HomeMy WebLinkAboutWashinton State University, Jefferson County Extention, Memorandum of Understanding re: Rain Garden Installment and Maintenance - 062016June 14, 2016 Jefferson- County WASHINGTON STATE UNIVERSITY EXTENSION Memorandum: Rain Garden installation on Jefferson County Right of Way, Walker and Washington Streets, Port Townsend, WA 98689 Jefferson County Extension acknowledges it is obligated to maintain (defined to include, but not be limited to, planting, watering, weeding, grooming and trimming) the 20' x 40' rain garden to be installed at the corner of Walker and Washington Streets, within the City ROW. The Jefferson County general fund shall not bear any fiscal responsibility for the costs associated with installing, implementing and maintaining this rain garden. Jefferson County Extension will hold harmless and indemnify Jefferson County for any injury, claim, lawsuit or other action filed or generated by a third party alleging or asserting the negligent acts and/or omissions of Jefferson County Extension caused injury to the third party allegedly injured. Jefferson County Extension staff and volunteers will ensure that the rain garden is maintained (as defined above) on a regular basis to ensure its proper function and aesthetic appeal. The rain garden will be designed, installed and maintained so that each roadway (Walker St., Washington St.) will be visible to the other roadway starting at a point not less than 25 feet ("sight triangle") from where the two roadway pavements intersect. The location is valued since it will serve a meaningful function in reducing contaminated storm water reaching Port Townsend Bay, as well as for its location for public demonstration capacity since it is located adjacent to a busy street and a county park. This facility will be used as part of the Jefferson County Extension program that educates and empowers individuals to implement such practices in their landscapes.
