HomeMy WebLinkAboutBLD1995-00106 11111 Jefferson County Permit Center March 23 , 1995 621 Sheridan ,...._..., _� Port Townsend WA 98368 (360) 379-4463 , 9 1995 FINDINGS AND CONDITIONS OF APPROVAL AS REQUIRED UNDER THE JEFFERSON COUNTY JEFFERSON COUNTY INTERIM CRITICAL AREAS ORDINANCE PERMIT CENTER Critical Area Review Case No: CAR95-0038 Date Received: 03/13/95 Applicant BOB MARTIN Mailing Addr: 340 ADELMA BEACH RD PORT TOWNSEND WA 98368 Project Description: Site Address: 340 ADELMA BEACH RD PORT TOWNSEND, WA 98368 Legal Description: Subdivision Block Lot S-T-R: 32-30-01 W Parcel # 001324050 FINDINGS In accordance with the authority provided under subsection 4.101 and the requirement contained in Subsection 5.402 of the Jefferson County Interim Critical Areas Ordinance, the Critical Areas Administrator enters the following findings of fact relating to the referenced application: 1) The application was reviewed by Jefferson County Permit Center staff on 03/21/95 for the potential presence of critical areas regulated under the provisions of the Ordinance, and the following critical areas were confirmed as potentially present on the subject property: landslide hazard area, fish and wildlife habitat area. 2) Acting upon the above information, Jefferson County staff conducted additional review of the subject property on 03/23/95 and confirmed the existence of the following critical areas and/or their associated buffers on the property: landslide hazard area, fish and wildlife habitat area. 3) County staff reviewed the subject application and found that the Coastal Zone Atlas of Washington shows that the slopes in the vicinity of the proposed development are considered unstable. However, staff believes that the planned addition to the existing home will not have any significant impact on slope stability. The mapped landslide hazard area is that area along the shoreline within (approximately) 200 feet of the shore. 4) Staff did not conduct a site visit for this planned development since the nature of the development is unlikely to CAR95-0038 111111 cause any substantial alteration to the critical areas on site. County staff does not have information on the current condition of existing natural vegetation on site within the mapped landslide hazard area or the mapped fish and wildlife habitat area both of which are associated with the shoreline along Discovery Bay. This waiver from the provisions of the Jefferson County Interim Critical Areas Ordinance is granted subject to the applicant complying with the following conditions. Any deviation from these conditions shall result in this waiver being revoked by the Critical Area Administrator and the application becoming subject to further review under the Interim Critical Areas Ordinance. CAR95-0038 lilt Page: 3 CAR95-0038 BOB MARTIN CONDITIONS OF APPROVAL 1) A permanent set-back (buffer) of 30 feet shall be permanently maintained from the top/toe or edge of the landslide hazard area. All buffers shall be measured perpendicularly from the top of the landslide hazard area. 2) Landslide hazard areas and their associated buffers shall remain naturally vegetated. Should buffer disturbance occur during construction, replanting with native vegetation shall be required by the Critical Area Administrator. No alteration shall be made to the landslide hazard area or its associated buffer without prior authorization by the Critical Area Administrator. 3) A minimum set-back of 30 feet shall be permanently maintained as a fish and wildlife habitat area buffer associated with the shoreline. This buffer shall be measured perpendicularly from the ordinary high water mark along the shoreline. This buffer lies entirely within the landslide hazard area on subject parcel . 4) Fish and wildlife habitat area buffers shall remain naturally vegetated. Should buffer disturbance occur during construction, replanting with native vegetation shall be required by the Critical Area Administrator. No alteration shall be made to the fish and wildlife habitat area buffer without prior authorization by the Critical Area Administrator. 5) The proposed development shall be located on the subject property exactly as identified on the Universal Plot Plan, or other Site Plan, approved by the County as part of the triggering permit application. rnt Anders n, Cr tics Areas dministrator Da e I understand that the granting of the above waiver from the provisions of the Jefferson County Interim Critical Areas Ordinance is made subject to my complying with the above listed conditions, and that any violation of said conditions shall result in revocation of the permit or approval and further review of the project under the critical Areas Ordinance.
