HomeMy WebLinkAbout061 15COUNTY OF JEFFERSON State of Washington 1 t Resolution repealing Resolution No. 33-15 ) and delegating certain job titles ) and responsibilities to the Interim ) Director for Community Development, ) David Goldsmith ) Resolution # 61-15 WHEREAS, David Goldsmith has agreed to become the Interim Director for the Department of Community Development (or "DCD"), the County's planning and land use department; and WHEREAS, there are certain job title and job responsibilities within the scope of the governmental duties that DCD collectively performs that would otherwise remain vacant unless the County Commission takes affirmative action to designate someone with those job titles and related job responsibilities; and WHEREAS, it is important for permit application review efficiency to delegate to Mr. Goldsmith certain job titles, which carry connected responsibilities; and WHEREAS, the Board of County Commissioners approved Resolution No. 33-15 on September 8, 2015 delegating certain job titles and responsibilities to Interim Department of Community Development Director David Goldsmith, with an expiration date of no later than December 31, 2015; and WHEREAS, Mr. Goldsmith has agreed to perform as Interim Director past December 31, 2015; NOW, THEREFORE, BE IT RESOLVED by the Jefferson County Commission as follows: 1 of 3 1. Mr. Goldsmith is hereby designated as the Interim Director of DCD, the terms and obligations of his service in that position having been separately memorialized in a Professional Services Agreement executed by Goldsmith and this Commission. In said role he shall be the chief administrative officer for DCD. 2. He is granted such lawful authority as is necessary to manage that agency and implement its regulations, such authority to be exercised consistent with said Professional Services Agreement. _ 3. Mr. Goldsmith is hereby designated as the county's Responsible Official with respect to the State Environmental Policy Act as that statute is enacted at Ch. 43.21C RCW and further defined at Ch. 197-11 WAC. 4. Mr. Goldsmith is hereby designated as the Unified Development Code or Zoning Administrator charged with administering and enforcing Title 18 of the Jefferson County Code and any related sections found elsewhere in the County Code, for example, Titles 15 and 17, including, but not limited to, any development regulations relating to critical areas or management of those areas and permit applications falling within the jurisdiction of Ch. 18.25 JCC. 5. Mr. Goldsmith is designated as the County's Building Official charged with implementation and management of Ch. 15.05 of the County Code. 6. Mr. Goldsmith is designated as the County's Chief Flood Damage Prevention Officer charged with implementation and management of Ch. 15.15 of the County Code. 7. Any and all authority granted or delegated to Mr. Goldsmith expires and becomes null and void upon the earliest date of any of these events: 1) the Personal Services Agreement is terminated by either party, 2) the Personal Services Agreement by its express term expires, or 3) a permanent DCD Director begins their employment with the County. 2 of 3 I 8. ANALYSIS: Carl Smith is retiring as the Director of Community Development (DCD) on September 25, 2015. David Goldsmith has agreed to serve as Interim Director of DCD while the County conducts a search for a new permanent DCD Director. The proposed Resolution is a companion to a Professional Services Agreement engaging Mr. Goldsmith as Interim Director of DCD, and the Resolution formally delegates to him the authority to perform the responsibilities of the position under County code and State law. FISCAL IMPACT: The delegation of authority has no direct fiscal impact. RECOMMENDATION: Approve the proposed Resolution 1*4 AN 1_ EiRAM Date JEFFERSON COUNTY BOARD OF COUNTY COMMISSIONERS AGENDA REQUEST TO: Board of County Commissioners FROM: Philip Morley, County Administrator DATE: December 21, 2015 RE: Resolution Repealing Resolution No. 33-15 and Delegating Certain Job Titles and Responsibilities to the Interim Director of Community Development, David Goldsmith STATEMENT OF ISSUE: Board of Commissioners approval is requested for the attached proposed Resolution which repeals Resolution No. 33-15, and which delegates the titles and responsibilities of the Director of the Department of Community Development to David Goldsmith during his service as Interim Director of that department. ANALYSIS: Resolution No. 33-15 was adopted on September 8, 2015, delegating to David Goldsmith until December 31, 2015, the titles and responsibilities of the Director of the Department of Community Development. Mr. Goldsmith is continuing to perform those duties into the first part of 2016, so it is necessary to repeal Resolution No. 33-15, and replace it with the new proposed Resolution, attached to this Agenda Request. The Resolution would grant or delegate those authorities to Mr. Goldsmith until the Personal Services Agreement expires or terminates, or a permanent DCD Director begins their - employment with the County, whichever is first.
