Dear Mr. Wedam
On October 14, 2015, you participated in a Pre -Application Conference (PRE15-00030) at our
Department to discuss the Delaware North proposal. The proposal includes development of the
existing property with small cabins and tree houses to be rented out on a nightly basis. The proposal is
to create the maximum allowed 12,000 square foot gross Floor area, requiring a minimum parcel size of
20 acres.
I understand you are anticipating submitting a lot consolidation application for the property located at
153573 Highway 101 in Forks, in order to create a resulting parcel of at least 20 acres.
It is not uncommon for a project to include multiple approvals. As in this case with the Kalaloch Cabins,
when one approval is contingent on meeting another approval, we can bring both project parts together
under the same review. We will maintain the Boundary Line Adjustment (BLA) case with the
Conditional Use Permit (CUP) case under the same master file. The permit will include both approvals.
The CUP is subject to a Type III review process with a public hearing and final decision made by a
Hearing Examiner. The BLA is a Type I administrative process decided in our Department. When we
have multiple permits being considered together in a project, the highest level permit review must be
completed before the others (the Type III before a Type 1).
I will write a staff report that evaluates all land -use aspects of the project. In this report it is made clear
that approval of a CUP requires a 20 -acre parcel, and the BLA will be use to consolidate existing
parcels for the purpose of this use. Although the CUP will be contingent upon completing the BLA, they
both occur together. The Hearing Examiner will add a condition to his decision, to the effect that the
BLA needs to be completed for the CUP to be valid.
The BLA will be recorded AFTER the approval of the CUP. The applicant is in complete control and we
will not cross any thresholds unless it is the express desire of the applicant. If you would like, you or
the applicant may write "Contingent upon approval of CUP" on the front page of the application or
adjacent to the signature line within the property owner information and signature section.
The lot consolidation will not be recorded if the CUP is not approved, unless the applicant wishes to do
so. Please let me know if you would like any clarification of the process. I look forward to working with
