessed from South Discovery Road. The Department of Public Works does not require any road improvements. The proposal is consistent with the above criteria. The Subdivision Design Requirements of Subsection 5.308(2) state: "Short subdivision applicants shall incorporate standard sixty (60) foot wide rights-of-way where public roads are to be dedicated. Private road easements shall also be sixty(60) feet wide, and shall be established by recording a separate instrument, or by declaration of easement dedication, and shall he graphically portrayed on the final short plat. However, easement width for private roads which: (a) dead-end due to topographic features such as a shoreline or river, or (b) do not exceed five hundred (500) feet in length, may be reduced by the Board pursuant to recommendation by the Director of Public Works. In instances where the standard sixty (60) to wide easement is not required,provisions for par llel easements for utility installation and maintenance shall be required if deemed necessary by th Director of Public Works. All reduced width easements shall be designed to include provisions for emergency vehicle turnarounds." The site is accessed from South Discovery Road. Lot 1 has an existing access. Lot 2 will have a separate access from South Discovery Road. A right-of-way 30 feet from the centerline of South Discovery Road 4 shall be conveyed to Jefferson County by either statutory warranty deed or de•ication on the plat, if such right-of-way has not been previously conveyed. The proposal is consistent with e above criteria. The Subdivision Design Requirements of Subsection 5.308(3) state: "All dead-end roads shall b designed to include provisions for emergency vehicle turnarounds in accordance with standards e tablished by the Director of Public Works. Both lots access off of South Di overy Road. No road improvements are required. Therefore, no turnarounds are required. The prop sal is consistent with the above criteria. The Subdivision Design Requirements of Subsection 5.308(4)state: "Where necessary to join with exiting roads, or to provide for future area-wide circulation,roads or road rights-of-way may be required to extend to the outside boundaries of short subdivisions." South Discovery Road extends north and south beyond the proposed subdivision. The proposal is consistent with the above criteria. The Subdivision Design Requirements of Subsection 5.308(7)state: "Access to short subdivisions adjacent to arterial or collector roads should be restricted. All lots shall be served by an internal road system unless the lots front on a local access road." South Discovery Road is a minor collector. The parcel has an existing access that serves the existing residence on the proposed southerly,lot. An additional access would serve Lot 2 and located approximately 400 feet northerly of the existing access. There is adequate separation to avoid traffic hazards. The plat shall include a notice that additional road approaches from South Discovery Road will not be approved. The proposal is consistent with the above criteria. The Subdivision Road Improvement Criterion of Subsection 5.401(1) state: "Roads providing access to and/or within a short subdivision shall be constructed according to Department of Public Works design standards, based upon projected use and traffic volume. Agreements for the continued maintenance of all private roads shall be established and referenced on the final short plat. The Department of Public Works does not require any road improvements or construction. The proposal is consistent with the above criteria. The Subdivision Road Improvement Criterion of Subsection 5.401(3)state: "Legal access from the nearest public road to the entire tract being divided shall be secured and graphically portrayed on the final short plat." The Subdivision Road Improvement Criterion of Subsection 5.401(4)state: "Road approach permits for private roads that access onto a Countyroad or State highway shall be secured prior to final short plat approval. When adjacent to a County road or State highway, the approach shall be graphically portrayed on the final short plat." 5 A notice shall be placed on the pla stating that " At time of building permit application a road approach permit is required and shall be cons a ucted to the standards as set forth in the per iit". The existing approach shall be graphically portrayed on t e face of the final mylar. The proposal is consistent with the above criteria. The Subdivision Sign Improvement riterion of Subsection 5.404 state: "Road signs shall be installe. in accordance with the Jefferson County standards. Road names shall be approved by the Board, .ursuant to recommendation by the Director of Public Works. Traffic signs and safety devices s 11 be provided and installed by the applicant in accordance with the Manual on Uniform Traf c Control Devices." The Department of Public Works s all be consulted when naming any private road to avoid duplication of road names. In accordance with 3pter 486, Washington Laws of 1993 addresses shall be assigned to all lots and clearly shown on the fac: of the final mylar. Address plates for the lots shall be located in accordance with Jefferson County '11 Emergency Locator System Ordinance provisions. The proposal is consistent with the above criteria. The Subdivision Drainage Improve pi ent Criterion of Subsection 5.405 state: "Drainage facilities adequat- to prevent erosion, flooding, or hazard to the use of the roads, lots, property, or facilities within he short plat,or to adjacent private or public property, shall be installed according to a drainage pl. approved by the Director of Public Works in accordance with County standards. The plan shall s ow full details, including the locations, lengths, and sizes of culverts, and the method and location of nm-off water disposal." No land disturbing activity is requ`ed for the proposal. No erosion control or stormwater management facilities are required. The Subdivision Water Supply Impr vement Criterion of Subsection 5.406(1)state: "For short subdivisions wh e any one (1) lot is less than two (2) acres, an adequate potable water supply shall be provided to,each lot within the subdivision. Water supply may be accomplished through connection to a public or community water supply system,through individual wells, or any other alternative method consistent with State law. Individual wells shall meet minimum Jefferson County Health Departmen and Coordinated Water System Plan standards. Additionally, individual wells shall be s rued by well easements that may not encumber adjacent properties without the prior written co sent of the adjacent land owner(s). Well easements shall be established by recording a separate i strument, or by declaration of easement dedication, and shall be graphically portrayed on thefinal short plat." There is an existing well on site that serves the existing residence. A notice shall be placed on the plat that states "If potable water is supplied .y means of individual wells, when drilled, wells shall not encumber adjacent properties without prior wri en consent of the adjacent property owner". In addition,the following notice shall be placed on the plat: ` e lots, parcels, or tracts contained within this short subdivision have not been provided with a potable ater supply. No building permit will be issued by Jefferson County without first satisfying the potab - water requirements established by the Jefferson County Health Department." The proposal is consi-tent with the above criteria. The Subdivision Sewage Disposal I provement Criterion of Subsection 5.407 state: "Installation of sewage di.posal systems for short subdivision shall be in compliance with regulations and standards o the Washington State Department of Health,the Washington State 6 Department of Ecology, an the County Health Department, and shall be approved only after a site inspection by the County Health Department." The Jefferson County Health Department has stated that there are existing permitted septic system for Lot 1. Review of soil reports and site inspection by the Health Department indicates that there is sufficient area within Lot 2 with soils suitable for the use of an on-site sewage system. The following notice shall be placed on the final plat: "The lots, parce . or tracts contained within this subdivision were approved based on design standards and regulatory re'uirements in effect at the time of fmal approval. Sewage disposal systems have not been approved fo the lots, parcels, or tracts contained within the subdivision. On-site sewage disposal systems shall mee• design standards and regulatory requirements in effect at the time of application for a sewage disposal pe it. Purchaser should contact the Jefferson County Health Department for procedures concerning permit asplications. Any removal of or major disturbances of soil within the proposed drainfield areas may crea e site conditions that are unacceptable for the installation of sewage disposal systems". The proposal is *Insistent with the above criteria. The Subdivision Fire Protection Imp ovement Criterion of Subsection 5.408(1)state: "Applicants for short subdi •sion where the smallest lot is less than two (2) acres shall incorporate adequate fire protection me.sures in accordance with the Uniform Fire Code and local fire district recommendations consisten'with State law." These requirements vary in width,depending upon the number of daily trips generated by the development(ADT).Each individual lot is estimated to generate ten (10)trips per day. Developments that produce less than 100 ADT and dead-end may utilize the minimum standard which is a fourteen foot wide road with twenty feet of clear zone. Road plans shall be designed to meet the criteria of the American Association of State Highway and Transportation Officials(AASHTO). All roads,regardless of width, must meet the "Typical Minimum Roadway Section" for compaction,ballasting,surfacing and ditching. Right-of-way and easement widths may vary depending upon roadway construction widths. However,if reduction in right-of-way or easement width is proposed, an adjoining easement for utilities may be required. Rights-of-way/Easements Subdivision Ordinance Section 5.3082 requires dedication of 60 feet wide rights-of-way for public roads. South Discovery Road is a minor collector. Subdivision Ordinance Section 5.308.7 states that access to subdivisions from collector roads should be restricted. The parcel has an existing access that serves the existing residence on the proposed soitherly lot. An additional access that would serve Parcels B and C is proposed approximately 400 feet northerly of the existing access. There is adequate separation to avoid traffic hazards. Public Works Department Recomirendations: • A right-of-way 30 feet from the centerline of South Discovery Road shall be conveyed to Jefferson County by either statutory warranty deed or dedication on the plat, if such right-of-way has not been previously conveyed. • The plat shall include a notice th. additional road approaches from South Discovery Road will not be approved. • All easements of record shall be .epicted on the final plat. • South Discovery Road shall be s own on the plat. Fee Requirement In accordance with the Jefferson Co ty Department of Public Works Fee Schedule,the applicant shall pay all costs of work incidental to review of the subdivision before final approval is granted. Final Approval The applicant shall submit a blue lin copy of the site plan and lot closure information prepared by a licensed surveyor to the Department or review.
