HomeMy WebLinkAbout11 1217 15STATE OF WASHINGTON JEFFERSON COUNTY BOARD OF HEALTH AN ORDINANCE TO AMEND Ordinance No. 11-1217-15 FEE SCHEDULE FOR JEFFERSON COUNTY PUBLIC HEALTH Section 1 — Purpose Section 2 - Effective Date Section 3 — Fees Section 4 — Severability Section 5 — Prior fee schedule repealed WHEREAS, the purpose of this Ordinance is to amend the fee schedule for Jefferson County Public Health, Environmental Health Division WHEREAS, this Ordinance promotes the health, safety and welfare of the citizens of Jefferson County, and WHEREAS, this Ordinance is proposed and may be enacted pursuant to the general police power granted to Jefferson County and its Board of Health by the State Constitution, NOW, THEREFORE, BE IT ORDAINED by the Jefferson County Board of Health as follows: Section 1— Purpose That the Fee Schedule for Jefferson County Public Health be amended to reflect adjustments to services affected by the changes to Food Establishment and General Fees, Ordinance 05-0618-15. Section 2 — Effective Date That this Ordinance (and its Attachment) shall be effective as of January 1, 2016. Section 3 — Fees That the schedule for Jefferson County Public Health, Division of Environmental Health, adjustments to the Environmental Health Fee Schedule, Environmental Health hereby set by the Jefferson County Board of Health as listed on the attached fee schedule of the proposed Ordinance; That any text listed, specifically text within the columns entitled "General Fees, Food Service Establishments Fees, Other Food Fees," is deemed regulatory rather than advisory and as such has the full force and effect of local law. Section 4 — Severability A determination that any text, fee, or fees adopted as part of this Ordinance is unlawful or illegal shall not cause any other text, fee, or fees adopted as part of this Ordinance unaffected by that determination to be repealed, revised, or reduced. Section 5 — Prior Fee Schedules Repealed Any prior fee schedule previously adopted by this Board that contains or reflects fee amounts that are less than those adopted herein is hereby repealed and replaced by this Ordinance. Fixed amount fees established by this ordinance shall be adjusted annually on the first business day of January (Adjusted Date) by the amount of the increase in the Consumer Price Index (CPIW). The CPIW is the Consumer Price Index - US City Average for All Urban Wage Earners and Clerical Workers, published by the Bureau of Labor Statistics for the United States Department of Labor. The annual fee adjustment shall be calculated as follows: each fee in effect immediately prior to the Adjustment Date will be increased by the percentage increase in the CPIW as reported for the month of September preceding the Adjustment Date. Increases will be rounded to the nearest dollar. A fee shall not be reduced by reason of such calculation. However, fee increases in accordance with this calculation shall not exceed 5 percent per year.
