Chairman Dave Garing was absent. DETERMINATIONS Per WAC 458-14-095(4) post hearing deliberations of the Board of Equalization are not recorded. The Board began post hearing deliberations at 10:01 a.m. At the conclusion of the deliberations the Board resumed the regular meeting at 10:40 a.m. and the following actions were taken. F&P Durbin Family Trust BOE: 14-35-R PN: 957 306 704 Pat Durbin, Trustee 1932 Washington Street Port Townsend, WA 98368 The appellant is appealing the value of property located at 1932 Washington Street, Port Townsend. The property was assessed as of January 1, 2014 and is currently valued at $617,776 ($311,262 for the land and $306,514 for the improvements). The appellant estimates the value to be $588,358 ($296,440 for the land and $291,918 for the improvements). The appellant presented three (3) comparable property sales, however, the primary reason for the lower estimate of value is that the adjoining property is a detriment to prospective buyers should the appellant decide to sell. She presented a number of photographs showing the condition of the neighboring yard as overgrown, with old vehicles, scrap wood, and a tattered tent. Anyone visiting the property has to pass that property. The Assessor's representative submitted a history of the property citing the total valuation of $740,720 in 2012 and $588,358 in 2013. During the hearing the appellant indicated that an independent valuation of the property was conducted by a Real Estate agent. The comparative market analysis indicated that as of October 27, 2014 the home should be valued between $685,000 and $695,000. After reviewing all the information submitted, the Board concurred that the appellant did not present clear, cogent, and convincing evidence necessary to overcome the presumptive correctness of the value established by the Assessor. Vice -Chairman Krist moved to sustain the Assessor's valuation of $617,776 ($311,262 for the land and $306,514 for the improvements). Member Smith seconded the motion. The motion carried. (See also minutes of June 29, 2015 and August 5, 2015) Helm Living Trust BOE: 14-11-R PN: 601 074 023 Frederic Helm, Trustee 9202 NW 27A Avenue Vancouver, WA 98665 The appellant is appealing the value of property located at 500 Point Whitney Road, Brinnon. The property was assessed as of January 1, 2014 and is currently valued at $213,300 ($135,400 for the land and $77,900 for the improvements). The appellant estimates the value to be $160,600 ($145,400 for the land and $15,200 for the improvements). The appellant's property consists of medium/high bank waterfront valued at a rate of $1,300 per front foot. There is a difference of opinion between the appellant and the Assessor's representative as to what interior improvements were made to the 1,080 square foot garage/living space. The Assessor's representative was not allowed access to the property. The appellant did not submit any documents to validate his estimate of value. After reviewing all the information submitted, the Board concurred that the appellant did not present clear, cogent, and convincing evidence necessary to overcome the presumptive correctness of the value established by the Assessor. Vice -Chairman Krist moved to sustain the Assessor's valuation of $213,300 ($135,400 for the land and $77,900 for the improvements). Member Smith seconded the motion. The motion carried. Discovery Road 14 -69 -LO 001 324 058 Port Townsend, WA 98368 14 -70 -LO 001324 061 The appellants are appealing the value of property located at 4372 S. Discovery Road, Port Townsend. The property was assessed as of January 1, 2014 and the following is the current assessment and the Board of Equalization Minutes — August 11, 2015 Page: 3 appellants' estimate of value for the parcels under appeal: Parcel No. Current Assessed Value Appellant's Estimate of Value 001 321 012 $818,994 ($254,760 Land/$564,234 imp.) $677,097 ($231,600 land/$445,497 imp.) 001 324 058 $616 (Land Only) $560 (Land Only) 001 324 061 $1,870 (Land Only) $1,700 (Land Only) 14-68-R (001321012) The appellant stated the Assessor raised values in the area by 10%, but according to Real Estate internet sites such as Zillow, local values have risen only 1-3% and in some cases decreased. The appellant also testified that there are problems with the construction of their new house, and that they have filed a $50,000 lawsuit against the builder. He stated that $35,000 to $50,000 would be required to cure the defects in construction. The Assessor's representative stated he was unaware of the condition of the appellants' home. During the hearing he agreed to meet with the appellant to look at the alleged defects. In a subsequent letter to the Board of Equalization dated August 5, 2015, the Assessor's representative stated that, after inspecting the property on July 28, 2015, a reduction of the improvement value in the amount of $40,000 would be appropriate for the cost to cure the problems noted by the appellant in his testimony. After consideration of all the evidence and testimony, Member Smith moved to overrule the assessed value and reduce it from $818,994 ($254,760 for the land and $564,234 for the improvements) to $778,994 ($254,760 for the land and $524,234 for the improvements). Vice -Chairman Krist seconded the motion. The motion carried. (See also minutes of June 29, 2015) 14 -69 -LO (001324 058) The appellant stated the Assessor raised values in the area by 10%, but according to Real Estate internet sites such as Zillow, local values have risen only 1-3% and in some cases decreased. He also stated that the property consists of tidelands and has little or no value without adjacent uplands. The Assessor's representative testified that the appellants' property had been assessed in the same manner as other tidelands. After careful consideration, the Board finds that the appellants did not present clear, cogent, and convincing evidence necessary to overcome the presumptive correctness of the value established by the Assessor. Member Smith moved to sustain the Assessor's valuation of $616. Vice -Chairman Krist seconded the motion. The motion carried. Discovery Road 14 -72 -LO 977 100 811 Port Townsend, WA 98368 The appellants are appealing the value of two parcels located in Ocean Grove Estates, Port Townsend. The property was assessed as of January 1, 2014 and the following is the current assessment and the appellants' estimate of value for the parcels under appeal: Parcel No. Current Assessed Value Appellant's Estimate of Value 977 100 802 $15,400 (Land Only) $14,000 (Land Only) 977 100 811 $38,500 (Land Only) $28,000 (Land Only) BOE 14 -71 -LO (977 100 802) The appellants stated the Assessor raised values in the area by 10%, but according to Real Estate internet sites such as Zillow, local values have risen only 1-3% and in some cases decreased. They also testified that by itself, this lot is unbuildable. The Assessor's representative testified that property values in the area have increased 10% based on the statistical update. There is no evidence to indicate that this parcel is unbuildable. After careful consideration, the Board finds that the appellants did not present clear, cogent, and convincing evidence necessary to overcome the presumptive correctness of the value established by the Assessor. Member Smith moved to sustain the Assessor's valuation of $15,400. Vice -Chairman Krist seconded the motion. The motion carried. (See also minutes of June 29, 2015) BOE 14 -72 -LO (977 100 811) The appellants stated the Assessor raised values in the area by 10%, but according to Real Estate internet sites such as Zillow, local values have risen only 1-3% and in some cases decreased. They also testified Board of Equalization Minutes — August 11, 2015 Page: 5 that by itself, this lot is unbuildable. The Assessor's representative testified that property values in the area have increased 10% based on the statistical update. There is no evidence to indicate that this parcel is unbuildable. He stated that an error was made on the value of the appellants' lot. He explained that the base land rate should be $28,000, with a 10% increase for a total of $30,800. After consideration of all the evidence and testimony, Member Smith moved to overrule the assessed value and reduce it from $38,500 to $30,800. Vice -Chairman Krist seconded the motion.
