RE: Joint Use Parking Agreement with Trinity United Methodist Church
STATEMENT OF ISSUE: Board approval is requested of a Joint Use Parking Agreement with Trinity
United Methodist Church of Port Townsend.
ANALYSIS: Trinity United Methodist Church has a pending permit application with the City of Port
Townsend to demolish an old structure and to build a new fellowship hall. The church is located on the
corner of Taylor Street and Clay Street, across from the County's Port Townsend Community Center and
Recreation Center. Both the County and the church share on -street parking along city -owned Taylor and
Clay Streets. One of the potential impacts of this development and expansion by the church is increased
use of on -street parking during the church's regular services and special events, which could potentially
conflict with parking for activities at the Community Center and Rec. Center. The proposed Joint Use
Parking Agreement has been sought by Trinity United Methodist Church to coordinate the use of on -
street parking within the vicinity of the Community Center, in order to reduce use conflicts and mitigate
the potential impact of the Church's development.
Staff recommends approving the Joint Use Parking Agreement.
FISCAL IMPACT: None to Jefferson County.
RECOMMENDATION: Approve the proposed Joint Use Parking Agreement.

JOINT USE PARKING AGREEMENT
This Joint Use Parking AGREEMENT is entered into effective as of July _6�2016
between JEFFERSON COUNTY and TRINITY UNITED METHODIST CHURCH (TUMC).
A. Jefferson County authorizes TUMC (located at 609 Taylor Street) including its
employees, patrons, members, invitees and vendors, to utilize the on -street
parking facilities associated with the Jefferson County Recreation Center, located
at 620 Tyler Street, between the hours of 8:30 a.m. and 2:30 p.m. on Sundays, on
identified TUMC evening or weekend special events, and other identified events
(collectively "special events") which will result in higher than normal attendance
(such as Christmas or the monthly Candlelight Concert).
B. Within 15 days of when this Agreement is signed by both parties and annually
thereafter TUMC shall provide Jefferson County Central Services in writing a list
of the dates and start and finish times of any scheduled special events which will
likely cause patrons or attendees of that TUMC special event to need or use the
on -street parking facilities associated with the County's Recreation Center. This
list of scheduled special events may be revised at any time by TUMC upon
reasonable (at least seven calendar days whenever possible) written notice to
Jefferson County Central Services. Email notices are acceptable.
C. Jefferson County and TUMC agree to cooperate to the best of their abilities to
mutually use the on -street parking facilities without disrupting the other party,
If conflicts between Jefferson County and TUMC events occur in which both
parties will need the on -street parking facilities at the same time, the parties
agree to meet and coordinate timing of events to ensure that adequate on -street
parking remains available but TUMC acknowledges that in the case of a conflict
between the parties regarding simultaneous or overlapping events the event
being held at the County's Recreation Center shall generally have priority for use
of the on -street parking facilities associated with the Recreation Center.
D. TUMC's Right to Use on -street parking facilities associated with the Jefferson
County Recreation Center will remain in effect so long as Jefferson County
retains ownership and the facilities remain used for parking.
E. This Agreement contains the complete and entire agreement between Jefferson
County and TUMC respecting the joint on -street parking agreement. This
Agreement may not be modified or changed except by a further agreement or
amendment to this Agreement in writing, duly executed by authorized
representatives of Jefferson County and TUMC.
F. The provisions of this Agreement are severable and, in the event that any
portion of this Agreement is found to be invalid or unconstitutional for any
reason, the remainder of this Agreement will not be affected and this Agreement
will be construed as if it had never contained such invalid or unconstitutional
provision.
G. TUMC will take all reasonable steps to publicize to its members, congregants,
attendees, officers, invitees, vendors and volunteers the terms and conditions of
this Agreement so as to strive for compliance with the terms of this Agreement.
TUMC will have absolute discretion to determine how to publicize this
Agreement to persons belonging to their congregation or those using or entering
their facility
